REPORT TO THE CITY OF CRYSTAL FALLS CITY COUNCILDATE: April 10, 2017TO: Mayor David Sherby; Councillor Jeff Hagglund; Councillor Adam Schiavo; Councillor MikeMcCarthy, Councillor Maria PetersonFROM: Patrick Reagan, City ManagerRE: Manager’s Report to City CouncilMayor Sherby and City Council Members,Please find below my report on the happenings of last month; a brief overview of the non-actionitems for tonight; and an overview of the proposed resolutions that are placed before you for ourApril 10, 2017 Council meeting.Public HearingSecond Reading and Acceptance of Proposed Ordinance Amendment 1.04 – A: An Ordinance toAmend Ordinance 1.04 to have the City of Crystal Falls Planning Commission Assume the Duties ofthe Downtown Development Authority Board of Directors: As you may recall, at their regularmeeting on October 10, 2016, the DDA Board made a motion to have the Planning Commission serveas the DDA Board. After speaking with the City’s Attorney, the Counsel for the Michigan MunicipalLeague, and Steve Mann, the attorney for Miller Canfield, it was determined that transfer from theDDA to the Planning Commission is allowed under PA 197 of 1975, commonly referred to as the“DDA Establishing Act.” Steve Mann, who has worked with the City in the past as a Bond Attorney,took a look at our DDA Ordinance and updated it for the City of Crystal Falls, at no cost. This isordinance amendment is presented to you today.I would highly recommend that this ordinance amendment be read, any comment be heard (wehave received no comment, either written or verbal, at this point) and passed. The DDA may seem tobe a minor issue now but, with some planning and due diligence on our part, the DDA could be anintegral part of the City’s future.Old BusinessProposed Resolution 17-17: Acceptance of Proposed City of Crystal Falls Social Media Policy:Per the March City Council meeting, I made a change to the proposed social media policy – I haveadded the line to the policy:“All posts and comments may be subject to review by city page managers prior to being posted onany city-managed social media page.”My plan is to have all posts and comments be reviewed by me prior to them being allowed on theCity’s Facebook page. Further, I plan to perform a monthly analysis to determine how many posts/comments are received that violate the policy. I will report this number to the council each month.1

New BusinessProposed Resolution 17-27: Approving the City’s Participation in ATC’s Second Quarter Capital Call:As a member of the UPPPA, the City owns a small share of the American Transmission Company.According to Clerk/ Treasurer Peltoma, the City receives approximately 16,000 per year in interestfrom this ownership stake and by participating in these quarterly capital calls. I recommend that weparticipate in this capital call.Proposed Resolution 17-28: Approving the City’s Participation in the State Bid Process forWinter Road Salt for the 2017-2018 Season:While the weather is getting warmer, it is now time to think about the upcoming snowfall and ourroads by ordering salt through the MiDeal program. MiDeal is a state run program that assistsmunicipalities with cooperative bidding for items such as vehicles, equipment, contracted services,and road salt. I received a memo from Mary Hanses, of the Department of Technology,Management, and Budget (DTMB) that stated it is once again time for us to order our salt for the2017-2018 season.The City has typically used the MiDeal ordering process for salt due to both ease and price. Both theease and the price are directly attributable to the cooperative nature of the program itself. We orderonline, getting the best negotiated price possible, and DTMB takes care of the rest. This system istime-tested and is used by virtually every Michigan community.After speaking with DPW Foreman Stankewicz, he recommends that we order the typical amount of200 tons which will almost assuredly allow the City to get through the winter while keeping ourroads driveable and safe.Proposed Resolution 17-29: Approving the Mayor’s Reappointments to the Planning Commission:Carol Azan and Mark Ahola currently serve on the City’s Planning Commission, with both termsexpiring on April 30. I have met with both Mark and Carol and they have expressed an interest inbeing reappointed to the Planning Commission for another term.Proposed Resolution 17-30: Approving the Proposal from White Water Associates to Perform aRequired Five-Year Water Quality Monitoring Study for the City’s Hydroelectric Dam:Per the Federal Energy Regulatory Commission (FERC) – the regulatory body that grants us thelicense to operate our hydroelectric dam – the City must perform a Water Quality Monitoring Studyevery five years. I have spoken with Chief Electrician Dave Graff and he informed me that not onlydoes White Water Associates offer some of the best pricing for this type of study, they have workedwith the City before on numerous projects, including this five-year Water Monitoring Study (WhiteWater Associates also performs the testing for our Water Department). In short, the City of CrystalFalls has an excellent working relationship with this organization and I would strongly recommendthat this continue.2

