DEFINITIONS1. MCPI - means Ministry of Construction and Public Infrastructure.2. Board – means Construction Industry Development Board (CIDB).3. Registration – means National Contractors Registration (NCR).4. Construction – means the performance of building, altering, repairing, addition to , subtracting from,improving, reconstruction, moving, excavating, reclaiming, wrecking or demolishing of any building, roads,bridges or other structure, project, development or improvement to real property or to do any part of thereof,including the erection of scaffolding or other structures.5. Contractor – meansa. any person who in any capacity undertakes, offers to undertake, purports to have the capacity toundertake or submit a bid to or does himself or through others , perform construction orb. a construction manager who performs construction management services6. Person/applicant – means any individual, firm, partnership, limited liability company, limited partnership,cooperation, trust, association or other entity or organization capable of conducting business, or any combinationthereof acting as unit.NATIONAL CONTRACTOR REGISTRATION

SUMMARYPURPOSE OF REGISTRYThe purpose of Contractors Registration is toregister contractors who provide constructionrelated work goods & services to the public sector.Contractors who wish to be registered with theRegistry must show that they have the relevantexperience, financial, technical and managementcapability.The MCPI Contractor Registration Requirementsspecify the registration requisites. Contractors whowish to apply for registration are advised to readthe Terms of Registration carefully beforesubmitting the application form. All applicationsmust be accompanied by the necessary supportingdocuments.To help applicants have a quick grasp of theregistration requirements, the basic requisites areoutlined as follows:RegulatingNCRNationalRegistration is regulated by CIDBConsultants or part-time employees cannot beconsidered as personnel resources for registrationpurposes. For purpose of verification ofemployment status of employees, the followingmust be submitted during application:Personnel/QualificationFull time employeesForeign technicalpersonnelTo Submit(i) EducationalCertificates.(ii) Curriculum vitaelisting past experience(iii) WorkpermitContractorREGISTRATION WITH THE MINISTRY OFTRADE AND INDUSTRIESAll local applicants must be registered with theMinistry of Economic Development and Trade atthe time of application. Foreign applicants will beregistered entitling to undertake work only for theduration or period of the contracted works or asdirected by the board.FINANCIAL REQUIREMENTSThe applicants must submit their latest auditedfinancial report or accounts during the time ofapplication for verification.All the audited financial reports must be tant who is registered in the AuditOfficeSPECIAL CONCESSIONARY RULESNew firms entering the construction industry orexisting firms that wish to diversify into a relatedline of business may be considered under thespecial concessionary rules (see Appendix B).NATIONAL CONTRACTOR REGISTRATIONPERSONNEL REQUIREMENTSA person applying for registration depending onthe work head must employ sufficient number offull-time qualified technical and professionalpersonnel in the relevant disciplinesTRACK RECORD REQUIREMENTIn terms of track record, the firm must have, in thelast three years; completed projects relevant to theparticular registration head (see Appendix A). Theapplicants must forward the relevant letters ofaward and completion certificates to substantiatethese track records.A firm applying for renewal of its registrationstatus is required to prove that it is still active inthe line of business. It must produce evidence toshow that it has undertaken relevant works orsupplies during the preceding three years.INSURNACEMinimum insurance coverage of 1.Public Liabilityand 2.Third party insurance.RENEWAL OF REGISTRATIONRegistered firms are advised to submit theirrenewal applications one month before thecertificate expiry date.

REGULATING CONTRACTORS REGISTRATIONThe MCPI contractor’s registration is regulated by the Construction Industry Development Board. Theregistration will be administered by the construction industry development section of MCPIGENERAL POWERS AND DUTIES OF THE BOARD‐ CIDBThe board shall enforce the minimum standards and requirements therefore as provided by this chapter and byrule adopted by the board. The board may exercise such powers and duties as are reasonably necessary to carryout the provisions of this chapter and it may, among other things:(1) Accept or reject applications for registration and establish the fees to be charged for application, registrationand renewal, subject to the provisions of this chapter;(2) Hold meetings, seminars and attend or be represented at such meetings related to construction , prepare andpublish rules pertaining to this chapter and such other information as may be necessary, and furnish copiesthereof to those engaged in the business, trade, practice or work of contracting and to the public upon request;(3) Furnish standards and procedures and prescribe reasonable rules for applications, qualifications andregistration of contractors, including prorating of registration fees and staggering initial annual registration; and(4) Under such rules as it may adopt, investigate, classify and determine the qualifications of applicants forregistration pursuant to this chapter.NATIONAL CONTRACTOR REGISTRATION

