IntroductionThis is Your travel insurance policy. It contains details of cover,conditions and exclusions relating to each Insured Person and is thebasis on which all claims will be settled. It is validated by the issue ofthe numbered Schedule which must be attached to the policy.In return for having accepted Your premium, We will, in the eventof Bodily Injury, death, illness, disease, loss, theft, damage or otherevents happening within the Period of Insurance provide insurancein accordance with the operative sections of Your policy as referred toin Your Schedule.The Schedule and any endorsements are all part of the policy.The information You have supplied forms part of the contract ofinsurance with Us. Your policy is evidence of that contract.Help linesIt is recommended that You keep this policy in a safe place and thatYou carry it with You when You travel. Your Schedule containsimportant medical emergency contact numbers.EligibilityThis policy is only available to You if You have been a Maltese Resident for a least 6 months; and are not aged 81 years or over.at the time of purchasing Your policy.The Law applicable to this contractThis contract of insurance shall for all effects and purposes be deemedto be a Maltese contract and shall be governed by and accordingto Maltese law. Without prejudice to any arbitration proceedings inMalta under current statutory provisions, this policy is subject to theexclusive jurisdiction of the Maltese courts.The indemnity provided in this policy shall apply only to judgements,orders or awards that are delivered by or obtained from a court withinMalta or within the Geographical Area shown in the Schedule or inarbitration in Malta under Maltese statutory provisions.Furthermore the indemnity shall not apply to:- a judgement, order or award obtained in Malta for the enforcementof a judgement or arbitration award obtained elsewhere except inthe Geographical Area noted in the Schedule or- to costs and expenses of litigation recovered by any claimant fromYou which costs and expenses of litigation are not incurred inMalta or in the Geographical Area noted in the Schedule.Policy information or adviceIf You would like more information or if You feel the insurance may notmeet Your needs, phone Our office on 356 2343 5363.AtlasTravelPakPolicy1

Each person must be a Maltese Resident as at theDate of Issue of the Schedule.We/Us/Ourmeans Atlas Insurance PCC Limited 48-50 Ta’ Xbiex Seafront Ta’ XbiexXBX1021 Malta.Abandonment/Abandonmeans either:1. You cutting short the Trip after You leave Your Home bydirect early return to Your Home: or2. You attending a hospital after You leave Your Home asan in-patient or being confined to Your accommodationdue to compulsory quarantine on the orders of a MedicalPractitioner, in either case for more than 24 hours.Claims will be calculated on the number of nights of Your Trip Youmissed due to Your early return or the number of nights which Youwere hospitalised, quarantined or confimed to Your accommodation.Claims under part 2, above, will only be paid for the ill/injured/quarantined/confined Insured Person, but where We or Our IEAPagree for another Insured Person (including any children travellingwith them) to stay with You, We will also pay for the Insured Person’sproportion only of any unused travel and accommodation costs andexpenses they have not used by remaining with You.Accompanying Personmeans a person with whom You are travelling or have arranged totravel with and without whom the Trip cannot commence or continueexcluding a tour or group leader.Baggagemeans luggage, clothing, personal effects, Valuables and otherarticles which belong to You (or for which You are legally responsible)worn, used or carried by You during the Trip.Baggage includes articles purchased during the Trip but excludesPersonal Money and Ski Equipment.Bodily Injurymeans an identifiable accidental bodily injury caused solely anddirectly by sudden, unexpected, violent, external and visible means.This definition includes: unavoidable exposure to the elements; accidental drowning, gassing, poisoning or electrocution; accidental bodily injury sustained whilst lawfully arresting,detaining or attempting to arrest or detain a criminal orsuspected criminal.AtlasTravelPakPolicy3

Close Business Associatemeans any person whose absence from business for one or morecomplete days at the same time as Your absence prevents the propercontinuation of that business. A director or senior manager of Yourbusiness must agree with this.Family Covermeans up to two adults and any number of their children, step childrenor foster children aged under 16, accompanying the parents or legalguardian insured on the same policy travelling on any Trip to the samedestination.Close Relativemeans mother, father, sister, brother, wife, husband, daughter, son,grandparent, grandchild, parent-in-law, son-in-law, daughter-in-law,sister-in-law, brother-in-law, step parent, step child, step sister, stepbrother, foster child, aunt, uncle, cousin, nephew, niece, legal guardian,partner (who lives with You) or fiancé/fiancée.Full Valuemeans the current cost as new less an appropriate deduction for wear,tear and depreciation.Communicable Diseasemeans any disease which can be transmitted by means of anysubstance or agent from any organism to another organism where: the substance or agent includes, but is not limited to, a virus,bacterium, parasite or other organism or any variation thereof,whether deemed living or not, and the method of