PREAMBLEThis Memorandum of Understanding is entered into pursuant to the provisions of Sections 3500 et seq. of theGovernment Code of the State of California.The parties have met and conferred in good faith regarding wages, hours and other terms and conditions ofemployment for the workers in said representation unit, and have freely exchanged information, opinions andproposals and have reached agreement on all matters relating to the employment conditions and employer-employeerelations of such workers.This Memorandum of Understanding shall be presented to the City Council of the City of Redwood City as the jointrecommendation of the undersigned parties for salary and employee benefit adjustments for the period commencingFebruary 1, 2017 and ending January 31, 2019.1

ARTICLE 1 - RECOGNITION1.1Union RecognitionService Employees International Union Local 521 has been recognized as the Exclusive Representative,pursuant to the Employer-Employee Relations Resolution of the City adopted August 7, 1972, andperiodically revised subject to the provisions of Government Code section 3507, for the regular full-time andpart-time workers initially and regularly scheduled to work at least twenty (20) hours per week for a minimumof twenty-six (26) pay periods, and term-funded workers. This unit of workers shall for the purpose ofidentification be titled the SEIU Unit.A term-funded worker shall be defined as a worker in the job classification of Recreation and CommunityServices Program Coordinator, hired to work in a program that is subject to annual renewal or time-limitedfunding, including grant-funded programs and/or programs funded by service contracts with outsideagencies. This group includes former contract employees who were added to the unit as of December 7,2007, and designated term-funded workers as of July 1, 2015. The classifications used for term-fundedworkers are subject to change by mutual agreement only.Term-funded workers shall be employed for a maximum of one fiscal year, subject to annual renewal. Thelimited term is not a guarantee of employment for any specified period of time. Except where otherwisespecified in this agreement, all Memorandum of Understanding provisions for term-funded workers shall beequal to those of regular workers.At the end of each fiscal year, the City shall prepare a list of casual workers who were hired to work lessthan twenty (20) hours per week (less than 1,000 hours per year) but who, during the immediately precedingtwelve months, have been regularly scheduled to work and have worked a minimum of one-thousand(1,000) hours. Effective on the first day of the first pay period at least thirty (30) days following the fiscal yearin which the worker met the regular and continuous, and one-thousand (1,000) hours per year standard, theCity will provide SEIU with the opportunity to meet and confer over whether such workers shall be added tothe SEIU representation unit. “Regularly scheduled to work” shall be defined as not having a consecutivebreak in service of thirty (30) calendar days or more.1.2Employer RecognitionThe City Manager is the representative of the City of Redwood City, hereinafter referred to as "the City", inemployer-employee relations pursuant to the Employer-Employee Relations Resolution of the City adoptedAugust 7, 1972, and periodically revised subject to the provisions of Government Code section 3507.ARTICLE 2 - NO DISCRIMINATIONIt is the policy of the City of Redwood City to provide equal employment opportunity to all workers and applicants foremployment. All employment practices, such as recruitment, selection, promotions, and other terms and conditionsof employment are administered in a manner designed to ensure that workers and applicants for employment orservices are not subjected to discrimination on the basis of age (over 40), race, color, sex, national origin, ancestry,medical condition, physical or mental disability, genetic information, gender, gender identity, gender expression,sexual orientation, marital status, religious creed, political preference, military or veteran status or union affiliations,or any other basis protected by applicable federal, state or local laws.2

ARTICLE 3 - UNION SECURITY3.1Union RepresentativesA qualified representative of the Union shall be allowed to visit the work location for the purpose ofascertaining whether or not this Agreement is being observed. This right shall be exercised reasonably. Aqualified representative of the Union shall report to management before proceeding to the work location.He/She shall not interfere with the normal conduct of work. Activities such as the soliciting of membership,collection of dues, holding membership meetings, campaigning for office, conducting elections anddistributing literature is strictly prohibited during working hours without the prior approval of the PersonnelOfficer or his/her representatives.3.2Use of City FacilitiesThe Union may, with the prior notice to the Human Resources Manager, be granted the use of City facilitiesfor meetings of City workers provided space is available and does not interfere with City business. The useof City equipment, other than items normally used in the conduct of meetings, is strictly prohibited.3.3Bulletin BoardsThe Union may use portions of designated City bulletin boards in those areas which have workers in theSEIU Unit for the purpose of posting notices of official Union business such as times and places ofmeetings. The bulletin board may be used for lawful political or campaign notices.3.4Advance NoticeThe Union shall be notified of any creation of or change to an ordinance, rule, resolution or regulation withinthe scope of representation proposed to be adopted by the City