CIDB’S AUTHORITY TO INVESTIGATE AND DISCIPLINE ‐‐ SUSPENSION ORREVOCATION OF REGISTRATION.(1)The board may investigate any person engaged in contracting within the country, or any personbelieved to have acted as a contractor without being duly registered as required by this registration. Upon receiptof a written complaint from a person who claims to have been injured or defrauded by such person, or uponinformation received by the board, the board shall perform an investigation of the facts alleged against suchperson.If the board investigation reveals that the facts alleged or received are sufficient to proceed with aformal action, the board may authorize the filing of an administrative complaint against such person and may seekinjunctive relief prohibiting such person from engaging in construction business.(2) The board shall have the authority to issue informal letters of reprimand, suspend or revoke a registration, orfile a lawsuit in the court of law against any registered contractor if, after an opportunity for a hearing, the boarddetermines that:(a) A contractor has violated any of the provisions of this chapter including, but not limited to, failureto keep current or provide insurance coverage as required.(b) A contractor has violated any provisions, relating to consumer protection and fair trading laws andregulations including, but not limited to, making fraudulent misrepresentations to consumers;(c) A contractor employed fraud or deception, made a misrepresentation or misstatement, oremployed any unlawful means in applying for or securing registration as a contractor;(d) A contractor employed fraud or deception, made a misrepresentation or misstatement, oremployed any unlawful means in applying for or securing a building permit or other permits forconstruction of any type;(e) A contractor failed to pay the required fee for registration as provided in this chapter;(f) A contractor has been convicted of or has engaged in conduct constituting a violation of laws ofthe country , or any subdivision thereof, relevant to contracting, reflecting on the registeredcontractor's ability or qualifications to continue contracting for other persons, and making theregistered contractor a threat to the public safety, health or well-being;(g) A contractor has engaged in any conduct in business which constitutes dishonest or dishonorabledealings;(h) A contractor was grossly negligent or reckless in his conduct in the performance of construction.For purposes of this chapter, conduct is grossly negligent or reckless if, when taken as a whole, it isconduct which substantially fails to meet the generally accepted standard of care in the practice ofconstruction in Republic of Maldives.(i) A contractor had the registration or certification revoked, suspended or refused by the board oromitted such information from any application to the board, or failed to divulge such informationwhen requested by the board;(j) A contractor has been adjudged mentally incompetent by a court the court of law or(k) A contractor interfered with an investigation or disciplinary proceeding by a willfulmisrepresentation of facts or by the use of threats or harassment against any person to prevent suchperson from providing evidence in a disciplinary proceeding, investigation or other legal actioninstituted in accordance with this chapter.(3) A contractor whose registration has been revoked or suspended shall be required to return his certificate ofregistration within the time determined by the board or, upon a failure to do so, shall be liable for civil penaltiesas set by the board but not to exceed MRF 50.00 per day for each day the certificate is not returned after theexpiration of the period allowed.NATIONAL CONTRACTOR REGISTRATION

