Stanislaus County District Attorney's Office Bureau of InvestigationPolicy ManualCHIEF’S PREFACEIt is the mission of the Bureau of Investigation to maintain professional and effective workingrelationships with all law enforcement agencies and promote efficiency and trust within ourcommunity; working together to drive down crime, serving victims of crime and shaping the qualityof life in Stanislaus County.Policing involves a special trust given to us by the public to uphold and enforce the law. Asservants of the public, policing entails and requires us to do the right thing all the time, everytime. This manual cannot predict every aspect of policing, nor can it reasonably anticipate allthe potential situations that might be encountered by employees of this Bureau. This manualdoes establish a framework of rules, guidelines and performance expectations for all Bureaumembers. Each employee is equally important and plays an essential role in our effort to partnerwith the community and our law enforcement neighbors. As a Criminal Investigator for the DistrictAttorney, all employees will work cooperatively with members of this Office, our law enforcementpartners and the community. Collectively we will work together seeking justice, serving justiceand doing justice.All bureau members are required to familiarize themselves with the directives in this manual andwhen necessary, seek guidance and clarification from a supervisor. If there is a question of theinterpretation of this manual, that interpretation rests with the Chief Investigator. This manualwill be updated as necessary to reflect changes in the law, personnel responsibilities and Bureaugoals. As the Chief Investigator, I am most proud of our Office and every member of our Bureau.Every day our employees act with professionalism and dedication that often goes unnoticed. Policy100Stanislaus County District Attorney'sOffice Bureau of InvestigationPolicy ManualLaw Enforcement Code of Ethics100.1 PURPOSE AND SCOPEThe purpose of this policy is to ensure that all peace officers are aware of their individualresponsibilities to maintain their integrity and that of their bureau at all times.100.2 POLICYThe Law Enforcement Code of Ethics shall be administered to all peace officer trainees duringthe Basic Academy course and to all other persons at the time of appointment (11 CCR 1013).100.3 LAW ENFORCEMENT CODE OF ETHICSAS A LAW ENFORCEMENT OFFICER, my fundamental duty is to serve; to safeguard lives andproperty; to protect the innocent against deception, the weak against oppression or intimidation,and the peaceful against abuse or disorder; and to respect the constitutional rights of all to liberty,equality and justice.I WILL keep my private life unsullied as an example to all; maintain courageous calm in the face ofdanger, scorn, or ridicule; develop self-restraint; and be constantly mindful of the welfare of others.Honest in thought and deed in both my personal and official life, I will be exemplary in obeyingthe laws of the land and the regulations of my bureau. Whatever I see or hear of a confidentialnature or that is confided to me in my official capacity will be kept ever secret unless revelationis necessary in the performance of my duty.I WILL never act officiously or permit personal feelings, prejudices, animosities or friendships toinfluence my decisions. Policy101Stanislaus County District Attorney'sOffice Bureau of InvestigationPolicy ManualLaw Enforcement Authority101.1 PURPOSE AND SCOPEThe purpose of this policy is to affirm the authority of the members of the Stanislaus County DistrictAttorney's Office Bureau of Investigation to perform their functions based on established legalauthority.101.2 POLICYIt is the policy of the Stanislaus County District Attorney's Office Bureau of Investigation to limit itsmembers to only exercise the authority granted to them by law.While this bureau recognizes the power of peace officers to make arrests and take otherenforcement action, investigators are encouraged to use sound discretion in the enforcement ofthe law. This bureau does not tolerate the abuse of law enforcement authority.101.3 PEACE OFFICER POWERSSworn members of this bureau are authorized to exercise peace officer powers pursuant toapplicable state law (Penal Code § 830.1 et seq.).101.3.1 ARREST AUTHORITY INSIDE THE JURISDICTION OF THE STANISLAUS COUNTYDISTRICT ATTORNEY'S OFFICE BUREAU OF INVESTIGATIONThe arrest authority within the jurisdiction of the Stanislaus County District Attorney's Office Bureauof Investigation includes (Penal Code § 830.1; Penal Code § 836):(a)When the investigator has probable cause to believe the person has committed afelony, whether or not committed in the presence of the investigator.(b)When the investigator has probable cause to believe the person has committed amisdemeanor in this jurisdiction and in the presence of the investigator.