Using technology, weare now able to disseminate new orders, policy changes, and reference material to all of ouremployees efficiently, effectively, and in a timely manner. Our goal is to be able to provide eachemployee with the necessary information they need with a touch of a button. I hope that you findthis policy system useful. If there is additional information you think would be useful to have in thissystem, please do not hesitate to contact our administrative staff members.This manual is the preeminent publication for the Antioch Police Department's Policies. Therules and regulations contained in this policy manual contain the guidelines for all Departmentpersonnel. They also provide a set of values and beliefs which give substance and meaning to theactivities of the employees of this Department. You will find links to our Mission Statement, ourOrganizational Values, and the Law Enforcement Code of Ethics. I encourage you to review theseon a regular basis. All employees are responsible for making certain they know and understandthe policies and procedures contained in this policy system.It is the policy of the Antioch Police Department to maintain training, policies and procedures thatensure employees conduct official business in a safe and professional manner. Our goal, throughperiodic training and reference to this manual, is to provide direction and guidance for the dayto-day efficient operations of the Department. Suggestions for updates or content changes arewelcome and encouraged by any member of this Department.I want to thank you for the great job that you perform every day. Antioch Police DepartmentAntioch PD Policy ManualLAW ENFORCEMENT CODE OF ETHICSAs a law enforcement officer, my fundamental duty is to serve the community; to safeguardlives and property; to protect the innocent against deception, the weak against oppression orintimidation and the peaceful against violence or disorder; and to respect the constitutional rightsof all to liberty, equality and justice.I will keep my private life unsullied as an example to all and will behave in a manner that doesnot bring discredit to me or to my agency. I will maintain courageous calm in the face of danger,scorn or ridicule; develop self-restraint; and be constantly mindful of the welfare of others. Honestin thought and deed both in my personal and official life, I will be exemplary in obeying the lawand the regulations of my department. Whatever I see or hear of a confidential nature or that isconfided to me in my official capacity will be kept ever secret unless revelation is necessary inthe performance of my duty.I will never act officiously or permit personal feelings, prejudices, political beliefs, aspirations,animosities or friendships to influence my decisions. With no compromise for crime and withrelentless prosecution of criminals, I will enforce the law courteously and appropriately withoutfear or favor, malice or ill will, never employing unnecessary force or violence and never acceptinggratuities.I recognize the badge of my office as a symbol of public faith, and I accept it as a public trust to beheld so long as I am true to the ethics of police service. I will never engage in acts of corruptionor bribery, nor will I condone such acts by other police officers. PolicyAntioch Police Department100Antioch PD Policy ManualPolicy Manual100.1 PURPOSE AND SCOPEThe manual of the Antioch Police Department is hereby established and shall be referred to asthe Policy Manual or the manual. The manual is a statement of the current policies, rules andguidelines of this department. All members are to conform to the provisions of this manual.All prior and existing manuals, orders and regulations that are in conflict with this manual arerescinded, except to the extent that portions of existing manuals, procedures, orders and otherregulations that have not been included herein shall remain in effect, provided that they do notconflict with the provisions of this manual.100.2 POLICYExcept where otherwise expressly stated, the provisions of this manual shall be consideredas guidelines. It is recognized that the work of law enforcement is not always predictable andcircumstances may arise which warrant departure from these guidelines. It is the intent of thismanual to be viewed from an objective standard, taking into consideration the sound discretionentrusted to members of this department under the circumstances reasonably available at thetime of any incident.100.2.1 DISCLAIMERThe provisions contained in the Policy Manual are not intended to create an employment contractnor any employment rights or entitlements. The policies contained within this manual are forthe internal use of the Antioch Police Department and shall not be construed to create a higherstandard or duty of care for civil or criminal liability against the City, its officials or members.Violations of any provision of any policy contained within this manual shall only form the basis fordepartment administrative action, training or discipline. The Antioch Police Department reservesthe right to revise any policy content, in whole or in part.100.3 AUTHORITYThe Chief of Police shall be considered the ultimate authority