Section 103.1.1(Local Amendment) 103.1.1 Permits Required. It shall be unlawful forany person, firm, or corporation to make anyinstallation, alteration, repair, replacement, or toremodel any plumbing system regulated by thiscode except as permitted in section 103.1.2, orto cause the same to be done without firstobtaining a separate plumbing permit for eachseparate building, structure, or on-site plumbingor non-potable water reuse system.

Ch. 2 Definitions(Local Ordinance) Plumbing System: includes all potable water,building supply, and distribution pipes; allplumbing fixtures and traps; all drainage andvent pipes; and all building drains and buildingsewers, including their respective joints andconnections, devices, receptors, andappurtenances within the property lines of thepremises and shall include potable water piping,nonpotable water reuse systems, irrigationsystems, potable water treating or usingequipment, medical gas and medical vacuumsystems, liquid and fuel gas piping, and waterheaters and vents for same.

Chapter 3-General Regulations 313.9 Plastic and copper pipingpenetrating a framing members to withinone (1) inch (25.4 mm) of the exposedframing shall be protected by steel nailplates not less than No. 18 gauge (0.0478inches) (1.2 mm) in thickness. The steelnail plate shall extend along the framingmember not less than one and one-half (11/2) inches (38 mm) beyond the outsidediameter of the pipe or tubing.

Chapter 4 Fixtures(Local Amendment) 402.2 Water Closets. Effective May 1st,2010, water closets, including flush tank,flushometer tank, and flushometer valveoperated, shall have an averageconsumption of a maximum of 1.28gallons of water per flush. (The Ordinance is effective October 1st,2010)

Chapter 4 Fixtures(Local Amendment) 402.3.1 Nonwater Urinals. Nonwater urinalsshall be listed and comply with the applicablestandards referenced in Table 14-1. Nonwaterurinals shall have a barrier liquid sealant tomaintain a trap seal. Nonwater urinals shallpermit the uninhibited flow of waste through theurinal to the sanitary drainage system. Nonwaterurinals shall be cleaned and maintained inaccordance with the manufacturer's instructionsafter installation. Where nonwater urinals areinstalled they shall have a water distribution linerough-in to the urinal location to allow for theinstallation of an approved backflow preventiondevice in the event of a retrofit. Chapter 4 Fixtures(Local Amendment) Nonwater urinals that are determined by theAuthority Having Jurisdiction to have beenmaintained contrary to the manufacturer'sinstructions, and determined to be a healthhazard or detrimental to public health and safetyshall be retrofitted by a flushometer type urinalcomplying with Section 402.3. The BuildingOfficial shall establish the timeline for a retrofit ifpublic health is compromised.

Chapter 4 Fixtures 407.5 Setting. Fixtures shall be set level and inproper alignment with reference to adjacentwalls. No water closet or bidet shall be set closerthan fifteen (15) inches (381 mm) from its centerto any side wall or obstruction nor closer thanthirty (30) inches (762 mm) center to center toany similar fixture. The clear space in front ofany water closet or bidet shall be not less thantwenty-four (24) inches (610 mm). No urinalshall be set closer than twelve (12) inches (305mm) from its center to any side wall or partitionnor closer than twenty-four (24) inches (610mm) center to center. Exception: The installation of paper dispensersor accessibility grab bars shall not be consideredobstructions.

Chapter 4 Fixtures(Local Amendment) 411.6.1 Accessible Shower Stalls. A roomthat contains an accessible shower whichhas a threshold or curb which is less than1/2 inch in height and all roll-in accessibleshowers shall be equipped with a Codeapproved emergency floor drain.

Chapter 4 Fixtures Excerpt from 411.8 Showers that are provided with a built in place,permanent seat or seating area that is locatedwithin the shower enclosure, shall be first linedwith sheet plastic,* lead,* copper,* or shall belined with other durable and water-tight materialsthat extend not less than three (3) inches (76mm) above horizontal surfaces of the seat or theseating area.

