O-08-111 AND EXTENDING THE FRANCHISE OFTHE CONWAY CORPORATION TO OPERATE A CABLE TELECOMMUNICATIONS PLANT ANDFACILITIES OF THE CITY OF CONWAY, ARKANSAS.WHEREAS, the City of Conway, Arkansas (the “City”), a city of the first class, presently owns aTelecommunications Plant (as defined in Ordinance No. O-08-111) serving the residents of the City, whichTelecommunications Plant is presently operated and maintained by the Conway Corporation, a nonprofitcorporation organized and existing under the laws of the State of Arkansas (the “Corporation”), pursuantto an exclusive franchise to operate and maintain the Telecommunications Plant granted to theCorporation by the City pursuant to Ordinance No. O-08-111 adopted on September 23, 2008; andWHEREAS, the City desires to extend the term of the franchise previously granted to theCorporation;NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Conway, Arkansas that:Section 1.The term of the franchise granted to the Corporation by Ordinance No. O-08111 is hereby extended to December 31, 2050 and Section 2 of Ordinance No. O-08-111 is hereby deemedamended to such effect. All other provisions of Ordinance No. O-08-111 shall remain in full force andeffect.Section 2.The extension of franchise granted by this Ordinance shall be accepted inwriting by the Corporation within thirty (30) days from the date of adoption of this Ordinance, whereuponthe franchise shall be deemed to be extended as provided in Section 1.Section 3.The provisions of this Ordinance are hereby declared to be severable, and if anysection, phrase or provision shall for any reason be declared to be illegal or invalid, such declaration shallnot affect the validity of the remainder of the sections, phrases or provisions of this Ordinance.Section 4.All ordinances, resolutions and parts thereof in conflict herewith are herebyrepealed to the extent of such conflict.ADOPTED AND APPROVED THIS 28th day of June 2022.Approved:Attest:Michael O. O-08-112 AND EXTENDING THE LEASE OF THECITY’S TELECOMMUNICATIONS PLANT AND FACILITIES TO CONWAY CORPORATION;INCREASING THE MONTHLY LEASE PAYMENT; AND DECLARING AN EMERGENCY.WHEREAS, the City of Conway, Arkansas (the “City”), a city of the first class, presently owns aTelecommunications Plant (as defined in Ordinance No. O-08-112) serving the residents of the City, whichTelecommunications Plant is presently leased to and operated and maintained by the ConwayCorporation, a nonprofit corporation organized and existing under the laws of the State of Arkansas (the“Corporation”), pursuant to a lease (the “Lease”) between the City and the Corporation embodied in andapproved by Ordinance No. O-08-112 adopted on September 23, 2008; andWHEREAS, the City desires to extend the term of the Lease of the Telecommunications Plant tothe Corporation;NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Conway, Arkansas that:Section 1.The term of the Lease of the Electric Plant to the Corporation set forth inOrdinance No. O-08-112 is hereby extended to December 31, 2050 andSection 2.Section 3 of Paragraph 2 of Ordinance No. O-08-112 is hereby amended to readas follows. The Lessee agrees and promises to pay a Lease payment of 16,000 per month beginningAugust 1, 2022.Section 3.Ordinance No. O-08-112 is hereby deemed amended to such effect. ANDALLOWING FOR THE APPLICATION OF THE REQUIRED PERMITS FROM THE ARKANSAS ALCOHOLICBEVERAGE CONTROL DIVISION PER ARKANSAS CODE ANNOTATED §3-9-222 AS AMENDEDWHEREAS, The Rogue Roundabout Inc. has applied for a private club permit as required underChapter 4.12.04 of the Conway City Code per Ordinance No. O-17-100 and A.C.A §3-9-222; andWHEREAS, the application is limited and specific to The Rogue Roundabout Inc., located at 804Chestnut Street, Conway, AR 72032; andWHEREAS, the applicant has provided all the information required in the permit applicationprocess and met all the standards set forth by the Conway City Council; andWHEREAS, the City Council for the City of Conway hereby approves the application for a permitfor the proposed location to operate a private club within the City limits of Conway; andWHEREAS, this approval does not authorize the operation