Each School has its own Comprehensive Safety Plan whichoutlines our emergency response system and how we will respond to a variety of incidents.In the event of an emergency. Securing our students and staff is the first order of business.The District will maintain frequent communication with school staff, police and/or other local authorities.As soon as it is safe to do so, staff will begin parent notification and communication by either phone, email, or textmessages.Please be aware that, STUDENTS CAN ONLY BE RELEASED TO THOSE PEOPLE IDENTIFIED ON THEPUPIL'S EMERGENCY CONTACT CARD. Be sure the emergency contacts are up to date and that the school canreach you or your designee in the event of an emergency.PURPOSE OF ANNUAL PARENT RIGHTS AND RESPONSIBILITIESDue to evolving nature of the COVID-19 pandemic, federal, state, and local orders impacting district operations are subjectto change without notice.All students will be given equal educational opportunity regardless of their disability, gender, gender identity, genderexpression, nationality, race or ethnicity, religion, sexual orientation, or immigration status. (Equal Educational OpportunitiesAct; CSD Policy and Procedure 5145.3)California Education Code, Section 48980, requires school districts to give parents or guardians annual notice of certainrights and responsibilities, and of certain district programs listed below. As a parent or guardian, you are invited to requestadditional information regarding Cambrian School District policies related to these activities or programs, from the office ofyour child’s school of attendance.ATTENDANCE AND ABSENCESCambrian School District believes that regular attendance plays an important role in student achievement. The District shallwork with parents, guardians, and students to ensure their compliance with all state attendance laws and may useappropriate legal means to correct problems of chronic absence or truancy. Compulsory attendance is required in Californiafor pupils between age six and eighteen years of age and there are legal consequences if your child misses too muchschool. There are two types of absences from school: Excused and Unexcused. Cambrian uses an automated calling andemail system to notify parents of student absences.EXCUSED ABSENCES:(a) Notwithstanding Section 48200, a pupil shall be excused from school when the absence is: Due to the pupil’s illness, including an absence for the benefit of the pupil’s mental or behavioral health. Due to quarantine under the direction of a county or city health officer. For the purpose of having medical, dental, optometric, or chiropractic services rendered. For the purpose of attending the funeral services of a member of the pupil’s immediate family, so long as theabsence is not more than one day if the service is conducted in California and not more than three days if theservice is conducted outside California. For justifiable personal reasons, including, but not limited to, an appearance in court, attendance at a funeralservice, observance of a holiday or ceremony of the pupil’s religion, attendance at religious retreats, attendance atan employment conference, or attendance at an educational conference on the legislative or judicial process offeredby a nonprofit organization when the pupil’s absence is requested in writing by the parent or guardian and approvedby the principal or a designated representative pursuant to uniform standards established by the governing board. For the purpose of spending time with a member of the pupil’s immediate family who is an active duty member ofthe uniformed services, as defined in Section 49701, and has been called to duty for, is on leave from, or hasimmediately returned from, deployment to a combat zone or combat support position. Absences granted pursuantto this paragraph shall be granted for a period of time to be determined at the discretion of the superintendent ofthe school district. For the purpose of attending the pupil’s naturalization ceremony to become a United States citizen. For the purpose of participating in a cultural ceremony or event. Authorized at the discretion of a school administrator, as described in subdivision (c) of Section 48260.Page 4

Cambrian School District2022-23 Parent Rights and Responsibilities(b) A pupil absent from school under this section shall be allowed to complete all assignments and tests missed during theabsence that can be reasonably provided and, upon satisfactory completion within a reasonable period of time, shall begiven full credit therefore. The teacher of the class from which a pupil is absent shall determine which tests and assignmentsshall be reasonably equivalent to, but not necessarily identical to, the tests and assignments that the pupil missed duringthe absence.(c) For purposes of this section, attendance at religious retreats shall not exceed four hours per semester.(d) Absences pursuant to this section are deemed to be absences in computing average daily attendance and shall notgenerate state apportionment payments.(e) “Immediate family,” as used in this section, means the parent or guardian, brother or sister, grandparent, or any otherrelative living in the household of the pupil.(Education Code 48205; CSD Board Policy and Procedure 5113, 5113.1, 5114.4)ABSENCES FOR RELIGIOUS PURPOSES: Upon advance written parental or guardian request, a pupil may be excusedto participate in religious exercises or to receive moral and religious instruction at their respective places of worship or atother suitable place away from school property. (Education Code 46014; CSD Board Policy 5113)ABSENCES FOR SEXUAL HEALTH EDUCATION AND HIV PREVENTION EDUCATION: Upon written consent, a parentor guardian of a pupil has the right to excuse their child from all or part of comprehensive sexual health education, HIVprevention education, and assessments related to that education through a passive consent (“opt-out”) process. (EducationCode 51938(a))HOME, HOSPITAL AND RESIDENTIAL HEALTH FACILITY INSTRUCTION FOR STUDENTS WITH TEMPORARYDISABILITIES: It is the primary responsibility of the parent to notify the school district that their student has a temporarydisability. Students, whose temporary disability makes school attendance impossible or inadvisable, may receive individualinstruction. Either: at home, provided by the school district in which the student resides, or in a hospital, or other residentialhealth facility, excluding state hospitals, provided by the school district in which the hospital or residential health facility islocated. (Assembly Bill 2109; Education Code 48206.3 & 48208 (a))UNEXCUSED ABSENCE: An unexcused absence is when a pupil misses school for reasons not listed under excusedabsences. Parents shall be notified by their student’s school