What to do in the Event of an AccidentRegardless of blame it is important that youtake the following action:Making contact followingan incident.Stop: Stop as soon as possible, in a safe place(if you have a warning triangle, place it wellbefore the obstruction). If anybody has beeninjured, call the police and ambulance service.At the roadside?Call 03330 436513Sketch: Make a quick sketch of the directionand final position of each vehicle (it is worthkeeping a pen and paper in your car).Note down: You will need to make a note of: The vehicle registration number, name,address and telephone number of any otherdrivers involved in the accident. The number of passengers in each vehicle. The name and address of anyone whois injured (or suggesting they have beeninjured). The name, address and telephone numberof any witnesses to the accident. The name, telephone number andconstabulary of any police officer whoattends the accident.Take a photo: If you are able to do so, tryand take photographs to support the positionsof the vehicles and the extent of damage.Provide: You must give your own detailsto anyone who has reasonable groundsfor requesting them.DO NOT: Do not admit responsibility, eitherverbally or in writing. Instead, simply supplyyour details along with your policy numberto the other driver(s)/person(s) involved inthe accident and ask him/her to call the claimsadvisors on 03330 436 558. By passing thesedetails to the other person(s) involved in theaccident you will give him/her the opportunityof obtaining assistance in progressing repairsand assisting with the provision of a courtesyvehicle if the circumstances of the accidentwarrant this.If for any reason you have not been able toexchange details with other drivers or ownersof property or you were in collision with ananimal, you must report the accident to thepolice as soon as possible, and certainly within24 hours of the accident.To obtain immediate assistance at the roadsidecall the Roadside Priority Claims Helpline on03330 436513.Experienced advisors will take initial claimdetails and discuss recovery of your vehicle.Unable to call from the roadside?Call 03330 436 519If you are unable to call from the roadsideyou must call the 24 hour Claims Helpline on03330 436 519 as soon as it is safe to do so.Please call within 24 hours of the accident,but ideally within 1 hour.This is regardlessof whether you wish to make a claim underthe policy or not. Introduction to Your PolicyINTRODUCTION TO YOUR POLICY5Thank you for choosing to purchase a ZenithInsurance policy.This Policy Document is evidence of a legallybinding contract of insurance between you(the Insured) and us (Zenith Insurance Plc).This contract is entered into on the basis that: you have taken all reasonable care to answerall questions asked honestly, accurately andto the best of your knowledge; and any other information given either verballyor in writing by you, or on your behalf atthe time you applied for insurance is alsocomplete; and the information supplied has been givenhonestly and to the best of your knowledgeand belief.The information that you have given to usis shown on your signed proposal form orstatement of fact or statement of insurancebut will also include further information giveneither verbally or in writing by you or on yourbehalf at the time you applied for insurance.You must read this policy document, the PolicySchedule and the Certificate of Motor Insurancetogether. The Policy Schedule tells you whichsections of the policy apply. So that you can easilyidentify these words and phrases theyare shown in bold print throughout thispolicy document.Approved RepairerA motor vehicle repairer authorised by usor our representative to repair the insuredvehicle following a valid claim under Section Aor Section B of this insurance.Certificate of Motor InsuranceA document, which is legal evidence of yourinsurance and is required by law and formspart of this contract of insurance. It showsthe insured vehicle’s registration number,who may drive it and what it may be used for.The Certificate of Motor Insurance must beread with this policy document.Courtesy CarA car loaned to you by our approved repairerwhilst the insured vehicle is being repairedfollowing a valid claim under Section A orSection B of this insurance.EndorsementsA change in terms of this insurance,which replaces or alters the standardinsurance wording.ExcessDEFINITIONS6An amount you have to pay towardsthe cost of a claim under this insurance.You have to pay this amount regardlessof the circumstances leading to the claim.Geographical LimitsThe United Kingdom of Great Britain & NorthernIreland, the Isle of Man and the Channel Islands.Insurance IntermediaryThe intermediary who has placed this insurancewith us, acting on your behalf as your agentand through whom all matters concerning thisinsurance are handled.Insured VehicleThe motor car, the details and registrationnumber of which are shown in the PolicySchedule. Definitions (continued)DEFINITIONS7In-car Entertainment, Communicationand Navigation EquipmentPermanently fitted radios, cassette, MP3,compact disc or DVD players, telephones,CB radios and visual navigation equipment.Portable items (such as radar detectionequipment, personal digital assistants orportable GPS navigators), cassette tapes,memory cards, compact discs or DVDsare not included within this definition.Market ValueThe cost of replacing the insured vehicle atthe time of loss or damage compared withone of the same make, model, specificationand condition. If the insured vehicle was firstregistered as new in a country other thanthose contained within the geographical limitsany assessment of market value will