TheMNA CIRCULAR 2022 - #0606th May 2022PulseITF Says Inspectors Denied Welfare Checks of P&O Ferries ReplacementCrew at Dover PortMike Schuler - April 20, 2022The International Transport Workers’ Federation (ITF) said its inspectors were denied the ability toconduct welfare checks for replacement crew members on board P&O Ferries in the Port of Dover.The checks come after P&O Ferries, which is owned by Dubai-based DP World, abruptly fired some 800UK-based ferry workers last month and replaced them with cheaper labor. The decision has raised somelegal questions considering P&O Ferries did not notify the British government or worker unions of thesackings. Britain’s Maritime and Coastguard Agency (MCA) has since detained at least three P&OFerries vessels over deficiencies.The ITF said the welfare checks were prompted after issues were raised by some replacement crewmembers. But the union group said Port Police refused the inspectors access to the port on the basis thatthe had no advanced notice of the inspector’s visit.ITF Inspectors have ISPS (International Ship and Port Facility Security) code clearance, which allowsthem to enter all UK ports and board all vessels in UK waters where seafarers request assistance, the ITFasserterted in a statement.“Despite emailing ahead of time as a courtesy and completing the online security course required, the PortPolice refused the inspectors access on the day, on the basis that they had no advance warning of theinspectors’ visit. The inspectors are not obliged to provide prior warning to ports or vessel owners ofimpending visits to inspect vessels or investigate abuse of seafarers’ rights,” the ITF statement said.“As an ITF Inspector in the UK for 17 years this is the first time I have been refused access to a UK portto investigate crew welfare issues,” said ITF inspector Tommy Molloy.“Experience shows us that if non-compliant employers are tipped off to our inspections, often crewmembers get threatened and incriminating documentation goes missing. Our inspections are random bynature and by necessity,” Molloy added.ITF General Secretary Stephen Cotton said: “P&O Ferries have shown that they have no regard for thelaw, it’s staggering that the Port of Dover would prevent access to ITF Inspectors who are simply there tocheck on crew welfare and the safety of the ships.”“ITF Inspectors across the world are at the frontline of protecting safety standards for seafarers and thevessels they crew. We have grave reservations about why they would be denied access, especiallyfollowing MCA detentions related to safety concerns and crew familiarity of the vessels.”“We call on the Secretary of State for Transport Grant Shapps to find answers as to why our inspectorswere blocked, and give a commitment that it won’t happen again,” said Cotton.The ITF said it has notified the UK Maritime and Coastguard Agency about the incident as a violation ofthe ISPS Code, and both the ITF and Nautilus International, the union representing some of the firedworkers, are calling on the UK government to interveneP&O Ferries Fires Agency Crew Citing Breach of Alcohol PolicyMike Schuler April 21, 2022P&O Ferries has fired seven of its new agency employees after they showed up to work in breach of thecompany’ zero-tolerance alcohol policy.The latest scandal comes after the company abruptly fired some 800 UK-based ferry workers in March,replacing them with cheaper agency crew.“We can confirm that seven agency-employed seafarers who returned from shore were found to be inbreach of our strict guidelines on alcohol consumption and have been dismissed with immediate effect,” aspokesperson for the company said, as reported by various news outlets.“The safety of our passengers and crew is our foremost priority and we continue to operate a zerotolerance policy towards drinking whilst on duty.”P&O Ferries has admitted that it may have broken the law in firing its ferry crews without notifying theBritish government or unions of the action. Britain’s Insolvency Service has initiated an investigation intothe firings. .4

TheMNA CIRCULAR 2022 - #0606th May 2022PulseNautical Coincidence & Lifeboat Morality – Richard Parker and theMignonette by Rick Spilman Apr 20, 2022“The Unsinkable Hugh Williams – Truth Behind the Legend?”We recently posted in response to a video, “The Strangest Coincidence Ever Recorded?.” It recountedhow three men named Hugh Williams were each the only survivors of shipwrecks in the treacherousnessMenai Straits off North Wales. The Strangest Coincidence Ever Recorded? - Strange as it Seems (2010) YouTubeOn the topic of nautical coincidences, Chris Quigley at the Quigley’s Cabinet blog, mentioned theMignonette coincidence. All that we can say is, Hugh Williams meet Richard Parker. The case ofRichard Parker and the Mignonette does indeed involve coincidence, but the story remains compellingbecause it raises issues of morality that are very tricky to address, even to this day.Richard Parker was a 17-year-old cabin boy on the English yacht Mignonette in 1884. While in the SouthAtlantic, the Mignonette sank, leaving Parker and three others in a lifeboat with little food or water. Thethree ultimately killed and ate the cabin boy. The three were rescued after 24 days by the German sailingbarque Montezuma, named fittingly enough after the Aztec king who practiced ritual cannibalism. Thecase caused a great uproar in Victorian Britain. The men