ARTICLE 1 - RECOGNITIONPursuant to the certification of the Public Employment Relations Board dated November 4,1976, (Docket Number LA-R-35), as amended through collective bargaining, the Districtrecognizes the Federation as the exclusive representative of all Board-approved Faculty, includingcertificated Instructors, Coaches, Counselors, Librarians, Registered Nurses, Nurse Practitioners,Physician Assistants, Faculty Coordinators, Disabilities Specialists, Clinical Psychologists, andany persons acting as the Instructor-of Record, hereinafter referred to as "Faculty Members."Position descriptions are set forth in Appendix A. Excluded are all other employees of the Districtincluding management employees, temporary substitute employees, physicians, and all employeesholding positions not requiring certification qualifications.1122044v1 / EC.10ARTICLE 1

ARTICLE 2 - RIGHTS OF THE DISTRICTExcept as limited specifically by the express terms of this Agreement, the District retainsall of the rights and authority conferred upon it by the laws of the State of California to direct,manage, and control the affairs of the District. Such rights of the District include, but are notlimited to:(a)The right to determine its organizational structure and to delegate its rights andresponsibilities to the Superintendent-President and to such other officials, persons, divisions,departments, and committees as it shall determine from time to time;(b)The right to determine its financial structure including (i) all decisions andconditions relating to all sources of District income, (ii) all investment policies and practices, and(iii) all budgetary matters and procedures, to wit, the budget calendar, the budget formation process(subject to Article 21, Section 6, respecting budget requests), accounting methods, payrollpractices, fiscal and budget control policies and procedures, and all budgetary allocations, reserves,and expenditures;(c)The right to acquire, administer, and dispose of all District property whether realor personal and whether owned, leased, or otherwise controlled, including all land, buildings,facilities, grounds, fixtures, machinery, and other improvements;(d)The right to determine all services to be rendered to the students and to thepublic, including the nature, methods, quantity, quality, frequency, and standards of service, andthe personnel, facilities, vendors, supplies, materials, vehicles, equipment, and tools to be used inconnection with such service, the contracting of services to be rendered and functions to beperformed, including educational support, educational aids and devices, structural maintenance,and repair services;(e)The right to determine the utilization of personnel, including:(1) the determination of the number of Faculty Member positions,(2) the selection and utilization of personnel not covered by this Agreement,(3) the determination of the use of certificated management personnel to performteaching and other work that is also performed by Faculty Members covered by thisAgreement,2122044v1 / EC.10ARTICLE 2

(4) the selection of Faculty Members subject to the provisions of Article 4,Section 5,(5) the determination of the assignment or reassignment of certificatedmanagement employees of the District to positions covered by this Agreement shall besubject to the provisions of the Education Code, and, in cases where such reassignmentresults in the layoff of a Full-Time Faculty Member, shall be subject to the competencycriteria as specified in Article 6, Section 3;(f)The right to make final determinations on all matters relating to the instructionalprogram of the College, subject to the referral of certain specific matters to joint DistrictFederation Committees or to the Academic Senate or the General Curriculum Committee or theprocedures for textbook selection as otherwise provided by this Agreement, and the right todetermine all matters related to student personnel services;(g)The right to make final determinations regarding the assignment of FacultyMembers to work schedules, functions, and activities, and the right to determine the assignmentof Faculty Members to courses to be taught, classrooms, laboratories, and other facilities andequipment, and offices, subject to Articles 8, 9, and 10 and Appendix A of this Agreement;(h)The right to adopt reasonable rules and regulations, including rules andregulations related to safety and security matters;(i)The right to determine the requirements for, management and control of Districtfacilities, such as the food service centers and the bookstore.(j)The exercise of any right reserved to the District herein in a particular manneror the non-exercise of any such right shall not waive such right or preclude the District fromexercising the right in a different manner.3122044v1 / EC.10ARTICLE 2

ARTICLE 3 - RIGHTS OF THE FEDERATIONSection 1. Payroll DeductionsThe District will deduct from the pay of Faculty Members covered by this Agreement thefollowing deductions:(a)AFT/CFT Life Insurance, AFT/CFT Federation Credit Union, upon receiving theFaculty Member’s voluntary and written authorization, revocable by the Faculty Member;(b)Federation dues, upon receiving notification from the Federation that a membershipform is on file, and(c)Special assessments upon notification from the Federation that such assessment hasbeen approved by the membership in accordance with the Federation’s Constitution & Bylaws.The District will pay over to the Federation the amount(s) so withheld, which amount(s)shall be reported to and paid to the Federation on a monthly basis. The Federation shall provideadvance notice to members authorizing deduction(s) of any increase in the dues. The Federationwill give the District thirty (30) days advance notice to the Director of Accounting in FiscalServices of any change in the amount of the monthly deduction(s) and a list of those membersimpacted by the change. No authorization, deduction, or revocation will be effective until it hasbeen on file with the District for at least thirty (30) days. The Federation agrees to reimburse theMember for any deduction(s) withheld and paid to the Federation by mistake. If the District failsto comply with the deduction(s) of a Faculty Member who has executed a valid authorization forsuch deduction, the District will make the correction at the next payroll period if notified by theFederation within ample time to make the correction. No such payroll adjustment shall exceedfive (5) months’ dues.Any unit member who is paying dues through payroll deduction may stop makingpayments by giving written notice to the Federation pursuant to the Authorization for DuesWithholding from Earnings section of the Federation membership form. The District will honorthe employee’s dues authorization unless revoked in writing by the employee and submitted to theFederation. The District shall direct any inquiry about dues deduction authorization to theFederation Executive Director and shall not stop the dues deduction until notified by theFederation.4122044v1 / EC.10ARTICLE 3

