She alsocollaborates with the Boardto oversee the investigation ofnurses and others in violationof the Kansas Nurse PracticeAct. She was a registered nurseat Stormont Vail Health for 10years, including while earningher law degree at Washburn.Her law career includes workin her own private practice,an associate attorney and anassistant attorney general.She is a guest lecturer for theWashburn School of Nursingand was an adjunct professorin the criminal justice andlegal studies program. Dianehas been a dedicated nursingregulator. Diane retired onDecember 14, 2018 from herrole as Practice Specialist. TheKansas State Board of Nursingextends their congratulationsand deep appreciation for herloyal service for more than 27years to the Kansas State Boardof Nursing and the citizens ofKansas. The minutes from June 12, 2018 were approved.The site visit report from Salina Area Technical College (SATC) ADN Programwas reviewed. It was moved to accept the site visit report for SATC ADN programwith recommendations and to approve the program to admit up to 32 studentseach academic year beginning in August 2019 with a site visit to occur after thefirst graduation.The following schools presented major curriculum changes: Highland Community College ADN Program (3) Rasmussen College ADN and BSN Programs Baker University BSN Program Kansas Practical Nurse Core EducatorsFlint Hills Technical College requests the approval of an ADN program. It wasmoved to accept the request from Flint Hills Technical College to offer a ADNprogram with a site visit to occur before approval is given to admit students.MidAmerica Nazarene University requested approval for an Adult GerontologyPrimary Care NP Program. It was moved to accept the request from MidAmericaNazarene University to offer an Adult Gerontology Primary Care NP program witha site visit to occur before approval is given to admit students.Annual Report was reviewed. It was moved to reapprove the PN, ADN, andBSN programs on full approval status through December 2019. It was moved toreapprove the graduate nursing programs through December 2020. It was movedto reapprove the conditional approval status of Pratt Community College ADNProgram and Kansas Wesleyan University BSN Program through December 2019.There will be four scholarships in the amount of 1000.00 each given as inprevious years. The Education Committee by consensus agreed to change theessay topic to “What Does Professionalism in Nursing Mean to You.”A letter of intent was received from Larned State Hospital to have a MentalHealth Technician program. Their next step would be to submit an applicationfor a Mental Health Technician Program. Also shared was a letter from BartonCommunity College dissolving their Mental Health Technician program partnershipwith Larned State Hospital.Site visit schedules for 2018 and 2019 were reviewed. Carol Moreland willemail committee members requesting assistance with site visits, if needed.An update on the Military Initiative was given. A discussion had been held inJuly regarding the Military Articulation model and where we would like to go inthe State of Kansas as it relates to Nursing Education in supporting Veterans whowant to seek nursing education opportunities after they leave armed services. Theconsensus of the Education Committee is to bring forward at the December 2018Education Committee, data from nursing programs who want to bring military inand how that will impact their numbers.Twelve petitions for permission to test/retest were reviewed and action taken.There was discussion about the possibility of putting a deadline on petitionersthat have met the conditions to test or retest and when they should test onceconditions have been met. The consensus was that data should be brought backto the December 2018 meeting with statistics on petitioners and when, afterconditions are met, they actually test and if they were successful.The meeting was adjourned at 10:20 am.September 2018 APRN CommitteeThe APRN Committee was called to order by Carol Bragdon, PhD, APRN, Chairon September 11, 2018 at 1:30 pm in Room 509 of the Landon State OfficeBuilding. Minutes from June 12, 2018 were approved.Carol Bragdon presented Cara Busenhart, PhD, CNM, APRN with a certificateof appreciation for her time served on the APRN Committee.Bobbe Mansfield, DNP, FNP-BC reported on the Prescription MonitoringProgram Committee. Funding continues to be an issue as PMP is the wave ofthe future nationwide. There has been discussion on creating data that wouldbe meaningful for guiding practice on three levels: 1) recognizing patients whomay be having outlining behavior and what to do about it; 2) prescribers whomay be performing outside of guidelines; 3) media impact with reality and hypeconcerning the opioid epidemic. Committee meetings have included a KBIrepresentative to discuss what to do if a patient is referred.Cara Busenhart, PhD, CNM, APRN reported on the Nurse Midwife Council. Itwas decided that Tucker, Poling, General Counsel, Kansas State Board of HealingArts, would bring the BOHA CNM-I Regulations to the APRN Committee and thefull Board for approval. The consensus of the APRN Committee is to conduct aroll call vote of the BOHA CNM-I Regulations at the September 12, 2018 Boardmeeting.It was moved to approve the following out of state schools and their coursesas meeting the board’s criteria:Binghamton University – Community Health NPLouisiana State University Health Sciences Center at New Orleans - RNASpring Arbor University – Family NPMichelle Knowles, APRN, RN gave an update on the Kansas Advanced PracticeNurses (KAPN) organization. After working with AANP (American Association ofNurse Practitioners) and NCSBN (National Council of State Boards of Nursing) andtheir recommendations on language they plan to develop a bill for 2019. Theyhave been working on putting in a working description or definition of whatan APRN role is, based on the APRN Consensus Model, how to require nationalcertification and malpractice and removal of written protocol authorization by aresponsible physician language.The meeting was adjourned at 2:36 pm.Practice CommitteeThe September 2018 Practice IV Therapy Advisory Committee was called toorder at 3:00 p.m. in room 1051 of the Landon State Office Building in Topeka byM. Struble, Chair. A plaque was presented to Julie Putnam for her contributionsto the Committee. The minutes from the June 2018 meeting were approvedwithout corrections.The Committee discussed that the Pharmacy Board is reviewing regulationsas they relate to School Nurse and Epi Kits. The Committee will await moreinformation.The Committee approved KAR 60-7-110 and KAR 60-7-111 without revision.The Committee reviewed a report on IV Therapy programs.The meeting was adjourned at 4:00 p.m.

