Hillsborough Township Committee MeetingDecember 18, 2002Minutes of a Regular Meeting of the Township Committee of the Township of Hillsborough, in theCounty of Somerset, held at the Municipal Building starting at 8:00 p.m. on the above date.Those in attendance were as follows: Mayor Joseph Tricarico, Deputy Mayor John Gelardi, SecondDeputy Mayor Sonya Anne Martin, Committeeman Anthony Gwiazdowski, Committeeman William B.Gold, Township Attorney Karl P. Kemm, Township Administrator Judith C. Haas, Township Clerk AnnMarie McCarthy and Deputy Clerk Ann Marie Fuccello.Following roll call and the salute to the Flag, Mayor Tricarico advised that notice of this regular meetingwas made in accordance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975,by the posting on the bulletin board at the Municipal Building and by mailing to the Township’s officialnewspapers, a notice that this meeting would take place at the Hillsborough Municipal Building at 8:00p.m. on December 18, 2002.MEDALS OF MERITMayor Tricarico presented Patrolman James V. Maguire IV and detective Theodore S. Lewis withthe following proclamation:WHEREAS, from May 2002 until October 2002, the Hillsborough Township Police Department,in conjunction with the Somerset County Narcotic Strike Force conducted an investigation into thepossibility of someone growing marijuana; andWHEREAS, Officer James V. Maguire IV and Detective Theodore S. Lewis both used excellentinvestigative skills to bring the investigation to a successful conclusion; andWHEREAS, after the above named officers, along with the Somerset County Narcotic StrikeForce executed a Search Warrant and located 293 marijuana plants with an estimated street value ofapproximately one million dollars, resulting in the arrest of one individual and the closing of a majordrug manufacturing operation; andNOW, THEREFORE, BE IT PROCLAIMED that we, the Mayor and Township Committee, dohereby join together to recognize Officer James V. Maguire IV and Detective Theodore S. Lewis for theirinvestigative abilities and are credited for closing down a major drug growing operation.BE IT FURTHER PROCLAIMED that upon recommendation from Chief Robert K. Gazaway, theDepartment Medal of Merit be awarded to Officer James V. Maguire IV and Detective Theodore S. Lewisfor bringing this major investigation to its successful conclusion.Police Chief Robert Gazaway presented Patrolman James V. Maguire IV and Detective TheodoreS. Gazaway be and hereby is accepted and approved and David Farrell Wilson is hired as PoliceOfficer in the Police Department at an annual salary of 46,229.00, effective January 8, 2003.PROCLAMATIONSSchilke ConstructionMayor Tricarico presented the following proclamation to Schilke Construction:WHEREAS, the Hillsborough Township Department of Public Works has on many occasionsreceived assistance from Schilke Construction in Hillsborough, New Jersey; andWHEREAS, Schilke Construction has provided a track machine each year for the Township’s“clean-up” day; andWHEREAS, Schilke Construction loaned the Township their track hoe for the digging of a newseptic system at Mark Singley Park; andWHEREAS, Schilke Construction also loaned the Township their track hoe for the construction ofWoodfern Road; andWHEREAS, Schilke Construction supplied a harness to the Township for the installation of thewater main for the irrigation system at Docherty Park; and2

GOLD has served the Township of Hillsborough in a constructive andexemplary manner; andWHEREAS, William B. Gold was appointed to the Township Committee of the Township ofHillsborough to complete the unexpired term of Committeewoman Christine Jensen; andWHEREAS, William B. Gold has been tireless in his efforts as Township Liaison to the Board ofAdjustment, Environmental Commission, Cultural & Arts Commission and the Hillsborough MunicipalUtilities Authority, and his work with the Police, Fire and Rescue Squad; andWHEREAS, William B. Said term is the unexpired term of Kathy Gelardi. Said motion carried as followsupon call of the roll:Roll Call – Ayes: Gold, Martin, Gelardi, TricaricoNays: Gwiazdowski (Opposed appointment, felt it should be filled by 2003 TownshipCommittee.)Mayor Tricarico announced that with the agreement of the Township Committee that they wouldsuspend the order of the agenda. The Reports and New Business from Committee Liaisons and Businessfrom the Floor for Items on the Agenda