The Judgeis responsible for hearing all cases with the Buckley Municipal Court and fulfilling theobligations of the Court as established by State Law and City Ordinances. The Judge will presideover both criminal and civil cases (as limited by Municipal Court statutory authority) whichinclude gross misdemeanor & misdemeanor violations under State and City Code, traffic/nontraffic infractions, parking violations, animal control cases, impound hearings, with a moreextensive description of duties/responsibilities set forth below.This position serves a four-year term under an employment contract with the City of Buckley.Salary to be determined.

The Municipal Court is an independent branch of City government. However, the judge worksunder the broad policy guidance of the Mayor and City Administrator for nonjudicial administrative matters. All administrative staff are employees of the City Buckley.Buckley Municipal Court is currently held on Thursdays and is located in the Buckley MultiPurpose Center Building.Examples of Essential Duties:The duties of the Buckley Municipal Court are generally governed by Title 3 of the Revised Codeof Washington, RCW 3.50 et seq., and Administrative Rules for Courts of Limited Jurisdiction,Rule 5 (ARLJ 5). Exercises supervision over all court department staff directly or through subordinatesupervisors for all judicial matters. Selects and manages the work of judges pro tem in accordance with Buckley MunicipalCode and Personnel Policies. Serves as a principal advisor to the city council, mayor, city administrator, and other cityofficials regarding judicial and court administration issues. Works closely with the Legislative and Executive branches of the city government toplan, organize and administer an effective judicial system for the City. Promptly responds to all-hours requests for search and arrest warrants by City lawenforcement officers. Reviews affidavits for sufficiency of facts and determinationof the existence of probable cause to issue search and arrest warrants. Determines if theobjects of searchwarrants are appropriate, if the warrants are being requested in a timely manner, and ifthe scope of each warrant is appropriate. Hears cases and renders judgments, establishing appropriate sentences and finesas necessary. Presides over bench trial and jury trials in accordance with Washington Statelaw. Directs and controls the proceedings and personnel involved in court hearingsand trials including prosecuting and defense attorneys, defendants, witnesses, courtclerks and others. Conducts arraignments, pre-trial hearings, readiness hearings, contested hearings,mitigation hearings, motion hearings, compliance review hearings, show-cause hearings,and bench warrant recall hearings for criminal, traffic, and non-traffic violators. Imposes appropriate sentences and penalties as prescribed by law; communicatewith other city, county, and state criminal justice agencies. Communicates with various departments, community agencies, and othergovernmental offices regarding probation, specific referrals, driving records, domesticviolence cases, common defendants and treatment programs available for mentalhealth and alcohol problems. Directs the preparation and maintenance of court dockets and supportdocuments; assure proper collection, disbursement and accounting for fines and othermonies paid. As needed, consults and coordinates with the police department in

reference to "probable cause" hearings regarding crimes that occur on weekends andholidays and in reference to deadlines on arraignments regarding crimes that occur onweekends and holidays.Conducts out-of-court reviews in reference to files brought to the Judge's attentionby court personnel.Attends continuing legal education seminars as well as reviewing literature furnishedby the Administrative Offices of the Courts, so as to keep current on courtprocedures, including the Washington Justice Court rules and regulations, and allapplicable state and federal laws and city ordinances.May be required to interact with other city, county or state law enforcement agencies;this may include correspondence with AOC or other Judges on an occasional basis.Attends all meetings of the Council at which attendance may be required to addressmatters pertaining to the Municipal Court.Peripheral Duties: Administers the Oath of Office to various City officials and law enforcement officers.Maintains membership and participation in the Washington State District and MunicipalCourt Judges Association.Typical Qualifications:Education and Experience: Juris Doctorate from a licensed and accredited law school in the United StatesPreferred experience practicing law in both criminal and civil proceedingsExperience in Municipal, District, Superior, Court of Appeals, Supreme Courts and/orFederal CourtsCourt experience in Jury Trials, Bench Trials, Hearings, Motions, In-Custody CalendarsJudicial experience to include; Judge, Judge Pro-Tem, Commissioner, Commissioner ProTem, Administrative Law Judge, Hearing Examiner.We will also review and consider candidates’ Bar ratings, references, length ofexperience and/or legal practice, as well as other relevant experiences.Necessary Knowledge, Skills and Abilities: Must possess a high degree of ethics and integrity.Considerable knowledge of the standards for Municipal Court Administration in theState of Washington; considerable knowledge of proper courtroom procedure and therules of evidence; working knowledge of criminal law; working knowledge of localordinances, laws, and procedures; knowledge of City organization, operations, andpolicies.

This appointment will follow a selection process which will

include panel interviews conducted by a committee that includes members of the CityCouncil, Leadership Team, citizens, and members of the Bar Association. Additionalinterviews may be scheduled with the Mayor and City Administrator. Formalapplication, rating of education and experience, oral interviews, and background andreference checks are required.