TERMS OF REGISTRATIONFUNCTIONS & SCOPE OF THECONTRACTORS REGISTRYFunctions of the RegistryThe Contractors Registry is regulated by theConstruction Industry Development Board(CIDB). The registration serves the procurementneeds of government departments, statutory bodiesand other public sector organizations.The Registry functions as an administrative bodyonly for the public sector procurement. As such,business entities, which are not registered withCIDB are not precluded from conducting businessas contractors or suppliers outside the publicsector.Scope of RegistrationThere are six major groups of registration heads,namely1. Harbour contractors ( HC)2. General building contractors ( GC)3. Specific building construction works (OB)4. specific mechanical /electrical works (ME)5. Supply works (SY)6. Other types of construction related works(OT)APPLICATION DETAILSApplication ProcedureAll applications should be submitted in theprescribed application forms. The submissionsshould include every item in the checklist in thecorrect sequence. It is the applicants’responsibility to ensure completeness of thesubmissions.Incompleteoruncompiledsubmissions will be returned. Processing willcommence only after the submissions are found tobe in order.Application forms are available from Ministry’swebsite.( www.constructon.gov.mv)NATIONAL CONTRACTOR REGISTRATIONReferencesIn the course of processing the applications,reference will be obtained from the applicant’sbankers and the clients/professional consultantswho supervised the works of the applicant eitherby requesting the presence of such person orsending officers from MCPI to applicant’s headoffice(Local or overseas) for further verification.All flights / transport, accommodation (regionaland overseas), incidental and any service chargesimposed by bankers or professional consultantsshall be borne by the applicant.Processing TimeUnder normal circumstances, if the submissionsare complete and in order, the applicants will beinformed of the outcome within 4 weeks.Nevertheless, the processing time can be reduced ifthe applicants could forward references directlyfrom the clients/consultants of the projects whichthe firms have undertaken.The references should be submitted together withthe application form to MCPI in an envelopemarked “Strictly Confidential”. In the event thatno reference is forwarded, MCPI will complete theprocessing based only on the availableinformation.Firms are requested to apply for renewals onemonth before the expiry of the validity period oftheir registration certificates. Processing is onfirst-come-first-serve basis. Late applicationscannot be expedited.INSURNACEAll local and foreign applicants are required toproduce certificate issued by an insurancecompany as satisfactory proof of the minimumcoverage of public liability and third party

Outcome of ApplicationBoard will notify each applicant on the outcome ofthe application as soon as the case has beenprocessed. The successful applicant will be issuedwith a certificate of registration, which shall statethe head of registration allocated to the applicant.Registration fees local applicantsA registration fee of MRF 3000.00 (ThreeThousand Maldivian rufiyaa) per registration perwork head is applicable to any applicant seekinginterest to register in the following work heads.1.2.General building construction ( GC)Harbour contractors (HC)A registration fee of MRF 100.00 (One HundredMaldivian Rufiyaa) per registration per work headis applicable for applicants seeking to registrationin all the other work heads.NATIONAL CONTRACTOR REGISTRATIONRegistration fees for foreign and JV applicantsA registration fee of USD 1000.00 (One ThousandDollars unites states) per registration per workhead is applicable to any applicant seeking interestto register in the following work heads.3.4.General building construction ( GC)Harbour contractors (HC)A registration fee of USD 100.00 (One HundredDollars Unites states) per registration per workhead is applicable for applicants seeking toregistration in all the other work heads.

REGISTRATION REQUISITESTrack Record and PerformanceThe Registration Heads are listed in Appendix A.Applicants are expected generally to have executedengineering or construction works similar to thoseHeads which they wish to be registered.The minimum personnel requirements are laid outin Appendix A. If foreign personnel based inMaldives are employed to satisfy the personnelresources requirement, their work permit should besubmitted.Main contracts and nominated subcontractors(NSC) must form the substantial portion of thetrack records. Subcontracts awarded directly byanother contractor may be considered provided thescope and value of projects are clearly describedand accompanied with the necessary contractualdocuments. However, the contract value ofsubcontract work may not be taken at face value.This will depend on the extent of involvement ofthe applicant in a particular project.EquipmentsAll firms seeking to register in the in the categoriesof HC and GC 01 and GC 02 are required tosubmit proof that they have the necessaryequipments and facilities to complete the works.The minimum required equipments are listed inAppendix A – registration heads.In addition to the requirements on aggregateproject values, applicants are expected to have aconsistently good performance record. Those withpoor performance history may be refusedregistration.Financial CapacityApplicants should satisfy Board that they havesufficient financial resources to meet the financialcommitments which would normally arise.Applicants are required to submit with theirapplications a copy of their latest audited financialreport or other suitable accounting document thatwill clearly certify the financial position of theapplicant for the preceding one year. Outdatedreports or documents will not be accepted.Financial statements submitted by sole-proprietoror partnership firms must be duly signed by thesole-proprietor or principal partners and must beproduced by a registered accountant in AuditOffice in Maldives.Personnel ResourcesApplicants should satisfy the Board that they havethe necessary full-time personnel resourcesstationed in Maldives to undertake the workcorresponding to the registration head applied for.NATIONAL CONTRACTOR REGISTRATIONThe applicant must prove that they have thenecessary equipments bya. submission of registration certificatesissued by the Ministry of Transport andCivil Aviation ( the certificate must showthat the equipments are registered underthe applicants name)orb. Submission of lease agreements with aleasing company (foreign/ local) for thelease of required equipments for the termof registration with no conditions.Company Status with the Ministry of EconomicDevelopment and TradeAll local firms have to be registered with theMinistry of Economic Development and Trade forthe business during the time of application.Foreign applicants will be required to register thebusiness with Ministry of Economic Developmentand Trade to conduct the business after they meetthe Board’s requirements to be registered as acontractor.