Proposed Resolution 17-31: Approval to Allow the Medicare Foundation to Host a GolfScramble at Crystal View Golf Course on July 1, 2017:Keary Beck, representing the Medicare Foundation, has requested that this group be allowed toutilize the golf course for a fundraising golf scramble on July 1, 2017. Historically, the City hasallowed the course to be closed for community fundraisers such as this for a 400.00 fee. The setupproposed in the resolution is the same as the granted request from 2016. I recommend that thisproposal be passed.Proposed Resolution 17-32: Approving the Use of City Streets and City Property for a 5k Run/ 2Mile Walk Event on Saturday, July 22, 2017:Shari Tollefson has requested to utilize city street’s for a 5k Run/ 2 mile walk to help raise funds forthe Amyloidosis Foundation during the 2017 Summerfest. The run portion will utilize the same routeas the annual “Run Your Bass Off” event while the walk will utilize streets in the Western Location. Ibelieve events such as these are great – not only for the non-profit that is receiving the proceeds butalso a great opportunity to entice groups and families to experience our city. I recommend that thisproposal be passed and that I – along with event organizers – work with the Crystal Falls PoliceDepartment as well as the Michigan Department of Transportation to ensure that all necessaryforms and permits are filed so that this event can proceed smoothly.Proposed Resolution 17-33: Approval to Allow Forest Park Public Schools to Host a GolfScramble at Crystal View Golf Course on June 10, 2017:I was contacted by Kurt Anderson, on behalf of Forest Park Public Schools, with the request that thisgroup be allowed to hold a golf scramble fundraiser at Crystal View Golf Course in order to help raisefunds for an expansion of the schools weight room. Again, similar to last year’s granted event, thisgroup will pay a 400.00 fee to use the course on June 10, 2017. I recommend that this proposal bepassed.Proposed Resolution 17-34: Approval to Write Off 2,741.17 of Uncollectible MiscellaneousReceivables and 36,350.33 of Uncollectible Utility Bills:As you may recall from the audit presentation, Scott Kenny mentioned that the City has numerousunpaid utility accounts and accounts receivable that have been on the City’s books for literally years(if not, in some cases, a decade), and that correct procedure is to write these off as uncollectible.It is my understanding that City staff has made numerous attempts to collect these fees – frommonthly bills, reminder letters, and multiple letters from the City’s Attorney, nothing has producedpayment. As you can see from the calculations sheet that is attached to the resolution, many of theaccounts were from homes that were foreclosed upon with the owners simply moving awaybetween billing cycles. This has made collection nearly impossible with many of these bills being heldonto with the hope that they could be collected in the future.While I do not like writing off these accounts as bad debt, I am following the advice given by theCity’s Auditor and by the City Treasurer. However, I will be working with City staff to bring you a veryfirm policy next month that works to outline our utility billing process, our required deposit process,3

our delinquent bill paying process, the shutoff process for delinquent accounts, and a process thatdirectly outlines the steps staff is to take when all payments stop in hopes of negating this action inthe future.Proposed Resolution 17-35: Approval to Allow the Use of the Crystal View Golf Course for a ForestPark Golf Team Invitational Tournament on Friday, May 5, 2017:You can certainly tell that spring is in the air as it appears that we are discussing the golf course quitea bit this evening. I received a call from FPPS Athletic Director Bill Santilli about an upcominginvitational that the school would like to host at Crystal View Golf Course. This resolution will allowthe schools golf team to utilize the course on Friday, May 5, 2017 from 1:00 – 4:00 pm. While thereis no doubt that allowing the school to utilize the course is great for the community, I would add thatthis is also a terrific promotional device for the golf course itself as this type of event willundoubtedly introduce people from outside of our community with the intention that they gain anunderstanding of the courses beauty and fun and come back (hopefully, many times) during thesummer of 2017 and beyond. I recommend that this resolution be passed.Other Items not on the AgendaCampground Caretaker Position: the City received nineteen applications for our CampgroundCaretaker position. On Friday, April 7, I met with Gerard Valesano and Tara Peltoma to go over theapplications we received. From the original nineteen, we have selected four candidates to interview.I have contacted these candidates and we expect to interview each of them over the course of thenext week and a half.Meeting with the MEDC and Local Property Owners: I am pleased to report that I have had threemeetings in the last month with Julie Gardiner, the Community Assistance Team Representativefrom the Michigan Economic Development Corporation. The first meeting was with Mayor Sherby,Ms. Gardiner, and me where we reviewed the various programs offered to communities by theMEDC. The second meeting was between Ms. Gardiner, myself, and the new property owner at 309Superior Avenue, commonly known as the Wills Hardware Building. The property owner appeared tobe engaged and enthused and I am hoping to meet with him again very soon to further discuss hispotential project.The third meeting was again with Ms. Gardiner, I, and a business-owner that is looking to potentiallypurchase a building in our Industrial Park. As the situation progresses, I
