LEXUS PRE-OWNED WARRANTY GENERAL INFORMATIONThe terms and conditions of your vehicle's Lexus Pre-Owned Warranty are as follows:DEFINITIONSBelow a definition of key concepts, entities and parties referred to in your vehicle's Lexus Pre-Owned Warranty :“You/your”: Refers to the person whose name and address appears on the welcome letter schedule, proposal form or dealerschedule.“Insurer”: Refers to Guardrisk Insurance Company Limited (Registration No. 1992/001639/06).“Administrator”: Refers to Innovation FSP (Pty) Ltd (Registration No. 1997/005662/07). Innovation FSP is a licensedFinancial Services Provider for the purposes of the Financial Advisory and Intermediary Services Act 37 of 2002.“Your vehicle”: Refers to your vehicle as specified in the welcome letter schedule, proposal form or dealer schedule.“Mechanical Breakdown”: Refers to the unforeseen failure of any of the components arising from mechanical and/orelectrical failure, causing a sudden stoppage of their functions and necessitating repair and/or replacement.“Cost of repair”: Refers to the usual and reasonable charges for components and/or labour to repair or replace the damagedcomponent(s).“Insured”: Refers to the owner of your vehicle at the time of purchase of your vehicle's Lexus Pre-Owned Warranty , or inthe instance where the Policy has been transferred in terms of your vehicle's Lexus Pre-Owned Warranty , the new owner ofyour vehicle.“Authorised Dealer”: Refers to a Lexus SA Authorised Dealer or Service Centre appointed by the Manufacturer to sell newand/or used vehicles marketed from time to time by the Manufacturer, also appointed to perform servicing and any repairswhich are deemed necessary.“Manufacturer'': Refers to Toyota South Africa Motors (Pty) Ltd.“Current Trade Value”: Refers to the average value that your vehicle is worth when trading-in or selling your vehicle. It isan industry guideline that vehicle dealerships use in order to determine a purchase price when buying or selling a vehicle.“Cover”: Refers to your vehicle’s Lexus Pre-Owned Warranty .“Benefits”: Refers to the components covered by your vehicle’s Lexus Pre-Owned Warranty and their amounts.“Roadworthy”: Refers to your vehicle that must be maintained according to the roadworthy requirements of the applicableNational Road Traffic Act.“Pro Rata”: Refers to the portion of the premium paid back to you using the unexpired risk period calculated as a percentageof the total risk term of your vehicle’s Lexus Pre-Owned Warranty .“Skipped Service”: Refers to any one service that was missed by either interval (time) or mileage as per the Manufacturer'sspecified intervals.INSURERGuardrisk Insurance Company Limited (Registration No. 1992/001639/06) underwrites the benefits of the Lexus Pre-OwnedWarranty . Your vehicle's Lexus Pre-Owned Warranty conforms to the requirements of the Short Term Insurance Act53 of 1998 (as amended) and in no way detracts from your legal rights.Upon receipt of a fully completed proposal form and the required premium, the Insurer will accept the risk if your vehiclecomplies with your vehicle's Lexus Pre-Owned Warranty conditions. Guardrisk Insurance Company Limited however,reserves the right to decline this proposal, which will be done within 30 days of receipt of the proposal form or welcome letterschedule. In the event of such a refusal the paid premium will be refunded in full.2

