IntroductionThe Monroe County Assigned Counsel Program marked its twenty-seventh yearof operation in all courts within Monroe County. It was also the sixteenth year ofoperation for the Conflict Defender Office.The attorneys of the Monroe County Conflict Defender Office represent indigentclients in Family Court, Rochester City Court and appeals where there is a conflict ofinterest preventing the individual from being represented by the Monroe County PublicDefender Office. The Conflict Defender Office, when fully staffed, is made up of nineteenstaff members. The Office’s thirteen attorneys include the Conflict Defender, sevenFamily Court attorneys, three attorneys handling misdemeanor cases in Rochester CityCourt and two appellate attorneys. The Office, when fully staffed, also has five full-timesupport staff and one part-time position. Three support staff positions and three FamilyCourt attorney positions continue to be filled pursuant to grants from the Office ofIndigent Legal Services of New York State (OILS). Outside support services such asinvestigators and process servers continue to be done on a contract basis.In 2018, the Conflict Defender Office experienced a period of staff stability. TheOffice was fully staffed with both support staff and attorneys and the make-up of theoffice did not change throughout the year. Conflict Defender Office staff providedquality representation in 789 criminal cases, 2,033 Family Court cases, 35 new appellatecases, and processed approximately 5,000 assignments in 2018.Under the joint Monroe County/Monroe County Bar Association Plan for ConflictAssignments, assigned counsel panel attorneys, attorneys in private practice willing torepresent indigent clients, accepted assignments in all town and village courts, all felonycases, Family Court cases, all statutorily assigned cases in Superior Court as well as allcases where the Conflict Defender Office has a conflict of interest. As of the end of theyear, there were 173 private attorneys who accepted assignments, and they handledapproximately 5,000 assignments in 2018.This report outlines, with statistical information, the Program's success inmeeting the goals of the Plan which are articulated here:"The objectives of this conflict assignments plan are toprovide quality representation to eligible indigent defendants orother litigants in those cases where the Public Defender has aconflict of interest; to provide a coordinated and centralizedassignment system for conflict cases arising in the courts specified1

in Article IV herein; to provide a more equitable distribution ofconflict assignments among lawyers; to attract more lawyerswilling to handle conflict assignments; to maintain uniform andproper billing practices; to ensure cost accountability of services,and to provide increased efficiency for the courts by makingqualified attorneys more readily available to handle conflict cases."Monroe County Bar Association Sponsored Plan for ConflictAssignments, ARTICLE II. Plan Objectives"To Provide Quality Representation"In 2018, the total number of case referrals was 8,394 (see page 8). Last year saw alarge spike in the number of cases over the totals from 2015 and 2016. The 2018 totalnumbers represents a continuation of that trend. The largest increases were inmisdemeanors and D-E Felonies. On the other hand, there were declines in the categoriesof probation/parole violations, appeals and “other”, such as the representation ofwitnesses. The number of Family Court cases topped 4,000 for the second year in a row.With respect to appellate cases, the 2018 number was a return closer to the levelsof 2015 and 2016. In 2017 there was a significant increase in the number of cases due inlarge part to two factors, the Chief Judge’s “excellence initiative” increased the numberof cases going to trial which resulted in more appeals and older cases were assigned toprivate counsel, using grant funds, to reduce the Conflict Defender’s Office backlog ofappeals.All Assigned Counsel panel attorneys have qualified for their respective panelsunder the enhanced requirements for panel membership that were implemented in 2014by then-Conflict Defender Charles Noce, Esq. These panel requirements remain ineffect in an ongoing effort to continue to maintain and enhance the quality ofrepresentation that indigent clients in Monroe County receive.With respect to the Conflict Defender Office, the attorneys handling appeals andmisdemeanor cases in Rochester City Court were able to maintain a high level ofrepresentation for their clients, as did the staff attorneys assigned to Monroe CountyFamily Court (including the three OILS grant funded positions).As the Continuing Legal Education (CLE) requirements of all staff attorneys of theConflict Defender Office and panel attorneys for the Assigned Counsel Program overlap2

with the Mandatory Continuing Legal Education requirements of the State of New York,compliance is 100%.However, it is a goal of the Conflict Defender Office, in conjunction with theappropriate committees of the Monroe County Bar Association, to create moreopportunities for training of attorneys. This is of a particularly necessity in Family Court."To Provide a Coordinated and CentralizedAssignment System for Conflict Cases"The Assigned Counsel Program is fully computerized, and has been through anumber of electronic transformations. The initial computer program (2003-2010) enteredall cases reported in it to a centralized database that tracked the representation fromassignment through payment of the voucher for all cases; both Assigned Counsel andConflict Defender cases. At the end of calendar year 2011, a new database was purchasedfor use by the office, and the underlying support system needed for the use of the priorACP Database was discontinued. This system was in operation from approximately2011-until August 2016. In August 2016, a new electronic voucher system and overallconflict case assignment database became operational. This current integrated systemhas resulted in a savings on time and effort, as well as an improvement on efficiency.Assignments referred by the courts continue to be assigned from a rotating list ofqualified attorneys who meet the requirements to be on the varying panels. The program,when used by the Courts, is very successful in ensuring continuity of counsel where aclient is re-arrested on new charges, even when the arrests span differing jurisdictions.Additionally, the program continues to track conflict of interest information so that panelattorneys are not unnecessarily assigned when the Conflict Defender’s Office couldethically continue."To Provide a More Equitable Distribution ofConflict Assignments Among Lawyers"The Assigned Counsel Program continually strives to improve its system ofassignment of conflict cases. The Program constantly attempts to implement new andbetter systems to distribute assignments more equitably among the participatingattorneys. In criminal cases, the current system is highly effective when fully utilized bythe Courts of Monroe County. There are, however, still several criminal courts that do-3-