were charged with murder and were foundguilty. (The sentences were later reduced to 6 months of hard labour.) Most importantly, their trial, R vDudley and Stephens, established a legal precedent in common law around the world, that necessity is nodefence to a charge of murder.OK, so what does this have to do with coincidence? The coincidence arises with Edgar Allen Poe’s onlyfull-length novel, The Narrative of Arthur Gordon Pym of Nantucket, written in 1838 in which a whalingship sinks, one of the survivors is named Richard Parker and is eaten by the other survivors. Some claimthat Poe’s novel, written fifty years before, foretold of poor Richard Parker’s end. The only problem is,that while both the fiction and the history involved a ship and cannibalism, the rest of the details did nottrack so closely. Poe’s Parker was a mutineer, not a cabin boy and the events took place on the hull of anoverturned ship and not a lifeboat. Poe may have modelled his character on another mutineer namedRichard Parker who lead the mutiny at the Noire in 1797 and was subsequently hanged by the RoyalNavy.In Poe’s novel, the ship’s dog was named Tiger. In 2001, Yann Martel published the novel, Life of Pi. Inthe novel Martell’s hero, Pi is trapped in a lifeboat with a tiger, named Richard Parker. Martelcommented about naming the tiger in the lifeboat, “So many Richard Parkers had to mean something.”There have also been two plays written about Richard Parker – Owen Thomas’ “Richard Parker” and“Mr. Parker’s Bones, or The Strange, Lamentable, Bloody, and mostly true History of Parker of Pear TreeGreen and of his Captain, the Dastardly Cannibal Tom” written by Russ Tunney.There was yet another Richard Parker in history, on the ship, Francis Spaight, ship in 1846, which sankand whose survivors practiced cannibalism, but Richard Parker had nothing to do with it. He drownedwhen the ship foundered. Jack London would later write a short story about the sinking, “FrancisSpaight.” There was a cabin boy killed for food after the ship sank. (Note to self: Never ship as a cabinboy.) His name was not Richard Parker. TheMNA CIRCULAR 2022 - #0606th May 2022PulseMoskva: Questions about fate of crew of sunken warship as Russia shows offsurvivorsRussia has been accused of suppressing details of crew deathsQuestions have been raised about the fate of the crew of sunken Russian warship Moskva.The Soviet-era flagship of Russia’s Black Sea fleet sank on Thursday as it was being towed back to portafter a fire, according to the Russian defence ministry, however Ukraine said the blaze was caused by itsmissile strike.A video was released by the ministry on Saturday purported to show the survivors of theship on a parade ground in the Crimean port city of Sevastopol.In the clip, Russia’s Navy chief NikolaiYevmenov and two other officers can be seen talking with crew members. It is not known when the clipwas recorded.The original equipment onboard the SLAVA (Project 1164 Atlant class) (later renamed in MOSKVA)The two other missile cruisers—the MARSHAL USTINOV and the VARYAG —are deployed withRussia’s Northern and Pacific fleets respectively. There were onlyaround 150 men visible on the Sevastopol parade ground and Russia has not made it clear why so manywere missing. Some journalists have questioned why details of the crew deaths have not been publishedor why their families have not discussed the incident. Nataliya Vasilyeva, Moscow correspondent for TheTelegraph said: “What is most stunning is we haven’t seen a single wife or mother going public about theloss, demanding answers from the Russian government.” BBC reporter Liza Fokht questioned why therewas still no clear official report of what exactly happened to the crew, as she alleged a wreath at amemorial for the ship in Sevastopol on Friday said “to the ship and sailors” – suggesting some died.Pavel Lobkov, a correspondent for Russian television channel NTV, asked why there had been no detailsreleased about the crew, their widows or relevant words about heroism and official condolences.Meanwhile, Austrian Chancellor Karl Nehammer, who met with Putin in Moscow this week said theRussian president believes he is winning the war, adding he is “in his own war logic” on Ukraine.In an interview on NBC’s “Meet the Press,” Nehammer said he thinks Putin believes he is winning thewar, and “we have to look in his eyes and we have to confront him with that, what we see in Ukraine.”Russia has powerful air defence systems deployed in Crimea, which it seized from Ukraine in 2014, butthe MOSKVA was able to provide long-range and mobile air defence protection for the entire Black SeaFleet. The loss of the ship degrades the fleet’s air defences, particularly on longer-range missions as itwas a floating command and control centre. Although the Russian navy has so far not played a big role inthe conflict, Britain’s Ministry of Defence says its loss is likely to prompt Russia to review its navalposture in the Black Sea. TheMNA CIRCULAR 2022 - #0606th May 2022PulseUkraine says grain on ships in blocked Black Sea ports may deteriorateAround 1.25 million tonnes of grains and oilseeds are still on commercial vessels blocked in Ukrainianseaports due to Russia’s invasion and part of the cargo may deteriorate in the near future, Ukraine’s farmminister was quoted as saying on Friday. Ukraine used to export almost all its grain and oilseeds viaseaports and now is forced