transmission, whether direct or indirect, includesbut is not limited to airborne transmission, bodily fluidtransmission, transmission from or to any surface or object, solid,liquid or gas or between organisms, and the disease, substance or agent can cause or threaten bodilyinjury, illness, emotional distress or damage to human health orhuman welfare or can cause or threaten damage to, deteriorationof, loss of value of, marketability of or loss of use of property.Coronavirusmeans the virus officially known as “severe acute respiratory syndromecoronavirus 2 (SARS-CoV-2) and/or any related illness including“COVID-19” (previously known as “2019 novel coronavirus”) diseaseand/or any mutant derivatives or variations thereof however caused.Direct Journeymeans travel between Malta and a pre-booked destination overseasand vice versa including scheduled stops for refuelling and changeof connection which involves the same mode of transport and whentime spent at the stop is less than 12 hours.Electronicsmeans cameras, camcorders, photographic, audio, video, computer,television and telecommunications equipment (including CD’s,DVD’s, tapes, films, cassettes, cartridges, headphones, personalorganisers, tablets, laptops and mobile phones and their relatedaccessories), computer games and associated equipment.Excessmeans the amount that You will have to pay towards any claim. Thisapplies to each claim per Insured Person per section, if applicable.However, if Family Cover, the amount of the Excess applicable tosuch section shall be limited to two times the Excess regardless ofthe number of Insured Persons claiming. If You pay the additionalpremium due in respect of an Excess Waiver all excesses applicableunder this policy shall be waived. Your Schedule will show you if anExcess Waiver applies.4AtlasTravelPakPolicyGeographical Areameans the area defined in the Schedule. Cover under this policyapplies only to travel within the geographical area noted in theSchedule.Homemeans Your normal place of residence in Malta.Loss of Limbmeans loss by permanent severance of an entire hand or foot or thetotal and permanent loss of use of an entire hand or foot.Loss of Sightmeans total and irrecoverable loss of sight.Malta/Maltesemeans the islands of Malta, Gozo and Comino.Medical Conditionmeans any disease, illness or injury.Medical Practitionermeans a registered practising member of the medical profession whois not related to You or to any Accompanying Person.Maltese Residentmeans a person whose main place of residence is in Malta.Pandemic and Epidemicmeans pandemic or epidemic declared as such by the World HealthOrganisation or any governmental authority.Period of Insurancemeans the period of the Trip and terminating upon its completion, butnot in any case exceeding the period shown in the Schedule.In respect of cancellation cover provided by Section A - Cancellation orAbandonment Charges, cover shall be operative from the Date of Issueof the Schedule or 12 calendar months prior to the start of the Tripwhichever is the later.For all other sections of the policy, the insurance commences whenYou leave Your Home or Your place of business in Malta (whicheveris the later) to commence the Trip and terminates at the time of Yourreturn to Your Home or place of business in Malta (whichever is theearlier) on completion of the Trip.AtlasTravelPakPolicy5

The Period of Insurance is automatically extended for the period ofthe delay up to a maximum of thirty days in the event that Your returnto Malta is unavoidably delayed due to an event insured by this policy.This extension is provided without additional premium being charged.Permanent Total Disablementmeans disablement that entirely prevents You from carrying outYour usual occupation (or other suited occupation for which You arequalified by knowledge, training, education, ability and experience),continues for 52 weeks and, upon expiry of this period, is beyond hopeof improvement.Personal Moneymeans bank notes, currency notes and coins in current use, travellers’and other cheques, postal or money orders, pre-paid coupons orvouchers, travel tickets (excluding lift passes), passport, event andentertainment tickets, phone cards and credit/debit or charge cards allheld for private purposes.Pre-existing Medical Conditionmeans any Medical Condition You have, or have had,a) for which You are taking or have been taking prescribedmedication within the last 12 months; orb) for which You are waiting to receive, or have receivedtreatment (including surgery, tests or investigations) withinthe last 12 months.Public Transportmeans any publicly licensed aircraft, sea vessel, train or coach on whichYou are booked to travel.Schedulemeans the validation page attached to this travel policy setting outthe names of those persons insured (You/Your/Insured Person), theGeographical Area, the Period of Insurance, the policy number, theCover Option applicable, details of any optional Extension Sectionschosen and any special conditions and terms. The Schedule isvalidated by Us.Secure Baggage Areameans any of the following, as and where appropriate: the locked dashboard, boot or luggage compartment of amotor vehicle; the locked luggage compartment of a hatchback vehiclefitted with a lid closing off the luggage area, or of an estatecar with a fitted and engaged tray or roller blind cover behindthe rear seats; the fixed storage units of a locked motorised or towedcaravan; or a locked luggage box, attached to a roof rack which is itselfattached to the vehicle