REPORT ON STATUS OF MUNICIPAL UTILTY CUSTOMER ACCOUNTSMarch 16, 2020 – December 15, 2020IntroductionItem 4-14.00 Paragraph 7h of the 2020 Appropriations Act, as amended, requires utilities notsubject to regulation by the State Corporation Commission (municipal utilities) to submit informationon the status of customer accounts to the Commission on Local Government (CLG). 1 Each utility isrequired to report to the CLG information covering specific time periods. For this report, that timeperiod covers March 16, 2020, through December 15, 2020 and covers the following information: 2a) The number and value of accounts that are at least 30 days in arrears;b) the number and value of accounts that are at least 60 days in arrears;c) The number, total value, and average debt of accounts that are participating in the Repayment Plan,or another repayment plan as set forth by the utility;d) The number of accounts removed from the Repayment Plan, or another repayment plan as set forthby the utility, categorized by reason;e) The amount of and average debt still remaining for accounts removed from the Repayment Plan oranother repayment plan as set forth by the utility;f) the carrying costs of the debt for accounts participating in a repayment plan and any associatedadministrative costs incurred;g) The number, total value, and average debt of accounts offset by the funds provided in Item 479.10,paragraph B.2. of this act and local programs using Coronavirus Relief Funds, categorized by days inarrears, customer account type, and Coronavirus Relief Fund type; and,h) The cumulative level of customer arrearages by locality.Upon receipt of such information, the CLG is directed to compile an aggregated anonymizedreport and provide it to the Chairs of the House Committees on Labor and Commerce andAppropriations, the Senate Committees on Commerce and Labor and Finance and Appropriations,and the Secretary of Commerce and Trade.On December 10, 2020, CLG staff shared advanced notice of the reporting requirement andquestions with points of contact for municipal utilities and the chief administrative officers for cities,counties, and towns. On December 15, 2020, an email was sent to the same individuals with a link toa survey for purposes of collecting this information. 3 Responses were received from 146 municipalutilities, which does not appear to account for every municipal utility system that is within theCommonwealth of Virginia; however, an analysis and listing on unresponsive municipal utilities is notprovided in this report.4Please note that the CLG has not formally adopted the report because the reporting deadlinesestablished in the Appropriations Act do not comport with the CLG’s adopted meeting schedule. Thisreport will be presented to the CLG for formal consideration at their next regularly scheduledmeeting on January 5, 2021.The full text of this reporting requirement can be found in Appendix A.In many cases, CLG staff was asked to provide additional guidance/interpretation to municipal utilities with some ofthe information requested. Additional refinement and clarification on these matters may be necessary in futureAppropriations Acts to ensure consistency and greater efficiency in the reporting process.3Please see Appendix B for a copy of the survey questions.4A table summarizing all responses that were received has been included as Appendix C.212

Summary of Municipal Utility Customer Account DataThe following is a statewide summary of data collected for items (a) through (h) as described inItem 4-14.00 Paragraph 7h of the 2020 Appropriations Act, as amended.a) The number and value of accounts that are at least 30 days in arrears;Reporting municipal utilities indicated that 513,495 accounts were on file as being at least 30days in arrearages with a total statewide value of 88,523,441.01.b) The number and value of accounts that are at least 60 days in arrears;Reporting municipal utilities indicated that 423,072 accounts were on file as being at least 60days in arrearages with a total statewide value of 81,215,837.69.c) The number, total value, and average debt of accounts that are participatingin the Repayment Plan, or another repayment plan as set forth by the utility;Reporting municipal utilities indicated that 42,997 accounts were on file as participating in arepayment plan with a total statewide value of 20,257,595.47. Average debts for these accountsvaried widely by municipal utility, ranging from a low of 82.07 to a high of 6,882.00.d) The number of accounts removed from the Repayment Plan, or anotherrepayment plan as set forth by the utility, categorized by reason;Reporting municipal utilities indicated that 14,376 customers had been removed fromrepayment plans as of December 15, 2020, because they had paid their past due balance in full.Municipal utilities also reported 16,632 accounts were removed from repayment plans for reasonsother than full payment of past due balances.e) The amount of and average debt still remaining for accounts removed fromthe Repayment Plan or another repayment plan as set forth by the utility;Reporting municipal utilities indicated that those accounts removed from repayment plans asof December 15, 2020, have a total statewide balance of 4,859,728.87. Average debt for thoseaccounts ranged from a low of 90.92 to a high of 2,928.47.f) The carrying costs of the debt for accounts participating in a repayment planand any associated administrative costs incurred;Reporting municipal utilities indicated that the carrying costs associated with maintainingrepayment plans accounted for a statewide total of 454,300.47. Additional administrative costsassociated with repayment programs accounts for an additional statewide total of 474,545.21.3

