!F A I T HF O R M A T I O N6MINISTRY MINUTESMercy and Canon LawReflection Robin Black-RubensteinThere is nowhere in our Church where the difference inapproaches to upholding the teachings of the Church are moresharply illustrated then in how our Church applies canon law.Canon Law is the name given to the official body of laws for theCatholic Church. The name is derived from the Greek wordkanon, meaning a measure or rule. Only the Pope or anecumenical council has the power to create legislation orinterpret it officially for the Church. The last major revision ofcanon law was in 1983 when Pope St. John Paul II promulgatedthe revised code. The sharpness and the firmness with whichthe law is applied is where we find disagreement among ourChurch leaders. This is important because, as a practical matter,canon law is routinely interpreted in daily Church life by bishops,pastors and other Church leaders. In a recent article in Americamagazine, Rev. Kevin McKenna, who is the former president ofthe Canon Law Society of America, tells us that Pope Francis hasdirected canonists to a different perspective on the purpose oflaw within the church: a vehicle of mercy.In St. Augustine's Confessions he states "You have made usfor yourself, O Lord, and our heart is restless until it rests inyou." Lately I have felt a little restless. I know that part ofmy restlessness is the anticipation of December.InDecember (actually Nov. 29) we have Advent, beginning theJubilee Year of Mercy, Immaculate Conception, Our Lady ofGuadalupe and Christmas. Thinking of these upcomingevents in our church and world and the busyness thataccompanies them, I simply pray to remember two importantthings; first that I do not let these celebrations pass withoutfirst resting in God. I do not want to be so restless that Iforget to rest in the Divine and to spend some time toreconcile my spirit with God’s loving spirit.I need toremember that we are called human “beings” not human“accomplishers”. Even though the month may be a busy one,in order to truly experience the celebration of love that theyoffer, I must offer my heart first. Taking time to be with Godin prayer and the Sacrament of Reconciliation is a way tobegin. The second on my list, but equally important, is tolove in imitation of God. Pope France reminds us of Jesus’greatest commandments “To Love God above all things,(which, if I am able to rest my heart in God I will be moreable to live this out) and to “Love our neighbor as ourselves.”This upcoming Year of Mercy invites me to Love others andmyself in imitation of God.Although canon laws cover almost the entirety of our life withinthe Church, it is when seeking an annulment that many Catholicsare confronted with the way Canon Law is applied. This is anarea where our Holy Father sees opportunities for extendingGod’s mercy while not changing the substance of the laws. Rev.McKenna points out that in two recent decrees concerning thisarea of canon law our Holy Father has streamlined theannulment process to make it less cumbersome and expensive.Hopefully the amount of time that the process takes to come toa decision will be shorter because of these changes. Our HolyFather is trying to put less emphasis on the technicalities of thelaw and more emphasis on the pastoral aspects of the process.In our Diocese, these last changes will be less noticeable becausewe are already blessed to have Tribunal Judges (priests who arecanon lawyers) who are wonderfully pastoral and see the processas an opportunity for healing and grace.Cardinal Walter Kasper in his recent book on mercy asks if thereis room for both justice and mercy within canon law. Heacknowledges the importance of our Church being governed bya clear and just set of laws and then reminds his readers thatthere is, in the law, a tradition of mercy that does not dismissjustice but is the higher righteousness. Only when both of theseelements are present can fair and just solutions be achieved.Rev. McKenna suggests that in the final canon (ca. 1752) we canfind the filter and the lens by which its entirety is implemented inthe spirit of Pope Francis. “The salvation of souls, which mustalways be the supreme law in the church, is to be kept beforeone’s eyes.” When a person has received a corrective actionfrom his bishop or pastor as a stinging rebuke, instead of aloving and corrective action, then there will no longer be anopportunity for discourse in which to guide the salvation of thatperson’s soul! Mercy tempers justice. Deacon DanSt. Boniface RCIA-RCICRCIA will not be meeting this Monday ofThanksgiving week. In Pope Francis’ Papal Bull on the Year of Mercy he calls onall of us to be bearers of God’s love and Mercy, “TheChurch’s first truth is the love of Christ. The Churchmakes herself a servant of this love and mediates it to allpeople: a love that forgives and expresses itself in the giftof oneself. Consequently, wherever the Church ispresent, the mercy of the Father must be evident. In ourparishes, communities, associations and movements, ina word, wherever there are Christians, everyone shouldfind an oasis of mercy.” This weekend as we honor OurLord Jesus Christ, King of the Universe, I pray that each of usare able to listen to His voice and testify to the truth of God’slove.Two Different Online Reflection Opportunities1.
