SCOPE OF COVERLiabilities under transportationlegislation in respect ofPASSENGERILLNESS OR INJURYRisks coveredLiabilities under governingtransportation legislation in respect of: Illness or death of or personalinjury sustained by the passenger. Loss of or damage to thepassenger’s property and fordelay in the carriage of thepassenger.Liabilities under the EU Directive inrespect of Repatriation of the passenger. Accommodation andmaintenance on shore followingsuch repatriation of thepassenger.The cover extends to pre andpost journey transportation, hotelaccommodation and shore-sideexcursions/activities prior to, duringor after the sea journey. The insuredevents need not arise in directconnection with the ship.4Important exclusions Passenger liabilities recoverableunder the P&I cover cannot beinsured under the tour operatorpassenger liability. The Insurer shall not cover refundof passenger money, substitutecruises, future cruise discounts orsimilar means of restitution.Limit of cover USD 10 million per event (higherlimits by special agreement).Who can be covered? Gard clients/Members withunderlying P&I cover.

CASE STUDIESInjury at inland hotel betweenferry crossingsA French passenger purchases apackage tour from a Paris travel agent.The tour includes ferry transportationfrom Denmark to Norway, one weekat a luxury hotel and a return seapassage to France via Denmark.Whilst at the hotel, the passengersustains a slip and fall injury whengetting into a jacuzzi. It is later foundthat the jacuzzis were in generallypoor condition. Instead of suing theowner of the Norwegian hotel, thepassenger sues his travel agent underthe French Package Tour Act. Theagent passes the claim on to the touroperator, who decides to settle quicklyto avoid mounting legal costs.5The Gard solutionThe Gard solutionThe liability did not arise from a directconnection with the operation ofthe ship and would fall outside thescope of P&I cover. However, touroperator insurance covers passengersbefore and after the sea journey, sowould respond to any legal liabilityin connection with the injury. Gardautomatically acquires the right ofrecourse against any third party, suchas the hotel in Norway.The client would need the touroperator cover to respond to liabilityfor those passengers waiting ashore(P&I cover would only respondto liability for passengers thathave already boarded the vessel).Tour operator cover would alsorespond to extra costs for additionalaccommodation (food expenses,lodging etc.) if the trip is cancelleddue to the hurricane.Extraordinary expenses dueto delayA package tour offered by the clientincludes flights and one night’saccommodation at the embarkationport. A hurricane delays thevessel’s arrival in port. The clientincurs expenses accommodatingpassengers for an extra hotelnight while waiting ashore, andrebooking flights for those whosedisembarkation is delayed.