of a private club within the City ofConway but does function as an authorization to apply for a private club permit through the ArkansasAlcoholic Beverage Control Division per A.C.A §3-9-222.THAT:NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CONWAY, ARKANSAS,Section 1. The application for a private club permit is hereby approved for and specific to TheRogue Roundabout Inc. located at 804 Chestnut Street Conway, AR 72032.Section 2. That no private club operations will begin unless and until a permit to operate a privateclub is issued by the Arkansas Alcoholic Beverage Division.Section 3. B-2City of Conway, ArkansasOrdinance No. O-22-AN ORDINANCE AUTHORIZING THE CREATION OF A NEW JOB TITLE FOR THE PERMITS AND INSPECTIONSDEPARTMENT; AND FOR OTHER PURPOSES:Whereas, the Permits and Inspections Department has determined a need to reorganize thedepartment; andWhereas, the Permits and Inspections Department’s current staffing includes: one Director ofPermits and Inspections, four Building Inspectors; andWhereas, the Permits and Inspections Department desires to create a new Job Classification,“Assistant Director of Permits and Inspections”; andWhereas, the Assistant Director of Permits and Inspections will continue to perform the presentduties of the Building Inspector and gain new duties of Assistant Director; andbudget.THAT:Whereas, this change will not affect the adopted 2022 Permits and Inspections DepartmentNOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CONWAY, ARKANSAS,Section 1. B-3City of Conway, ArkansasOrdinance No. O-22-AN ORDINANCE APPROPRIATING MATCHING FUNDS AND ACCEPTING THE LOWEST BID FORTHE MARKHAM STREET JUMP START PHASE IIPROJECT FEDERAL AID SURFACETRANSPORTATION PROGRAM (STP) FUNDS.Whereas, Conway City Council previously approved the application and committedmatching funds for the Federal-aid Transportation Grant administered by the ArkansasDepartment of Transportation and Metroplan for Markham Street Jump Start Phase II RoadwayImprovements, andWhereas, The City of Conway was awarded 1,500,000.00, andWhereas, The City of Conway received a total of two bids for this construction project.Fureigh Heavy Construction Submitted the lowest bid, in the amount of 1,782,413.57, andNOW, THEREFORE, BE IT ORDAINED BY CONWAY CITY COUNCIL THAT:Section I: The City of Conway accepts the lowest bid for Fureigh Heavy Construction inthe amount of 1,782,413.57.Section II: The City of Conway shall appropriate the grant match of 375,000 from theStreet Pay as You Go Sales and Use Fund Balance Appropriation Account 613-201-4900 into theexpense account 613-201-5905.Section III: Conway City Council pledges its full support and hereby authorizes the City ofConway to cooperate with Metroplan and the Arkansas Department of Transportation to initiateaction to implement this project.Approved this 28th day of June 2022.Approved:Attest:Michael O. B-4City of Conway, ArkansasResolution No. R-22-A RESOLUTION ADOPTING A PUBLIC ART MASTER PLAN AS AN AMENDMENT TO THE COMPREHENSIVEPLAN FOR THE CITY OF CONWAY, ARKANSAS;Whereas, cities of first class have the power to adopt and enforce plans for the coordinated,adjusted, and harmonious development of the municipality and its environs; andWhereas, the City Council of the City of Conway, Arkansas wishes to adopt a Public Art MasterPlan; andWhereas, the Conway Planning Commission held a duly advertised Public Hearing on May 23rdJune 21 , 2022 to allow discussion and citizen comments on the proposed plan; andstWhereas, the Planning Commission adopted the plan on June 21st, 2022 and has forwarded it tothe City Council for adoption as an appendix to the Comprehensive Plan.THAT:NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CONWAY, ARKANSASSection 1. The Public Art Plan is hereby adopted and shall be enforced through the ConwayComprehensive Plan and other regulations of the City of Conway, Arkansas.Section 2. This will mark the formal acceptance of the plan and its establishment as a municipal plan for the city.The plan was presented to this body on May 10th, and has subsequently gone through a public hearing before the Planning Commission on May 23rd – June 21st.
