CONSTITUTION AND BY LAWSOFFAITH FREE WILL BAPTIST CHURCH OF CHANDLER INDIANA303 NORTH FIFTH STREETCHANDLER, INDIANA 47510PREAMBLEIn order to preserve and secure the principles of our Faith; to provide for the governing ofthis body in an orderly manner; to preserve the liberties of each individual member of thischurch; to guarantee the freedom of action of this body, yet respect its relationship to otherchurches of the same faith, and to secure the blessings of God; we do declare and establishthis Constitution.The Faith Free Will Baptist Church is in no way regulated or dominated by any organization.The Church functions on its own membership as to how we vote, elect our officers, call ourPastor, spend our monies, buy our properties, build our churches and the such. Faith FreeWill Baptist Church is a self-governing body, while voluntarily associated with The NationalAssociation of Free Will Baptist.ARTICLE 1NAME AND PURPOSESECTION 1-CHURCH NAMEThis congregation of believers shall be known as the Faith Free Will Baptist Church ofChandler, Indiana.SECTION 2-PURPOSEA. This congregation is organized as a church exclusively for charitable, religious andEducational purposes within the meaning of section 501 3 of the InternalRevenue Code of 1986 (or the corresponding provision of any future United Statesrevenue law), including, but not limited to, for such purposes: the establishing andmaintaining and operating of churches, parsonages, schools, chapels, radio stations,television stations, rescue missions, print shops, day care centers, camps, nursinghomes, cemeteries,, and any other ministries that the Church may be led of God toestablish or supportB. The Church shall also license and ordain men to the Gospel ministry, evangelize theUnsaved by the proclaiming of the Gospel of the Lord Jesus Christ, educate believersin a manner consistent with the requirements of Holy Scriptures, both in Sunday andweekday schools of Christian Education, maintain missionary activities in the United

States and any Foreign Country; and engage in any other ministry that the Church maydecide, from time to time, to pursue in obedience to the will of God.ARTICLE IISTATEMENT OF COVENANT, FAITH AND PRACTICESSECTION 1- STATEMENT OF COVENANT, FAITH AND PRACTICESThe statement of Free Will Baptist Church is contained in the Treatise of the National Association ofFaith Free Will Baptists as adopted by the National Association November 7, 1935, at Nashville,Tennessee. Revised 1948, 1956, 1969, 1973, 1974, 1977, 1979, 1981, and 1992. Published by theExecutive Office of the National Association of Free Will Baptists, Inc. and presently printed 1996.SECTION 2 – ADDITION TO THE TREATISEA. Civil GovernmentWe believe that God has ordained and created all authority consisting of three basicinstitutions: 1) The home; 2) The church; and 3) The state. Every person is subjectto these authorities, but all (including the authorities themselves) are answerable toGod and governed by His Word. God has given each institution specific Biblicalresponsibilities and balanced those responsibilities with the understanding that noinstitution has the right to infringe upon the other. The home, the church, and thestate are equal and sovereign in their respective Biblically assigned spheres ofresponsibility under God (Rom. 13:1-7; Eph. 5:22-24; Heb. 13:17; I Pet. 2:13-14).B. Human SexualityWe believe that sexuality is a gift of God to be practiced within the union of a Godordained marriage between a man and woman and not before. Any Sexual activitysuch as adultery (having sex with someone other than one’s married partner) orfornication (any other forms of sex) is a sin against God and the person committingthe act (Genesis 2:24; Genesis 19:5,13; Genesis 26:8-9; Leviticus 18:1-30; Romans1:26-29; I Corinthians 5:1,6:9; I Thessalonians 4:1-8; Hebrews 13:4.C. Divorce and Remarriage