March, April, May 2019Kansas Nursing Newsletter Page 3Frequently Asked Questions about the Nurse Licensure Compact1.How can I get a multistate nursinglicense?Kansas implements the Nurse LicensureCompact (NLC) on July 1, 2019. You will notbe able to get a multistate nursing license inKansas before that date. Nurses that reside inKansas can obtain a multistate nursing license7/1/19 and after by submitting an applicationfor a multistate nursing license, pay the fee, andsubmit the supporting documentation. Therewill be communication sent to each nurse with aKansas nursing license that lives in Kansas withthe specific information about the applicationprocess. You must obtain your multistate nursinglicense within the state in which you reside.2. Why would a nurse need a multistate license?Nurses are required to be licensed in the state where the recipient of nursing practiceis located at the time service is provided. A multistate license allows the nurse to practicein the home state and all compact states with one license issued by the home state. Thiseliminates the burdensome, costly, and time-consuming process of obtaining single statelicenses in each state of practice.3. What is the difference between a compact license and a multistate license?There is no difference between a compact license and a multistate license. Thisterminology is used interchangeably to reference the Nurse Licensure Compact (NLC)license that allows a nurse to have one license, with the ability to practice in all NLCcompact states.4. What does Primary State of Residence (PSOR) mean?For compact purposes, PSOR is not related to property ownership in a given state. It isabout your legal residence status. Everyone has legal documents such as a driver’s license,voter’s card, federal income tax return, military form no. 2058, or W2 form from the PSOR.If a nurse’s PSOR is a compact state, that nurse may be eligible for a multistate (compact)license. If a nurse cannot declare a compact state as his/her PSOR, that nurse is not eligiblefor a compact license. That nurse may apply for a single state license in any state wherethey wish to practice.5.I am graduating from a nursing program. Can I take the NCLEX in adifferent state?The NCLEX is a national exam and can be taken in any state convenient to you. It is nota state exam. The results will be directed to the board of nursing where you applied foryour authorization to test (ATT) and licensure. If you are applying to a compact state for a multistate license, you should apply inthe state where you intend to legally reside If you are applying for a license in a noncompact state, you should apply for alicense in the state where you intend to practice6.I have a compact license and have accepted a temporary assignment inanother compact state. My employer is telling me that I need to get thatstate’s license. Is this true?When hired in a remote state for a temporary position or commuting to a remote statefrom the primary state of residence (PSOR), employers should not require you to apply forlicensure in the remote state when you have lawfully declared another state as your PSOR.PSOR is based on where you pay federal income tax, vote and/or hold a driver’s license.The remote state board of nursing cannot issue a license to a nurse who has declaredanother compact state as the PSOR, since the multistate license from the home stateapplies to both states. You have the privilege to practice in any remote compact state withyour multistate license issued by your home state.7. How does the NLC pertain to advanced practice registered nurses (APRNs)?The NLC pertains to registered nurses and licensed practical/vocational nurses’ licensesonly. An APRN must hold an individual state license in each state of APRN practice.8. I have a compact license. How long can I work in another compact state?There is no time limit. If you maintain legal residence in the state that issued yourmultistate license and you remain in good standing, you may practice in other compactstate. If you were to take an action (while practicing in another NLC state or otherwise)which would change your legal residency status, then you have given up legal residencyin that home state and you must now apply for license by endorsement in the new stateof residence. The new license issued will replace the former license.9.I live in a compact state where I have a multistate license. How do I get alicense in a noncompact state?Apply for licensure by endorsement to the board of nursing in the state where youseek a license. You may be issued a single state license valid only in the state of issuance.Applications can be found on that board of nursing’s website.10. What if I move to another compact state?When permanently relocating to another compact state, apply for licensure byendorsement and complete the Declaration of Primary State of Residence form within theapplication, which can be found on your board of nursing’s website. You may start theapplication process prior to or after the move. You should not delay applying once youhave moved. There is no grace period. If you are moving from a compact state, you may not wait until your formermultistate license expires before applying in your new state of legal residence. Youcan only practice on your former home state license until the multistate license inthe new NLC home state is issued. If you are moving from a noncompact state applying to a compact state in advanceof the move, you may be issued a single state license, or your application may beheld until you move and have proof of legal residence at which time you may beissued a multistate license.There will be more communication in the coming weeks and months as we get closerto July 1, 2019. Odor of alcohol on breath or the excessive use ofbreath-fresheners or perfume to disguise the odorof alcohol.What is KNAP?KNAP is a professional assistance program designed toassist all nurses and mental health technicians who have aproblem or illness that has or could impair their ability topractice safely.The Goal of KNAPMental and physical illness, including alcohol and otherdrug addiction, can potentially impair practice and health.We estimate that at any given time, approximately 10%of the population is affected. This same percentage isthought to be true of healthcare professionals.Alcohol and other drug addiction, as well as mentaland physical illnesses, are treatable. KNAP works with theprogram participants to obtain an evaluation, treatment(if indicated), and monitoring throughout the recoveryprocess.ReferralsSelf-referrals to the program are encouraged, butreferrals may be made by a family member, a friend,employer or anyone concerned about the nurse/LMHT.Anonymous referrals are not accepted. A person maycall for information or advice without giving their name,however.
