Except for Atlantic Canada, 90% of Canada’sforested land is provincialCrown land, and the provinces lease Crown land toforest companies and charge“stumpage fees” for the rightto harvest timber. The US,on the other hand, uses anauction-based sales system.The first dispute (LumberI) happened in 1982. At thattime, the US lumber industrypetitioned the US Department of Commerce (DoC)to impose a countervailingduty. It ended when the DoCfound Canada’s stumpagesystem to be not countervailable.The second dispute, (Lumber II), occurred four yearslater when the DoC did findCanadian forest programs tobe countervailable and seta preliminary duty of 15%.Before the subsidy was imposed, the US and Canadaagreed to a Memorandum ofUnderstanding that createda phased tariff.In 1991, the US Department of Commerce initiateda countervailing duty investigation (Lumber III),resulting in duties. This time,a binational panel organized under the Canada–U.S.Free Trade Agreement foundthat the DoC’s determinationcould not be supported bysubstantial evidence.In 2002, the US DoC announced it had determinedsubsidy and anti-dumpingrates, and began chargingtarrifs (Lumber IV). Within one year, 15,000 workershad been laid off, primarilyin B.C.