We believe that God hates divorce and intends marriage to last until one of thespouses dies. Divorce and remarriage is regarded as adultery except on the groundsof fornication or desertion. (Mal.2:14-17; Matt. 19:3-12; Romans7:1-3; I Cor. 7:15).Although divorced and remarried persons of divorced persons may hold positions ofService in the Church, and be greatly used of God for Christian service they may notbe considered for the offices of pastor or deacon. (Timothy 3:2, 12; Titus 16.D. AbortionWe believe that human life begins at conception and that the unborn child is a livingHuman being. Abortion constitutes the unjustified unexcused taking of unbornhuman life. Abortion is murder. We believe in extreme cases of difficulty, themother’s life is a priority, and judgment should be left to the people involved(parents, family, doctors, and pastor) to seek the will of God, (Job3:16; Psalms 51:5;139:14-16; Isaiah 44:24; 49:1, 5; Jeremiah 1:5; 20:15-18: Luke 1:44)E. Sexual PerversionWe believe that God has commanded that no intimate sexual activity should beengaged in outside of a marriage between a man and a woman. We believe thatany form of homosexuality, lesbianism, bisexuality, bestiality, incest, fornication,adultery and pornography are sinful perversions of God’s gift of sex. (Genesis 2:24;Genesis 19:5, 13; Genesis 26:8-9; Leviticus 18:1-30; Romans 1:26-29; I Corinthians5:1; 6:9; I Thess. 4:1-8; Hebrews 13:4).F. CreationWe believe that God created the universe in six literal, 24 hour periods. We rejectevolution, the Gap Theory, the Day-Age Theory , and Theistic Evolution asunscriptural theories of origin ( Genesis 1-2; Exodus 20:11).G. MissionsWe believe that God has given the Church a Great Commission to proclaim theGospel to all nations so that there might be a great multitude from every nation,tribe, ethnic group, and language group who believe on the Lord Jesus Christ. Asambassadors of Christ we must use all available means to go to the foreign nationsand not wait for them to come to us. (Matt 28:19-20; Mark 16:15; Luke 24:46-48;John 20:21; Acts 1:8; II Corinthians5:20).H. Lawsuits Between BelieversWe believe that Christians are prohibited from bringing civil lawsuits against other

Christians or the Church to resolve personal disputes between members. We believe the Church possesses all the resources necessary to resolve personal disputesbetween members. We do believe, however, that a Christian may seek compensation for injuries from another Christian’s insurance company as long as the claim ispursued without malice or slander (I Corinthians 6:1-8; Ephesians 4:31-31).I.GivingWe believe that every Christian, as a steward of that portion of God’s wealthentrusted to him, is obligated to support his local church financially. We believethat God has established the tithe as a basis for giving but that every Christianshould also give other offerings sacrificially and cheerfully to the support of theChurch, the relief of those in need, and the spread of the Gospel. We believe that aChristian relinquishes all rights to direct the use of the tithe once the gift has beenmade. However, one can designate money to a particular ministry within thechurch(Genesis 14:20; Proverbs 3:9-10; Acts 4:34-37; I Corinthians 16:2; IICorinthians 9:6-7; Galatians 6:6; Ephesians 4:28; I Timothy 5:17-18; I John 3:17).ARTICLE IIICHURCH MEMBERSHIPSECTION 1 – PURPOSE FOR MEMBERSJIPWe believe that every person who has accepted Jesus as their personal Savior should identifythemselves with the visible Church, “Take Membership”. They should labor diligently in the work of theLord and should contribute of the material, physical and spiritual means to the spreading of the gospelto the ends of the earth. We also feel that every member should consider it their duty to attend allservices if at all possible. No person shall be considered for any office or position unless that individualis a member or associate member of this Church (I Corinthians 16:2; II Corinthians 9:10-15; Hebrews10:25).SECTION – 2 QUALIFICATIONS FOR MEMBERSA A person may become a member of this body by either profession of faith in Jesus Christ asLord and Savior followed by baptism or letter of transfer of membership from anotherchurch of like precious faith.B. No one shall be received into membership who does not manifest works of genuinerepentance as evidence of salvation.C. Letters of transfer of membership into this church shall only be received if the personrequesting such is granted a letter of good standing from the sister church. Persons expelledfrom sister churches for disciplinary reasons shall not be received into membership untilrestitution is properly made to the sister church.