(c)When the investigator has probable cause to believe the person has committed apublic offense outside this jurisdiction, in the presence of the investigator and theinvestigator reasonably believes there is an immediate danger to person or property,or of escape.(d)When the investigator has probable cause to believe the person has committed amisdemeanor for which an arrest is authorized or required by statute even though theoffense has not been committed in the presence of the investigator such as certaindomestic violence offenses.(e)In compliance with an arrest warrant.101.3.2 ARREST AUTHORITY OUTSIDE THE JURISDICTION OF THE STANISLAUSCOUNTY DISTRICT ATTORNEY'S OFFICE BUREAU OF INVESTIGATIONThe arrest authority outside the jurisdiction of the Stanislaus County District Attorney's OfficeBureau of Investigation includes (Penal Code § 830.1; Penal Code § 836):(a)When the investigator has probable cause to believe the person committed a felony.Copyright Lexipol, LLC 2022/05/09, All Rights Reserved.Published with permission by Stanislaus County DistrictAttorney's Office Bureau of InvestigationLaw Enforcement Authority - 8

Stanislaus County District Attorney's Office Bureau of InvestigationPolicy ManualLaw Enforcement Authority(b)When the investigator has probable cause to believe the person has committed amisdemeanor in the presence of the investigator and the investigator reasonablybelieves there is immediate danger to person or property or of escape.(c)When the investigator has probable cause to believe the person has committed amisdemeanor for which an arrest is authorized even if not committed in the presenceof the investigator such as certain domestic violence offenses and there is immediatedanger to person or property or of escape or the arrest is mandated by statute.(d)When authorized by a cross jurisdictional agreement with the jurisdiction in which thearrest is made.(e)In compliance with an arrest warrant.On-duty arrests will not generally be made outside the jurisdiction of this bureau except in casesof hot or fresh pursuit, while following up on crimes committed within the County, or while assistinganother agency.On-duty investigators who discover criminal activity outside the jurisdiction of the County shouldwhen circumstances permit, consider contacting the agency having primary jurisdiction beforeattempting an arrest.101.3.3 DELIVERY TO NEAREST MAGISTRATEWhen an investigator makes an arrest pursuant to a warrant with bail set, and the warrant wasissued in a county other than where the person was arrested, the investigator shall inform theperson in writing of the right to be taken before a magistrate in the county where the arrest occurred(Penal Code § 821; Penal Code § 822).101.3.4 TIME OF MISDEMEANOR ARRESTSInvestigators shall not arrest a person for a misdemeanor between the hours of 10:00 p.m. of anyday and 6:00 a.m. of the next day unless (Penal Code § 840):(a)The arrest is made without a warrant pursuant to Penal Code § 836 which includes:1.A misdemeanor committed in the presence of the investigator.2.Misdemeanor domestic violence offenses (See the Domestic Violence Policy).(b)The arrest is made in a public place.(c)The arrest is made with the person in custody pursuant to another lawful arrest.(d)The arrest is made pursuant to a warrant which, for good cause shown, directs that itmay be served at any time of the day or night.101.3.5 OREGON AUTHORITYSworn members of this bureau who enter the state of Oregon in order to provide or attempt toprovide law enforcement assistance have Oregon peace officer authority within 50 miles from theCalifornia-Oregon border (ORS 133.405). Stanislaus County District Attorney's Office Bureau of InvestigationPolicy ManualLaw Enforcement Authority(a)In response to a request for law enforcement assistance initiated by an Oregon sheriff,constable, marshal, municipal police officer or member of the Oregon State Police.(b)In response to a reasonable belief that emergency law enforcement assistance isnecessary to preserve life, and circumstances make it impractical for Oregon lawenforcement officials to formally request assistance.(c)For the purpose of assisting Oregon law enforcement officials with emergencyassistance in response to criminal activity, traffic accidents, emergency incidentsor other similar public safety situations, regardless of whether an Oregon lawenforcement official is present at the scene of the incident.Stanislaus County District Attorney's Office Bureau of Investigation investigators have no authorityto enforce Oregon traffic or motor vehicle laws.Whenever practicable, investigators should seek permission from a bureau supervisor beforeentering Oregon to provide law enforcement services. As soon as practicable, investigatorsexercising law enforcement authority in Oregon shall submit any appropriate written reportsconcerning the incident to the Oregon agency having primary jurisdiction over the area in whichthe incident occurred.101.4 INTERSTATE PEACE OFFICER POWERSPeace officer powers may be extended to other states:(a)As applicable under interstate compacts, memorandums of understanding or mutualaid agreements in compliance with the laws of each state.