Treating Domestic Customers FairlyCustomer Objective0.1The objective of this condition is for the licensee and any Representative to ensure thateach Domestic Customer, including each Domestic Customer in a Vulnerable Situation,is treated Fairly (“the Customer Objective”).Achieving the Standards of Conduct0.2The licensee must, and must ensure that its Representatives, achieve the Standards ofConduct in a manner consistent with the Customer Objective.0.3The Standards of Conduct are that the licensee and any Representative:a) behave and carry out any actions in a Fair, honest, transparent, appropriate andprofessional manner;b) provide information (whether in Writing or orally) to each Domestic Customerwhich:i. is complete, accurate and not misleading (in terms of the information provided oromitted);ii. is communicated (and, if provided in Writing, drafted) in plain and intelligiblelanguage with more important information being given appropriate prominence;iii. relates to products or services which are appropriate to the Domestic Customer towhom it is directed;iv. in terms of its content and in terms of how it is presented, does not create amaterial imbalance in the rights, obligations or interests of the licensee and theDomestic Customer in favour of the licensee; andv. is sufficient to enable the Domestic Customer to make informed choices abouttheir supply of electricity by the licensee;c) in relation to customer service arrangements:i. make it easy for a Domestic Customer to contact the licensee;ii. act promptly and courteously to put things right when the licensee or anyRepresentative makes a mistake; andiii. otherwise ensure that customer service arrangements and processes are complete,thorough, fit for purpose and transparent;d) in relation to Domestic Customers in Vulnerable Situations:9

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022i. seek to identify each Domestic Customer in a Vulnerable Situation, in a mannerwhich is effective and appropriate, having regard to the interests of the DomesticCustomer; andii. when applying the Standards of Conduct in paragraphs (a) to (c) above, do so in amanner which takes into account any Vulnerable Situation of each DomesticCustomer identified in accordance with (d)(i) above or otherwise.Scope of condition0.4Standard condition 0 only applies to the licensee if:a) the Secretary of State has provided, by a scheme made under Schedule 7 to theUtilities Act 2000, that Section B of the standard conditions will have effect; orb) the Authority has issued a Domestic Supply Direction to the licensee under paragraph3.3 of standard condition 3.0.5Subject to paragraph 0.6, standard condition 0 applies to all activities of the licensee andany Representative which involve, or otherwise relate to, dealings with a DomesticCustomer.0.6Apart from any matters relating to Deemed Contracts, standard condition 0 does notapply in respect of the amount or amounts of any Charges for the Supply of Electricity orany other type of charge or fee, applied or waived.0.7Standard Condition 0 applies to the exercise of a licensee’s discretion to apply or waiveany fee or charge.Guidance0.8The licensee must have regard to any guidance on standard condition 0 (including inrespect of definitions which appear in standard condition 1) which, followingconsultation (which may be conducted before this condition takes effect), the Authorityhas issued, may issue and may from time to time revise (following further consultation).Definitions0.9For the purposes of this condition:Customer ObjectiveFair and cognateexpressionsStandards of ConductIs to be interpreted in accordance with paragraph 0.1.The licensee or any Representative would not be regardedas treating a Domestic Customer Fairly if their actions oromissions give rise to a likelihood of detriment to theDomestic Customer, unless the detriment would bereasonable in all the relevant circumstances.Means one or more of sub-paragraphs 0.3(a) to (d).10

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022Vulnerable SituationMeans the personal circumstances and characteristics ofeach Domestic Customer create a situation where he orshe is:(a) significantly less able than a typical DomesticCustomer to protect or represent his or her interests;and/or(b) significantly more likely than a typical DomesticCustomer to suffer detriment or that detriment is likely tobe more substantial.11

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 20220A.6 Standard Condition 0A applies to the exercise of a licensee’s discretion to apply or waiveany fee or charge.0A.7 In the event of a conflict between this condition and paragraph 14.2 of standard condition14, this condition will prevail.Guidance0A.8 The licensee must have regard to any guidance on standard condition 0A (including inrespect of definitions which appear in standard condition 1) which, following consultation(which may be conducted before this condition takes effect), the Authority has issued,may issue and may from time to time revise (following further consultation).Definitions0A.9 For the purposes of this condition:“Billing”“Contractual Information”“Customer Objective”“Customer Transfers”“Designated Activities”all matters relating to the provision of a Bill orstatement of account to a Customer, includingthe content and calculations relating to such aBill or statement of account and the collectionand use of information relating to theconsumption of electricity.includes the drafting and content of a Nondomestic Supply Contract or Deemed Contractand the provision of information relating to theNon-domestic Supply Contract or DeemedContract that applies to a Micro BusinessConsumer which is being supplied by thelicensee.Is to be interpreted in accordance withparagraph 0A.1.includes, but is not limited to, any matters thatrelate to a Customer’s ability to changesupplier and/or affect the timeframe forchanging supplier (including related terms andconditions of a Non-domestic Supply Contractor Deemed Contract that applies to a MicroBusiness Consumer).mean each of the following:a) the accuracy of a Bill or statement ofAccount;b) the timeframe for a Micro BusinessConsumer receiving a Bill or statementof account and the timeframe for thepayment of a Bill;13

