Significant laws passed in 2019affecting workers’ compensationNote:The Oregon Revised Statutes are published every two years. This law book incorporatesthe changes to laws enacted by the Legislative Assembly through the 2019 session. Therewere no new laws enacted during the 2020 session.HB 2087 affects the division’s civil penalty law,primarily used to address claimsprocessing and benefit paymentperformance. This law has a statutorycap that was set in the 1970s. The billchanges the penalty cap to acalendar-year basis, instead of athree-month rolling period. It alsoseparates the civil penalties into threedistinct categories, each with separatecaps. Lastly, it increases the maximumpenalty amounts for insurers, selfinsured employers, and servicecompanies that fail to payassessments or comply with the lawfrom 2,000 to 4,000per violation and up to 180,000 peryear.Effective: Jan. 1, 2020.HB 3003 modifies the security depositrequirement for employers whoself-insure for workers’ compensationpurposes. Under the current law,when an employer stops being selfinsured, its security remains ondeposit for at least 62 months tosecure any remaining liability from theperiod of self-insurance. At the end ofthis period, the director may accept apaid-up insurance policy covering theemployer’s self-insurance liability inlieu of any remaining security. HouseBill 3003 allows the director to accepta paid-up policy in lieu of a formerself-insured employer’s securitybefore the end of the 62-monthperiod. The bill allowsthe director to adopt rules asnecessary to implement theprovisions of the bill.Effective: Jan. 1, 2020.HB 2788 increases the required balance for theWorkers’ Benefit Fund from six to 12months of projected expenditures.The Workers’ CompensationManagement-Labor AdvisoryCommittee (MLAC) recommendedthis change after conducting a studyof the fund balance requirement. Ifthe fund is projected to fall below the12-month balance, the departmentmust prepare a plan to address thesituation and present the plan toMLAC for discussion.Effective: Jan. 1, 2020.vContinued.

SB 507creates a presumption for certainpublic safety workers that posttraumatic stress disorder (PTSD) andacute stress disorder are compensableoccupational disease claims. For thepresumption to apply, the workermust establish, through apreponderance of persuasive medicalevidence from a psychiatrist orpsychologist, that the worker morelikely than not satisfies the diagnosticcriteria for the condition. To use thepresumption, the worker must havebeen employed at least five years orexperience a single traumatic eventfor PTSD. The presumption is nolonger available seven years after aworker is no longer employed.Employers can refute the presumptionwith clear and convincing medicalevidence that duties as a coveredemployee were not of real importanceor great consequence in causing thediagnosed condition. Employers canlater deny compensability of the claimin specified circumstances.Effective: Claims filed on or after Sep. 29,2019.vi

Significant laws passed in 2019affecting Oregon OSHASB 2087 requires health care employers toconduct a comprehensive securityand safety evaluation by June 30,2021, to identify factors that maycause violence committed againstemployees on the employer’spremises. This law requires employersto complete the evaluation and reportto the Department of Consumer andBusiness Services (DCBS) by Dec. 31,2021. DCBS must compile submittedreports and submit them to theLegislative Assembly by March 22,2022. This bill also makes it unlawfulto discriminate against a person whohas, in good faith, reported an assaultthat has occurred on the premises of ahealth care employer or in the homeof a patient receiving home healthcare services. Health care employersmust also establish a process toreview their prevention andprotection program at least onceevery two years in consultation withthe employer’s workplace safetycommittee. Upon the request of anemployee or workplace safetycommittee, health care employersmust generate and make available areport summarizing assaultinformation. This bill also specifiespermissible uses of reports.Effective: Jan. 1, 2020.vii
