Terms and conditions ofour agreementTerms and ConditionsYour Lexus Premium Care Extended Factory Warranty Agreement consistsof two parts: the Warranty Certificate; this Terms and Conditions booklet.The Terms and Conditions booklet sets out the terms, conditions andlimitations that apply to your Lexus Premium Care Extended FactoryWarranty. Please read this document carefully so that you understand whatis covered and what is not covered. If you do not understand which items arecovered or not covered, please contact us – our contact details are printedon the back cover of this booklet.Note that your Lexus Premium Care Extended Factory WarrantyAgreement is an important document and you should keep it in a safe andaccessible place. All pages are numbered, and if any pages are missing youshould contact us for a replacement.The privacy of your personal informationThe personal information you have provided in relation to your warrantyand other personal information provided by you in connection with theadministration of your warranty is collected by LFS on Lexus Australia’sbehalf for purposes related to the provision and administration of yourwarranty and for associated planning, product development and researchpurposes.Lexus Australia and LFS may provide your information to its relatedcompanies, the dealer named in the contract or to third parties engaged byLFS in connection with the purposes referred to above.Lexus Australia and LFS may also use your information for marketing purposes.If at any time you no longer wish to receive marketing material from LexusAustralia or LFS, please contact us by calling LFS Customer Service on1300 888 840 or writing to us at PO Box 1354, Macquarie Centre NSW2113. Commonly used wordsor expressionsThe following words have a specific meaning in these Terms and Conditions.Approved repairmeans a repair or replacementauthorised by the Lexus Premium CareAdministrator.Authorised repairermeans a repairer recommended orapproved by the Lexus Premium CareAdministrator.Authorised Lexus dealermeans a dealer appointed by Lexus tosell for and on behalf of Lexus, newLexus vehicles.Dealer statutory warrantymeans the warranty required by law tobe provided by the dealer at the time youpurchased the vehicle.Extended warranty periodmeans the period described in the sectiontitled “Your warranty period”.Fails, failed or failuremeans the inability of any coveredcomponent to satisfactorily perform itsintended function, but excludes reductionin operating performance due to wearand tear consistent with its age anddistance travelled.Helpful benefitsmeans the additional benefits under thiswarranty, which are described in thesection titled “Helpful benefits”.Lexus componentmeans any component or part of thevehicle including components authorisedand marketed by Lexus as accessories,provided such accessories are fitted atthe time the vehicle first entered serviceas a new vehicle and includes any Lexusgenuine accessories fitted after vehicledelivery, but within the Lexus new vehiclewarranty period.Lexus Premium CareAdministratormeans Lexus Financial Services (LFS),a division of Toyota Finance AustraliaLimited ABN 48 002 435 181Australian Credit Licence 392536.4Extended factory warranty

Lexus new vehiclewarrantymeans the vehicle warranty set out in theowner’s documentation supplied withthe vehicle.Market valuemeans our determination of the valueof your vehicle immediately prior to theevent that leads to a claim under thiswarranty. Our determination will take intoaccount such things as your vehicle’s age,condition and kilometres travelled.Owner’s documentationmeans the owner’s manual and warrantyand service book provided by Lexus inrelation to the vehicle.Repair, replace orreplacementmeans to make good, to acceptableworking condition, using parts of a likekind and quality. Parts used to repairyour vehicle may be genuine new orguaranteed reconditioned. Wheregenuine parts are not available in Australiaor where non-genuine parts have beenfitted after purchase, replacement partswill be of a similar type and quality tothose used in your vehicle, taking intoaccount its age and distance travelled.Selling dealermeans the Authorised Lexus dealer whosold you the vehicle and this warranty.Vehiclemeans the vehicle manufactured and/ormarketed by Lexus and described in thewarranty certificate.Warranty or LexusPremium Care ExtendedFactory Warrantymeans this warranty contract consistingof the warranty certificate and theseTerms and Conditions.We, Our, Us or Lexusmeans Lexus Australia; a division ToyotaMotor Corporation Australia LimitedABN 64 009 686 097.You or Yourmeans you, the purchaser of the vehicleand any subsequent person to whomthis warranty is transferred in theseTerms and Conditions.Premium care5