g) The number, total value, and average debt of accounts offset by fundsprovided in Item 479.10, paragraph B.2. of the 2020 Appropriations Act andlocal programs using Coronavirus Relief Funds, categorized by days in arrears,customer account type, and Coronavirus Relief Fund type;Accounts Offset by Item 479.10, paragraph B.2. of the 2020 Appropriations Act, as AmendedFor residential accounts 30 or more days in arrears, reporting municipal utilities indicated a totalof 3 accounts with a total statewide value of 1,927.64 and average debt from a single locality.For residential accounts 60 or more days in arrears, reporting municipal utilities indicated a totalof 3 accounts with a total statewide value of 1,927.64 and average debt from a single locality.For non-residential accounts, no municipality had allocated money from the 2020Appropriations Act for any account 30 or 60 days in arrears.Accounts Offset by Direct and Indirect (State Pass-through) Coronavirus Relief FundsFor residential accounts 30 or more days in arrears, reporting municipal utilities indicated a totalof 3080 accounts with a total statewide value of 1,516,735.96 and average debt ranging from alow of 18.68 to a high of 1,205.96.For residential accounts 60 or more days in arrears, reporting municipal utilities indicated a totalof 3,859 accounts with a total statewide value of 2,977,851.97 and average debt ranging from alow of 58.03 to a high of 3,240.49.For non-residential accounts 30 or more days in arrears, reporting municipal utilities indicateda total of 62 accounts with a total statewide value of 129,088.10 and average debt ranging from alow of 68.52 to a high of 4,262.87.For non-residential accounts 60 or more days in arrears, reporting municipal utilities indicateda total of 90 accounts with a total statewide value of 334,904.32 and average debt ranging from alow of 78.19 to a high of 5,000.h) The cumulative level of customer arrearages by locality;Because the number of localities covered by municipal utilities varies, this data cannot besummarized at the state level.4

h. Utilities not subject to regulation by the Commission shall submit informationon the status of customer accounts to the Commission on Local Governmentmanaged by the Department of Housing and Community Development, including(a) the number and value of accounts that are at least 30 days in arrears; (b) thenumber and value of accounts that are at least 60 days in arrears; (c) the number,total value, and average debt of accounts that are participating in the RepaymentPlan, or another repayment plan as set forth by the utility; (d) the number ofaccounts removed from the Repayment Plan, or another repayment plan as setforth by the utility, categorized by reason; (e) the amount of and average debt stillremaining for accounts removed from the Repayment Plan or another repaymentplan as set forth by the utility; (f) the carrying costs of the debt for accountsparticipating in a repayment plan and any associated administrative costsincurred; (g) the number, total value, and average debt of accounts offset by thefunds provided in Item 479.10, paragraph B.2. of this act and local programs usingCoronavirus Relief Funds, categorized by days in arrears, customer account type,and Coronavirus Relief Fund type; and, (h) the cumulative level of customerarrearages by locality. The Commission on Local Government shall provide theChairs of the House Committees on Labor and Commerce and Appropriations, theSenate Committees on Commerce and Labor and Finance and Appropriations, andthe Secretary of Commerce and Trade an aggregated anonymized report by utilitycontaining such compiled information by December 31, 2020, within 90 days of theexpiration of the universal prohibition established in clause 7.a., and annually, onor before December 31st, thereafter for the following two years. The report due onDecember 31, 2020 shall cover the period from March 16, 2020 through December15, 2020. The report due within 90 days of the end of the universal prohibitionestablished in clause 7.a. shall cover the period from December 16, 2020 to the endof the universal prohibition established in clause 7.a. Annual reports shall coverthe period from the end of the universal prohibition established in clause 7.a. toDecember 16th of the year the report is due.6
