Citation of ChapterThis chapter constitutes the chapter on hair, skin, nail care, and electrolysisand may be known and cited as the Barbering and Cosmetology Act.7302. DefinitionsThe following definitions shall apply for purposes of this chapter:(a) “Department” means the Department of Consumer Affairs.(b) “Director” means the Director of Consumer Affairs.(c) “Board” or “bureau” means the State Board of Barbering andCosmetology.(d) “Executive officer” means the executive officer of the State Board ofBarbering and Cosmetology.7303. State Board of Barbering and Cosmetology; Executive Officer(a) Notwithstanding Article 8 (commencing with Section 9148) of Chapter1.5 of Part 1 of Division 2 of Title 2 of the Government Code, there is inthe Department of Consumer Affairs the State Board of Barbering andCosmetology in which the administration of this chapter is vested.(b) (1) The board shall consist of 13 members. Seven members shall bepublic members, and six members shall represent the professions.(2) The Governor shall appoint five of the public members and the sixprofessional members. The six professional members shall be comprised asfollows:(A) A cosmetologist.(B) A barber.(C) An esthetician.(D) An electrologist.(E) A manicurist.(F) An establishment owner.(3) The Senate Committee on Rules and the Speaker of the Assemblyshall each appoint one public member.(4) Members of the board shall be appointed for a term of four years,except that of the members appointed by the Governor, two of the publicmembers and two of the professions members shall be appointed for aninitial term of two years. No board member may serve longer than twoconsecutive terms.3
BARBERING AND COSMETOLOGY ACTRevised 2022(5) Each member of the board shall receive a per diem pursuant toSection 103.(c) The board may appoint an executive officer who is exempt from civilservice. The executive officer shall exercise the powers and perform theduties delegated by the board and vested in the executive officer by thischapter. The appointment of the executive officer is subject to the approval ofthe director. In the event that a newly authorized board replaces an existingor previous bureau, the director may appoint an interim executive officerfor the board who shall serve temporarily until the new board appoints apermanent executive officer.(d) The executive officer shall provide examiners, inspectors, and otherpersonnel necessary to carry out the provisions of this chapter.(e) This section shall remain in effect only until January 1, 2027, andas of that date is repealed. Notwithstanding any other law, the repeal ofthis section renders the board subject to review by the appropriate policycommittees of the Legislature.7303.1. Priority of Board; Protection of the PublicProtection of the public shall be the highest priority for the Board ofBarbering and Cosmetology in exercising its licensing, regulatory, anddisciplinary functions. Whenever the protection of the public is inconsistentwith other interests sought to be promoted, the protection of the public shallbe paramount.7305. Annual Election of OfficersThe board shall elect officers annually from among its members, each ofwhom shall hold office for a term of one year. An officer shall not serve in aparticular officer position for more than two terms.7309. Principal Office and Branch OfficesThe board shall establish a principal office, and may establish branch officesand examination facilities in the state as may be deemed necessary for theboard to conduct its business.7311. SealThe board shall adopt and use a common seal for the authentication of theboard’s records.7312. Powers and Duties of the Board(a) The board shall do all of the following:(1) Make rules and regulations in aid or furtherance of this chapter inaccordance with the Administrative Procedure Act.4