Chapter 4 Fixtures 413.1 Limitation of Hot WaterTemperature for Public Lavatories. Hotwater delivered from public use lavatoriesshall be limited to a maximum temperatureof 120 F (49 C) by a device that conformsto ASSE 1070 or CSA B125.3. The waterheater thermostat shall not be considereda control for meeting this provision.

Chapter 4 Fixtures 414.5 Limitation of Hot Water inBathtubs and Whirlpool Bathtubs. Themaximum hot water temperaturedischarging from the bathtub and whirlpoolbathtub filler shall be limited to 120ºF(49ºC) by a device that conforms to ASSE1070 or CSA B125.3. The water heaterthermostat shall not be considered acontrol for meeting this provision.

Chapter 4 Fixtures 416.3 Limitation of Water Temperaturein Bidets. The maximum hot watertemperature discharging from a bidet shallbe limited to 110ºF (43ºC) by a device thatconforms to ASSE 1070 or CSA B125.3.The water heater thermostat shall not beconsidered a control for meeting thisprovision.

Chapter 4 Fixtures 418.0 Shower and Tub-Shower Combination ControlValves. Showers and tub-shower combinations inbuildings shall be provided with individual control valvesof the pressure balance, thermostatic, or combinationpressure balance/thermostatic mixing valve type thatprovide scald and thermal shock protection. Thesevalves shall conform to ASSE 1016 or ASMEA112.18.1/CSA B125.1. Gang showers, when suppliedwith a single temperature-controlled water supply pipe,shall be controlled by a mixing valve that conforms toASSE 1069. Handle position stops shall be provided onsuch valves and shall be adjusted per the manufacturer’sinstructions to deliver a maximum mixed water setting of120 F (49 C). The water heater thermostat shall not beconsidered a suitable control for meeting this provision.

Chapter 5 Water Heaters 505.0 Water Heater Requirements. 505.1 Location. Water heater installations in bedroomsand bathrooms shall comply with one of the following[NFPA 54:10.28.1]: (1) Fuel-burning water heaters may be installed in acloset located in the bedroom or bathroom provided thecloset is equipped with a listed, gasketed door assemblyand a listed self-closing device. The self-closing doorassembly shall meet the requirements of Section505.1.1. The door assembly shall be installed with athreshold and bottom door seal and shall meet therequirements of Section 505.1.2. All combustion air forsuch installations shall be obtained from the outdoors inaccordance with Section 507.4. The closet shall be forthe exclusive use of the water heater. Chapter 5 Water Heaters 505.1.1 Self-Closing Doors. Self-closingdoors shall swing easily and freely andshall be equipped with a self-closingdevice to cause the door to close and latcheach time it is opened. The closingmechanism shall not have a hold openfeature. [NFPA 80:6.1.4.2] (contd)

Chapter 5 Water Heaters 505.1.2 Gasketing. Gasketing on gasketeddoors or frames shall be furnished only inaccordance with the published listings of thedoor, frame, or gasketing material manufacturer.[NFPA 80:6.4.8] Exception: Where acceptable to the AuthorityHaving Jurisdiction, gasketing of noncombustible or limited-combustible material (seeNFPA 220, Standard on Types of BuildingConstruction) shall be permitted to be applied tothe frame, provided closing and latching of thedoor are not inhibited.

Chapter 5 Water Heaters 510.7.4.1 Prohibited Use. Single-wallmetal pipe shall not be used as a vent indwellings and residential occupancies.[NFPA 54-09:12.8.4.1]

Chapter 5 Water Heaters 510.10.4.1 Where two (2) or moreopenings are provided into one (1)chimney flue or vent, the openings shalleither be at different levels, or theconnectors shall be attached to the verticalportion of the chimney or vent at an angleof 45 degrees or less relative to thevertical. ENERGY ORDINANCELANGUAGE THAT AFFECTSCOMMERCIAL WATER HEATERS 504.8 Electric water heater timers. For Group Rbuildings electric resistance water heaters mustbe installed in conjunction with apreprogrammed water heater timer. The timershall be preprogrammed to turn the water heateroff between the hours of 3:00 p.m. and 7:00 p.m.from June 1 to September 30 and from 12:00a.m. to 4:00 a.m. throughout the year. The timershall have a readily accessible override, asdefined by the building official administrativerule, capable of restoring power to the waterheater for one hour when activated.