Your obligations underthis warrantyThis warranty is designed to replace or repair any Lexus componentsdefective in material or workmanship which fail under normal operationand use during the extended warranty period.It is a condition of this warranty that your vehicle must be maintained tothe manufacturer’s recommendations by an Authorised Lexus dealer orlicensed motor vehicle repairer. These servicing requirements are outlinedwithin your owner’s documentation.You should keep evidence of how and where your vehicle has beenserviced, as it will help to minimise any delay in processing your claim.Please note that if your vehicle is inadequately maintained we may refuseyour claim.Approval for warranty repairsAll repairs made under this warranty require the express approval of theLexus Premium Care Administrator, who can be contacted on the numberprinted on the back cover of this booklet. Apart from selling and issuing thiswarranty, your Selling dealer is not authorised to act as the agent for us or theLexus Premium Care Administrator or to bind any party to any arrangementwith you.If your vehicle fails and needs to be repaired outside the Lexus Premium CareAdministrator’s normal office hours and cannot be approved before repairsare carried out, you must contact the Administrator as soon as possible afterthey re-open if you want to claim for the repairs under this warranty.6Extended factory warranty

Your warranty periodYour warranty will apply for defects that arise during the warranty periodspecified in your Warranty Certificate.The warranty will commence the later of:1. the date of issue as stated in the warranty certificate; or2. the date that the Dealer statutory warranty expires; or3. the date that the Lexus new vehicle warranty expires.The warranty will end the earlier of:1. the date the term in months shown on your warranty certificate haselapsed from the date the warranty commenced; or2. when the vehicle has travelled the distance since new, as noted onyour warranty certificate.What your warranty coversWe warrant that within the extended warranty period we will repair orreplace free of charge any Lexus component found to be defective inmaterial or workmanship under normal operation and use in Australia, withthe exception of any item listed under “What your warranty does not cover”.Our goods come with guarantees that cannot be excluded underthe Australian Consumer Law. You are entitled to a replacement orrefund for a major failure and compensation for any other reasonablyforeseeable loss or damage. You are also entitled to have the goodsrepaired or replaced if the goods fail to be of acceptable quality and thefailure does not amount to a major failure.The benefits given to you by this warranty are in addition to the other rightsand remedies you as a consumer have under law in relation to the goodsand services to which this warranty relates.What we payIf we approve your claim, we may choose, at our option, to pay thereasonable cost of either repairing or replacing those Lexus components.Replacement parts will be of similar type and quality to the other Lexuscomponents of your vehicle, taking into account its age, condition anddistance travelled.The most we will pay under this warranty for repairing or replacing Lexuscomponents during the extended warranty period is limited to the marketvalue of the vehicle as at the date of repair.Premium care7

Helpful benefitsYour warranty also provides you with a number of other helpful benefitsto ease the inconvenience of a failure:1. Towing expensesWe will pay for the reasonable costs you incur in towing your vehicle tothe nearest Authorised Lexus dealer or licensed repairer should towing berequired for the purpose of carrying out an approved repair.You must also ask the Authorised Lexus dealer or licensed repairer to tell theLexus Premium Care Administrator if you had your vehicle towed, so thatthey can authorise your claim for towing expenses.The most we will pay for such towing expenses during the extendedwarranty period is 500 (including GST).2. Quality guaranteeIf your vehicle suffers a failure during the extended warranty period, thenany authorised repairs made under this warranty will be covered for theremaining extended warranty period.4. Consumable itemsWe will pay to replace any consumable items if they require replacementdue to the failure of any other Lexus component covered by this warranty.Genuine original factory partsEvery Lexus genuine original factory part is designed and constructed tooriginal manufacturer’s specifications for maximum performance, longevityand perfect fit. Under this warranty all Lexus genuine original factory partsare warranted for the balance of the Lexus New Vehicle warranty or carry a12 month unlimited kilometre Lexus warranty, whichever is the greater.Any Lexus genuine original factory parts fitted during the Lexus new vehiclewarranty are covered under this warranty for the extended warranty period.8Extended factory warranty