ELIGIBILITYYour vehicle's Lexus Pre-Owned Warranty covers only Lexus passenger vehicles with a gross vehicle mass of less than 3500 kg, with no modification to the Manufacturer's original specifications and must be maintained according to the roadworthyrequirements of the applicable National Road Traffic Act.Any Lexus motor vehicle outside the original Manufacturer’s Warranty with a service history by a Lexus SA Authorised dealeror Service Centre, may qualify under the following conditions: The vehicle may not be older than 7 years from original date of sale; The odometer reading may not be more than 200 000km; Maximum of 2 skipped services (not 2 consecutive intervals) either on prescribed interval or mileage (within theManufacturer’s Warranty).PERIOD OF COVERThe Lexus Pre-Owned Warranty will be subject to a 45 (forty five) day no-claim window from the date of purchase. Covercommences after this 45 day period for a maximum 2 years or up to an overall distance of 250 000 km's (whichever occursfirst) for all vehicles not covered by the Manufacturer’s Warranty or Lexus Extended or Unlimited Warranty.For vehicles still covered under the Manufacturer’s Warranty or Lexus Extended or Unlimited Warranty, cover will commenceon the expiry of the active warranty for a maximum of 2 years or up to an overall distance of 250 000 km’s (whichever occursfirst).Upon receipt of a fully completed proposal form or voice-logged proposal and the required premium, the Insurer will acceptthe risk if your vehicle complies with the terms and conditions as set out in your vehicle's Lexus Pre-Owned Warranty .PREMIUM PAYMENTThe premium is payable in advance, either in cash or to be included in the finance agreement, as concluded with your financialinstitution. The benefits will not apply until such time as the premium due is received by the Administrator or the Insurer.Please note that you will be afforded a 15 day grace period, from the date of the purchase of your Lexus Pre-OwnedWarranty , within which you would be able to make payment for an unsuccessful premium payment. If no payment isreceived within this period, you will not be covered and your Lexus Pre-Owned Warranty will be cancelled.SERVICE REQUIREMENTSIt is a condition of your vehicle’s Lexus Pre-Owned Warranty that your Lexus vehicle be serviced and maintained bya Lexus SA Authorised Dealer or Service Centre for the duration of your vehicle’s Lexus Pre-Owned Warranty .Please refer to your “Lexus Book of Life” to familiarise yourself with the prescribed service intervals and the allowed serviceover-run specific to your vehicle.The original invoices reflecting the date of service, invoice number and odometer reading must be retained by the policyholderas these may be required by the Administrator in the event of a claim.Failure to adhere to the servicing requirements of your Toyota vehicle could invalidate your vehicle's Lexus Pre-OwnedWarranty .This Lexus Pre-Owned Warranty does not cover the cost of servicing, routine maintenance or accident damage.3

COVERAll the items covered under the standard Lexus Manufacturer's Warranty will be covered under your vehicle's Lexus PreOwned Warranty and is subject to the terms, conditions and exclusions set out herein. All repair work must be authorisedin advance and carried out by a Lexus SA Authorised Dealer or Service Centre.Please note that this Lexus Pre-Owned Warranty provides partial cover for a claim where services (non-consecutiveintervals) have been skipped after inception of your vehicle’s Lexus Pre-Owned Warranty (maximum of two skippedservices).The partial cover (in the instance of skipped services post Lexus Pre-Owned Warranty inception) is as follows: There will be a 20% co-payment on the authorised claim value, payable by the policy holder, in the instance whereone service interval was skipped after inception of the policy. There will be a 40% co-payment on the authorised claim value, payable by the policy holder, in the instance wheretwo non-consecutive service intervals were skipped after inception of the policy. Where two consecutive or more than two service intervals are skipped (after inception of the policy), no claims willbe covered under your Lexus Pre-Owned Warranty .WEAR AND TEARYour vehicle's Lexus Pre-Owned Warranty only provides cover against mechanical and/or electrical malfunction or failureresulting from defective parts (i.e. parts failing due to material or manufacturing defect).Parts failing or malfunctioning due to wear and tear resulting from age, extended usage and/or operating conditions are notcovered by your vehicle's Lexus Pre-Owned Warranty .The following components are considered wear and tear items: Brake pads, shoes and discs;Clutch components;Shock absorbers;Serviceable wheel bearings;Wiper blades;Globes.BETTERMENTWhere the repair requires new or exchange units, which in the opinion of the Administrator are in excess of what is necessaryto repair your vehicle according to the Manufacturer's specifications, you will be liable for the additional costs.Please consult with the Administrator should you be in doubt regarding this.GENERAL EXCLUSIONSThe conditions of your vehicle's Lexus Pre-Owned Warranty shall not apply to:1.2.Any cause of failure as a result of negligence, misuse, ignorance, alteration or modification.Any vehicle serviced or repaired other than by a Lexus SA Authorised Dealer or Service Centre or a Lexus SAAccredited Body and Paint Repairer.3. Any vehicle which has been subjected to any form of competition.4. Any normal maintenance and service costs as per service schedule and the replacement costs of service items andconsumables.5. Any problems which may arise from the use of parts and accessories other than Lexus Genuine Parts and Accessories.6. Any vehicle not maintained and serviced as per prescribed Maintenance schedule by a Lexus SA AuthorisedDealer or Service Center or Lexus SA Accredited Body and Paint Repairer.7. Any damage caused by the direct result of an accident.8. Any vehicle which has missed more than 4 services. In these circumstances your claim will not be covered under theLexus Pre-Owned Warranty and the Administrator, acting on behalf of the Insurer, is entitled to cancel yourvehicle's Lexus Pre-Owned Warranty by giving you 30 days' notice in writing, either by mail or fax, or via electronicmedia in the form of an email to the last known address.9. Any of those components listed in the SPECIAL EXCLUSIONS (see below).10. Any further or additional cost resulting from a component failure not related to the original failure.11. Any vehicle if the incorrect type of fuel (e.g. diesel added to a petrol vehicle) has been used to operate it.12. Any vehicle utilised as a taxi, rental vehicles, rebuilt vehicles (Code 3), or modified vehicles.4

