General Cooditions and Definitions1.THIS TARIFF AND THE BELOW DEFINITIONS AND CONDITIONS AREIN ADDITION TO THE ABU DHABI PORT COMPANY STANDARD TERMSAND CONDITIONS WHICH SHALL FORM AN INTEGRAL PART OF THETARIFF AND GOVERN THE USE OF THE PORT OR PROVISION OFSERVICES BY AD PORTS.2.DEFINITIONS2.1AD PORTS:2.2Al Dhafra region:The Abu Dhabi Ports CompanyThe general area and coastline from the port limits ofMusaffah to the western border limit of the Emirate ofAbu Dhabi.2.3Al Dhafra region Ports:Shall include all ports, terminals and channels in theAl Dhafra region including the water alongside berths,jetties and terminals in any AD PORTS port2.4Day:A calendar day consisting of 24 continuous hourscommencing at midnight2.5GT:The Gross Tonnage (GT) of a vessel as mentioned inthe valid class certificate, issued by a recognized vesselclassification society. Where a vessel or craft has a dualGT, then the higher tonnage applies.2.6LOA:Length Overall2.7PEC:Pilotage Exemption Certificate2.8Metric Tonne (MT): A weight of 1000 kilos2.9Freight Tonne (FRT):Unless otherwise specified, all tonnes shall be regardedas freight tonnes and shall be determined by a weighttonne of 1000 kilos or a measurement tonne of onecubic metre, whichever is greater.2.10NOSMeans: Not Otherwise Specified3Al Dhafra region Ports

2.11Port Clearance Certificate:A certificate issued by AD PORTS to vessels who havecomplied with all government formalities, have not beendetained by order of a court of competent jurisdiction ora government agency and have paid all charges due toAD PORTS, before a vessel is given permission to leavean AD PORTS Port.2.12Ro/Ro Vehicle:Any truck, car, trailer or similar vehicle on wheels ortracks capable of being 'rolled-on or rolled-off' a vessel,(including cassettes, non wheeled trailers andcontainers) by means of a ramp.2.13Ro/Ro Vessel:A single or multi deck cargo ship for the carriage of ladenvehicles which are loaded via ramps.2.14Direct Delivery:Means discharging or loading of cargoes to or from anyvessel across the rails or ramp directly into or from atruck and/or trailer and/or similar vehicle, without thecargoes touching the jetty or terminal area or ground, orthe vehicle stopping in the Terminal Area.2.15Area 'A':Denotes vessel and cargo movements between any twoAbu Dhabi coastal ports, excluding Mina Zayed andKhalifa Port (the concessional rates shown in the tariffapply to inter-port movements only between any 2 suchports. Any and all other vessel and / or cargomovements will be charged as per relevant 'standard'tariff.2.16Private TerminalA berth, terminal or other facility used to load or unloadvessels, which is not owned, managed or leased by ADPORTS.4Al Dhafra region Ports

3.CONDITIONS3.1Alterations to Tariff:AD PORTS reserves the right to amend, change, edit oralter from time to time, upon 60 days notice, any or allitems under this tariff, including terms and conditions orinterpretations contained herein.3.2Currency:All charges and rates mentioned in this tariff are payable3.3Documentation:The documentation required for the processing of anyin United Arab Emirates Dirhams.application or interaction with AD PORTS is availableon the AD PORTS website3.4Notice of Arrival {NOA):Procedures and documentation are available on theAD PORTS website. www.ADPorts.ae3.5Administration Working Hours:AD PORTS administration working hours are from 07: 30hours to 15:30 hours Sunday to Thursday, excludingpublic holidays. AD PORTS offices are closed on Fridaysand Saturdays.3.6Consent to these Terms and Conditions:The use of any channel(s), port(s) and/or terminal(s) orfacility managed and/or monitored by AD PORTS shallautomatically constitute agreement to the terms andconditions of this Tariff between AD PORTS and all portusers including, but not limited to vessels, their owners,crew, agents and/or representatives, operators,charterers, mortgagors, mortgagees, cargo agents,stevedores, cargo owners, forwarders, shippers andconsignees, to be governed by all the rules andregulations, terms and conditions, abide by them andpay all rates and charges specified herein.3.7Administration:The Administration & Control of the Ports in the AlDhafra region is under Abu Dhabi Ports Company PJSC(AD PORTS). The facilities and services provided by ADPORTS are covered and governed by this tariff.5Al Dhafra region Ports

i.ii.VATAll amounts in this tariff are VAT exclusive, any services provided or performed shall besubject to 5% VAT rate according to the applicable Laws and regulations.iii.Any Services related to the international transportation of goods or Passenger shall besubject for Zero rated VAT as per the Federal Decree-Law No. (8) Of 2017 on Value AddedTaxiv.International transportation means (transporting passengers or Goods, either or both, ifthe first place of departure, or the final place of destination, is outside UAE) according tothe Federal Decree-Law No. (8) Of 2017 on Value Added Taxv.This is subject to change without prior notice depending on interpretation of the FederalDecree-Law No. (8) of 2017 on Value Added Tax7Al Dhafra region Ports