D. Anyone desiring membership with this church should request such to any church member,Pastor or Deacon. The request will be followed by a weeks’ time interviews allowing forprospective members may then be received in fellowship at any regular service of thechurch by majority vote of the membership present.SECTION 3 – INACTIVE MEMBERSAnyone who willfully absents himself from the meetings and support of the church for a period of 90days without just cause shall be placed on an inactive roll by vote of the church in any regular businessmeeting. Inactive members deprive themselves of voting privileges at any business meeting of thechurch. Should a person display a spirit of repentance and return to support of the church, their namewill be removed from the inactive roll by vote of the church and voting privileges renewed.SECTION 4 – DISMISSAL FROM CHURCH MEMBERSHIPA. By deathB. By personal request to the Pastor and/ or Board of Deacons.C. By letter of transfer to other churches of like faith. Letters of transfer will not begranted to groups considered to be false cults.D. By disciplinary expulsion.1.) If a person continues to remain inactive for a total period of 9 months afterbeing contacted by the Pastor and/ or Board of Deacons, his name shall beremoved from the church roll entirely.2.) In cases of immorality, unchristian conduct or heretical deviations from theStatement of Faith and violations of the Church Covenant, membership maybe terminated upon the guidelines set forth in Matthew 18:15-20. Such as:a.) There shall be a Discipline Committee consisting of the Pastor andThe Board of Deacons. These men shall have authority todetermine heretical deviations from the Statement of Faith andviolations of the Church Covenant. If the Pastor or a Deacon is thesubject of a disciplinary matter, he shall not sit as a member of theDiscipline committee. He shall be entitled to the same steps asother Church members and be subject to the same disciple

b.) When a member becomes aware of an offense of such magnitudethat it hinders spiritual growth and testimony, he is to go alone tothe offending party and seek to restore his brother. Before he goes,he should go with a spirit of humility and have the goal ofrestoration.c.) If reconciliation is not reached, a second member, either a Deaconor the Pastor is to accompany the one seeking to resolve thematter. This second step should also be preceded by selfexamination, and exercised in a spirit of humility with the goal ofrestoration.d.) If the matter is still unresolved after the steps outlined insubsections (b) and (c) have been taken, the Discipline Committee,Such as the Church representatives biblically responsible for puttingdown murmuring shall hear the matter. If the matter is notresolved during the hearing before the Discipline Committee, theCommittee shall recommend to the members of the Church thatthey, after self-examination, make an effort personally to go to theoffending member and seek that member restoring,e.) If the matter is still unresolved after the steps outlined insubsections (b), (c), and (d) have been taken, such members whorefuse to repent and be restored are to be removed frommembership of the Church upon a majority vote of themembership present at meeting called for the purpose ofconsidering disciplinary action.f.) No matter may be heard by the Discipline Committee or the Churchunless the steps outlined in subsections (b) and (c) have been taken,except in the case of a public offense.g.) If an unrepentant offending party is removed from the Churchmembership they may not participate in church business or practicethe ordinances set forth in the Scripture. Although, they may visitthe regular church services.SECTION 5 – ASSOCIATE MEMBERSIn certain cases persons may become associate members for the purpose of working in the church or inother field with the church’s blessing. This may apply to those who may live in the area for a short timebut circumstances would not necessitate changing their membership permanently, or to those who, are

approved and liberated to work in another field. Associate members do not have voting privileges Inchurch business meetings.SECTION 6 – PRIVILEGES OF MEMBERSHIPA. This congregation functions as a body under the Headship of the Lord Jesus Christ and thedirection of the Pastor as the Undersheperd with the counsel of the Church Board.Membership in this church does not afford those individuals with any property, contract, orcivil rights. Determination of the internal affairs of this church are ecclesiastical matters andshall be determined exclusively by the Church’s own rules and procedures. All items ofbusiness should be given in as in writing to the Church Board for consideration with all itemsof major concern given to the Board thirty days prior to the Church’s annual businessmeeting.B. Members of the church and immediate family may reserve the church auditorium,Fellowship hall, classrooms, tables and chairs with the approval of the Pastor and ChurchBoard. (Example: weddings, funerals, showers, birthdays and anniversaries, Etc.) NOTE:No alcoholic beverages shall be allowed or consumed here for any reason. Also, the use ofall tobacco is prohibited.ARTICLE IVOFFICERSSECTION 1 – CHURCH OFFICERSThe Church officers are Pastor (see Article V, Section 1), Deacon (see Article V, Section 2), minister ofrecords (se Article V, Section 3), minister of finance (see Article V, Section 4), minister of Sunday School(see Article V, Section5). One person may hold two or more offices, except that of Pastor. The Pastor,from time as he deems appropriate, may appoint other Church officers, subject to a confirmation voteof the church membership,SECTION 2 – DESIGNAITON OF CORPORATE OFFICERSAs an accommodation to legal relationships outside the Church the chairman of trustee board shallserve as president of the corporation; the church clerk shall serve as secretary of the corporation; theminister of finances shall serve as treasurer of the corporation; and the chairman of the board ofdeacons shall serve as vice president of the corporation.SECTION 3 – ELEGIBILTY FOR CONTINUANCE IN OFFICEA. All Church officers shall affirm their agreement with the Statement of Faith (as set forth inArticle II) annually in the presence of each other.

