Human trafficking is modern-day slavery. Traffickers use force, fraud and coercion to control theirvictims. Any minor engaged in commercial sex is a victim of human trafficking. DRIVERS OF FARM COVERED VEHICLES NOW EXEMPTFROM COMMERCIAL DRIVER’S LICENSE REQUIREMENTSLegislative Bill 983 was signed into Nebraska law by Governor Heineman on March 29, 2014 andbecame effective March 30, 2014. Among the provisions of LB 983 was the implementation ofFederal MAP 21 legislation regarding drivers of Covered Farm Vehicles.Covered Farm Vehicle means a motor vehicle, including an articulated motorvehicle that:-Is operated by a farm/ranch owner or operator, or an employee or a family member of thefarmer or rancher.Transports agricultural commodities, livestock or machinery or supplies to and from a farm orranch.Is equipped with a special license plate or other designation by the state in which the vehicle isregistered to allow for the identification of the vehicle as a farm vehicle by law enforcement.Covered Farm Vehicle does NOT include:-Vehicles for hire.A combination of truck-tractor and semitrailer which is operated by a person under eighteenyears of age.A combination of truck-tractor and semitrailer transporting hazardous materials in quantitiesrequiring placarding.Where can covered farm vehicles be operated?-26,000 pounds or less – anywhere in Nebraska and in any other state.26,001 pounds or more – anywhere in Nebraska26,001 pounds or more – may cross state lines, provided it is operated within 150 miles of thefarm/ranch’s operation.If you plan to travel in other states using the covered farm exemption, be surethat you know what regulations apply in those states:-Wyoming Department of Transportation 307.777.4375Missouri State Patrol Commercial Vehicle Enforcement 573.526.6128South Dakota Motor Carrier Headquarters 605.773.4578Iowa Department of Transportation 800.925.6469Kansas Transportation Division 785.271.31454/24/14Page 1

FAQ’s about Covered Farm Vehicle Law Change1. I drive a farm-plated tractor-trailer placarded for hazmat. Do I need a CDL?Yes. Tractor-trailer drivers of vehicles placarded for hazmat are not exempt fromCDL requirements under LB983.2. I’ve been exempt from CDL requirements for years driving my farm-plated straight truckthat hauls placardable amounts of hazmat. Has anything changed?No. Drivers of farm-plated straight trucks can continue to operate without a CDLeven when hauling placardable amounts of hazmat.3. I am 19 years old and previously needed a Class A CDL to drive my farm-plated tractortrailer. I have a K restriction (no interstate driving). Am I now allowed to drive across statelines with my farm-plated tractor-trailer? How does the K restriction figure into this? Sinceyour tractor-trailer now falls under the Covered Farm Vehicle definition, as long asyour vehicle is not placarded for hazmat and you stay within the state of Nebraska orwithin 150 of the farm/ranch, you may operate this vehicle since it is not considereda commercial vehicle. The K restriction is not germane to non-commercial vehicles.A Nebraska Class O license is required to operate a Covered Farm Vehicle.4. Do I have to give up my CDL now that the only vehicle I drive is exempt from CDLrequirements?There is no need to surrender your CDL, unless you want to. Keep in mind, if youdrop your CDL, you’ll have to start all over if you ever want to drive vehiclesrequiring a CDL in the future.5. I want to keep my CDL, but I cannot determine on the Self Certification Categories charthow I medically qualify? I am now exempt from CDL requirements and only drive aCovered Farm Vehicle. How should I medically certify?The decision on the proper category to medically certify is completely up to you, thedriver. TANk VEHICLE DEFINITION:The tank vehicle definition is: “Tank vehicle means any commercial motor vehicle that is designed to transportany liquid or gaseous materials within a tank that is either permanently or temporarily attached to the vehicle orthe chassis. Such vehicle includes, but is not limited to, a cargo tank and a portable tank, as defined in 49 C.F.R.171. However, this definition does not include a portable tank that has a rated capacity under one thousandgallons.A commercial motor vehicle hauling any portable tank with a maximum capacity greater than 119 gallons that isnot permanently attached to a vehicle, but is loaded and unloaded without being removed from the vehicle is tobe treated the same as if it were a permanently attached cargo tank. In these instances, the exception forportable tanks with capacities less than one thousand gallons would not apply and the tank endorsement wouldbe required.A commercial motor vehicle hauling a portable tank having a rated capacity under one thousand gallons doesnot need the tank endorsement, provided the tank is filled before being loaded on the truck and then emptiedafter being unloaded from the truck.SECuRITy THREAT ASSESSMENT pROCEDuRES:Prior to the issuance of a Nebraska CDL with the hazardous materials endorsement, individuals are required perthe U.S. PATRIOT ACT to have a Transportation Security Administration (TSA) security threat assessmentcompleted.The security threat assessment procedures require individuals to pre-enroll and be fingerprinted. A fee will becharged. This