CONDITIONS OF REGISTRATIONRegistration StatusRegistration status shall be accorded only to firmswhich Board considers as having sufficientresources, experience and technical expertise toundertake contracts of a nature and size as definedby the Registration Head. The requirementsstipulated, as set forth shall be taken as definingonly the minimum requirements expected of anapplicant.ValidityThe validity of any registration is for a period ofthree years. ( However contractors registered inGC01,GC02,GC03,GC04,HC01,HC02,HC03 arerequired to submit their audited accounts annuallyand meet the financial requirement in order toretain in their respective grades of registration).Registration will thereafter lapse automaticallyunless a renewal is filed and approved by MCPI.Renewals shall be made one month before theexpiry of the validity period. Application forms forrenewals will be sent by MCPI to all registeredcontractors one and a half-month before thecertificate expiry date.Update of Firms’ ParticularsA registered contractor is required to advise Boardimmediately of any changes in its managementstatus, address or any other pertinent particularswhich may occur from time to time.It should be noted that registration status isaccorded to the firm on the basis of the firm’sparticulars at the time of application and Boardreserves the right to revoke or modify theregistration status in the event of any developmentor change in the firm’s particulars which, in theopinion of Board, renders the firm unsuitable to beaccorded the current registration status.Notification of change of firm’s particulars shouldbe in writing and accompanied by copies of thesupporting documents. In addition, Board mayperiodically require registered firms to furnishpertinent particulars to Board for the purpose ofassessing the eligibility of their continuedregistration.NATIONAL CONTRACTOR REGISTRATIONCertificate of RegistrationThe Certificate of Registration is the property ofBoard and must be surrendered to MCPI wheneverthe registered firm is debarred or when the firm’sregistration is terminated for any reason.Authority of Board - CIDBBoard reserves the right to review the registrationstatus of the registered firms from time to time.The following courses of action may, inter alia, betaken by Board if the firms fail to fulfil theregistration requisites as set forth in this brochure:(a)(b)Downgrading of registration grades;De-registering the firm fromContractors Registry.theBoard is not bound to accept any applicationnotwithstanding that the applicant may havecomplied with the minimum requirements as setforth in this brochure. Furthermore, the applicant isalso deemed to accept that Board is not bound toassign any reasons for rejecting applications or fordowngrading/suspending a registered contractor orde-registering a firm from the registerFirms which are debarred by the Ministry ofEconomic Development and Trade will be refusedregistration for all lines of business and for theduration stated in the debarment order. They mayapply for consideration to be re-registered after thedebarment period has lapsed.Board may publish information on projectshandled by the registered contractors. Note: (refer: general powers and duties of the board –CIDB, page No.03 )