SPECIAL EXCLUSIONSYour vehicle's Lexus Pre-Owned Warranty does not cover costs incurred as a result of normal wear and tear orinspections; neither does it cover any loss or deterioration, of whatever nature, as a result of the vehicle being out of use orstored for an extended period. Therefore costs related to the items listed below are your brication: Extremes of temperatures, adverse weather and severe road conditions will result in the need for morefrequent servicing. During services, lubricant and fluid levels, doors, locks, rubber seals, throttle and parking brakelinkages need to be checked.Engine oil and filters: To prolong engine life and performance, engine oil and filters must be changed as recommended.Engine tuning and electrical systems: Must be checked and adjusted periodically for maximum economy, performanceand driving safety.Belt adjustments: Belts are subject to wear and must be adjusted or replaced when necessary.Brake and clutch adjustments: Linings and pads are subjected to wear and must be adjusted or replaced when necessary.Tyre rotation: Severe driving habits, such as heavy braking, harsh acceleration, high cornering loads and high speeds ingeneral contribute towards a shorter tyre life. To achieve uniform tyre wear and longer tyre life it is recommended thattyres be rotated periodically.Wheel alignment and balance: Adverse driving conditions and poor driving habits can cause wheels to go out ofbalance. Maintaining the correct wheel alignment and balance will provide better handling, improved ride comfort andlonger tyre life.Fuel system cleaning/correct fuel as specified: Contaminates can sometimes enter the fuel system from external sources.Should this occur, the fuel system must be drained and the filters replaced to restore proper engine performance. It is yourobligation, in every instance to take extra care to ensure that the correct fuel is used.Rattles and squeaks: Before delivery of a vehicle the Lexus SA Authorised Dealer or Service Centre will, as a matter ofcourse, ensure that the vehicle is free of any unusual noises. However, after a while, poor road conditions may result inrattles or squeaks developing. It is therefore advisable that adjustments be checked regularly, and all bolts, nuts, screwsand clamps should be checked periodically.Spark plugs: These items are subject to wear and tear and/or carbon build-up. For maximum performance and economythey should be checked periodically and replaced at specific times.Fuel and air filters: In order that these items can perform their important function of cleaning the fuel and air for theengine they should be properly maintained and replaced at the recommended intervals. In severe operating conditionsreplacement should be more frequent than recommended for normal operation.Wiper Blades: The life of windscreen wiper blades is dependent on the amount of use and climatic conditions. For safetyreasons these items should be replaced when wear impairs their function to clear the windscreen efficiently.Globes and Fuses: The replacement of electric globes and fuses and lamp glasses on failure is not covered by thewarranty.Engine coolant: Please consult your Lexus SA Authorised Dealer or Service Centre for the latest available servicebulletin for the specified coolant additives and concentrations. These must be maintained as recommended to preventcorrosion and erosion.Please note that this warranty does not cover expenses incurred as a result of normal wear and tear or inspections.Neither does it cover any losses, of whatever nature, as a result of the vehicle being out of use. The warranty period isnot extended as a result of repairs during the warranty period.5

