Motion carried, 9 in favour 1 against (Chipman).Re: Finance Committee (March 5th meeting) Amendment to M10 Sewer Charges Bylaw – 1st ReadingMOTION 100316.04 M10 Sewer Charges Bylaw – Amendment (First Reading)Pursuant to the recommendation of the Finance Committee, Councillor Vitiello moved,seconded by Councillor Chipman, that Municipal Council give first reading to approve anamendment to the M10 Sewer Charges Bylaw to increase the transfer to reserves for capitalreplacement from point eight percent (.8) to point nine percent (.9) as attached. Motion carriedunanimously. Borrowing Resolution – Royal Bank ( 3,500,000)MOTION 100316.05 Borrowing Resolution – Royal Bank ( 3,500,000)In accordance with the recommendation of the Finance Committee, it was moved by CouncillorVitiello, seconded by Councillor Fowler, that Municipal Council authorize the Warden and Clerkto sign a Short-Term Borrowing Resolution with the Royal Bank of Canada (for the operatingline of credit) in the amount of 3,500,000 for the fiscal year commencing April 1, 2010. Annapolis Basin Conference Centre – Council AppointmentMOTION 100316.07 Annapolis Basin Conference Centre – Council AppointmentIn accordance with the recommendation of Committee of the Whole, it was moved by CouncillorWilkins, seconded by Councillor McWade that Municipal Council send a letter advising theABCC that we received their information and informing that Councillor McDonald has beenappointed as the County‟s representative on the Board. Bridgetown Volunteer Fire Department – Fire Services Reserve Fund LoanMOTION 100316.11 Bridgetown Vol. Fire Dept – Fire Services Reserve Fund Loan ( 165,000)In accordance with the recommendation of Staff and Committee of the Whole, it was moved byCouncillor Wilkins, seconded by Councillor Chipman, that Municipal Council authorize a 10year, 165,000 loan from the Fire Services Reserve Fund to the Bridgetown Volunteer FireDepartment for the purchase of a pumper. Deputy Warden Absence (Exemption)MOTION 100316.13 Deputy Warden Absence (Exemption)In accordance with the recommendation of Committee of the Whole, it was moved by CouncillorWilkins, seconded by Councillor Chipman, that Municipal Council exempt Deputy WardenRitchie from the consecutive meeting attendance requirement (i.e. Section 5 under AM 1.2.1Remuneration, Allowances & Expenses Policy), in conjunction with his medical leave. Motioncarried unanimously.New Business:Re: Cornwallis Stingrays Swimteam Request – Correspondence was received on March 11th fromJane Fowler, President of the Cornwallis Lifeplex Stingrays Swim Club, with a proposal to rent thepool for on-going training.MOTION 100316.14 Cornwallis Stingrays Swimteam RequestIt was moved by Councillor Wilkins, seconded by Councillor McDonald, that Municipal Councilauthorize the Solicitor to draw up a contract for pool rental to the Cornwallis StingraysSwimteam from Monday to Friday, 4:30 – 6:30 p.m., with certified lifeguards and liabilityinsurance being provided by the Team. Motion carried unanimously.In-CameraIt was moved by Councillor Wilkins, seconded by Councillor Fowler, to go in-camera to discusscontract negotiations in accordance with Section 22(2)(e) of the Municipal Government Act. Council resumed regular session at 10:55.Re: Request from WaterArt MOTION 100316.15 WaterArt RequestCouncillor Wilkins moved, seconded by Councillor Fowler, that Staff be authorized toinvestigate adequate group liability insurance and negotiate a contract with WaterArt includingcost recovery, with a report to Special Council on March 23rd. Motion carried unanimously.Re: Request for Decision (RFD) – ACPS File No. 2010-DA-002: Stephen Morse – An RFD datedMarch 16th was received from the Planner.MOTION 100316.16 ACPS File No. 2010-DA-002: Stephen MorseIt was moved by Councillor Wilkins, seconded by Councillor Chipman, that Municipal Councilaccept the application, ACPS File No. 2010-DA-002, submitted by Stephen Morse to considerentering into a development agreement to permit the change in use of a nonconforming use in astructure to another nonconforming use(s), as per Policy 1.6.1 of the Annapolis County East EndArea Municipal Planning Strategy; andthat Municipal Council conduct a public participation program that would include referring theapplication, ACPS File No. 2010-DA-002, to the Planning Advisory Committee and the East EndPage 2 of 8