would be deferred after the public hearings and business portionsof the meeting. He stated that the public hearings would continue until 10:00 p.m. At that time, theconsideration, consent and claims list would be acted on. After completion of these actions, the publichearings would continue. Shestated her reasons for opposing the Gateway.Robert Kwiatiak, 17 Grouse Road, agreed with Ms. Sammer’s comments. Mr. Kwiatiak requestedclarification to Section E – Dimensional requirements for the detached single-family, duplex and triplexresidential dwellings. He asked that “per unit” be inserted into the table in this section of the ordinance.Andrew Bayer, Esq., Attorney for the Township, reviewed the legal procedures that led to thisordinance.Tom Rodriguez, 18 Grouse Road, expressed his concerns with the projects, particularly how closethe project is to his home and his well water concerns.Close Public HearingUpon motion by Deputy Mayor Gelardi, seconded by Committeeman Gold, the public hearingfor Ordinance 2002-45 was closed. Said motion carried as follows upon call of the roll:Roll Call:Ayes – Gold, Gwiazdowski, Martin, Gelardi, TricaricoNays – NoneJim O’Reilly, Dominic Street, Manville, opposed Ordinance 2002-46 and stated that the 25-footbuffer is inadequate. Mayor Tricarico explained that this ordinance is in accordance with the settlementagreement mandated by the Courts.Leonard Nitti, Dominic Street, Manville, stated that the 25-foot buffer is inadequate.John Mehalick, Dominic Street, Manville, former Manville Councilman, stated that the 25-footbuffer is unacceptable and requested that the buffer be changed to 100 feet.Rich Borowski, Dominic Street, Manville, asked for the buffer to be increased to 100 feet. He alsoexpressed his wetlands and flooding concerns.Nicholas Paul Novak, 25 North 4th Avenue, opposed Ordinance 2002-46 and stated that the 25foot buffer in unacceptable.Dean Sheppard, PO Box 222, Manville, opposed Ordinance 2002-46 and asked that the buffer beincreased to 100 feet.Mr. Bayer explained that the ordinance is in accordance with the settlement agreement. It is alsoa requirement of the settlement agreement.Annette Sammer, 35 Partridge Road, stated that the buffer concerns were brought up and it wasindicated that it would be discussed at the planning level. She indicated that this was not true.Close Public HearingUpon motion by Second Deputy Mayor Martin, seconded by Deputy Mayor Gelardi, the publichearing for Ordinance 2002-46 was closed. Said motion carried as follows upon call of the roll:Roll Call:Ayes – Gold, Gwiazdowski, Martin, Gelardi, TricaricoNays – NoneCommitteeman Gwiazdowski made a motion to table Ordinance 2002-46 until further study isconducted. Hillsborough Township Committee MeetingDecember 18, 2002Mayor Tricarico offered the following resolution:WHEREAS, Hillsborough Township’s Master Plan has long valued agriculture, and includedover 9,000 acres in the Agriculture Zone; andWHEREAS, Hillsborough’s Planning Board has adopted a Farmland Preservation Plan whichidentifies farmland preservation priorities in Hillsborough Township; andWHEREAS, Hillsborough Township has successfully submitted applications to the StateAgricultural Development Committee for planning incentive grants to acquire development easementson agricultural lands; andWHEREAS, the Garden State Preservation Trust has established that appraisals for parcelsentering the Farmland Preservation Program shall be based on 1998 zoning; andWHEREAS, a provision which protects the 1998 zoning will expire in June 2004; andWHEREAS, the zoning protection afforded by the Garden State Preservation Trust isinstrumental in encouraging participation by landowners in the Farmland Preservation Program;NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township ofHillsborough hereby supports an extension of the period of zoning protection under the Garden StatePreservation Trust beyond the June 2004 sunset date;BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to GovernorJames E. McGreevey and the Members of the Legislature.Upon motion by Second Deputy Mayor Martin, seconded by Committeeman Gold, the aforesaidresolution was adopted unanimously upon call of the roll.Consideration #3:Resolution to award contract for 4 and 6 cubic yard containers for 2003 to Dave’sSuburban Disposal in an amount not to exceed 5,468.00.Mayor Tricarico offered the following