(b)When an investigator enters an adjoining state in close or fresh pursuit of a personbelieved to have committed a felony (ARS § 13-3832; NRS 171.158; ORS 133.430).The person arrested out of state must be taken without unnecessary delay before a magistrate ofthe county in which the arrest was made (ARS § 13-3833; NRS 171.158; ORS 133.440).101.5 CONSTITUTIONAL REQUIREMENTSAll members shall observe and comply with every person’s clearly established rights under theUnited States and California Constitutions.Copyright Lexipol, LLC 2022/05/09, All Rights Reserved.Published with permission by Stanislaus County DistrictAttorney's Office Bureau of InvestigationLaw Enforcement Authority - 10

Policy103Stanislaus County District Attorney'sOffice Bureau of InvestigationPolicy ManualOath of Office103.1 PURPOSE AND SCOPEThe purpose of this policy is to ensure that oaths, when appropriate, are administered to bureaumembers.103.2 POLICYIt is the policy of the Stanislaus County District Attorney's Office Bureau of Investigation that, whenappropriate, bureau members affirm the oath of their office as an expression of commitment tothe constitutional rights of those served by the Bureau and the dedication of its members to theirduties.103.3 OATH OF OFFICEAll bureau members, when appropriate, shall take and subscribe to the oaths or affirmationsapplicable to their positions. All sworn members shall be required to affirm the oath of officeexpressing commitment and intent to respect constitutional rights in discharging the duties of alaw enforcement officer (Cal. Const. Art. 20, § 3; Government Code § 3102). The oath shall beas follows:“I, (employee name), do solemnly swear (or affirm) that I will support and defend the Constitutionof the United States and the Constitution of the State of California against all enemies, foreignand domestic; that I will bear true faith and allegiance to the Constitution of the United Statesand the Constitution of the State of California; that I take this obligation freely, without any mentalreservation or purpose of evasion; and that I will well and faithfully discharge the duties uponwhich I am about to enter.”103.4 MAINTENANCE OF RECORDSThe oath of office shall be filed as prescribed by law (Government Code § 3105).Copyright Lexipol, LLC 2022/05/09, All Rights Reserved.Published with permission by Stanislaus County DistrictAttorney's Office Bureau of InvestigationOath of Office - 12

Policy104Stanislaus County District Attorney'sOffice Bureau of InvestigationPolicy ManualPolicy Manual104.1 PURPOSE AND SCOPEThe manual of the Stanislaus County District Attorney's Office Bureau of Investigation is herebyestablished and shall be referred to as the Policy Manual or the manual. The manual is a statementof the current policies, rules and guidelines of this bureau. All members are to conform to theprovisions of this manual.All prior and existing manuals, orders and regulations that are in conflict with this manual arerescinded, except to the extent that portions of existing manuals, procedures, orders and otherregulations that have not been included herein shall remain in effect, provided that they do notconflict with the provisions of this manual.104.2 POLICYExcept where otherwise expressly stated, the provisions of this manual shall be consideredas guidelines. It is recognized that the work of law enforcement is not always predictable andcircumstances may arise which warrant departure from these guidelines. It is the intent of thismanual to be viewed from an objective standard, taking into consideration the sound discretionentrusted to members of this bureau under the circumstances reasonably available at the timeof any incident.104.2.1 DISCLAIMERThe provisions contained in the Policy Manual are not intended to create an employment contractnor any employment rights or entitlements. The policies contained within this manual are for theinternal use of the Stanislaus County District Attorney's Office Bureau of Investigation and shallnot be construed to create a higher standard or duty of care for civil or criminal liability againstthe County, its officials or members. Violations of any provision of any policy contained withinthis manual shall only form the basis for bureau administrative action, training or discipline. TheStanislaus County District Attorney's Office Bureau of Investigation reserves the right to reviseany policy content, in whole or in part.104.3 AUTHORITYThe Chief of Investigations shall be considered the ultimate authority for the content and adoptionof the provisions of this manual and shall ensure compliance with all applicable federal, stateand local laws. The Chief of Investigations or the authorized designee is authorized to issueInterim Directives, which shall modify those provisions of the manual to which they pertain.