for the content and adoption of theprovisions of this manual and shall ensure compliance with all applicable federal, state and locallaws. The Chief of Police or the authorized designee is authorized to issue Interim Directives,which shall modify those provisions of the manual to which they pertain. Interim Directives shallremain in effect until such time as they may be permanently incorporated into the manual.100.4 ISSUING THE POLICY MANUALAn electronic version of the Policy Manual will be made available to all members on the departmentnetwork for viewing and printing. Antioch Police DepartmentAntioch PD Policy ManualPolicy ManualEach member shall acknowledge that he/she has been provided access to, and has had theopportunity to review the Policy Manual and Interim Directives. Members shall seek clarificationas needed from an appropriate supervisor for any provisions that they do not fully understand.100.5 PERIODIC REVIEW OF THE POLICY MANUALThe Chief of Police will ensure that the Policy Manual is periodically reviewed and updated asnecessary.100.6 REVISIONS TO POLICIESAll revisions to the Policy Manual will be provided to each member on or before the date the policybecomes effective. Each member will be required to acknowledge that he/she has reviewed therevisions and shall seek clarification from an appropriate supervisor as needed.Members are responsible for keeping abreast of all Policy Manual revisions.Each Bureau Commander will ensure that members under his/her command are aware of anyPolicy Manual revision.All department members suggesting revision of the contents of the Policy Manual shall forwardtheir written suggestions to their Bureau Commanders, who will consider the recommendationsand forward them to the command staff as appropriate.Copyright Lexipol, LLC 2022/05/12, All Rights Reserved.Published with permission by Antioch Police DepartmentPolicy Manual - 11

PolicyAntioch Police Department101Antioch PD Policy ManualLaw Enforcement Authority101.1 PURPOSE AND SCOPEThe purpose of this policy is to affirm the authority of the members of the department to performtheir functions based on established legal authority.101.2 POLICYIt is the policy of the Antioch Police Department to limit its members to only exercise the authoritygranted to them by law.While this department recognizes the power of peace officers to make arrests and take otherenforcement action, officers are encouraged to use sound discretion in the enforcement of thelaw. Antioch Police DepartmentAntioch PD Policy ManualLaw Enforcement Authority(b)When the officer has probable cause to believe the person has committed amisdemeanor in the presence of the officer and the officer reasonably believes thereis immediate danger to person or property or of escape.(c)When the officer has probable cause to believe the person has committed amisdemeanor for which an arrest is authorized even if not committed in the presence ofthe officer such as certain domestic violence offenses and there is immediate dangerto person or property or of escape or the arrest is mandated by statute.(d)When authorized by a cross jurisdictional agreement with the jurisdiction in which thearrest is made.(e)In compliance with an arrest warrant.On-duty arrests will not generally be made outside the jurisdiction of this department except incases of hot or fresh pursuit, while following up on crimes committed within the City, or whileassisting another agency.On-duty officers who discover criminal activity outside the jurisdiction of the City shouldwhen circumstances permit, consider contacting the agency having primary jurisdiction beforeattempting an arrest.101.3.3 TIME OF MISDEMEANOR ARRESTSOfficers shall not arrest a person for a misdemeanor between the hours of 10:00 p.m. of any dayand 6:00 a.m. of the next day unless (Penal Code § 840):(a)The arrest is made without a warrant pursuant to Penal Code § 836 which includes:(a)A misdemeanor committed in the presence of the officer.(b)Misdemeanor domestic violence offenses (See the Domestic Violence Policy).(b)The arrest is made in a public place.(c)The arrest is made with the person in custody pursuant to another lawful arrest.(d)The arrest is made pursuant to a warrant which, for good cause shown, directs that itmay be served at any time of the day or night.101.4 INTERSTATE PEACE OFFICER POWERSPeace officer powers may be extended to other states:(a)As applicable under interstate compacts, memorandums of understanding or mutualaid agreements in compliance with the laws of each state.(b)When an officer enters an adjoining state in close or fresh pursuit of a person believedto have committed a felony (ARS § 13-3832; NRS 171.158; ORS 133.430).The person arrested out of state must be taken without unnecessary delay before a magistrate ofthe county in which the arrest was made (ARS § 13-3833; NRS 171.158; ORS 133.440).Peace officers of another state who enter the State of California in fresh pursuit to arrest a personwho has committed a felony in the other state have the same authority to arrest and hold in custodyCopyright Lexipol, LLC 2022/05/12, All Rights Reserved.Published with permission by Antioch Police DepartmentLaw Enforcement Authority - 13