B. All Church officers must be approved initially and thereafter annually by the Pastor in orderfor them to commence or continue in their offices.C. Only Church members are eligible for election or appointment to any church office orposition.SECTION 4 – TERMS OF OFFICEThe length of terms of office shall be as follows:A. The relationship between the Pastor and Church shall be permanent unless dissolved at theoption of either party by giving of a 60 day notice, or less by mutual consent. Theserverance of the relationship between the Pastor and the Church may be considered at anyregular Church administration meeting. A three-fourths majority of the members presentand voting shall be required to decide the matter. Disciplinary removal of the Pastor fromoffice automatically terminates his membership.B. The term of service for all offices and position in the Church, except the Pastor and Deacon,shall be a term of one year, or as the rotation of board may require. Boards may rotate atthe pleasure of the church body.C. A vacancy occurring in any office or board, except in the case of Pastor, may be filled at anyregular Church administration meeting.D. All elected and appointed officers shall serve in their respective offices until their successorsare duly elected or appointed.SECTION 5 – ELECTION OF OFFICERSA. The Pastor shall be elected by three-fourths vote of the active members. The election of aPastor must be announced two weeks in advance. The Deacon board plus one duly electedlay member shall serve as the pulpit committee.B. The election of a Deacon shall be announced two weeks in advance. A hand-out from theDeacon board, listing qualified prospective Deacons shall be handed out to the members,who in turn will vote by secret ballot to elect a Deacon or Deacons.C. The annual election of officers by the church membership shall occur during the month ofJanuary at the annual church administration meeting.SECTION 6 – PASTORAL OVERSIGHT OF OFFICERS AND STAFFA. Subject to the approval of the church membership on the condition that they shall become amember of the church upon assuming their duties, the Pastor may hire associates andassistants, to assist the Pastor in carrying out his God-given responsibilities.B. All church staff, whether paid or volunteer, shall be under the supervision of the Pastor,who has the sole authority to hire appoint or dismiss the same by approval of the church.ARTICLE V

DUTIES OF OFFICERSSECTION 1 – THE PASTORThe Pastor shall preach the Gospel regularly and shall be atg liberty to preach the whole counsel of theWord of God as the Lord leads him. He shall administer the ordinances of the Church, act as moderatorat all Church meetings or the transaction of Church matters, supervise the teaching ministries of theChurch, and tenderly watch over the spiritual interests of the membership. The Pastor shall be ex-officioof all boards and committees.SECTION 2 – THE BOARD OF DEACONSThe board of Deacons shall assist the Pastor, in such manner as he shall request, in promoting thespiritual welfare of the church, in conducting the religious services, and in performing all other work ofthe Church. They shall make provision for the observance of the ordinances of the Church. They shall, ifrequested by the Pastor consider application for Church membership. They shall, in cooperation withthe Pastor, disburse the benevolence fund. They shall assist the Pastor in visitation and all otherevangelistic efforts of the Church. They shall provide the pulpit supply and act as leaders for Churchmeetings if the office of Pastor is vacant. The board of Deacons shall assist the Pastor in caring for theadministrative needs of the Church’s various ministries as requested by the Pastor. The board will selecta chairman among itself, so as to be moderator of any board meeting or business meeting if the Pastoris unable to be present.SECTION 3 – THE MINISTER OF RECORDS (CHURCH CLERK)The minister of records shall keep a record of Church proceedings, the minutes of all business meetings,the membership rolls and all transfers of membership.SECTON 4 – THE MINISTER OF FINANCEThe minister of finances shall account for all funds contributed to the church and shall disburse the sameas ordered by the Church. He or she shall present a written report of itemized disbursements at theregular monthly Church administration meetings. All expenditures of the church except miscellaneouspetty cash disbursements shall be paid by check. The minister of finances shall also serve as treasurer ofthe corporation.SECTION 5 – DAY SCHOOL PRINCIPALThe principal, serving under the Pastor’s discretion and approval, shall supervise the affairs (instructionaland non-instructional) of Faith Christian School in accordance with a job description presented by thePastor and approved by the Church school board.SECTION 6 – DAY SCHOOL STAFFAll Faith Christian School personnel (employees and volunteer workers) shall serve under the authorityof the school Principal in all curricular and extracurricular activities.SECTION 7 – GENERAL SUNDAY SCHOOL SUPERINTENDENT, SECRETARY HEAD USHER AND YOUTHSPONSOR shall perform the duties incumbent to their offices in harmony with the Pastor.SECTION 8 – THE CHURCH NURSERY SUPERVISOR