(d)The Federation agrees to indemnify and hold harmless the District, its officers,employees and agents with respect to any claims or actions arising out of union dues deductions,the cancellation of dues or fees to the union as well as the processing of dues deduction orcancellation of dues or fees to the union.Section 2. Meeting RoomsThe Federation shall have the right to use without charge District facilities and equipmentinstalled therein for the purpose of meetings concerned with the representation rights in theDistrict, at reasonable times that do not interfere with normal District operations, nor cause afterhour increased maintenance costs to the District. Arrangement for such use shall be made inaccordance with established procedures. Use of the facilities that involves after-hours increasedmaintenance costs shall be paid for by the Federation.Section 3. Federation RepresentativesDuly authorized representatives of the Federation who are not Faculty Members shall bepermitted to transact official Federation business on the District premises so long as the transactionof such business does not interfere with the performance of Faculty Members' duties to the District.Section 4. Communication FacilitiesThe Federation shall have the right to use designated faculty email listservs and bulletinboards for posting notices of its activities and disseminating information to faculty, and shall havethe right to list meetings in the weekly Calendar and the right to use faculty mailboxes forcommunications with Faculty Members. The exercise of these rights is subject to applicableDistrict regulations. Any notice posted/sent pursuant to this Section shall clearly indicate it is aFederation notice by logo, title or sender email signature and shall be posted/sent by an appropriateofficer of the Federation who is authorized by the Federation to make such posting. The Federationshall keep on file with the Vice Presidents - Student Services, Academic Affairs and HumanResources, a list of those officers so authorized. Any Federation material distributed through theintra-campus mail or e-mail system shall clearly indicate the Federation as the distributor of thematerial.5122044v1 / EC.10ARTICLE 3

Section 5. Copies Of The AgreementThe District will continue to post a current copy of this Agreement on the District’s website.Section 6. Board of Trustees Minutes and AgendaThe District will continue to post electronic copies of the minutes of Board meetings andelectronic copies of the agenda of Board meetings and supporting documents submitted to theBoard with such agenda, except for supporting documents of a confidential and/or privilegednature.Section 7. Personnel RosterThe District will furnish the Federation with an up-to-date listing of the names, homemailing addresses, work, home and personal telephone numbers, work and personal emailaddresses on file with the District, and job titles, and the home departments/Divisions of all FacultyMembers fully processed as of the third week of each semester (fall & spring) and second week ofsummer and winter sessions. The District will furnish to the Federation telephone numbers exceptfor those Faculty Members who request exclusion.Section 8. Board Policies and ProceduresThe District will continue to post electronic copies of Board policies and procedures andshall supplement it with additions, deletions, or amendments as soon after their adoption aspossible.Section 9. DocumentsUpon written request of the Federation, the District shall provide the Federation with copiesof any documents that are a matter of public record, provided that these materials are notconfidential. The Federation will bear the expense of duplicating any such materials.6122044v1 / EC.10ARTICLE 3

Section 10. Reassigned Time for the Federation(a)Effective Fall 2020, the District will provide 1 FTEF each semester of reassignedtime for the activities of Federation officers including adjustment of grievances and ongoingnegotiation issues.(b)The District will provide 0.6 FTEF of reassigned time for one semester prior to and1 FTEF for each semester during full contract negotiations.(c)The District will provide 0.6 FTEF of reassigned time for one semester to be usedfor reopener negotiations during the semester in which such negotiations would take place.(d) “Reassigned time” shall be defined as the assignment of an alternative task orresponsibility in lieu of a portion of a Faculty Member’s classroom or non-classroom assignmentduring the regular semesters. The distribution of the reassigned time shall be at the discretion ofthe Federation Executive Committee. Notification of the distribution of the Faculty Member’samount of reassigned time to the Vice President of Academic Affairs will be provided at least six(6) weeks in advance of the beginning of any semester. Additionally, reassigned time may bedisbursed by the Federation Executive committee hourly at the Appendix D-3 Rate I. TheFederation will provide the Human Resources with the names and hours for these individualswithin one week of the end of the academic semester.(e) Notwithstanding the various formulas set forth in Appendix B of this Agreement,teaching load, for purposes of this Article 3, Section 11 (a, b, c) above, shall be calculated asfollows:Hours per semester of reassigned time percentage of load360 (see note)Note: “360” represents 5 (months) times 4 (weeks) times 18 (hours per week as agreed in pastcalculations for both lecture and lab hours).Section 11. Reduced LoadUpon the written request of the Federation, at least six (6) weeks in advance of thebeginning of any semester, the District shall grant a reduction in load to Faculty Membersdesignated by the Federation. Such reduction in load for all such Faculty Members collectivelyshall not exceed one hundred percent (100%) per semester in addition to the reassigned timeprovided by Section 11. Such load reduction granted pursuant to Section 11 and this Section shall7122044v1 / EC.10ARTICLE 3