GENERAL TERMS AND CONDITIONSa.b.c.d.e.f.g.h.i.j.k.l.These terms and conditions shall also incorporate as expressed terms and conditions all the contents of your vehicle'sLexus Pre-Owned Warranty , which you will be deemed to have read and understood.It is agreed and declared that the Administrator, acting on behalf of the Insurer, will be released from all liability andobligations under your vehicle's Lexus Pre-Owned Warranty if the terms and conditions of your vehicle's Lexus PreOwned Warranty are not fully complied with.All claims must be reported to the Administrator immediately. In the event of a breakdown after hours, over a weekend ora public holiday the claim must be reported to the Administrator on the next working day. Failure to do so may invalidatethe claim.All claims documentation must be received by the Administrator within 45 days of the date of completion of the repair.The Administrator, acting on behalf of the Insurer, reserves the right to cancel your vehicle’s Lexus Pre-OwnedWarranty should it be deemed that excessive claims have been submitted which outweigh the benefits limits of yourvehicle’s Lexus Pre-Owned Warranty . Your vehicle’s Lexus Pre-Owned Warranty will be cancelled for excessiveclaims within your Policy duration.You must service your vehicle as per the requirements defined in the section "SERVICE REQUIREMENTS". Failure tocomply with the above could invalidate your vehicle's Lexus Pre-Owned Warranty .Your vehicle's Lexus Pre-Owned Warranty is in addition to, and does not detract from, any contractual rights underStatute or Common Law.You must take all reasonable steps to maintain your vehicle and keep it in a proper and efficient state of repair and in theevent of any mechanical and/or electrical failure you must use all reasonable means to protect your vehicle from furtherloss or damage.In no case whatsoever will the Administrator, acting on behalf of the Insurer, be liable to make any payment in respect ofany mechanical and/or electrical failure after the expiration of 6 months from the occurrence of such mechanical and/orelectrical failure.It is your responsibility to ensure that, in the case of diesel vehicles, the diesel pump is calibrated as per theManufacturer’s specifications. A failure resulting from incorrect calibration will result in rejection of the claim.Your vehicle's Lexus Pre-Owned Warranty shall be null and void in the case of fraudulent claims.All repairing invoices by a Lexus SA Authorised Dealer or Service Centre must be submitted to the Administrator andsigned by you.COOLING OFF PERIODPlease note that you are entitled to cancel your vehicle’s Lexus Pre-Owned Warranty in writing to the Administratorwithin 14 days after the date of receipt of Lexus Pre-Owned Warranty documentation or from the reasonably determineddate on which you received your vehicle’s Lexus Pre-Owned Warranty documentation.Please note that you may only cancel your vehicle’s Lexus Pre-Owned Warranty within 14 days where no benefit has yetbeen paid or claimed or the event insured against under your vehicle’s Lexus Pre-Owned Warranty has not yet occurred.All premiums that were paid up to the date that the Administrator receives your written notice of cancellation will be refundedto you, subject to the deduction of the cost of any risk cover you may have enjoyed.Your request for cancellation shall be completed by no later than 60 days after the Administrator receives your cancellationnotice.6

AMENDMENTS AND CANCELLATIONSYou are entitled to cancel your vehicle's Lexus Pre-Owned Warranty at any time by giving the Administrator 31 days’notice. Should you wish to cancel your vehicle's Lexus Pre-Owned Warranty you are required to advise the Administratorin writing (please refer to Customer Care Contact Details).The Administrator, acting on behalf of the Insurer, is entitled to amend the terms and conditions of your vehicle’s Lexus PreOwned Warranty .The Administrator, acting on behalf of the Insurer, is entitled to cancel your vehicle's Lexus Pre-Owned Warranty bygiving you 31 days’ notice in writing, either by mail or fax, or via electronic media in the form of an email to the last knownaddress unless the following circumstances apply:a)b)c)Non-payment of premium – subject to 15-day grace period after non-payment;A material change in the risk which results in the risk being uninsurable or forms part of the excluded risks under yourvehicle’s Lexus Pre-Owned Warranty which will:oresult in your vehicle’s Lexus Pre-Owned Warranty automatically coming to an end; oroprovide the Insurer with a right to end the cover under your vehicle’s Lexus Pre-Owned Warranty .Where immediate termination is required by law.In the event that you cancel your vehicle's Lexus Pre-Owned Warranty , the following conditions will apply with regard tothe refund of premiums: Where a refund is due to you, all cost incurred, including commissions, and underwriting fees, will be deducted. All payments will be made in South African currency. Your vehicle's Lexus Pre-Owned Warranty will be governed by the laws of the Republic of South Africa whose courts will have jurisdiction in any dispute arising underyour vehicle’s Lexus Pre-Owned Warranty .FRAUDShould you or anyone acting on your behalf, knowingly or otherwise commit a fraudulent act or attempt to obtain a benefitunder your vehicle's Lexus Pre-Owned Warranty by improper means, all benefits shall immediately cease and yourvehicle's Lexus Pre-Owned Warranty shall be cancelled. Under these circumstances there will be no refund of any kind.TRANSFERABILITYIn the event that you sell / trade-in your vehicle, your vehicle’s Lexus Pre-Owned Warranty will be transferred to thesubsequent new vehicle owner, provided your vehicle’s Lexus Pre-Owned Warranty is still valid.Should you not wish to transfer your Lexus Pre-Owned Warranty , you are required to cancel the Lexus Pre-OwnedWarranty prior to selling / trading-in your vehicle, failing to do so will result in an automatic transfer of your Lexus PreOwned Warranty to the new vehicle owner.7