The Church nursery supervisor shall supervise the Church Nursery, seeing that ample help is provided inthe Nursery during the Worship Services of the Church. The supervisor may or may not remain in theNursery during the services. All help for the Church Nursery, including the Supervisor, must be at least18 years of age. No children over 3 years of age shall be allowed in the Nursery.SECTION 9 – THE JANITORThe Janitor shall be under the control and direction of the Board of Trustees at all times. The Janitorshall be paid a monthly salary as recommended by the Board of Trustees to the General Board andapproved by the Church Body in a regular business meeting.1. The Janitor shall vacuum all carpets each week.2. The restroom, basement and gym shall be wet mopped as needed.3. Restroom facilities shall be disinfected each week.4. The Janitor shall be responsible for a general dusting each weekend shall have theauthority to purchase general cleaning supplies for the Church as needed, as long assuch purchases are within reason.SECTION 10 – JUNIOR CHURCH WORKERSThe Junior Church workers shall be under the direction and control of the Board of Deacons and Pastorat all times. Junior Church Workers shall be at least 18 years of age and shall meet the Church Workerstandards. Their duties shall be that of leading all children ages 5-9 under their ministry in the worshipof the Lord. They shall diligently strive through Study, Prayer and Preparation to bring each child to asaving Knowledge of Christ and to encourage their growth “in grace and in the knowledge of our Lordand Savior Jesus Christ.” 2 Peter 3:18. Children’s Church shall meet at least twice monthly unlesspostponed for special services.SECTION 11 – THE MISSIONS CORRESPONDENTThe Missions Correspondent will maintain regular correspondence to all missionaries who the Churchadopts and will help to keep us aware of any urgent needs.SECTION 12 – FLOWER AND GIFT CHAIRMANThe Chairman will purchase flowers or suitable gifts for members who have extended hospital stays andfor families of members upon the death of mate, parent, child, brother, or sister.SECTION 13 – THE GENERAL CHURCH WORKERSAll general church workers are to be members or associate members of this Church, understanding theprivileges and responsibilities of their positions. These shall be recommended to the Church by thePastor and/or the Board of Deacons so as to be elected yearly or as otherwise specifiedNOTE: All material (curriculums, literature, music, etc.) used in the ministry of this Church is to beapproved by the Pastor and general board. Music with hard rhythms will not be acceptable.ARTICLE VICHURCH BOARDS

