1Preamble010020TitleThis Ordinance shall be formally known as the”Culver Zoning Ordinance,” and it may becited and referred to as the “Zoning Ordinance” or “Ordinance”.Defined Words & Rules of ConstructionA. Defined WordsWords used in a special sense in this Ordinance are defined in the Definitionssection of the Culver, Indiana Zoning Ordinance. The general meaning of all termsnot specifically defined by this Ordinance shall be consistent with the definitionsprovided by Glossary of Zoning, Development, and Planning Terms published bythe American Planning Association as PAS Report #491/492 and any subsequentamendments. All other words, terms, and/or phrases not specifically defined bythis Ordinance and not generally defined by the glossary noted above shall have themeaning inferred from their context in this Ordinance or their ordinarily accepteddefinitions.B. The following rules of construction shall apply to the text of the Ordinance:1. The particular will control the general.1 Preamble1 Preamble2. The words “shall” and “will” are always mandatory and not discretionary. Theword “may” is permissive.3. Words used in the present tense include the future; and words used in thesingular number include the plural; and the plural includes the singular; words ofthe masculine gender will include the feminine and the neuter gender will referto any gender as required, unless the context plainly indicates the contrary.4. A building or structure includes any part thereof.5. The phrase “used for” includes “arranged for, designed for, intended for,maintained for, or occupied for.”6. The word “person” includes an individual, a corporation, a partnership, anincorporated association, or any other similar entity.7. Unless it is plainly evident from the context that a different meaning is intended,a regulation which involves two (2) or more items, conditions, provisions, orevents connected by the conjunction “and, or,” or “either . . . or,” the use ofthe conjunction is defined as follows:a. “And” means that all the connected items, conditions, provisions, andevents apply together and not separately.b. “Or” means that the connected items, conditions, provisions, or eventsapply separately or in any combination.c. “Either . . . or” means that the connected items, conditions, provisions, orevents shall apply separately but not in combination.2Culver, Indiana Zoning OrdinanceBourbon, Indiana Zoning Ordinance

The word “Town” means Culver, Indiana. The word “County” means MarshallCounty, Indiana. The word “state” means the State of Indiana.030040050Document FormatThe structure of the text of this Ordinance is as follows: Article (indicated by 1, 2, etc.),Chapter (indicated by 010, 020, etc.), Section (indicated by A, B, etc.), and subsequentSubsections (indicated by 1, a, i, etc.)AuthorityThis Zoning Ordinance is adopted by the Town of Culver pursuant to its authority underthe laws of the State of Indiana, 36-7-4 et seq. Whenever codes cited in this Ordinancerefer to Indiana Code which has been amended or superseded, this Ordinance shall bedeemed amended in reference to the new or revised Indiana Code.JurisdictionThis Ordinance shall apply to all of the corporate limits of the Town of Culver and itsextraterritorial jurisdiction consistent with the provisions of IC 36-7-4-205.1 PreambleA. Federal and State PropertyThis Ordinance shall not apply to any property owned by the government of the Stateof Indiana or the United States of America.B. Heritage MarkersIn no instance shall this Ordinance be interpreted as prohibiting sites, memorials,edifices, and/or monuments in commemoration of persons or objects of historicalor architectural interest060PurposeThis Ordinance is intended to guide the growth and development of the Town of Culver inaccordance with the Town of Culver Comprehensive Plan and for the following purposes:A. To secure adequate light, air, and convenience of access; and safety from fire, flood,and other dangers.B. To promote the public health, safety, comfort, convenience, morals and generalwelfare.C. 1Preamble060Purpose (cont.)1. that the community grows only with adequate public ways, utilities, health,education, and recreation facilities;2. that the needs of agriculture, housing, industry, and business be recognized infuture growth;3. that residential areas provide healthful surroundings for family life;4. that the growth of the community is commensurate with and promotes theefficient and economical use of public funds; and1 Preamble1 Preamble5. that the community strives for high aesthetic value and quality planning anddesign.070Conflicting Requirements080Overlapping Regulations090Compliance100Transition RulesThe provisions of this Ordinance shall be held to be the minimum requirements forthe protection of the health, safety, convenience, and general welfare of the people atlarge, and are designed to encourage the establishment and maintenance of reasonablecommunity standards for the physical environment. If two or more provisions within thisOrdinance are in conflict or are inconsistent with one another, then the provision whichis most restrictive shall control.When this Ordinance along with private covenants, private contracts, commitments,permits, agreements, state laws, federal laws or other regulations regulates a