to find new routes as its ports are blocked. Before the war, Ukraine exportedup to 6 million tonnes of grain and oilseed a month, while in March the exports fell to 200,000 tonnes,Mykola Solskyi told the newspaper Ukrayinska Pravda. “It (the cargo) is not unloaded, and is still onvessels. There are currently 57 vessels with 1.25 million tonnes of grain and oilseeds,” Solskyi said. “Asfor the retention period, I think that even the captains themselves in most cases do not know if there areany problems with this. They certainly did not plan to keep this grain on the ships for a long time,” headded. Solskyi said that everything depended on the condition of the holds of the vessels and if the grainis stored for more than three months, “problems arise and part of the cargo can be spoiled.” Ukrainetraditionally exports grains to the north Africa and the Middle East and Solskyi said these regions wouldbe forced to spend more money and focus on wheat from non-Ukraine origins. He said importers werealready spending more and the situation with grain supply from Ukraine could push these countries tobuild greater grain reserves and this would also drive up prices. “That is, even if this story endedmagically tomorrow, the wave of high prices will be another 3 to 5 years, until the mood levels off, andthere will be no balance,” Solskyi added. Source: Reuters (Reporting by Pavel Polityuk; editing by DavidEvans)Seafarer lives don’t need to be risked during lifeboat drillsSeafarers are dying needlessly in lifeboat accidentswhen maritime legislation doesn’t actually requirevessels to be manned during drills.InterManager, the international trade association forship and crew managers, is raising awareness of thisfact by highlighting a legislative change whichmeans that it is not necessary for crew to be onboardwhen lifeboats are tested.SOLAS regulation III/19.3.3.3 requires each lifeboatto be launched at least once every three monthsduring an abandon ship drill, and manoeuvred in thewater by its assigned operating crew. However, theregulation, whilst requiring each lifeboat to bemanoeuvred in the water by its assigned operating crew, does not actually require that crew to be onboard when the lifeboat is launched. Many of the lifeboat fatalities have occurred during launch of thelifeboats, often due to problems with the hooks.In 2009 the International Maritime Organization’s (IMO) Maritime Safety Committee, agreed that theassigned operating crew should not be required to be on board lifeboats during launching, unless theMaster, within the authority conferred to him/her by paragraph 5.5 of the ISM Code, considers itnecessary, taking into account all safety aspects. Captain Kuba Szymanski, InterManager SecretaryGeneral, said: “This is an extremely important change which seems to have been missed by some shipoperators and is still included in some Shipboard / Safety Management Systems. To prevent any furtherloss of life in this way we are raising awareness of the fact that seafarers are not required to be in thelifeboat when launching during drills.”InterManager collates figures on lifeboat accidents on behalf of themaritime community and to assist in its role as a member of the International Lifeboat Group, which aimsto reduce lifeboat accidents and deaths. Since 1981 there have been 419 deaths involving lifeboats, 346serious injuries and 116 minor injuries. Capt Szymanski commented: “It’s important that everyoneinvolved, particularly Port State Control officers, understand and apply this regulation correctly. Themaritime community must do all we can to ensure the safety of seafarers.”7

A spokesperson of the Hong Kong Maritime Rescue Co-ordination Centre saidthere were 13 seafarers on Panama flagged Chuang Yi (IMO: 9196656). The 9,995 dwt tanker was about300 km east of the city's waters when it caught fire following the blast on Saturday. The injured crewmembers, including four in serious condition, are from Indonesia and Myanmar, according to local mediareports. They have been rescued by helicopters dispatched by the Government Flying Service. The firewas extinguished. The cause of the incident was not immediately clear. Hong Kong Maritime Departmenthas been approached for comment. Source : LloydslistELEKTRA – WORLD’S FIRST HYDROGEN-FUELED TUG TOOPERATE IN GERMANY’S INLAND WATERSA new hydrogen-fueled inland pusher tug recentlyarrived at the Port of Westhafen near Berlin to undergoa series of trials to prepare it for operational service.ELEKTRAwas built by Germany’s SchiffswerftHermann Barthel, which claimed that the vessel is thefirst tug in the world to be fitted with hydrogen-fueledengines. The tug has a length of 20 metres, a beam of8.2 metres, and a draught of 1.25 metres. The project team expects to make Elektra’s hydrogren fuel cell technology adaptable to awide range of vessels that sail on both inland and coastal waters.The hybrid system fitted on Elektra includes a battery package consisting of 242 DNV-approved moduleswith a total capacity of 2.5 MWh and three maritime fuel cell systems with 100 kW of peak power each.The battery was supplied by EST-Floattech.The battery and the fuel cells will be used together to powerthe electric motors. However, for complete redundancy, the two powertrains were designed to operate asentirely independent systems.The tug’s total electric power capacity of 21,200 kWh will enable an emissions-free round trip fromBerlin