SECTION 1 – EXECUTIVE/GENERAL BOARDA. The Executive General Board Consists of the Pastor and the Board of Deacons, the board oftrustees and the Sunday School Superintendent.B. The Executive Board’s responsibility is to oversee the welfare of the Church as servants inthese ways: recommendations of monies spent or saved and the nominations of generalchurch workers; to provide proper spiritual influence for all church workers; to provideproper spiritual influence for all church services; to be examples to others by way of beinginvolved in evangelism; to walk in the spirit and uphold each person within the church inprayer; and to do what is scripturally acceptable and necessary to keep harmony and unitywithin the Church. The General Board will meet once a month, unless otherwiseannounced. The General Board serves as an advisory board and makes recommendationsfor the Church to consider. The General board also serves as the Church Day School Board.SECTION 2 – DEACON BOARDRefer to Article V, Section 2.SECTION 3 – TRUSTEE BOARDThe Trustees hold the deeds to all properties, and are responsible for the general maintenance of allChurch properties. They are to evaluate and recommend the amount and coverage of insurance. TheTrustee Board is responsible for signing of all legal papers on behalf of the Church. The Trustees are a 3member rotating board. The senior member shall serve as chairman. The Trustees are servants of thechurch and operate with the church’s approval.ARTICLE VIITAX-EXEMPT PROVISIONSSECTION 1 – PRIVATE INUREMENT:No part of the net earnings of the Church shall inure to the benefit or be distributable to its members,trustees, officers, or other private persons, except that the Church shall be authorized and empoweredto pay reasonable compensation for the services rendered and to make payments and distributions infurtherance of the purposes set forth in Article I, Section 2 hereof.SECTION 2 - POLITICAL INVOLVEMENTNo substantial part of the activities of the Church shall be the carrying on of propaganda or otherwiseattempting to influence legislation. The Church shall not participate in, or intervene in (including thepublishing or distribution of statements) any political campaign on behalf of any candidate for publicoffice.SECTION 3 – DISSOLUTIONUpon the dissolution of the Church; the Trustees shall, after paying or making provisions for payment ofall liabilities of the Church, dispose of all the assets of the Church to such organization or organizationsorganized and operated exclusively for religious purposes as shall at the time qualify as an exemptorganization or organizations under Section 501 (3) of the Internal Revenue Code of 1986 (or the

corresponding provision of any future United States Internal Revenue Law), as the Trustees shalldetermine. Assets may be distributed only to organizations which agree with the Church’s Statement ofFaith.SECTION 4 – RACIAL NONDISCRIMINATIONThe Church shall have a racially nondiscriminatory policy and therefore shall not discriminate againstmembers, applicants, students, and others on the basis of race, color or national or ethnic origin.ARTICLE VIIIDESIGNATED CONTRIBUTIONSFrom time to time the Church, in the exercise of its religious, educational, and charitable purposes, mayestablish various funds to accomplish specific goals. Contributors may suggest uses for theircontributions but all suggestions shall be deemed advisory rather than mandatory in nature. Allcontributions made to specific funds or otherwise designated shall remain subject to the exclusivecontrol and discretion of the Pastor and of the Board of Deacons. No fiduciary obligation shall becreated by any designated contribution made to the Church other than to use the contribution for thegeneral furtherance of any of the purposed stated in Article I, Section 2.ARTICLE IXAMMENDMENTSThis Constitution may be revised or amended by a majority vote of the members present and voting, atany regular Church business meeting provided that said revision or amendment has been submitted inwriting and announced from the pulpit fourteen (14) days before the vote is taken.ADOPTIONThis Constitution was adopted by a two-thirds majority vote of the members present and voting at aduly-called meeting of the Church in which a quorum was present.This Constitution and By-Laws supersedes any other constitutions and/or by-laws eMinister of RecordsCHURCH BY-LAWSSECTIION I - QUORUMA. Ten (10) active voting members of this Church shall compose a quorum necessary toconduct business at any business meeting of the Church.

B. Members must be sixteen (16) years of age to vote.SECTION 2 – BOARD AND CHURCH MEETINGSA. An annual meeting of the Church shall take place on the second Sunday night of January forthe purpose of election of officers and adoption of the annual budget.B. The ordinance of communion and the ordinance of feet washing shall be observed at timesof the Pastor’s discretion.C. Board meetings shall be determined when necessary, however the following guidelineshould be considered: The Executive Board shall meet monthly with the General Board to discuss theneeds of the Church and make plans to further its cause.D. There will be no meetings of either deacon/advisory board or business of the Churchwithout the Pastor’s presence or knowledge. If for some reason the Pastor is not availablefor a needed meeting of the Church, the Pastor will have full knowledge of the meeting andthe chairman of the meeting board will act as moderator.E. All Church administration meetings shall be opened and closed with prayer for divineguidance and blessing,F. Robert’s Rules of Order shall be used as a guide to parliamentary procedure for all businessmeetings.SECTION 3 – CHURCH FISCAL YEARThe Church fiscal year shall run February 1 – January 31.SECTON 4 – SUPPORT OF THE CHURCHThe Church shall receive tithes and offerings for financial support of its ministries. Specialofferings may be received as needed. The Church shall operate on principles of Goodstewardship with a budget considered each year by the membership.SECRTION 5 – PARASITES AND INFECTIOUS DISEASESA. All members are expected to protect others from parasites or infectious diseases they mayhave.B.