Definitions for standard conditions1.1This condition sets out most of the defined words and expressions used in the standardconditions of this licence (all of which begin with capital letters) and gives theirdefinitions next to them.1.2But some defined words and expressions used in standard condition 15 (Assistance forareas with high distribution costs scheme: payments to System Operator) and standardcondition 21 (Fuel mix disclosure arrangements) and their definitions are included inthose conditions.1.3Definitions in alphabetical orderIn this licence, unless the context otherwise requires:About Your TariffLabelhas the meaning given in standard condition 31F.10;AccountManagementArrangementmeans:ActActive Supplier(a)where the Domestic Customer is subject to Offline AccountManagement, Offline Account Management; or(b) where the Domestic Customer is subject to Online AccountManagement, Online Account Management;means the Electricity Act 1989;is a supplier that is actively engaging in the act of supplyingelectricity to one or more Domestic Customers and / or one ormore Non Domestic Customers;Additional Electricity means a device which:Smart Meter(a) is either a SMETS1 ESME, or is a device installed (or to beinstalled) at premises which:(i) consists of the components or other apparatus identified in;and(ii) as a minimum, has the functional capability specified byand complies with the other requirements of,the part(s) of the ESME Technical Specification in a Version ofthe ESME Technical Specification which was within its15

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022Installation Validity Period on the date on which the device wasinstalled; and(b) is installed at premises in such a manner and/or configurationthat it is:(i) joined to a Communications Hub Function at thepremises; but(ii) incapable of being used for the purposes ofdetermining the quantity of electricity supplied to thepremises.Affiliatemeans, in relation to an Electricity Supplier, any holding companyor subsidiary or subsidiary undertaking of a holding company ofthe licensee, in each case within the meaning of the CompaniesAct 2006;Affiliate ElectricityLicenseemeans any Subsidiary, Holding Company, or Subsidiary of aHolding Company of the licensee which holds an electricitysupply licence granted or treated as granted pursuant to section6(1)(d) of the Electricity Act 1989;Affiliate Licenseemeans any Subsidiary, Holding Company, or Subsidiary of aHolding Company of the licensee which holds a gas supplylicence granted or treated as granted pursuant to section 7A(1) ofthe Gas Act 1986 and/or an electricity supply licence granted ortreated as granted pursuant to section 6(1)(d) of the Electricity Act1989;16

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022Alternative CheapestTariffmeans, in comparison with the Estimated Annual Costs for eachspecific Domestic Customer’s Tariff, the cheapest Tariff availablefrom the licensee (or, where there are any Affiliate Licensees, thelicensee and any Affiliate Licensees) for that Domestic Customerbased on:(a)their Estimated Annual Costs applied in respect of thecheapest Tariff, rather than the Tariff the DomesticCustomer is currently subject to;(b)where the Domestic Customer is not subject to aPrepayment Meter, the cheapest Tariff compatible with theElectricity Meter installed at the Domestic Customer’spremises;(c)where the Domestic Customer is subject to a PrepaymentMeter, the cheapest Tariff compatible with any ElectricityMeter which could be installed at the Domestic Customer’spremises; and(d)consideration of both Time of Use Tariffs for whichappropriate consumption data is available and Non-Time ofUse Tariffs;(e)where the Domestic Customer is subject to a White LabelTariff:(i) a White Label Tariff of the same White Label TariffProvider; or(ii) a Tariff of the licensee which is not a White LabelTariff; and(f)where the Domestic Customer is not subject to a WhiteLabel Tariff;(i) a Tariff which is not a White Label Tariff; or(ii) a White Label Tariff of any White Label TariffProvider of the licensee;17