structure orparcel of land, the greater restriction shall control. In no instance shall this Ordinance beinterpreted as altering or negating any other applicable regulations.No structure shall be located, erected, constructed, reconstructed, moved, altered,converted, or enlarged; nor shall any structure or land be used or existing use beexpanded, except in full compliance with all provisions of this Ordinance and after thelawful issuance of all permits and certificates required by this Ordinance.A. Prior Improvement Location Permit FilingAny application for an Improvement Location Permit that has been filed with thePlan Commission or its designees and is full and complete, prior to the effectivedate of this Ordinance, shall be regulated by the terms and conditions of the ZoningOrdinance that was in place at the time of rdinanceOrdinance

Prior Zoning Map Amendment FilingAny application for a Zoning Map Amendment that was filed with the PlanCommission or its designees, and is full and complete prior to the effective date ofthis Ordinance, shall continue through the process to completion pursuant to theterms and conditions of the Zoning Ordinance that was in place at the time of filing.However, if the proposed use would no longer be permitted in the proposed zoningdistrict or the proposed zoning district no longer exists in this Ordinance, the PlanCommission shall amend the application such that the request for rezoning wouldaccomplish the same end goal for the applicant.1C. Prior BZA Petition FilingAny application before the Board of Zoning Appeals (i.e. special use, use variance,development standards variance) that has been filed with the Board of ZoningAppeals or its designees and is full and complete, prior to the effective date of thisOrdinance, shall continue the process pursuant to the terms and conditions of theZoning Ordinance that was in place at the time of filing, provided that:1. If such application is no longer required by the terms of this Ordinance, theapplication will be dismissed; or1 Preamble2. If the proposed use or development requires additional approvals from the Boardof Zoning Appeals pursuant to the terms of this Ordinance that were not requiredunder the previous Ordinance, the application will be amended to include onlythose additional approvals that are now required and within the jurisdiction ofthe Board of Zoning Appeals.D. Expiration of Previous Approvals1. All Improvement Location Permits issued prior to the effective date of thisOrdinance shall be void six (6) months after their date of issue if construction hasnot begun.2. Improvement Location Permits issued prior to the effective date of this Ordinancefor which construction has begun shall become void if construction is abandonedfor a period of two (2) years or if, in the opinion of the Building Commissioner,construction has otherwise ceased.3. All approvals which expire and/or become void shall comply with all applicableprovisions of this ordinance if re-issued.110Computation of TimeUnless otherwise specifically provided, the time within which an act is to be done shall becomputed by excluding the first and including the last day of the specified period of time.If the last day is a Saturday, Sunday, or legal holiday, that day shall be excluded. 1Preamble1201301 Preamble1401506ConditionsThe attachment of reasonable conditions to the use and development of land withinthe Town Jurisdictional Area as part of the approval of rezoning petitions, SpecialExceptions, conditional uses, home occupations, temporary uses, variances, outlineplans, development plans, plat vacations, and amendments, or as otherwise authorized,is an exercise of valid police power delegated to the Town by the State. The applicanthas the duty of compliance with reasonable conditions laid down by the Commissionfor design, dedication, improvement, and restrictive use of the land in order to conformto the physical and economical development of the Town and to the safety and generalwelfare of present and future land owners and residents of the Town. The failure tocomply with any such conditions may be cause for denial of the permits and approvalsprescribed by these regulations and shall constitute a violation of the Zoning Ordinance.RepealerThe Culver, Indiana Zoning Ordinance dated November 9, 2010, and its associated ZoningMap and any amendments and/or revisions are hereby repealed. This Culver IndianaZoning Ordinance and the referenced and updated Official Zoning Map replace therepealed ordinance.SeverabilityIf any provision of this Ordinance or the application of any provision to particularcircumstances is held unconstitutional or invalid by the courts, the remainder of theOrdinance or the application of such provision to other circumstances shall not beaffected.Saving ProvisionThis Ordinance shall not be construed as eliminating or reducing any action now pendingunder, or by virtue of, an existing law or previous zoning ordinance. Uses other than residentialshall be closely regulated to protect areas of undeveloped land from incompatibleland development.BL-1, Lake DistrictThe Lake District is established specifically for property having lake or channelfrontage and property located in close proximity thereto which would logicallybe included in the same zoning district.