site in a timely manner, when their child is absent from schoolwithout permission. (Education Code 48205, 5110 (a)(f))EXCESSIVE ABSENTEE AND TRUANTS: A pupil who is absent from school without a valid excuse three full days in oneschool year, tardy, or absent for more than a 30-minute period during the school day without a valid excuse on threeoccasions in one school year, or any combination thereof, shall be classified as a truant and shall be reported to theattendance supervisor or to the superintendent of the school district. (Education Code 48260; CSD Board Policy andProcedure 5113.1)If a minor pupil in a school district of a county is a habitual truant, or is a chronic absentee, as defined in Section 60901, oris habitually insubordinate or disorderly during attendance at school, the pupil may be referred to a school attendance reviewboard (SARB), or to the probation department for services if the probation department has elected to receive these referrals.The school district supervisor of attendance, or any other persons the governing board of the school district or county maydesignate, making the referral shall provide documentation of the interventions undertaken at the school to the pupil, thepupil’s parents or guardians, the school attendance review board or probation department and shall notify the pupil andparents or guardians of the pupil, in writing, of the name and address of the school attendance review board or probationdepartment to which the matter has been referred and of the reason for the referral. The notice shall indicate that the pupiland parents or guardians of the pupil will be required, along with the referring person, to meet with the school attendancereview board or probation officer to consider a proper disposition of the referral. (Education Code 48263)ALTERNATIVE SCHOOLSCalifornia state law allows school districts, if they chose to establish and maintain one or more alternative schools withinthe district. Section 58500 of the Education Code defines alternative schools as a school or separate class group within aschool which is operated in a manner designed to: Maximize the opportunity for students to develop the positive values of self-reliance, initiative, kindness,spontaneity, resourcefulness, courage, creativity, responsibility, and joy.Recognize that the best learning takes place when students learn because they desire to learn.Page 5

This opportunity shall be a continuous and permanent process.Maximize the opportunity for the students, teachers, and parents, to react continuously to the changing world,including but not limited to the community in which the school is located.In the event any parent, pupil, or teacher is interested in further information concerning alternative schools, theadministrative office of this district has copies of the law available for your information. Parents and guardians are encouraged tospeak with the school principal to resolve concerns prior to speaking with the District Office. (CSD Board Policy 1312)WILLIAMS ACT: Focuses on any deficiencies related to instructional materials, emergency or urgent facilities conditionsthat pose a threat to the health and safety of pupils, and teacher vacancy or misassignment. (EducationCode 35186; CSD Board Policy and Procedure 1312.2; 1312.4) There is to be sufficient standards-aligned textbooks, instructional materials, state-adopted, district-adopted textbooksor other required instructional material to use in class or at home for each student including English learners.There should be a teacher assigned to each class and not a series of substitutes or other temporary teachers. Theteacher should have the proper credential and subject matter training to teach the class, including training to teachEnglish Learners if present.School facilities must be clean, safe, and maintained in good repair. Good repair means that the facility is maintainedin a manner that assures that it is clean, safe and functional as determined by the Office of Public School Construction.COMPLAINTS ABOUT SCHOOL EMPLOYEES: To promote prompt and fair resolution every effort should be made toresolve a concern at the earliest possible stage. Complaints concerning school personnel should be made directly by thecomplainant to the person against whom the compliant is lodged. If the complaint is not resolved at this level, thecomplainant is requested to put the complaint into writing and to direct it to the employee’s administrative supervisor, orprincipal. The parent of a pupil suspended by a principal may be required to attend aportion of a school day in his/her child’s class. A copy of the school’s pupil suspension and expulsion rules can be obtainedat your school site. (Education Code 48900; CSD Board Policies and Procedures 5144.1)INTERVIEWS AND RELEASE OF STUDENT TO PEACE OFFICER: Cambrian School District will collaborate with locallaw enforcement agencies to carry out their duties on school campus, including, when necessary, the questioning and/orapprehension of students. (Education Code 48906; CSD Board Policy and Procedure 5141.11)PARENTAL FINANCIAL RESPONSIBILITY: Parents or guardians are financially reliable for all the damages caused bythe willful misconduct of their minor children, which result in death or injury to other students, school personnel, or schoolproperty. This same liability will prevail when the damage or loss was not intentional and resulted from other negative orinappropriate behavior not acceptable on District property. The parent or guardian of a minor/student shall be liable to theschool district for all property belonging to the district loaned to the minor and not returned upon demand of an employee ofthe district authorized to make that demand. (Education Code 48904; CSD Board Policy and Procedure 3260)PERSONAL PROPERTY: The district is not responsible for personal property. Students are discouraged from bringing noninstructional items to school such as cell phones, computers, skate boards, etc.POSITIVE SCHOOL CLIMATE: Cambrian School District desires to enhance student learning by providing an orderly,caring, and nurturing educational and social environment in which all students can feel safe and take pride in their schooland their achievements. (CSD Board Policy 5137)BULLYING AND HARASSMENT: The Cambrian School District recognizes the harmful effects of discrimination,harassment, intimidation, and bullying on student learning, attendance, and desires to provide safe school environmentsthat protect students from physical and emotional harm. No individual or group shall, through physical, written, verbal, orother means, harass, sexually harass, threaten, intimidate, retaliate, cyberbully, cause bodily injury to, or commit hateviolence against any student or school personnel.