REGISTRATION OF FORIGENCONTRACTORSREGULATIONS FOR FOREIGN CONTRACTORS REGISTRATIONREQUIREMENTSREGISTRATIONFORFOREIGN CONTRACTORSLEGAL1.All foreign contractors shall satisfy therequirements set by the Board before they canbe registered as a contractor in the Maldives.2.All foreign parties who work as a contractorfor civil and building works in the Republic ofMaldives shall be registered as a contractorwith the Ministry Economic Development andTrade. The registration shall be for theduration of the contract period.All foreign parties wishing to register in NCR mustsubmit with the application.a. Certificate of Registration to dobusiness in the Republic of Maldivesor if not yet doing business,certificateofregistrationofrepresentative office;b. Company Brochure and companyprofile.3.A copy of the signed works contract shall besubmitted to Board when applying forregistration.The documents that shall included with the signedcontract shall include but not limited toa.Copy of “Invitation to Bid” or“Instruction toBidders” or “Notice toBidders” published in newspapers ordisseminated by the owners/tenderingagency showing the following:b.Deadline for submission ofIntent/Interest to pre-qualify, deadline forqualification and the date of bidding;c.Funding Source, Loan AgreementNumber, Approved Budget for the Project;d.Required registration Category,Project kind and Size Ranges4.All foreign contractors who work in theRepublic of Maldives, as part of joint venture(JV) with a Maldivian contractor or on theirown under a contract from an InternationalAid Agency or on International BankingInstitute, shall also be registered as acontractor with the Ministry of EconomicDevelopment and Trade.NATIONAL CONTRACTOR REGISTRATION5. Generally foreign contractors will not beallowed to participate in local competitivetenders. Depending on the nature, the type ofworks and the financial needs of the works,Board will decide on foreign participation inany local competitive tenders. Preference willbe given to local to foreign JVs over totalforeign participation on such tenders.6. In all local competitive tenders, foreigncontractors may participate as subcontractors.Subcontracting is limited to service relatedworks and those which require finish orproduct of a specialist nature. Subcontractingis limited to not more than 40% of the totalworks.7. Foreign contractors are allowed toparticipate in all International Competitivetenders called by the local authorities.Preference will be given to local to foreignJVs over total foreign participation on suchtenders.

FINANCIAL ,TECHNICAL AND TRACK RECORD1.7.The contractor shall have minimum five yearsof experience as a contractor in home countryor a third country. And shall be registered insuch the legal contractor’s registration of thatcountry during the period of execution of theworks.2.At least one project shall be completed insimilar nature of and size as to which thecontractor seeks the registration.3.List of completed and/or on-going projects duringthe last three (3) years. Including the nature, size,type and price of the project. Copies ofcompletion letters or certificates from theemployer must be accompanied as a proof forall the executed projects.4.All technical people of the company must holdthe degree level or equivalent qualifications.There must be a minimum of one for each ofthe following categories depending on theproject; Civil, Electrical and g.a. Financial Statements / Pre-OperatingBalance Sheet Partners’Statement under oath containingtheir combined financialresources (pre-operating balancesheet) to be committed/investedin the consortium.b. Partners’ statement under oathcontaining the names and otherdetails of their respectivenominated technical personnel tobe assigned in theimplementation of the project ofthe consortium.c. Track Record of the both the parties (ifnot previously submitted)c.1Copy of Contract/SubcontractAgreement/s duly authenticatedby the tendering agency orproject owner or in case ofsubcontract, by the prime/maincontractor.Note: in Maldives all the copies of documents have toauthenticate by the Public Examinations.5.Audited Financial Statements and financial recordsof the past three years from the date of applicationof registration. Including Income Tax Return (ifapplicable) of each non-contractor partner.Foreign, documents must be duly authenticated bythe authorized certifier of the country or the in thepartner’s home country.Note: Audited financial report and documents must beauthenticated by a registered chartered accountant of thatcountry.6.The turnover of the company for the last threeyears must not be less than US 6 million peryear.NATIONAL CONTRACTOR REGISTRATIONFor JVs applying for registration mustsubmit.c.2Copy of Certificate ofAcceptance/Completion fromtendering agency or projectowner, or in case subcontract,from the prime/main contractor.c.3For privately-owned projectsonly: Certified True Copy ofCertificate of Creditable Income