roof.6AtlasTravelPakPolicySpousemeans Your legally recognised husband or wife provided the partiesare not legally separated or divorced.Service Cancellationmeans the cancellation of a marine or flight service which You arebooked to utilise as a result of adverse weather conditions, flood,earthquake, volcanic eruption and/or volcanic ash clouds, tsunami orlandslide.Ski-Equipmentmeans skis (including bindings), ski boots, ski poles and snowboards.Ski-packmeans ski school fees, lift passes and the cost of hired Ski Equipment.Terrorismmeans an act, including but not limited to the use of force or violenceand/or the threat thereof, of any person or group(s) of persons, whetheracting alone on or behalf of or in connection with any organisation(s)or government(s), committed for political, religious, ideological orsimilar purposes including the intention to influence any governmentand/or to put the public, or any section of the public in fear.Tripmeans any conventional pleasure trip or business trip of a commercialnature (excluding manual work) made by You within the GeographicalArea shown in the Schedule which begins and ends in Malta duringthe Period of Insurance but excluding one way trips or journeys.Unattendedmeans when You are not in full view of and not in a position to preventunauthorised interference with Your property or vehicle.Valuablesmeans any of the following items: jewellery; gold, silver, precious metal or precious or semiprecious stonearticles; watches; furs; Electronics; telescopes and binoculars.AtlasTravelPakPolicy7

LimitsWe will not pay more than the following sums insured, benefits or limitsin the Period of Insurance. Disclosure and observanceYou must have answered truthfully all questions that We askedwhen Your policy started. You must also have truthfully agreedto any statements that We may have listed in the terms andconditions relating to Your policy when it started. You must alsoadvise us as soon as possible of all changes to this information.We only provide cover if any person insured under this policyobserves the terms, exceptions and conditions of this policy.2. Dual insuranceIf at the time of any incident which results in a claim under thispolicy, there is another insurance covering the same loss, damage,expense or liability, We will not pay more than Our proportionalshare (not applicable to Section D - Personal Accident).3. Reasonable precautionsYou must take and cause to be taken all reasonable precautionsto avoid illness, injury, disease, loss, theft or damage and take andcause to be taken all practicable steps to safeguard Your propertyfrom loss or damage and to recover property lost or stolen.4. CancellationYou may cancel this policy within 14 days of receipt of Your policydocumentation. If the policy is paid in full and provided that You have nottravelled and there has been no claim or incident likely togive rise to a claim We will refund any premium paid. ArbitrationIf We have accepted a claim under the policy and there is adisagreement over the amount to be paid to You, the disputemust be referred to an arbitrator to be appointed by mutualagreement between the parties in accordance with the provisionsof the Arbitration Act 1996. Claims Conditionswilful act or with Your connivance,then We shall not pay the claim; We shall not pay any other claim which has been or will bemade under the policy; We may at Our option declare the policy void; We shall be entitled to recover from You the amount of anyclaim already paid under the policy; We shall not make any return of premium; We may inform the police of the circumstances.You must comply with the following conditions to havethe full protection of Your policy.If You do not comply We may at Our option cancel the policy or refuseto deal with Your claim or reduce the amount of any claim payment.1. Claimsa) You must notify Us with full details in writing as soon as Youreasonably can, but not later than 15 days following Your returnto Malta, following any Bodily Injury, illness, disease, incident,event, redundancy or the discovery of any loss, theft or damagewhich may give rise to a claim under this policy.b) You must also inform Us immediately if You are aware of anywrit, summons or impending prosecution. Every communicationrelating to a claim must be sent to Us without delay. You oranyone acting on Your behalf must not negotiate admit orrepudiate any claim without Our written consent.c) You or Your legal representatives must supply at Your ownexpense all information, reports, evidence (including receipts),details of household and other insurance and medical certificatesas required by Us. We reserve the right to require You to undergoan independent medical examination at Our expense. We mayalso request and will pay for a post-mortem examination.d) You must retain any property which is damaged, and, if requested,send it to Us at Your own expense. If We pay a claim for the FullValue of the property and it is subsequently recovered or there isany salvage then it will become Our property.e) We may refuse to reimburse You for any expenses for which Youcannot provide receipts or bills.f) You may be asked to present a sworn statement (affidavit) at Yourexpense in support of Your claim.2. SubrogationWe are entitled to take over and conduct in Your name thedefence and settlement of any legal action. We may also takeproceedings at Our own expense and for Our own benefit, butin Your name, to recover any payment We have made under thispolicy to anyone else.3. FraudYou