to Hamburg. On hydrogen, it will be able to travel a minimum of 100 kilometres over a 16-hourday or longer.The energy storage system (ESS) delivered by EST-Floattech has a raft of integrated safety features. Itsunique active balancing and passive safety system is applied at the module and string level. Heat isdissipated by a simple off-the-shelf air-conditioning unit while the battery racks can easily be installed ina modular fashion. Diederick Stam, founder of EST Floattech, said that monitoring of the installation,and in turn the assessment of its performance, can be done either onboard or remotely. ELEKTRA isdesigned to push the cargo barge Ursus, developed by the Design and Operation of Maritime Systemsdepartment at the Technical University of Berlin (TU Berlin), and numerous other cargo boats. It is to beused primarily for transportation of goods on the Berlin to Hamburg and inner-city routes in the Germancapital city. EST-Floattech said the tug’s most important transportation task will be carrying Siemensturbines, which need to be shipped from the production site in the center of Berlin to the Western Harbouror to Hamburg. TheMNA CIRCULAR 2022 - #0606th May 2022PulseMaryland seeks 100m from Evergreen to cover costs related to EverForward grounding By : Kim BiggarThe State of Maryland has asked Taiwanese liner Evergreen to establish a so-called responsibility fund topay for costs related to the month-long grounding of its EVER FORWARD vessel in the state’sChesapeake Bay.In a letter to Benjamin Tsai, president of Evergreen Shipping Agency (America) Corporation, Marylandcomptroller Peter Franchot said, “While we do not know the full scope of the environmental impact thusfar, a 131,420-ton ship, carrying tons of cargo and fuel, getting stuck in our waters undoubtedly hasresulted in disruptions to the Bay’s fragile ecosystem.” Franchot asked the company to set up a 100mfund to cover the environment-related costs, as well as economic costs, in particular for the seafoodindustry. “The damage that this incident has already caused – and could potentially continue to cause –will require financial resources to correct,” he said. Regarding the dredging undertaken to help free theship, Franchot wrote: “While this may have been a necessary action, among its potential consequencesinclude damage to oyster beds and disruptions to the spawning season for several species that our seafoodindustry – already struggling economically due to labor shortages – will harvest in the coming months.”Franchot said money from the fund would potentially compensate workers in the seafood industry if theyare impacted, and pay the cost of labor for employees from federal, state and local agencies involved inrefloating the ship. “The establishment of this fund will send a clear message that Evergreen is a goodfaith actor,” he said, that “understands the environmental and economic damage this incident has causedto the state of Maryland.” Source : Splash 247Explainer: Turning Egypt's Suez Canal into world's longest green canalEgypt is working on turning its 72-kilometre-long Suez Canal — the world’s longest man-made canalwithout locks — into a “green route,” a step that aligns with the country’s ambitious plans to become atransit route for clean energy. The sea-level canal, through which around 12 percent of the world’s tradepasses, connects the Mediterranean and the Red seas, and is the shortest maritime route between Asia andEurope and the fastest crossing from the Atlantic Ocean to the Indian Ocean.Here is a look at the main pillars of the country's plan for the Suez Canal, where work is currently underway toextend its length to 82 kilometres:· The move means establishing environmental sustainability standards at the canal and contributing to puttingthe brakes on climate pollution by reducing reliance on traditional energy sources.· Several steps have been taken by the Suez Canal Authority (SCA) to implement the plan, including operating16 extension stations along the canal with renewable energy, according to an info-graph released by theEgyptian cabinet's Information and Decision Support Centre.· Some of the SCA's facilities and lighting poles also run on solar energy.· Work is underway to convert the SCA's navy to operate on natural gas.· The SCA encourages its customers to use environmentally friendly fuels.· A package of incentives is provided for ships that use Liquid Natural Gas (LNG) and apply environmentalsafety standards.· The Egyptian cabinet has agreed to allocate areas along the Suez Canal Economic Zone (SCZone) forproducing green hydrogen.· The Egyptian authorities have been reviewing various offers submitted by international companies toestablish green hydrogen projects in the SCZone, as the country seeks to localise the production of the cleanburning fuel.· As per presidential directives, the authorities are working on activating a host of recently signedMemorandums of Understanding (MoUs) with foreign partners to produce and export green hydrogen in theSCZone.· Prime Minister Mostafa Madbouly has assured that the country aims to become a transit route for cleanenergy to Europe and the whole world.· These efforts are in line with the country's role as host of the 2022 United Nations Climate ChangeConference (COP27) in November in the coastal city of Sharm El-Sheikh, with a special focus on promotinggreen energy projects, including green hydrogen projects.