not utilize, or only partially utilize, the services of the program in the assignment ofcounsel. This sometimes leads to a client having multiple attorneys for different pendingcharges, which can result in uncoordinated representation, as well as increased andunnecessary costs to the taxpayer.As Courts often need attorneys very quickly, those available when called get adisproportionate number of assignments. Thus, the assignment distribution can beskewed toward those attorneys who were most available for assignments. It should benoted that attorneys may notify the Conflict Office of their availability on certain datesand at certain times (particularly around holidays and long weekends) so we may contactthem when an assignment opportunity occurs on that date and time. Notice can beemailed, telephoned or faxed to our office.In Family Court, the situation regarding the equitable distribution of cases isimproving but the majority of assignments to panel attorneys in Family Court are stillmade directly from the bench. It remains a goal of the Conflict Defender Office to addressthe inequities in Family Court assignments. The fact that a few attorneys receive the bulkof the assignments places an undue burden on those attorneys and can impact directlyon the quality of representation."To Attract More Lawyers Willing toHandle Conflict Assignments"Included in this report (see page 6) is a list of new panel members added duringthe 2018 calendar year.These attorneys were added to the panels under the requirements for panelmembership that were implemented in 2014 by then-Conflict Defender Charles Noce,Esq. These panel requirements were created and remain in effect in an ongoing effort tocontinue to enhance the quality of representation that indigent clients in MonroeCounty receive.Generally, plenty of qualified assigned counsel attorneys remain on all panelsand are available to meet requests for assignment of counsel by the courts.The Conflict Defender has taken steps to recruit qualified attorneys to theassigned counsel panels.-4-

"To Maintain Uniform and Proper Billing Practices and to Ensure CostAccountability of Services"As was the case in previous years, the Conflict Defender reviews each voucher toensure compliance with the voucher regulations and notifies each attorney of anynoncompliance to educate the attorney on proper procedures. The review andnotification help maintain proper and uniform billing practices among the participatingattorneys.Having received a Grant from the New York State Office of Indigent Legal Servicesto fund the purchase of an electronic vouchering system, the system became operationalin August 2016. The use of the electronic voucher system has significantly increased theefficiency and accuracy of reviewing vouchers."To Provide Increased Efficiency for the Courts"The Courts that fully utilize the services of the Assigned Counsel Program reporta positive impact on the efficiency in obtaining assigned counsel in conflict cases. TheseCourts report a significant decrease in the burden on the court staff in finding attorneyswilling to accept assignments and a prompt response from the Assigned CounselProgram in obtaining assigned counsel.The electronic voucher system has increased the efficiency in voucher processing.Panel attorneys can access the system from any computer with a login username andpassword. This system requires timely filing of vouchers by assigned counsel. Thesystem allows for ease of review by the Conflict Defender. Furthermore, as the voucherscan be transmitted between the Conflict Defender Office and the Courts electronicallyinstead of through the mail, it cuts down on total processing time. Additionally, thesystem allows for County payment with minimal paperwork.The efficiency of the Courts has clearly been facilitated by the dedicated attorneysserving on the assigned counsel panels, and the staff attorneys in the Office of the ConflictDefender, while ensuring high quality representation in Family Court, all of the criminaland appellate courts in 2018.-5-

2018 AssignmentsThe following charts show the assignments each attorney received in 2018. Thenumber of assignments is higher than the number of cases referred because in some casesmore than one attorney receives an assignment for a case. Also, an attorney might beassigned in 2018 to a case originally referred in a previous year. This occurs most oftenafter a court relieves one attorney and either the court or the Assigned Counsel Programassigns a new attorney.Several factors should be considered in looking at these tables. First, approvedpanel members receive more assignments than non-approved panel members do. Someof the attorneys with a low number of assignments are non-approved panel members.Most often, such an attorney is court assigned. Secondly, those attorneys gainingmembership on a panel for the first time during 2018 will have fewer assignments in thatpanel because they were not on the panel for an entire year. Thirdly, a number ofattorneys decline a significant number of assignments, requested removal from theProgram for periods of time or resigned from the Program during 2018. While the reportincludes non-approved attorneys, new panel members, attorneys decliningappointments, and attorneys temporarily removed from panels at their own request,concentrating on those members who participated for the full year as approved membersof a particular panel gives a truer picture of the equitable distribution of assignments.Of particular significance in this report is the fact that in the criminal courts, wherethe Assigned Counsel Program assigns a large percentage of cases, there is a more evendistribution of assignments. This is attributable to the fact that, by comparison, FamilyCourt has a much lower percentage of cases assigned by the Assigned Counsel Program:the majority of assignments are directed by the court. Attaining more equitabledistribution of cases is difficult, if not impossible. The Administrator and AdvisoryCommittee must work diligently to provide a workable solution to the inequities of theFamily Court assignments. Looking at the last column of the tables, it takes significantlyfewer attorneys for the Family Court assignments to reach a high percentage than it doesfor the criminal court assignments. This is less of a concern since the Conflict DefenderOffice represents about half of the conflict cases in Family Court. Nonetheless, it is anissue that should be addressed for those cases where the Conflict Defender Office cannotrepresent the client in Family Court.-8-