must not act in a fraudulent manner.If You or anyone acting for You:a) make a claim under the policy knowing the claim to be falseor fraudulently exaggerated in any respect orb) make a statement in support of a claim knowing thestatement to be false in any respect orc) submit a document in support of a claim knowing thedocument to be forged or false in any respect ord) make a claim in respect of any loss or damage caused by Your12AtlasTravelPakPolicyImportant ConditionsRelating to HealthYou must comply with the following conditions to havethe full protection of Your policy.If You do not comply We may at Our option cancel the policy or refuseto deal with Your claim or reduce the amount of any claim payment.1.It is a condition of this policy that You will not be covered under: Section A - Cancellation Or Abandonment Charges; Section B - Emergency Medical And Other Expenses; Section C - Hospital Benefit; Section D - Personal Accident; Sub-section 3 of Section O - Slalom Extensionfor any claims arising directly or indirectly from:a) at the time of taking out this policy:i. any Pre-Existing Medical Condition;ii. any Medical Condition for which You have received aterminal prognosis;iii. any Medical Condition for which You are on a waitinglist for or have knowledge of the need for surgery, inpatient treatment or investigation at a hospital, clinic ornursing home;iv. any circumstances You are aware of that could reasonablybe expected to give rise to a claim on this policy including,but not limited to: when an Accompanying Person, a Close Relative,a Close Business Associate or a person with whomYou have arranged to stay is suffering from a Preexisting Medical Condition or a Medical Conditionas referred to in ii, and iii above; when You have had signs or symptoms for which aMedical Practitioner has not yet been consultedor You are awaiting day-patient, in-patient or outpatient treatmentunless You have been given Our agreement in writing.AtlasTravelPakPolicy13

b) at any time:i. any Medical Condition You have in respect of which aMedical Practitioner has advised You not to travel orwould have done so had You sought his /her advice;ii. any Medical Condition for which You are travelling withthe intention of obtaining medical treatment (includingsurgery or investigation) or advice outside of Malta;iii. any Medical Condition for which You are not taking theprescribed medication or recommended treatment asdirected by a Medical Practitioner;iv. normal pregnancy or childbirth without anyaccompanying complication.2.3.If You require private in-patient treatment or repatriation Youmust comply with the conditions of the Emergency and MedicalService section on page 18.If Your health changes after the start date of Your policy andthe date of Your travel tickets or confirmation of booking wereissued, You must telephone Us on 356 2343 5363 to make sureYour cover is not affected. You must check with Your generalpractitioner that You are still fit to travel. You will not be coveredfor medical and abandonment related claims if You travel againstmedical advice.General Exclusions Applicableto All Sections of the Policy(Exclusions 5, 6, 7, 8 and 9 do not apply to claims for cancellationunder Section A - Cancellation and Abandonment Charges)This policy does not insure any claim or payment of any benefithereunder to the extent that the provision of such cover, paymentof such claim or provision of such benefit would expose Us to anysanction, prohibition or restriction under United Nations resolutions orthe trade or economic sanctions, laws or regulations of the EuropeanUnion, United Kingdom or United States of America, or any of its states.Furthermore, We will not pay for claims arising directly or indirectlyfrom:1.a)b) Terrorism caused or contributed to by the use of, releaseor the threat thereof of any nuclear weapon or device orchemical or biological agent (regardless of any other causeor event contributing concurrently or in any other sequenceto the loss) and any action taken in controlling, preventing,suppressing or in any way relating to any act of suchTerrorism;You should also refer to the General Exclusions on page 15.14AtlasTravelPakPolicywar, invasion, acts of foreign enemies, hostilities or warlikeoperations (whether war be declared or not), civil war,rebellion, revolution, insurrection, civil commotion (assumingthe proportions of or amounting to an uprising) and militaryor usurped power;2.ionising radiation or contamination by radioactivity from anynuclear fuel or from any nuclear waste from combustion ofnuclear fuel, the radioactive, toxic, explosive or other hazardousproperties of any nuclear assembly or nuclear component of suchassembly;3.loss, destruction or damage directly occasioned by pressure wavescaused by aircraft and other aerial devices travelling at sonic orsupersonic speeds;4.the failure or fear of failure or inability of any equipment or anycomputer programme, whether or not You own it, to recognise orto interpret correctly or process any date as its true calendar date,or to continue to function correctly beyond that date;5.Your pursuit of winter sports or Your use of dry-ski slopesunless Section O - Slalom Extension is shown as operative in theSchedule;6.the following winter sports activities even if Section O - SlalomExtension is shown as operative in the Schedule: Off piste skiingwithout a guide, skiing against local authoritative warning oradvice, ski stunting, free-style skiing, Nordic skiing, ice hockey,AtlasTravelPakPolicy15
