NOTICE TO BIDDERSMORENO VALLEY UNIFIED SCHOOL DISTRICTRE-OPENING OF PREQUALIFICATION #16-17-06 FOR PROSPECTIVE BIDDERSFOR UPCOMING PROJECTS BID THRU JANUARY 2017Notice is given that the Moreno Valley Unified School District (“District”) requires that contractors (sub-contractors) ofthe type listed in Paragraph “B” below (“Contractor(s)” or “Firm(s)”) be pre-qualified prior to submitting a bid orproposal on any of the District’s proposed construction projects including, but not limited to those projects described inParagraph “A” below. The District passed measure “M” Bond in the amount of Three Hundred Ninety-Eight MillionDollars ( 398,000,000) and has received One hundred and one Million Dollars ( 101,000,000) as initial funding to starton the projects listed below. All such projects have an estimated value in excess of One Million Dollars ( 1,000,000) ormore, and are therefore subject to Prequalification under PCC 20111.6. Interested Contractors are encouraged tocomplete and submit the District’s Bidder Prequalification Package by the deadline set forth below.During the remainder of this CY 2016-2017 Prequalification Year (which will expire on January 15, 2017 when newPrequalification Packages must be submitted), the Moreno Valley Unified School District may bid any or all of thebelow-listed 11 school Projects.However, it is certain that Project #7 [Edgemont Elementary School Reconstruction] will be bid during the remainder ofthis Prequalification Year. It is also possible that Project #6 [Canyon Springs High School] will also be bid during thisremaining Period.A. Background:In accordance with Assembly Bill 1565 and Public Contract Code section 20111.6, the MorenoValley Unified School District (“District”) has enacted its pre-qualification process under BoardPolicy and Administrative Regulation 3311. On November 17, 2015, the Board approved aresolution to implement this process.Prospective bidders are required to be pre-qualified for projects in excess of one million dollars( 1,000,000) in estimated value using any funds received pursuant to the Leroy F. Greene SchoolFacilities Act of 1998 or any funds from any future state school bond that are undertaken by districtswith an average daily attendance of 2,500 or more students. Additionally, subcontractors in thetrades of mechanical, electrical and plumbing are required to be pre-qualified. These trades areassociated with California State Contractor’s License classifications including, but not limited to: C4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and C-46. The pre-qualification processmay be conducted on a per project basis and/or on scheduled basis, as determined by the needs ofthe District. Pre-qualification status is valid for one (1) calendar year. The District has elected topre-qualify prospective bidders on a scheduled basis, and on a per-project basis only as necessary.Pre-qualification questionnaires and financial statements are not subject to disclosure under thePublic Records Act. The only component that is subject to public inspection is the pre-qualifiedbidders list. The first page of the pre-qualification packet shall be used to compile, update andmaintain the District’s pre-qualified bidders list. No other information shall be available for publicreview.The District has developed a standard questionnaire, requirements and a rating system in order topre-qualify prospective bidders. In addition, the District has developed an appeals process for thoseprospective bidders who are deemed not qualified and who desire to appeal the District’s prequalification decision.TimelineAn advertisement will be issued inviting contractors and mechanical/electrical/plumbingsubcontractors to participate in the pre-qualification process. If the District determines that prequalification is necessary for a particular project, the notice inviting bids for the project will includelanguage regarding pre-qualification.The District and/or its appointed representatives will conduct an independent review of, evaluate,and score each contractor’s/subcontractor’s submitted pre-qualification packets. Letters regardingeach contractor/subcontractor’s pre-qualification status will be sent to each contractor/subcontractorupon completion of the review. Contractors/subcontractors who receive a non-qualified status willalso be given specific details as to the basis of the non-qualified rating so that they may have anopportunity to re-submit their packet.In order to submit a valid bid for any project requiring pre-qualification, prospective bidders mustsubmit a pre-qualification questionnaire, a financial statement, and a standardized bidding form atleast ten (10) business days prior to the date fixed for the public opening of sealed bids. prospective bidders must be deemed pre-qualified to bid at least five (5) business days prior to thatdate.If a pre-qualification window is open in conjunction with a specific project, prospective biddersmust submit pre-qualification packets at least ten (10) days prior to the bid closing deadline.Bidders shall receive notification of their pre-qualification status at least five (5) days prior to thebid closing deadline. The list of pre-qualified bidders shall be published at least five (5) days priorto the bid closing timeline. The District will accomplish this task by maintaining an up-to-date listof pre-qualified bidders and posting it to the District’s website.This prequalification