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022Annual ConsumptionDetailsmeans:(a)where the Customer has held their Domestic SupplyContract or Micro Business Consumer Contract (asapplicable) for at least 12 months and the licensee hasobtained actual meter readings (including meter readingsprovided by the Customer and accepted by the licensee inaccordance with standard condition 21B) which canreasonably be considered to cover the whole of that 12month period, the quantity of electricity which was treatedas consumed at the Customer’s Domestic Premises or NonDomestic Premises (as applicable) during the previous 12months on the basis of those meter readings; or(b)where the Customer has held their Domestic SupplyContract or Micro Business Consumer Contract (asapplicable) for:(i)less than 12 months; or(ii)at least 12 months and the licensee has notobtained actual meter readings (including meterreadings provided by the Customer and acceptedby the licensee in accordance with standardcondition 21B) which can reasonably beconsidered to cover the whole of that 12 monthperiod,the licensee’s best estimate of the quantity of electricity that theCustomer may be expected to consume during a 12 month periodhaving regard to any relevant information that is available to thelicensee or which the licensee could otherwise have reasonablyascertained (including any actual meter readings that have beenobtained and which cover part of the previous 12 months);Applicable Customermeans, in relation to an application made by the licensee to theAuthority in accordance with standard condition 10 (Restriction orrevocation of licence), a Customer if:(a)immediately before the restriction or revocation takeseffect, his premises are being supplied with electricity bythe licensee; and(b)in the case of a restriction, his premises will be excluded byit from this licence;18

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022ApplicationRegulationsmeans regulations made under section 6A of the Act that set out theform and manner in which applications for an Electricity SupplyLicence or an extension or restriction of such a licence are to bemade;ARS Specified Datemeans 30 June 2021 or such later date as may be specified in adirection issued by the Secretary of State.Authorisedin relation to any business or activity, means authorised by licencegranted or treated as granted under section 6 of the Act or, inappropriate cases, by exemption granted under section 5 of the Act;AuthorisedElectricity Operatormeans any person (other than the licensee) who is Authorised togenerate, participate in the transmission of, distribute or supplyelectricity, participate in the operation of an Interconnector orprovide a smart meter communications service and includes anyperson who has made an application to be so Authorised which hasnot been refused and any person transferring electricity to or from oracross an Interconnector or who has made an application for use ofan Interconnector which has not been refused;Authoritymeans the Gas and Electricity Markets Authority establishedunder section 1 of the Utilities Act 2000;Balancing andSettlement Codemeans the Balancing and Settlement Code provided for in standardcondition C3 (Balancing and Settlement Code (BSC)) of theTransmission Licence;Billmeans an invoice or a demand for payment or any other instrumentof the same or similar character and purpose;Category A MeteringArrangementmeans using an Electricity Meter on the basis of contractualarrangements whereby the Domestic Customer is required to payfor the Charges for the Supply of Electricity on the basis of asingle Unit Rate;Category B MeteringArrangementmeans using an Electricity Meter on the basis of any contractualarrangement (other than a Category C Metering Arrangement,Category D Metering Arrangement, or Category E MeteringArrangement) whereby the Domestic Customer is required to payfor the Charges for the Supply of Electricity on the basis of Timeof Use Rates;Category C MeteringArrangementmeans using an Electricity Meter on the basis of contractualarrangements (other than a Category D Metering Arrangement orCategory E Metering Arrangement) whereby the DomesticCustomer is required to pay for the Charges for the Supply ofElectricity on the basis of two separate Unit Rates incircumstances where, during each period of 24 hours, one Unit19

Electricitysuppliers Licence: Standard Conditions - Consolidated to 18 July 2022Rate applies to up to two separate specified periods of time duringthat period of 24 hours and the other Unit Rate applies to theremaining separate periods of time during that period of 24 hours;Category D MeteringArrangementCategory E MeteringArrangementmeans using an Electricity Meter on the basis of contractualarrangements (other than a Category C Metering Arrangement orCategory E Metering Arrangement) whereby the DomesticCustomer is required to pay for the Charges for the Supply ofElectricity on the basis of two or three separate Unit Rates incircumstances where, during each period of 24 hours:(a)one Unit Rate applies to a specified period of time duringthat period of 24 hours ("Period A");(b)one Unit Rate applies to a specified period of time which isdifferent to Period A during that period of 24 hours ("PeriodB");(c)one Unit Rate applies to the remaining periods of timeduring that period of 24 hours which are separate to PeriodA and Period B;means using an Electricity Meter on the basis of any contractualarrangement (other than a Category C Metering Arrangement orCategory D Metering Arrangement) whereby the DomesticCustomer is required to pay for the Charges for the Supply ofElectricity on the basis of Time of Use Rates in circumstanceswhere, during each period of 24 hours:(a)one or more Unit Rates apply to different periods of timewhich are determined by the licensee and/or a LicensedDistributor and activated via the use of radio signals duringthat period of 24 hours; and(b)no more than one Unit Rate applies at any given period oftime during that period of 24 hours;Central ChargeDatabasehas the meaning given in paragraph 1 of standard condition 35;CH TechnicalSpecificationmeans the Communications Hub Technical Specification, beingthe document (or part of a document) which:(a)identifies itself as such; and(b)applies in respect of a Communications Hub installed orprovided for the purposes of the supply of electricity.20
