- 2 Division of Gaming Enforcement1300 Atlantic AvenueAtlantic City, NJ 08401The agency proposal follows:SummaryEffective February 1, 2011, the Casino Control Act (Act)was amended.See P.L. 2011, c. 19 (N.J.S.A. 5:12-1 et seq.).Under the amendatory scheme, the Division of Gaming Enforcement(Division) is authorized to assume many regulatoryresponsibilities formerly held by the Casino Control Commission(Commission).One such responsibility is to promulgate rulesrelating the games authorized to be played in Atlantic Citycasinos.Under N.J.S.A. 5:12-70, the Division is required topromulgate rules.In accordance with that statutoryauthorization, the Division proposes new rules regarding allgames authorized to be played in Atlantic City casinos.Withthe exception of minor technical changes reflecting the recentlyenacted changes to the Act and the addition of rules governinggaming tournaments run by Atlantic City casinos, the new rulesrecodify the rules promulgated by the Commission.Proposed N.J.A.C. 13:69F contains subchapters addressingall authorized games.Subchapter 1 sets forth the rulesrelating to the games of craps, mini-craps and automated craps.Subchapter 1A sets forth certain rules specific to automated

- 3 craps.Subchapter 2 sets forth the rules relating to the gameof blackjack.Subchapter 3 sets forth the rules relating to thegame of baccarat-punto banco.Subchapter 4 sets forth the rulesrelating to the game of baccarat-chemin de fer.Subchapter 5sets forth the rules relating to the games of roulette and BigSix.Subchapter 6 sets forth the rules relating to the game ofred dog.Subchapter 7 sets forth the rules relating to the gameof mini-baccarat.Subchapter 8 sets forth certain rulesrelating to all games, with a new section being proposed thataddresses gaming tournaments.The proposed new rule, N.J.A.C.13:69F-8.6, addresses gaming tournaments and requires thatcasino licensees must notify the Division prior to conductingthe tournament and also provide certain information regardingthe logistics of the tournament.Subchapter 9 sets forth therules relating to the game of sic bo.Subchapter 10 sets forth the rules relating to the game ofpai gow.Subchapter 11 sets forth the rules relating to thegame of pai gow poker.Subchapter 12 sets forth the rulesrelating to the game of pokette.Subchapter 13 sets forth therules relating to the game of mini-dice.Subchapter 14 setsforth the rules relating to the game of poker and itsvariations.Within Subchapter 14, there are also new rulesbeing proposed which address the games of Triple Low Ball Deuceto Seven and Badugi.Triple Low Ball Deuce to Seven is a low

- 4 variation of the already authorized game of five card drawpoker, and Badugi is a low four-card variation of the game ofdraw poker.The new rules proposed relating to these games arelocated within N.J.A.C. 13:69F-14.3, 14.8, 14.12, and 14.12B.Both of these games have been previously authorized by temporaryadoption and are currently being tested. Subchapter 15 setsforth the rules relating to the game of keno.Subchapter 16sets forth the rules relating to the game of Caribbean studpoker.Subchapter 17 sets forth the rules relating to the gameof double down stud.Subchapter 18 sets forth the rulesrelating to the game of let it ride poker.Subchapter 19 setsforth the rules relating to the game of Spanish 21.Subchapter 20 sets forth the rules relating to the game ofthree card poker.Subchapter 21 sets forth the rules relatingto the game of fast action hold ’em.Subchapter 22 sets forththe rules relating to the game of casino war.Subchapter 23sets forth the rules relating to the game of Colorado hold ’empoker.Subchapter 24 sets forth the rules relating to the gameof Boston 5 stud poker.Subchapter 25 sets forth the rulesrelating to the game of double cross poker.Subchapter 26 setsforth the rules relating to the game of double attack blackjack.Subchapter 27 sets forth the rules relating to the game of fourcard poker.Subchapter 28 sets forth the rules relating to the