not affect the Faculty Member's eligibility for sabbatical leave, summer school priority, oreligibility for other leaves as herein provided. The Faculty Member's benefits as provided inArticle 17, Insurance Benefits, will be maintained. The Federation shall, for any such reductionin load pursuant to this Section, reimburse the District at the direct salary cost, including statutorybenefits, at the applicable rate, for the replacement of the Faculty Member.Section 12. AcknowledgmentOn the college website, telephone directory and any official Faculty Handbook that isdistributed to the faculty, the District shall acknowledge that the Federation is the exclusiverepresentative of Faculty Members and shall list the Federation's current officers, its officelocation, email address and telephone number.Section 13. Campus FacilitiesThe District shall provide the Federation with leased office space on campus to includeinternet access, a photocopier compatible electrical outlet, and on-campus and local phone service.The lease rate will not exceed the prevailing rate in the immediate area and will be negotiatedyearly. For the year of 2020, rent shall be 200/month and submitted to the Director of Accountingin Fiscal Services. Notice of any annual rent increase will be provided to the Federation at least 30days prior to the effective date. The District shall list the location and phone number of theFederation in the campus telephone directory. The Federation shall be allowed reasonable use ofDistrict reproduction services during regular business hours at the Federation's expense. Maildelivery will be provided as long as such delivery does not interfere with normal District services.The Federation shall be responsible for all postage and long-distance phone services.Section 14. Conference AttendanceThe Federation will be entitled to six (6) non-cumulative person days per year release timefor designated Federation representatives to attend Federation conferences, conventions, ortrainings. Release time shall normally be taken in full-day increments. Notification of attendanceshall be submitted to the respective Dean or Director with as much advanced notice as reasonablypossible. Federation, unless funding is requested and approved through regular District processes forconference attendance.Section 15. ParkingThe District will allow the Federation to purchase, at the current rate charged to managers,two (2) reserved parking spaces with applicable permits which will allow the Federation to parkin reserved parking.Section 16. New Faculty On-Boarding, Orientation(a)On-Boarding(1)The District will provide the Federation with the following informationelectronically for all new hire faculty bargaining unit members during the on-boardingprocess: First and Last Name, Job Title, Home Department/Division, Work Phone number,Home Phone Number, Personal Phone Number on file with the District, Work Emailaddress, Personal Email address on file with the District, Home address(2)All new faculty will meet face-to-face or virtually with a Federation Representativeas part of the on-boarding process.(3)The District and the Federation shall not disclose information about employees’home address, personal phone number, or personal email address to third parties.(4)The District shall not discourage employees or applicants from becoming orremaining members of the Federation, or from authorizing a union to represent them orfrom authorizing membership or dues deductions.(b)Orientation(1)For all New Full-Time Faculty Orientations, the Federation shall be included onthe program with up to two representatives.(2)For all New Part-Time Faculty Orientations, the Federation shall be included on theprogram with up to two representatives.(3)The District shall not disclose the date, time and place of new employee orientationsto outside third parties.9122044v1 / EC.10ARTICLE 3

ARTICLE 4 - INTRACOLLEGIATE RELATIONSSection 1. Academic Senate(a)The El Camino College Academic Senate, which is chartered to provide the facultywith a formal and effective procedure for participating in the formation of District policies onacademic and professional matters, will continue that role as is outlined in Board Policy, adoptedAugust 7, 1972. The Policy may be amended by the Board of Trustees when such amendment isrecommended jointly by the District and the Academic Senate. The Academic Senate shall haveno jurisdiction over matters specifically delegated to the Federation or to any joint DistrictFederation committee by terms of this Agreement.(b)Effective Fall 2020, the District will provide 3 FTEF of reassigned/release timeeach semester for the work of Academic Senate officers. The distribution of the reassigned timeshall be at the discretion of the Academic Senate Executive Committee. Notification of thedesignated Academic Senate officers and the schedule of their release/reassigned time will beprovided to the Vice President of Academic Affairs before the end of the prior semester.Section 2. CurriculumCurriculum will be governed by Board Policy, Curriculum Review and Approval, whichprovides for the responsibility and the authority of the Academic Senate to consider and makerecommendations on curriculum matters. Procedures to implement this policy may be found inthe Curriculum Handbook.Section 3. Textbook AdoptionThe procedures for textbook adoption and cancellation shall continue as set forth in BoardPolicy, and as amended from time to time. The District shall consult with the Federation as to anychanges in this policy.Section 4. District-Federation ConsultationsThe President of the College and the President of the Federation, or their designees, willmeet at least once each semester or upon the request of either person to discuss the definition ofeducational objectives of the College and matters that would facilitate the implementation of the10122044v1 / EC.10ARTICLE 4