packet includes a questionnaire and financial statement, to be verified underoath. The District will use the information and documentation required by the packet to prequalifygeneral contractors and MEP subcontractors in accordance with Public Contract Code section20111.6.QuestionnaireAll questions in the questionnaire must be answered. If a question is not applicable, then indicatea response of “N/A”. “You” or “Yours” as used herein refers to the prospective bidders’ firm andany of its owners, officers, principals and qualifying individuals. Any references to owners,officer, principals or partners herein shall include any qualifying individuals including any RMEor RMO. If two or more business entities submit a bid on a project as a Joint Venture, or expectto submit a bid as part of a Joint Venture, each entity within the Joint Venture must be separatelyqualified to bid.Each questionnaire must be signed under penalty of perjury in the manner designated at the end ofthe form, by an individual who has the legal authority to bind the contractor on whose behalf thatperson is signing. If any information provided by a prospective bidder becomes inaccurate, theprospective bidder must immediately notify the District and provide updated accurate informationin writing, under penalty of perjury. Each prospective bidder shall have a duly authorized owner,officer or principal complete the questionnaire and verify the truth of the information providedtherein and in the financial statement.Financial StatementIn addition to completing the attached questionnaire, each prospective bidder must submit its mostcurrent reviewed or year-end audited financial statement, which must have been prepared by acertified public accountant within twelve (12) months of each prospective bidder’s submission ofthe prequalification package. Each prospective bidder must also provide its most current financialstatement, which must have been prepared within three (3) months of each prospective bidder’ssubmission of the prequalification package. Finally, each prospective bidder must submit anotarized statement from an admitted surety insurer (approved by the California Department ofInsurance and authorized to issue bonds in the State of California) which states your currentbonding capacity.005155.0003313461924.1 AALR

Financial statements submitted with this prequalification package shall not be prepared by anyindividual who is in the regular employ of the firm submitting the statement, nor by any individualor entity who has more than a ten percent (10%) financial interest in the firm’s business. If theindividual or entity that prepared a financial statement submitted with this prequalification packagehas any financial interest in the firm’s business, the firm shall notify the District of such financialinterest in a separate signed statement accompanying this prequalification package.SubmissionProspective bidders are encouraged to submit prequalification packages as soon as possible, sothat they may be notified of prequalification status well in advance of the bid process. Theprequalification packages should be sealed, marked “CONFIDENTIALPREQUALIFICATION,” and delivered to the following:Moreno Valley Unified School District, Attention Josie H. Ripoly13911 Perris Blvd., Moreno Valley, CA 92553The questionnaire answers and financial statements included in the prequalification packagessubmitted by prospective bidders are not public records and are not open to public inspection. Allsuch information provided will be kept confidential to the extent permitted by law, although thecontents may be disclosed to third parties for the purpose of verification, investigation ofsubstantial allegations, and in the process of any subsequent proceedings. State law requires thatthe names of contractors applying for prequalification status shall be public records subject todisclosure, and the first page of the questionnaire will be used for that purpose.The District will evaluate the information provided and issue each submitting prospective biddera rating of “Prequalified” or “Not Prequalified.” The District’s decision will be based on theinformation provided, references, and such additional outside information as the District in itsdiscretion deems reasonable and necessary to obtain. The District may, but is not obligated to,investigate the truth of any statements or information provided by a prospective bidder in responsehereto.Prequalification approval will remain valid thru January 2017, except that the District reserves theright to adjust, increase, limit, suspend or rescind the pre-qualification ratings based onsubsequently learned information and after giving notice of the proposed action to the prospectivebidder and an opportunity for a hearing consistent with the hearing procedures described belowfor appealing a pre-qualification determination.While it is the intent of the prequalification questionnaire and documents required herein to assistthe District in determining bidder responsibility prior to the submission of bids and to aid theDistrict in selecting the lowest responsible bidder, neither the fact of prequalification, nor anyprequalification rating, will preclude the District from a post-bid consideration and determinationon a specific project of whether a bidder has the quality, fitness, capacity and experience tosatisfactorily perform the proposed work, and has demonstrated the requisite trustworthiness.005155.0003313461924.1 AALR