- 5 game of Texas hold ’em bonus poker.Subchapter 29 sets forththe rules relating to the game of flop poker.Subchapter 30 sets forth the rules relating to the game of twocard joker poker.Subchapter 31 sets forth the rules relatingto the game of Asia poker.Subchapter 32 sets forth the rulesrelating to the game of ultimate Texas hold ’em.Subchapter 33sets forth the rules relating to the game of winner’s pot poker.Subchapter 34 sets forth the rules relating to the game ofsupreme pai gow.Subchapter 35 sets forth the rules relating tothe game of Mississippi stud.Subchapter 36 proposes new rulesfor the game of triple attack blackjack which was previouslyauthorized by temporary adoption.Triple attack blackjack is avariation of blackjack which uses eight Spanish 21 decks, whichare standard 52-card decks with the 10’s removed.The gamefeatures head-to-head play against the dealer along with twooptional wagers as cards are dealt and two proposition wagers.Subchapter 37 proposes new rules for the game of mini-tex threecard hold ’em which is a variation of the previously authorizedgame of Texas hold ’em.In mini-tex three card hold ’em,players play use a combination of two hole cards and threecommunity cards to make the best three-card poker hand whileplaying against the house.

The standards and procedures set forthhave been effective in assuring fairness to the player,encouraging participation, preventing cheating and protectingcasinos and patrons against unfair play. These safeguards havegenerated a reputation for honesty and integrity for theAtlantic City casino industry. Failure to adopt the new ruleswould enhance the danger of unfair gaming practices and reflectadversely on Atlantic City. Failure to maintain public trust inthe integrity of gaming operations would undermine the basicpublic policy of the Casino Control Act, N.J.S.A. 5:12-1 et seq.Economic ImpactThe proposed repeal and new rules will benefit the publicand the casino industry. By regulating the rules, odds, andoperation of gaming, the chapter assures the gaming patron fairplay and a fair return. The procedural controls protect both thecasino and the player against the possibility of cheating andresulting financial losses. While casino licensees will incursome costs in complying with the standards and procedures in theproposed new rules, such compliance is essential to the

- 7 integrity of gaming operations in Atlantic City. To the extentthat any reduction in the costs of compliance may be effectedthrough regulatory amendment, without posing a threat to theintegrity of gaming will be proposed in the future.Federal Standards StatementA Federal standards analysis is not required because theproposed repeal and new rules are authorized by the provisionsof the Casino Control Act, N.J.S.A. 5:12-1 et seq., and are notsubject to any Federal requirements or standards.Jobs ImpactThe proposed repeal and new rules are not anticipated tocreate new jobs in the gaming industry except to the extent theymay enable more efficient and cost-effective casino operations.If the industry is able to realize these efficiencies andsavings, casino operators may be inclined to increase theirworkforces.However, any attempt to predict the impact of theproposed repeal and new rules upon the number of jobs in thegaming industry would be speculative at this time. The adoptionof this chapter regarding the rules of the games is notanticipated to cause any loss of jobs in New Jersey.Agriculture Industry ImpactThe proposed repeal and new rules will have no impact onagriculture in New Jersey.Regulatory Flexibility Statement

- 8 The proposed repeal and new rules will only affect theoperations of New Jersey casino licensees, none of whichqualifies as a "small business" as defined in the RegulatoryFlexibility Act, N.J.S.A. 52:14B-16 et seq., as each has morethan 100 full-time employees.Accordingly, a regulatoryflexibility analysis is not required.Smart Growth ImpactThe proposed repeal and new rules will have no impact onthe achievement of smart growth and implementation of the StateDevelopment and Redevelopment Plan.Housing Affordability Impact AnalysisThe proposed repeal and new rules will have no impact onthe affordability of housing in the State of New Jersey becausethey affect the regulation of casinos in Atlantic City.Smart Growth Development Impact AnalysisThe proposed repeal and new rules will have no impact onhousing production in Planning Areas 1 and 2, or withindesignated centers, under the State Development andRedevelopment Plan because they affect the regulation of casinosin Atlantic City.Full text of the rules proposed for repeal may be found inthe New Jersey Administrative Code at N.J.A.C. 19:47.Full text of the proposed new rules follows:

- 9 -CHAPTER 69FRULES OF THE GAMESSUBCHAPTER 1.CRAPS AND MINI-CRAPS13:69F-1.1 DefinitionsThe following words and terms, when used in this subchapter,shall have the following meanings unless the context clearlyindicates otherwise.“Boxperson” shall mean the first level supervisor assigned theresponsibility of directly participating in and supervising theoperation and conduct of the craps game."Come out point" shall mean a total of 4, 5, 6, 8, 9, or 10thrown by the shooter on the come out roll."Come out roll" shall mean the first roll of the dice at theopening of the game and the first roll of the dice after adecision with respect to Pass Bet and Don't Pass Bet has beeneffected."Come point" shall mean a total of 4, 5, 6, 8, 9, or 10 thrownby the shooter on the next roll following placement of a ComeBet or Don't Come Bet.13:69F-1.2 Permissible wagers(a)The following shall constitute the permissible wagers atthe games of craps, mini-craps and automated craps, except that

- 10 the fire bet in (a)40 below shall only be permitted at the gameof craps:1."Pass Bet" is a wager placed on the Pass Line of thelayout immediately prior to the come out roll.i.ThePassBetshallwinif,onthecomeoutroll:(1) A total of 7 or 11 is thrown; or(2) A total of 4, 5, 6, 8, 9, or 10 is The Pass Bet shall lose if, on thecome out roll:(1) A total of 2, 3, or 12 is thrown; y appears before that total is again thrown.2. "Don't Pass Bet" is a wager placed on the Don't PassLine of the layout immediately prior to the come outroll.i.The Don't Pass Bet shall win if, on the comeout roll:(1) A total of 2 or 3 is thrown; or(2) A total of 4, 5, 6, 8, 9, or 10 is thrown and a 7subsequently appears before that total is again thrown.

"Come Bet" is a wager placed on the Come Line ofthe layout at any time after the come out roll.i.The Come Bet shall win if, on the rollimmediately following placement of such bet:(1) A total of 7 or 11 is thrown; or(2)A total of 4, 5, 6, 8, 9, or 10 is thrown and that totalis again thrown before a 7 appears.ii.The Come Bet shall lose if, on the roll immediatelyfollowing placement of such bet:(1) A total of 2, 3, or 12 is thrown; or(2) A total of 4, 5, 6, 8, 9, or 10 is thrown and a 7subsequently appears before that total is again thrown.4."Don't Come Bet" is a wager placed on the Don't Comearea of the layout at any time after the come out roll.i.The Don't Come Bet shall win if, on the rollimmediately following placement of such bet:(1) A total of 2 or 3 is thrown; or

- 12 (2) A total of 4, 5, 6, 8, 9, or 10 is thrown and a 7subsequently appears before that total is again thrown.ii.The Don't Come Bet shall lose if, on the rollimmediately following placement of such bet:(1) A total of 7 or 11 is thrown; or(2) A total of 4, 5, 6, 8, 9, or 10 is thrown and that totalis again thrown before a 7 appears.iii.The Don't Come Bet shall be void if, on the rollimmediately following placement of such bet, a total of12 thrown.5. “Place Bet to Win" is a wager that may be made at any timeon any of the numbers 4, 5, 6, 8, 9, or 10 which shall win ifthe number on which the wager was placed is thrown before a 7and shall lose if a 7 is thrown before such number.All placebets shall be inactive on any come out roll unless called “on”by the player and confirmed by the dealer through placement ofan “on” marker button on top of such player's wager.6. A "Place Bet to Lose" is a wager that may be made at anytime against any of the numbers 4, 5, 6, 8, 9, or 10 cular number against which the wager is placed is thrownbefore a 7 appears.

"Four the Hardway" is a wager, that may be made at anytime, which shall win if a total of 4 is thrown the hardway(that is, with 2 appearing on each die) before 4 is thrown inany other way and before a 7 is thrown.8. "Six the Hardway" is a wager, that may be made at any time,which shall win if a total of 6 is thrown the hardway (thatis, with 3 appearing on each die) before 6 is thrown in anyother way and before a 7 is thrown.9. "Eight the Hardway" is a wager, that may be made at anytime, which shall win if a total of 8 is thrown the hardway(that is, with 4 appearing on each die) before 8 is thrown inany other way and before a 7 is thrown.10. "Ten the Hardway" is a wager, that may be made at anytime, which shall win if a total of 10 is thrown the hardway(that is, with 5 appearing on each die) before 10 is thrown inany other way and before a 7 is thrown.11. "Field Bet" is a one roll wager that may be made at anytime which shall win if any one of the totals 2, 3, 4, 9, cement of such bet and shall lose if a total of 5, 6, 7 or8 is thrown on such roll.12. "Any Seven" is a one roll wager that may be made at anytime which shall win if a total of 7 is thrown on the roll