Chapter 6 Water Supply 601.1.1 Hot and Cold Water Required. Inoccupancies where plumbing fixtures areinstalled for private use, hot and cold potablewater shall be required for bathing, washing,laundry, cooking purposes, dishwashing, ormaintenance. In occupancies where plumbingfixtures are installed for public use, hot watershall be required for bathing and washingpurposes. This requirement shall not supersedethe requirements for individual temperaturecontrol limitations for public lavatories, bathtubs,whirlpool bathtubs and shower control valves,nor shall it supersede the requirements for hotwater by the Health Authority.

Chapter 6 Water Supply(Local Ordinance) 601.1.2 Water System ConnectionRequired. The water system of everyhouse or building shall be separately andindependently connected to a statelicensed public potable water system if anypart of the lot or tract that contains thehouse or building is within 100 feet inhorizontal distance (measured on theclosest practicable access route) of thepublic water system. Connection to thepublic water system is not required if anyof the following apply: (cont’d)

Chapter 6 Water Supply(Local Ordinance) (1) The property owner has received a written denial ofservice from the owner or governing body of the publicwater system. (2) The property owner has received a writtendetermination from the water utility that it is not feasiblefor the building to be connected to the potable watersystem. (3) The property is served by an existing private potablewater system and the water utility has determined thatthe private potable water system may continue to beused based on factors such as the type of facility served,the age, condition, and capacity of the private potablewater system, and the availability of records regardingthe system, changes to the system, or the systemdemand.

Chapter 6 Water Supply(Local Ordinance) 601.1.3 If a state licensed public potable watersystem is unavailable within the full purposejurisdiction of the City of Austin, then anyalternative source used for potable water shallbe installed per the provisions of this code. Rainwater collection systems utilized for potablewater shall comply with the latest edition of theTexas Manual on Rainwater Harvesting by theTexas Water Development Board and any otherapplicable state laws.

Chapter 6 Water Supply(Local Ordinance) 601.2.2 Color and Information. Each system shall beidentified with a colored pipe or band and coded withpaints, wraps and materials compatible with the piping.Except as required by Chapter 16, non-potable watersystems shall have a yellow background with blackuppercase lettering, with the words "CAUTION:NONPOTABLE WATER, DO NOT DRINK." Eachnonpotable system shall be identified to designate theliquid being conveyed, and the direction of normal flowshall be clearly shown. The minimum size of the lettersand length of the color field shall conform to Table 6-1.The background color and required information shall beindicated every twenty (20) feet (6,096mm) but not lessthan once per room, and shall be visible from the floorlevel.

Chapter 6 Water Supply 604.8 Approved plastic materials shall be permitted to beused in water service piping, provided that where metalwater service piping is used for electrical groundingpurposes, replacement piping therefore shall be of likematerials. Exception: Where a grounding system acceptable to theAuthority Having Jurisdiction is installed, inspected, andapproved, metallic pipe shall be permitted to be replacedwith nonmetallic pipe. Plastic materials for water servicepiping outside underground shall have a blue insulatedcopper tracer wire or other approved conductor installedadjacent to the piping. Access shall be provided to thetracer wire or the tracer wire shall terminate aboveground at each end of the nonmetallic piping. The tracerwire size shall be not less than 18 AWG and theinsulation type shall be suitable for direct burial.

Chapter 6 Water SupplyThis is in response to your request for clarification on the UniformPlumbing Code regarding Materials. The question (s) consideredwas (were):The exception to 604.8 requires the installation of a tracerwire. Is the tracer wire installation requirement only applicableto replacement installation? Per Section 604.8 do allinstallations of outside underground water piping require atracer wire to be installed?The 2010 UPC Answers & Analysis Committee answered Item #1019 as follows:The requirements, found in Section 604.8 of the 2009 UPC, for atracer wire for underground plastic water services is requiredfor both new and replacement installations.