process will be handled by a TSA third party agent – NOT THE DMV.The following procedures should be followed to have a security threat assessment completed: Contact the TSA either by phone toll-free at 1-855-347-8371. Their hours are 8 a.m. – 10 p.m. EST,Monday-Friday. After completing pre-enrollment, access the following website to find a fingerprint collection locationnearest you: https://universalenroll.dhs.gov/locator. This website will provide you fingerprint collectionlocations in Nebraska as well as other states. The DMV will be notified by TSA when a “Determination of No Security Threat” is received. Upon receiptof that notification, individuals will be sent a letter informing them of such by the DMV. Individuals may thenproceed to any driver licensing office and after meeting all DMV requirements, a CDL with the hazardousmaterials endorsement will be issued. This CDL will be valid for five years from the date of the securitythreat assessment. Please remember that all questions related specifically to the security threat assessment should bedirected to the TSA toll free number or the TSA website.MISCELLANEOuS INFORMATION:Information regarding: reciprocity, school bus permit requirements, safety belt usage, proof of address andidentification, U.S. citizenship, social security number verification and other licensing requirements can be foundin the Nebraska driver’s Manual. Please read it in conjunction with this manual.Persons living in or employed in Nebraska for 30 days or more must apply for a Nebraska license.Please make application for a new, renewal, duplicate or replacement CDL to driver licensing staff – not theCounty Treasurer.Endorsement and disqualification information can be found on pages 1-1 through 1-5 of this manual.Audio versions of the knowledge tests are available at all driver licensing offices throughout the state.LEARNER’S pERMIT COMMERCIAL:A commercial learner’s permit (LPC) is valid for six months. Individuals shall present proof to driver licensing staffthat he or she holds a valid Class O (operator’s) license or Commercial Driver’s License or shall successfullycomplete the requirements for the Class O license before an LPC is issued. An applicant shall also successfullycomplete the CDL general knowledge examination. Upon application, the examination may be waived if theapplicant presents a Nebraska CDL which is valid or has been expired for less than one year, presents a validNebraska Specifics - Page 4

CDL from another State, or is renewing a Nebraska LPC that is valid or has been expired for less than one year.The LPC will authorize the person to operate a commercial motor vehicle for learning purposes whenaccompanied by a person who is at least 21 years of age, and who is CDL qualified for the class of vehicle beingoperated. An LPC may only be renewed once in a two-year period.RESTRICTED CDL:Any resident of this state who is a seasonal commercial motor vehicle operator for a farm-related or ranchrelated service industry may apply for a Restricted Commercial Driver’s License (RCDL). A RCDL authorizes thelicense holder to operate any Class B or Class C commercial motor vehicle. Any applicant for a RCDL must be18 years of age or older and must have possessed a valid operator’s license or Provisional Operator’s Permitduring the twelve-month period immediately preceding the date of application.SEASONAL pERMIT:A permit which is valid for 180 consecutive days, issued to the holder of a Restricted CDL, authorizing the personto operate a Class B or Class C vehicle. May only be issued once in a 12-month period.THIRD pARTy TESTERS:Third party testers are companies that are authorized to conduct the driving skills examination for the issuanceof the CDL for a fee. These companies must follow all requirements outlined in title 247 NAC, Chapter 8,Nebraska Department of Motor Vehicles Rules and Regulations Governing the Certification of Third-PartyTestersand Third-Party Examiners for the Commercial Driver’s License. You can view these rules and regulations andobtain a list of third party testers online at www.dmv.ne.gov/examining or by contacting the DMV.Applicants who are administered CDL skills tests at a third party tester location should be aware that they maybe required to retake the skills test administered by driver licensing staff or at a later date as part of the DMVaudit process. If you are asked to retake the skills tests by driver licensing staff and refuse, the issuance of yourCDL may be denied. 2005 Model Commercial Driver’s License Manual1.1 – Commercial Driver License Tests1.1.1 – Knowledge TestsYou will have to take one or more knowledge tests,depending on what class of license and whatendorsements you need. The CDL knowledgetests include:move your vehicle forward, backward, and turn itwithin a defined area. These areas may be markedwith traffic lanes, cones, barriers, or somethingsimilar. The examiner will tell you how each controltest is to be done.The passenger transport test, taken by all busdriver applicants.On-road Test. You will be tested on your skill tosafely drive your vehicle in a variety of trafficsituations. The situations may include left and rightturns, intersections, railroad crossings, curves, upand down grades, single or multi-lane roads,streets, or highways.