What your warranty doesnot coverYour warranty does not cover the following items: Consumable items that have a limited working life, including thoserecommended for regular replacement within the owner’s documentation,including but not limited to:- batteries;- tyres;- filters;- hoses; or- brake pads and linings,unless these items are found to be defective in materials or workmanshipor fail in circumstances referred to in clause 3 of Helpful Benefits above. The costs of normal maintenance or service. This includes adjustmentsto your vehicle that are part of the scheduled servicing recommended byLexus as described in the owner’s documentation; Any vehicle adjustments or replacements necessary to maintainroadworthiness, insurance or registration unless they result from defectiveLexus components or faulty workmanship in Lexus components; Superficial damage, such as cosmetic or surface corrosion from stonechips or scratches in the paint; Any consequential loss, expense or damage, including loss of time orconvenience, or a reduction in the value of your vehicle; Repairs to or replacement of components (including Lexus components)covered by any other warranty or guarantee, including:- Dealer statutory warranty;- Lexus new vehicle warranty;- Lexus recall campaigns; or- a repairer’s warranty or guarantee. Any Lexus component that fails outside the extended warranty period.Your warranty does not cover parts that fail because: you have neglected to properly maintain and service your vehicle; your vehicle has been fitted with non-genuine parts, not made or suppliedby Lexus; your vehicle has been modified from Lexus factory specifications (forexample, conversion to LPG operation, addition of a turbocharger, orinstallation of oversize pistons or valves) unless the modifications areLexus approved and installed; of acts of nature (for example, bushfire, earthquake, thunderstorm,hail, flood); your vehicle is vandalised, abused, raced or used in any othercompetition; or of corrosion, electrolysis or rust.Premium care9

Your warranty does not cover the failure of any Lexus componentswhere your vehicle is being used or has been used in circumstancesother than normal operating conditions, for example: as a rental vehicle; as a taxi; as a driving school vehicle; as a courier vehicle or for mail delivery; as a police, security or emergency vehicle; or on mining sites.When we may refuse a claimYour warranty is designed to protect you against Lexus components which failunder normal operation and use. Accordingly we may refuse a claim if you: fail to service your vehicle in accordance with your servicing requirements asset out in your owner’s documentation; (or anyone using your vehicle or acting with your consent) intentionallydamage your vehicle causing component failure; do not follow the requirements for “Claiming under this warranty”; fail to provide us with accurate information; or make or attempt to make a fraudulent claim.Claiming under this warrantyHow to make a claimAs soon as possible after a failure that you feel might be covered by thiswarranty, you must: take reasonable steps to prevent further damage to your vehicle; take your vehicle to the Selling dealer or, if this is not possible, to the closestAuthorised Lexus dealer or licensed motor vehicle repairer; andBefore any work is done to your vehicle, you must ask the Selling dealer,Authorised Lexus dealer or licensed motor vehicle repairer to read theRepairer Instructions at the rear of this booklet and to contact the LexusPremium Care Administrator for claim authorisation.A claim form can be obtained by calling 1300 888 840 or emailingpremiumcare@lexus.com.auThe expense associated with making a claim under this warranty is notcovered by this warranty. This means that you must bear the expense ofmaking a claim, including contacting the Administrator.What you must not doDo not have your vehicle repaired, nor authorise repairs, unless we haveexpressly approved repairs by the Authorised repairer.10Extended factory warranty

Additional terms andconditionsCancelling your warrantyYou may cancel your warranty at any time by writing to the Lexus PremiumCare Administrator requesting cancellation.We may also cancel your warranty where you have not fully complied withthe Terms and Conditions of the warranty.TransferabilityOnly you are entitled to make a claim or receive a benefit from your warranty.At the sole discretion of the Lexus Premium Care Administrator, wemay permit you to transfer your warranty upon sale of the vehicle to thepurchaser. The warranty cannot be transferred if you sell your vehicle toor through a motor dealer or trader. This does not affect your rights orentitlements otherwise available at law.A transfer form can be obtained by calling 1300 888 840 or emailingpremiumcare@lexus.com.auPremium care11

Repairer InstructionsDO NOT Commence REPAIRS UNLESS AUTHORISED BY THELEXUS PREMIUM CARE ADMINISTRATORPlease contact the Lexus Premium Care Administrator on 1300 888 840and advise them that you wish to make a claim under the warranty.A claim form can be obtained by calling 1300 888 840 or emailingpremiumcare@lexus.com.auIf the claim is authorised, the Lexus Premium Care Administrator will approverepairs and issue a repair authorisation number.Once repairs are completed, the Authorised repairer must forward a taxinvoice to the address below for payment. Tax invoices must be addressed tothe Lexus Premium Care Administrator and include the following information:1. Lexus Premium Care authorisation number;2. Vehicle registration number;3. Customer’s name in full (include ABN if a company);4. Odometer reading;5. Breakdown of repair costs, detailing parts, labour and GST content;6. Copies of any sublet repair invoice (when requested);7.