Motion carried unanimously.Re: Request for Decision (RFD) – ACPS File No. 2010-DA-003: Stephen Morse – An RFD datedMarch 16th was received from the Planner.MOTION 100316.17 ACPS File No. 2010-DA-003: Stephen MorseCouncillor Chipman moved, seconded by Councillor Trimper, that Municipal Council accept theapplication, ACPS File No. 2010-DA-003, submitted by Stephen Morse to consider entering intoa development agreement to permit the change in use of a nonconforming use in a structure toanother nonconforming use(s), as per Policy 1.6.1 of the Annapolis County East End AreaMunicipal Planning Strategy; andthat Municipal Council conduct a public participation program that would include referring theapplication, ACPS File No. 2010-DA-003, to the Planning Advisory Committee and the East EndArea Advisory Committee for their review and recommendation along with the appropriatepublic notification (newspaper ads and the personal service of landowners and residents in theimmediate area of the Morse property); andthat Municipal Council convene a meeting of the Annapolis County Planning AdvisoryCommittee on April 13, 2010 at 9:00 am so as to hold a public meeting in consideration of theproposed development agreement application. Motion carried unanimously.Correspondence:It was moved by Councillor Vitiello, seconded by Councillor Trimper, to accept the followingcorrespondence for information:- Department of Energy – (February 24th) received from Minister Bill Estabrooks regarding theprovince‟s regulations and legislation as it relates to renewable electricity production andsustainability.- NS Public Prosecution Service – (February 26th) received copy from Director of PublicProsecutions to David Brown, Chair of PAB, informing that no decision has been made to closeany office in the western region. Should office closures be seen as a possibility, consultations willbe initiated with all of the key municipal stakeholders in the local area.- Town of Bridgetown – (February 26th) received copy from Town of Bridgetown to Minister PercyParis, Department of Economic and Rural Development, regarding the importance of maintainingtransportation infrastructure, specifically ferry services in Southwest Nova Scotia.- Motion carried unanimously.Re: Graham Sancton – (March 1st) Resident of Hampton Mountain Road, expressing displeasure andapprehension over the possibility of wind turbines being installed in the Arlington-HamptonMountain area. Motion carried unanimously.Re: Annapolis West Health Foundation – (March 3rd) from Stuart Jamieson, Chair, noting that aposition statement dated February 26th for the Annapolis West Health Foundation Re: PossibleService Changes at the Annapolis Community Health Centre was forwarded to the Annapolis ValleyHealth authority and the Department of Health. It was moved by Councillor McWade, seconded byCouncillor McDonald, to receive for information. Motion carried unanimously.Re: Peter Wyman – (March 8th) to submit suggestions regarding maintaining Acadian Lines busservice along Highway 101. Councillor Wilkins moved, seconded by Councillor Vitiello, to receivefor information. Motion carried unanimously.Re: Annapolis Valley Regional School Board – (February 26th) copy of letter from Paul Spicer,Acting Chair, to BRHS School Advisory Council Chair, in recognition of the interest andcommitment of the SAC in the education of students. It was moved by Councillor Wilkins, secondedby Councillor Roberts, to receive for information. Motion carried unanimously.Other Business:Re: Community Recreation Grant Program South Shore Annapolis Valley Recreation Trail AssociationA request for 1,500 was received for a project totalling 35,260 to complete a parking area, trailentrance and signage on the former Nictaux CNR station road.MOTION 100316.19 CRGP – South Shore Annapolis Valley Recreation Trail AssociationIn accordance with the recommendation of staff, Councillor Wilkins moved, seconded byCouncillor Roberts, to recommend that Municipal Council approve a grant in the amount of 1,500 to the South Shore Annapolis Valley Recreation Trail Association (for a project totalling 35,260) from the 2009-10 Community Recreation Grant Program. Motion carried unanimously.Re: Valley Waste-Resource Management AuthorityMOTION 100316.20 VWRM – 2010/11 Operating Plan and BudgetIt was moved by Councillor Trimper, seconded by Councillor Connell, that Municipal Councilapprove the 2010/11 Operating Plan and Operating Budget of the Valley Waste ResourceManagement Authority as approved by the Authority on January 20, 2010 for forwarding toPartnership Councils. The Board holds