Previously, their occupational and professional license requirements and portability changed with each newassignment, causing military families valuable time and earned income as military spouses came into compliance. Ensuring military familiesexperience a seamless transition between their assignments is a top priority in Virginia.History of Virginia’s ProcessIn 2012, Virginia became one of the leading states to establish an expedited application process and automatic temporary license for theoccupational and professional licensure for military spouses who accompany their active duty service member assigned to installations in theCommonwealth: 2012: Legislation establishes an expedited licensure application process and a six-month temporary license within 30 days of receipt; 2014: General Assembly reduces the time applicants need to wait from 30 days to 20 days; 2016: General Assembly increases the length of the issued temporary license from 6 months to 12 months.Virginia's Previous ProcessVa. Code § 54.1-119, assigns the Virginia Department of Occupational & Professional Regulation (DPOR) and the Department of HealthProfessions (DHP) as the two agencies responsible for overseeing the implementation of this expedited process. A military spouse files an application with the agency after receipt of their service member spouse’s PCS orders.The agency has 20 days to determine whether the military spouse’s license is “substantially equivalent;”If YES, the applicant is granted a full Virginia License.If NO, the agency and boards automatically issues a 1-year temporary license; the parties then will work with the applicant to remedy anyissues identified.4

Improving Virginia’s Existing ProcessIdentified Issues:1.) Previously, the law only applied to the spouses of service members who wereassigned to active duty installations in the Commonwealth; Left out an assumed large number of military spouses residing in theCommonwealth, but whose spouses were assigned to an installation in asurrounding jurisdiction; Out of State, but Assigned vs In-state, and Assigned?2.) The law did NOT apply to the spouses of Virginia National Guardsmen whodeployed on Title 10 orders;3.) Lacked explicit Licensing Board Waiver Authority;4.) Did not address the needs of spouses of transitioning service members.5

Improving Virginia’s Existing ProcessEffects of Passed Legislation (HB967 / SB981)1.) Added eligibility to the spouses of service members assigned to installations in allsurrounding jurisdictions;2.) Included the spouses of National Guardsmen whose service member spousereceives Title 10 orders;3.) Included the spouses of Veterans transitioned from active duty (within 1 year);4.) Empowered Virginia Licensing Boards explicit and enhanced authority to waive“time in practice requirements.”6
