PrefaceThe Division of Industrial Accidents is charged withthe responsibility for the administration and enforcementof Chapter 152 of the General Laws.The statutory authorityfor the Division is Sections 14 to 24 of Chapter 23 of theGeneral Laws.The Division is placed within the ExecutiveOffice of Manpower Affairs by Section 17 of Chapter 6A ofthe General Laws.The Division is organized along functional lines toachieve optional use of staff expertise and resources.(SeeOrganization Chart)The Industrial Accident Board, an integral part of theDivision, is composed of twelve permanent members appointedfor twelve year terms.One member is designated by theGovernor as Chairman and serves co-terminous with the Governor.The primary functions of the Division are to enforce thecoverage provisions of Chapter 152 of the General Laws byensuring that all employers of one or more persons have, acontract of insurance or meet the statutory requirements forself-insurance; to keep records of injuries reported under thestatute; to approve agreements regarding compensation; and toadjudicate disputed claims arising from the provisions ofChapter 152.This Annual Report of the Division of Industrial Accidentsis published under the authority provided in Section 4 ofChapter 152 of the General Laws as amended.1

COMMENTARYDuring 1978 the Division continued to make progresstoward its goal of reducing the time intervals for conferencesand hearings.This progress was made even though for most ofthe year the Industrial Accident Board was operating withsubstantially less than a full complement of Commissioners.The Division has initiated the procurement of anelectronic data processing system to replace a manual systemand to establish more effective file management and control.Current plans are for a phased system development that willeffectively integrate all vital Division functions.Theobjective is to obviate the need for a significant increasein personnel while making substantial improvements inproductivity.The Division has refiled proposed legislation to makea comprehensive reorganization of the rehabilitation function.This bill was developed by a committee representing labor,employers, insurers, the Industrial Accident Board RehabilitationBoard and the Division.It represents a significant departurefrom the traditional approach and, if implemented, will greatlyfacilitate the return to work of a greater number of industriallyinjured persons while showing a decrease in overall workmen'scompensation costs.In association with the Workmen's Compensation Committeeof the Massachusetts Bar Association, the Division hascontinued the Hearings Conciliation Program although on aless frequent basis in recognition 'of the heavy time demandsplaced on participants. Also the Law Student Clinical Programprovides meaningful experience for the students and invaluableresearch assistance to the Industrial Accident Board.5