CLAIM PROCEDUREIn the event of a mechanical and/or electrical failure which may result in a claim, you must at your own expense: Notify the Administrator, telephonically on the numbers provided of any event resulting in a claim being made againstyour vehicle’s Lexus Pre-Owned Warranty ;Provide the Administrator with such proof and information as required to process the claim;The Administrator will recommend a Lexus SA Authorised Dealer or Service Centre in your preferred area who haveconformed to the stringent requirements of the Manufacturer;All repair work must be authorised in advance by the Administrator; failure to obtain prior authorisation before repairwork has been started will invalidate your claim;You will not be liable for any excess payments when lodging a claim.Information necessary when reporting a claim: Owner's name;Vehicle's Policy number;Current odometer reading on your vehicle;Nature of mechanical failure/breakdown (fault, cause, remedy);Address where vehicle can be inspected;Service records and/or invoices.Should it be necessary to disassemble any component to establish the cause or extent of the damage, it is your responsibility toauthorise such disassembly to establish whether there is any liability under your vehicle's Lexus Pre-Owned Warranty . Thecost for disassembly to ascertain the cause of failure will be for your own account should the claim not be covered.The Administrator reserves the right to inspect your vehicle and failure before authorisation is granted.After the work has been completed by the Lexus SA Authorised Dealer or Service Centre, you must inspect your vehicle toensure that the work is complete and satisfactory in all respects.Please ensure that the Lexus SA Authorised Dealer or Service Centre submits all repair invoice(s) signed by you, to theAdministrator via email, post or fax within 30 days after the completion of repairs, failing which the claim will not beconsidered and you will be liable for the repair cost.Should your claim be rejected, you are entitled to request a full explanation from the Administrator.In the event of double insurance for the same item, the Insurer may arrange with the other Insurer to pay the rateable portion inrespect of the claim.CORROSION WARRANTYIn order for the corrosion/perforation warranty to remain intact the following conditions should be adhered to: All body and/or paint repairs must be performed by a Lexus SA Accredited Body and Paint Repairer, within a reasonableperiod after the damage occurred.COMPLAINTSContact the Administrator’s Customer Care Centre 0860 123 329 (Monday to Friday from 7:30 to 17:00).8

ADDITIONAL BENEFITSLexus Roadside AssistanceThe Lexus Roadside Assistance Service is applicable to all Lexus vehicles covered by a Lexus Pre-Owned Warranty .The Roadside Assistance program is implemented to ensure carefree motoring. The meticulous quality control during themanufacturing of your vehicle makes it unlikely that you will experience a problem. In the areas where ADT Security does not have a presence, the AA willattempt to dispatch the local police service to wait with you;In the event that your vehicle has broken down more than 100 km's from your home, the AA will arrange for a 24-hour carrental to assist you in either completing your journey or return back home. The rental vehicle will be a Group B vehicle(subject to availability). This service is subject to terms and conditions as set by the car rental company i.e. you must be inpossession of a valid credit card and driver's license;9

8.In the event that your vehicle has broken down more than 100 km's from your home, provided that you have elected toforfeit the 24-hour car rental option, arrangements will be made for overnight accommodation for the driver and amaximum of four passengers. A maximum of R 350 cover per person for one night's accommodation to be paid (max 5people).Vehicle RepatriationIn the event you elect to continue your journey, while your vehicle is being repaired (opted for the 24-hour car rental option),the AA will provide you with a 24-hour Group B rental vehicle to collect your vehicle or alternatively, arrange for a flightticket for the customer to collect his or her vehicle once the repairs have been completed.OrShould you insist to have your vehicle towed to a Lexus SA Authorised Dealer or Service Centre closer to your home address,the AA will supplement the additional tow costs for your vehicle’s repatriationIn the event of an accident, the AA will arrange for your vehicle to be towed to the nearest Lexus SA Accredited Body andPaint Repairer from the accident scene.ROAD COVERRoad Cover provides victims of motor vehicle accident

The Lexus Pre-Owned Warranty will be subject to a 45 (forty five) day no-claim window from the date of purchase. Cover commences after this 45 day period for a maximum 2 years or up to an overall distance of 250 000 km's (whichever occurs first) for all vehicles not covered by the Manufacturer's Warranty or Lexus Extended or Unlimited Warranty.
