Specifically, the Mm York Times reported that Mr.Mauk informed your Task Force that:PHYSICIANS DO THINGS NOT BECAPSE THEYKNOW THEY ARE EFFECTIVE, BUT BECAPSETHEY KNOW THEY MIGHT BE CHALLENGEDLATER ON.I, again, refer you to the American Bar Association's TalJdngPoints on Medical Malpractice (enclosed). The observations on"Defensive Medicine" are on pages 2, 3 and 4 of thisdocument. On page 3, we stated:To the extent that physicians' concern about liabilityresults in more conscientious medical care, then"defensive medicine" is certainly desirable. When the fearof tort liability deters medical injwies, then health carecosts are lowered by avoiding the costs associated withmedical injury. Of course,this type of malpractice does not often result in damage; but,if a procedure that was not needed injures a patient, fewcould conclude that the doctor's negligence was notresponsible for the injury.We also point out there is no agreement as to what is meantby defensive medicine, and we make the controversialsuggestion on page 3 that defensive medicine is certainlydesirable.Again, I respectfully inquire into the opportunity of giving youa more elaborate version of the American Bar Association'srecommendations on medical negligence liability.The American Bar Association President J.