Appeals Process:Informal Appeal:Contractors/subcontractors who receive a non-qualified status shall have the opportunity to appealthe decision. First, contractors/subcontractors may wish to submit any necessary documents thatwill complete their submittal packet and/or that support a qualified rating. Contractors/subcontractors may do so during the open window prior to the pre-qualification deadline and/or biddeadline in accordance with all applicable laws, codes and regulations.Contractors/subcontractors may also wish to submit documents in support of a qualified rating afterthe deadline, while forgoing the opportunity to bid on the specific project, yet in anticipation ofbecoming pre-qualified for future projects.Interested contractors and subcontractors may submit pre-qualification packets, and/or additionaldocumentation at any time; however, packets will only be reviewed and responded to duringscheduled periods of open pre-qualification periods. Open pre-qualification periods will beadvertised in a newspaper of general circulation and on the District’s website.Formal Appeal:After the above procedures have been exhausted, should a contractor or subcontractor still bedeemed to be non-qualified, the contractor/subcontractor shall have the right to a formal appeal. Arequest for appeal of the District’s pre-qualification decision is timely if it is submitted within seven(7) days of the date of the District’s written notice to the contractor/subcontractor of itsprequalification status following a submittal (or resubmittal, if applicable), unless the time forappeal is expressly extended by the District in a public notice. All appeal requests must besubmitted in writing to the District’s Chief Business Official and the Purchasing Director. Therequest must specify the contractor’s/subcontractor’s grounds for seeking an appeal and shouldinclude all information supporting its position that the District’s determination should be changed.Upon receipt of a timely written request, the District shall establish an appeals panel to conduct ahearing to review the request and reconsider the contractor’s/subcontractor’s disqualification. Atthe hearing, the contractor/subcontractor will be given the opportunity to present information andmake an oral statement regarding its opposition to the District’s prequalification decision. Thepanel shall then issue a decision within five (5) business days of the hearing. The decision of theappeals panel shall be final. The contractor/subcontractor will be allowed to submit a new prequalification packet, at its discretion, at any time in accordance with the processes and timelinesoutlined above.Failure of a contractor/subcontractor to timely follow this appeal procedure shall constitute awaiver of the contractor’s/subcontractor’s right to appeal the District’s prequalificationdecision.005155.0003313461924.1 AALR

BiddingBids will not be accepted from any prospective bidder that did not timely submit a completedprequalification questionnaire and supporting documents, including financial statements, to theDistrict. Omission of requested information, falsification of information, or failing to use the formsprovided by the District may result in a finding of “not prequalified”.MEP subcontractors (licensed pursuant to Section 7058 of the Business and Professions Code,specifically contractors holding C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, andC-46 licenses) must also meet prequalification requirements on all projects using funds receivedpursuant to the Leroy F. Greene School Facilities Act of 1998 or any funds from any future stateschool bond that involves a projected expenditure of one million dollars ( 1,000,000) or more. Ifa project includes electrical, mechanical, or plumbing components that will be performed by MEPsubcontractors, a list of prequalified general contractors and MEP subcontractors will be madeavailable by the District to all bidders at least five (5) business days prior to the dates fixed for thepublic opening of sealed bids.Please note where mechanical, electrical, and plumbing subcontractors must meet pre-qualificationrequirements, general contractors will be required to specify subcontractors who have already beenplumbing subcontractor who is not on the District’s Bidder’s List, then such Contractor mustensure questionnaire to the District as required by this Notice and are pre-qualified with the Districtin accordance with the timelines and procedures applicable to all Bidders. Contractors seekingprequalification must answer all questions.If a general contractor uses any MEP subcontractor required for any project, such MEPsubcontractor must be prequalified pursuant to these prequalification forms and requirements. Ifa MEP subcontractor in any general contractor bid is not prequalified, that bid will not be accepted.Prospective bidders are warned that a project may have specific requirements that differ or are inaddition to being properly prequalified pursuant to these documents. A determination that acontractor or MEP subcontractor is prequalified pursuant to these documents does notautomatically mean a contractor or MEP subcontractor meets all of the requirements of a specificproject. Prospective bidders are instructed to carefully review the requirements for each projectbefore submitting a bid.The District reserves the right to amend the prequalification packet at any time.