resolution:WHEREAS, Assistant Township Engineer Thomas Belanger has determined that there is a needfor the acquisition of the following services:Refuse Removal at Hillsborough Township Parks, the Municipal Complex and the Department ofPublic Works for 4 and 6 cubic yard refuse containers; andWHEREAS, a solicitation for quotes was prepared and distributed to interested contractors inNovember 2002; andWHEREAS, four (4) quotes were received as follows:1.2.3.4.Dave's Suburban DisposalGary W. Gray Trucking, Inc.Raritan Valley Disposal ServiceActive Disposal Service 4,525.20 / year 5,508.00 / year 5,966.16 / year 5,598.60 / yearWHEREAS, Assistant Township Engineer Thomas Belanger has reviewed the proposals andrecommends that the award of contract be made to Dave's Suburban Disposal as the contractor with thelowest quote; andWHEREAS, funds are available to make such purchase or acquisition and have been certified assuch by the local finance officer, said certification being attached to the resolution.NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township ofHillsborough, County of Somerset, State of New Jersey as follows:1.An award of contract for Refuse Removal at the Hillsborough Township Parks, the MunicipalComplex and the Department of Public Works is hereby made to Dave's Suburban Disposal8

Hillsborough Township Committee MeetingDecember 18, 2002WHEREAS, the Township of Hillsborough wishes to apply to ABC for funds in connection witha project entitled Cops in Shops;WHEREAS, the Township Committee of the Township of Hillsborough has reviewed saidapplication and finds approval thereof to be in the best interests of the municipality; andWHEREAS, said project is a joint project between the State of New Jersey (ABC) and theTownship of Hillsborough for the purposes therein described:NOW, THEREFORE, BE IT RESOLVED by the Township Committee(1) that as a matter of public policy the Township of Hillsborough wishes to participate with theState of New Jersey (ABC) to the greatest extent possible;(2) that the Division of Alcoholic Beverage Control (ABC) be requested to accept said application onbehalf of the municipality; and(3) that the appropriate fiscal officer will accept the funds in connection with said project from theABC and make disbursements in accordance with said application.Upon motion by Deputy Mayor Gelardi, seconded by Second Deputy Mayor Martin, theaforesaid resolution was adopted unanimously upon call of the roll.Consideration #6:Resolution authorizing hiring process for part-time Secretary to the Department ofSocial Services.Mayor Tricarico offered the following resolution:WHEREAS, there exists a vacancy in the Department of Social Services for the position ofSecretary to the Department of Social Services; andWHEREAS, Health Officer Glen Belnay and Social Services Director Maryellen Stahley havedetermined that this position can be filled as a part-time position not to exceed 30 hours per week and itneeds to be filled as soon as possible; andWHEREAS, Health Officer Glen Belnay and Social Services Director Maryellen Stahley requestauthorization to fill this vacancy.NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township ofHillsborough, County of Somerset, State of New Jersey that authorization is given to begin recruitmentprocedure to fill the position of part-time Secretary to the Department of Social Services.Upon motion by Second Deputy Mayor Martin, seconded by Deputy Mayor Gelardi, theaforesaid resolution was adopted unanimously upon call of the roll.Consideration #7:Resolution awarding 2003 Custodial Services Contract to Advance BuildingMaintenance Company in the amount of 51,569.00.Mayor Tricarico offered the following resolution:WHEREAS, the Assistant Township Engineer Thomas Belanger has determined that there is aneed for the acquisition of the following services:Custodial Services for the Municipal Complex; andWHEREAS, sealed bids were opened and read on December 16, 2002 which was the time andplace as provided for in the Invitation to Bid entitled “Custodial Service 2003” in accordance with theLocal Public Contracts Law; andWHEREAS, the low bidder is as follows:1. Advanced Building Maintenance Company 51,569.00WHEREAS, the Assistant Township Engineer Thomas Belanger has reviewed the bids andrecommend that the award of contract be made to Advance Building Maintenance, as the lowestresponsible bidder; and10
