APPLICATION OF TARIFFI1.1 GeneralA.B.C.D.This Tariff contains regulations, rates and charges applicable to the provision of Carrier Common Line, Switched AccessServices, Special Access Services, and other miscellaneous services, hereinafter referred to as service(s), provided by theTelephone Companies listed below, hereinafter referred to as the Company, to Interexchange Carriers, Resellers, TelephoneCompanies and any other entity authorized to order service out of this Tariff, hereinafter referred to as IC(s).The services identified in this Tariff, with certain exceptions which are identified as follows, are also available to othercustomers, subject to the same constraints and limitations that are applicable to certified interexchange carriers.11. Automatic Number Identification2. Billing and Collection ServicesThe provision of such services by the Company as set forth in this Tariff does not constitute a joint undertaking with the IC forthe furnishing of any service.The regulations, rates, and charges contained herein are in addition to the applicable regulations, rates, and charges specified inother tariffs of the Company which are referenced herein.The regulations, rates and charges contained within this Tariff are not applicable to Radio Common Carriers, except for thoseCellular Mobile Carriers who receive additional authority (certification) from the North Carolina Utilities Commission toprovide Wide Area Call Reception Service for interCGSA traffic. GENERAL REGULATIONSI2.3 Obligations of the IC (Cont'd)I2.3.11 Claims and Demands for DamagesA.B.C.D.With respect to claims of patent infringement made by third persons, the IC shall defend, indemnify, protect and save harmlessthe Company from and against all claims arising out of the combining with, or use in connection with, the services providedunder this Tariff, any circuit, apparatus, system or method provided by the IC or end users.The IC shall defend, indemnify and save harmless the Company from and against any suits, claims, losses or damages,including punitive damages, Attorney's fees and court costs by third persons arising out of the construction, installation,operation, maintenance, or removal of the IC's circuits, facilities, or equipment connected to the Company's services providedunder this Tariff including, without limitation, Workmen's Compensation claims, actions for infringement of copyright and/orunauthorized use of program material, libel and slander actions based on the content of communications transmitted over theIC's circuits, facilities or equipment, and proceedings to recover taxes, fines, or penalties for failure of the IC to obtain ormaintain in effect any necessary certificates, permits, licenses, or other authority to acquire or operate the services providedunder this Tariff; provided, however, the foregoing indemnification shall not apply to suits, claims, and demands to recoverdamages for damage to property, death, or personal injury unless such suits, claims or demands are based on the tortuousconduct of the IC, its officers, agents or employees.The IC shall defend, indemnify and save harmless the Company from and against any suits, claims, losses or damages,including punitive damages, attorney's fees and court costs by the IC or third persons arising out of the Company provision ofBilling Analysis Services or any other service under this Tariff at the request of the IC, including, but not limited to claims forlibel, slander, invasion of privacy, conversion and trespass.The IC shall defend, indemnify and save harmless the Company from and against any suits, claims, losses or damages,including punitive damages, attorney fees and court costs by the IC or third parties arising out of any act or omission of the ICin the course of using services provided under this Tariff.I2.3.12 Notification of Service-Affecting ActivitiesA.B.The IC shall provide the Company timely notification of the following:1. Planned or unplanned outages of IC facilities which will affect the Company's capability to provide adequate service foranticipated traffic volumes,2. Facility failures within the IC network which will adversely impact upon the Company's capability to provide adequateservice for anticipated traffic volumes, and,3. IC marketing activities designed to generate rapid or short-term increases in anticipated traffic volumes.This timely notification will enable the Company to administer its network as set forth in I6.4.1 following.I2.3.13 Coordination with Respect to Network ContingenciesThe IC shall, in cooperation with the Company, coordinate in planning the actions to be taken to maintain maximum networkcapability following natural or man-made disasters which affect telecommunications services.I2.3.14 Jurisdictional Report Requirements(1)A.(N)Jurisdictional Reports1. When an IC initially orders Feature Group A (FGA), Feature Group B (FGB), 500, 800, and/or 900, Switched AccessService, the IC shall state in its order, the Percent Interstate Usage (PIU). Additionally, upon employing the use of the700 service Access Code over Feature Groups C or D Switched Access Services, the IC must provide the Company thePIU for the 700 calls. The IC shall report the PIU on a statewide, LATA or billing account number level (at the option ofthe IC). The report should be on a local exchange company specific basis.(1)See TDS Telecom exception language filed in section I15.5(N)

For usage sensitive (i.e., access minutes and calls) chargeable rate elements, multiply the percent intrastate use times theactual use (i.e., measured or Company assumed average use) times the stated tariff rate.The intrastate percentage will change as revised jurisdictional reports are submitted as set forth in I2.3.14 preceding.I2.3.16 Trouble DeterminationA.B.C.The IC shall be responsible for receiving trouble reports from its end users and determining, by testing or other means if thesource of trouble is caused by the equipment or facilities provided by the IC, its end user, or by the Company.When more than one Company service is used to provide service to an IC, the IC is responsible for determining which serviceprovided by the Company is causing the reported trouble.The IC shall be responsible for payment of Maintenance of Service Charges as set forth in I13.3.1 following when reportingtrouble to the Company and the obligations in A. and B. preceding are not met.I2.3.17 Reserved for Future UseI2.3.18 Reserved for Future UseI2.3.19 800 Number ProvisioningThe provision of 800 Access Ten Digit Screening Service, provided from Section I6. following, requires the IC's subscriptionto basic 800 Number Service features found in Section I13. of this Tariff or as an alternative the provision of those features byother responsible organizations or through direct access by the IC to the Service Management System.I2.3.20 Switched Access CreditA.As ordered on May 17, 1994 in Docket No. P-100, Sub 126, Defined-Radius Discount Calling Plan, and on February 9, 1994in Docket Nos. P-141, Sub 19 and P-100, Sub 65, and Sub 72, the following Companies will credit the IC the differencebetween the average revenue per minute for (1) MTS, Defined-Radius Plans, Defined-Area Plans, DDD, OCPs, Saver Service,WATSSaver and any future services of a similar nature in the aggregate; (2) WATS; or (3) 800 Service; and the averageintrastate calculated composite switched access rate. The Company will recalculate and change, if necessary, the creditapplicable to IC traffic when any switched access rate element changes, once a proposed change in the price of one of theexisting toll services becomes effective, or on January 1, 1995 and July 1, 1995 and on July 1 of each year thereafter. Thecredit will be given as long as the intrastate switched access charges exceed the average intraLATA toll rate.1.