"Any Craps" is a one roll wager that may be made at anytime which shall win if a total of 2, 3, or 12 is thrown onthe roll immediately following placement of such bet and shalllose if any other total is thrown.14. "Craps Two" is a one roll wager that may be made at anytime which shall win if a total of 2 is thrown on the rollimmediately following placement of such bet and shall lose ifany other total is thrown.15. "Craps Three" is a one roll wager that may be made at anytime which shall win if a total of 3 is thrown on the rollimmediately following placement of such bet and shall lose ifany other total is thrown.16. "Craps Twelve" is a one roll wager that may be made at anytime which shall win if a total of 12 is thrown on the rollimmediately following placement of such bet and shall lose ifany other total is thrown.17. "11 in One Roll" is a one roll wager that may be made atany time which shall win if a total of 11 is thrown on thenext roll and shall lose if any other total is thrown.18. "Craps-Eleven or C and E" is a one roll wager that may bemade at any time which shall win, as provided at N.J.A.C.13:69F-1.4(d), if either a craps (2, 3, or 12) or 11 is rolled

- 15 immediately following placement of such bet and shall lose ifany other total is thrown.19. "Horn Bet" is a one roll wager that may be made at anytime which shall win if any one of the totals 2, 3, 11, or 12is thrown on the roll immediately following placement of suchbet and shall lose if any other total is thrown.20. “Horn High Bet” is a wager that may be made at any timewhich shall win if any one of the totals 2, 3, 11, or 12 isthrown on the roll immediately following placement of such betand shall lose if any other total is thrown.A Horn High Betshall be placed in units of five with four units wagered as aHorn Bet and an additional unit wagered on one of the totals2, 3, 11, or 12.A casino licensee that does not have adesignated area on its layouts for the acceptance of a HornHigh Bet shall break down the wager into two separate wagerson the "Horn" and one of the totals 2, 3, 11, or 12.21. “Whirl Bet” is a one roll wager that may be made at anytime, consisting of a Horn Bet and the Any Seven wager.AWhirl Bet shall be placed in units of five, with four unitswagered on 2, 3, 11, and 12 and the fifth unit wagered as anAny Seven wager.A casino licensee shall break down a Whirlwager into two separate wagers on the Horn Bet and the AnySeven wager.

- 16 22. “Four The Hardway on the Hop” is a one roll wager that maybe made at any time, which shall win if a total of 4 is thrownthe hardway (that is, with 2 appearing on each die) on theroll immediately following placement of such bet and shalllose if any other combination is thrown.23. “Six The Hardway on the Hop” is a one roll wager that maybe made at any time, which shall win if a total of 6 is thrownthe hardway (that is, with 3 appearing on each die) on theroll immediately following placement of such bet and shalllose if any other combination is thrown.24. “Eight The Hardway on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 8 isthrown the hardway (that is, with 4 appearing on each die) onthe roll immediately following placement of such bet and shalllose if any other combination is thrown.25. “Ten The Hardway on the Hop” is a one roll wager that maybe made at any time, which shall win if a total of 10 isthrown the hardway (that is, with 5 appearing on each die) onthe roll immediately following placement of such bet and shalllose if any other combination is thrown.26. “One-Three (Ace-Trey) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 4 isthrown with a 1 appearing on one die and a 3 appearing on the

- 17 other die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.27. “One-Four (Ace-Four) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 5 isthrown with a 1 appearing on one die and a 4 appearing on theother die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.28. “Two-Three (Deuce-Trey) on the Hop” is a one roll wagerthat may be made at any time, which shall win if a total of 5is thrown with a 2 appearing on one die and a 3 appearing onthe other die on the roll immediately following placement ofsuch bet and shall lose if any other combination is thrown.29. “One-Five (Ace-Five) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 6 isthrown with a 1 appearing on one die and a 5 appearing on theother die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.30. “Two-Four (Deuce-Four) on the Hop” is a one roll wagerthat may be made at any time, which shall win if a total of 6is thrown with a 2 appearing on one die and a 4 appearing onthe other die on the roll immediately following placement ofsuch bet and shall lose if any other combination is thrown.31. “One-Six (Ace-Six) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 7 is