the position that by usingthe Public Transit funds to build a garage the partners will see a decrease in maintenance costs,eventually reducing the budget.Adjourn for LunchUpon motion of Councillor Fowler, seconded by Councillor Trimper, Council adjourned for lunch at11:40 p.m. Council reconvened at 12:55 p.m. with all Councillors present as previously stated(McDonald 1:05) along with 15 members of the public.PresentationRe: Mr. Len Creelman et als – Mr. Creelman introduced himself and spoke on behalf of citizensconcerned about the closure of Lifeplex, noting the following:- Recent Letters to the Editor in papers are a reaction to media releases, sent in frustration atbeing unable to participate with Council.- The Lifeplex was established for wellness and saw 1,100 users in January and 4,200 inFebruary despite reduced hours.- Staff and volunteers are very proud of their accomplishments and acknowledge that YMCA isa great benefit to communities, but that the Lifeplex currently operates at a benefit to thecommunity. He asked that Municipal Council reconsider their decision to close Lifeplex.The Deputy Warden thanked Mr. Creelman for addressing Municipal Council.Annual ReportRe: Clean Annapolis River Project (CARP) – Science Coordinator Andy Sharpe provided anoverview of the projects handled by CARP over the past year:- Energuide for Homes – delivery agent since 2009, completed 500 home energy audits- Soft Shell Clams in the Annapolis Basin -- working to revitalize and sustain- Environmental Home Assessment Program – educating and providing regular testing of well waterand proper maintenance of oil tanks and septic systems – 125 customers- Water Quality Monitoring – 2009 water quality index scores were up overall over 2008.- Clementsport Dam Feasibility Study – exploring options to restore fish passage up the river and torestore the river. He noted that funding for this project was received from the Gulf of Maine. Herequested a letter of support for continued funding from this group.MOTION 100316.22 Clean Annapolis River Project Letter of Support for Funding ApplicationIt was moved by Councillor Wilkins, seconded by Councillor Fowler, that Municipal Councilprovide a letter support for CARP‟s funding application for the Gulf of Maine Council (GoMC)Habitat Restoration program to carry out final engineering designs and environmental permittingfor the recommended option from the feasibility study. Motion carried unanimously.New Business:Re: Short Term Action Chart – Review & Update – An updated Short Term Action chart notingcompleted projects was presented to Council. Motion carried unanimously.Re: Student Grants and Bursaries – Nick HarveyMOTION 100316.25 Student Grants & Bursaries – Nick HarveyIt was moved by Councillor Wilkins, seconded by Councillor McDonald, to approve a grant inaccordance with Policy AM 1.4.4 Student Grants & Bursaries, in the amount of 150 to NickHarvey, for assistance with his attendance at the K2 Nationals Alpine Skiing event. Motioncarried unanimously.Re: CBC – Shelve Library Cuts: Antigonish – Councillor Chipman moved, seconded by CouncillorFowler to receive for information. Motion carried unanimously.Re: Request for Letter of Support – Wharf Rat Rally – an email dated February 22nd was received,requesting a letter of support that addresses the financial benefits from tourism and related spendingin the region.MOTION 100316.26 Wharf Rat Rally – Letter of SupportCouncillor Chipman moved, seconded by Councillor McDonald, that Municipal Council send aletter of support for the 2010 Wharf Rat Rally. Motion carried unanimously.Re: Area Rate: High Speed Internet along Shore Road West – a letter dated February 25th wasreceived from Melony Robinson of Shore Rd. West, expressing concerns about being requested tosupport an area rate in order to bring high-speed to the area. It was moved by Councillor Chipman,seconded by Councillor Vitiello, to receive for information. Motion carried unanimously.Re: Royal Canadian Legion Branch 122 Clementsport – a request dated January 22nd was receivedrequesting assistance in acquiring funding for proposed infrastructure repairs and upgrading projects.Page 6 of 8

Motion carried unanimously. (Staff to confirm that we can fund Legions)Re: Agricultural Land Review Community Public Meetings – Councillor Chipman reported he hadattended one of these public meeting where there were 135 in attendance. He noted that 1.62 millionhectares can support food production in this province.