- 18 thrown with a 1 appearing on one die and a 6 appearing on theother die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.32. “Two-Five (Deuce-Five) on the Hop” is a one roll wagerthat may be made at any time, which shall win if a total of 7is thrown with a 2 appearing on one die and a 5 appearing onthe other die on the roll immediately following placement ofsuch bet and shall lose if any other combination is thrown.33. “Three-Four (Trey-Four) on the Hop” is a one roll wagerthat may be made at any time, which shall win if a total of 7is thrown with a 3 appearing on one die and a 4 appearing onthe other die on the roll immediately following placement ofsuch bet and shall lose if any other combination is thrown.34. “Two-Six (Deuce-Six) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 8 isthrown with a 2 appearing on one die and a 6 appearing on theother die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.35. “Three-Five (Trey-Five) on the Hop” is a one roll wagerthat may be made at any time, which shall win if a total of 8is thrown with a 3 appearing on one die and a 5 appearing onthe other die on the roll immediately following placement ofsuch bet and shall lose if any other combination is thrown.

- 19 36. “Three-Six (Trey-Six) on the Hop” is a one roll wager thatmay be made at any time, which shall win if a total of 9 isthrown with a 3 appearing on one die and a 6 appearing on theother die on the roll immediately following placement of suchbet and shall lose if any other combination is thrown.37. “Four-Five on the Hop” is a one roll wager that may bemade at any time, which shall win if a total of 9 is thrownwith a 4 appearing on one die and a 5 appearing on the otherdie on the roll immediately following placement of such betand shall lose if any other combination is thrown.38. “Four-Six on the Hop” is a one roll wager that may be madeat any time, which shall win if a total of 10 is thrown with a4 appearing on one die and a 6 appearing on the other die onthe roll immediately following placement of such bet and shalllose if any other combination is thrown.39. “6-7-8” is a one roll wager, offered at the election of acasino licensee, that may be made at any time, which shall winif any one of the totals 6, 7, or 8 is thrown on the rollimmediately following the placement of such bet and shall loseif the total of 2, 3, 4, 5, 9, 10, 11, or 12 is thrown on suchroll.40. “Fire bet” is a wager that may only be made prior to thecome out roll of a new shooter, which wager shall win if atleast four different (unique) point totals (either 4, 5, 6, 8,

- 20 9, or 10) are made by the shooter before a loser 7 is thrown,and shall lose if fewer than four different (unique) pointtotals are made before a loser 7 is thrown.(b) Only the wagers listed in subsection (a) above shall bepermissible at the games of craps, mini-craps and automatedcraps.13:69F-1.3 Making and removal of owever, they may be made between the time the dice leave theshooter's hand and the time the dice come to rest providedthat they are confirmed verbally:1.In craps, by the dealer and a boxperson; or2.In mini-craps, by the dealer and floorperson.(b) All wagers shall be made by placing gaming chips, matchplay coupons (only for Pass or Don't Pass wagers) or plaqueson the appropriate areas of the layout, except that verbalwagers accompanied by cash may be accepted provided that ce with the regulations governing the acceptance andconversion of such instruments.

- 21 (c) A wager made on any bet may be removed or reduced at anytime prior to a roll that decides the outcome of such wagerexcept that:1.A Pass Bet and a Come Bet shall not be removed orreduced after a come out point or come point is establishedwith respect to such bet; d at any time, and shall not be removed prior to thethrowing of a loser 7.(d) A Don't Come Bet and a Don't Pass Bet may be removed orreduced at any time but may not be replaced or increased aftersuch removal or reduction.(e) All buy and place to win bets, come odds, and hardwaysshall be inactive on any come out roll unless called "On" bythe player and confirmed by the dealer through placement of an"On" marker button on the top of each player's wager.Allother wagers shall be considered "On."(f) Only players who are seated at a mini-craps table mayplace a wager at the game.Once a player has placed a wager,that player must remain seated until the completion of theround of play.