takeinto account that the car has been individuallyimported into a country contained withinthe geographical limits but will not includeany delivery costs incurred at the time ofimportation. The market value will be assessedby an automotive engineer in conjunction withthe published trade guides at the time of loss.Proposal FormThe application for insurance and declarationcompleted by you or on your behalf and signedby you. We have relied on the informationprovided on this form in entering into thiscontract of insurance.Statement of Fact or Statement ofInsuranceThe form that shows the information that yougave us or that was given on your behalf at thetime you applied for insurance. Insurance Provided - Guide to Policy Cover (continued)INSURANCE PROVIDED - GUIDE TO POLICY COVER9Notification of changesTo keep your insurance up to date pleasenotify us straight away via your insuranceintermediary about changes which affectyour cover.Some examples are: A change of vehicle or you have purchasedanother vehicle to which you want yourexisting cover to apply. The insured vehicle is changed ormodified from the manufacturer’s standardspecification or you intend to change ormodify it (including the addition of optionalfit accessories such as spoilers, skirts, alloywheels etc). A change in the use of the insured vehicle. A change relating to the ownership of theinsured vehicle. The insured vehicle has been stolen oris involved in an accident no matter howtrivial. If the insured vehicle is likely to exceedthe annual mileage declared at thecommencement or renewal of the policy forwhich you may have received a premiumdiscount. Any change in the main user of the insuredvehicle. You wish a new driver to be covered. Someone who drives the insured vehicleis convicted of an offence (whether motorrelated or not) or fixed penalty or otherlicence endorsement or suffers from amedical condition or has a claim on anotherpolicy. Someone who drives the insured vehiclehas any police enquiry or prosecutionpending (note – if you have been stoppedby the police a prosecution may be pendingand must be disclosed). A change of occupation (full or part-time) byyou or any other driver. A change of postal address. A change of garaging facilities and/orwhere the insured vehicle is normally keptovernight. The security system fitted to the insuredvehicle is no longer in operation.This is not a full list and if you are in anydoubt you should advise your insuranceintermediary for your own protection.If the information provided by you is notcomplete or accurate: we may cancel your policy and refuse to payany claim, or we may not pay any claim in full, or we may revise the premium and/or changethe compulsory excess, or the extent of the cover may be affected.Guidance notes - Notificationof changesThe premium that you pay is based oninformation you supplied at the inception orrenewal date of this insurance policy.If your circumstances, or the circumstances of anydriver covered by this policy change, then thepremium needs to be recalculated to ensure weare collecting the correct premium for the risk.It is important that you notify your insuranceintermediary immediately of any changes suchas those examples given under Notification ofchanges.If you fail to supply details of changes or theinformation supplied by you is not complete oraccurate then: we may cancel your policy and refuse to payany claim, or we may not pay any claim in full, or we may revise the premium and/or changethe compulsory excess, or the extent of the cover may be affected.Claims Helpline: 03330 436 519

Section A - Loss of or Damageto the Insured VehicleWhat is coveredWe will cover you against loss or damage tothe insured vehicle (less any excess thatapplies) caused accidentally or as a result ofmalicious damage or vandalism (malicious firedamage is covered by Section A of this policy).Loss or damage more specifically coveredunder Section B of this policy is excluded underthis section of the policy.Cover also applies under this section while theinsured vehicle is in the custody of a memberof the motor trade for servicing or repair.Under this section we may either: pay for the damage to the insured vehicleto be repaired; or with your agreement provide a replacementcar; or pay an amount of cash equivalent to the lossor damage.The most we will pay will be either: the market value of the insured vehicleimmediately before the loss; or the market value of a replacement carif we deal with your claim under the‘New Car Cover’ sub section below, or the cost of repairing the insured vehicle,whichever is the lower amount; or the written down value or market value,whichever is lower, if your insured vehicleis under a lease agreement.We are not liable for any amount you arecontractually obliged to pay under any leaseor finance agreement, you have enteredinto, over and above the cost of replacingyour vehicle.If the insured vehicle was not first registeredfrom new in any country contained within thegeographical limits we will not pay morethan the purchase price paid by you at thetime that you purchased the insured vehicle.If the insured vehicle is deemed to be beyondeconomical repair or settlement is agreedunder the ‘New car cover’ sub-section thedamaged car becomes our property once aclaim is met under the policy. You must sendus the vehicle registration document and MOTcertificate if one is required by law before weare able to meet the claim.SECTION AThis section only applies if the cover shownon your Policy Schedule is Comprehensive.10If the insured vehicle is the subject of a HirePurchase or Lease Agreement we will pay upto the amount defined under ‘the most we willpay’.This payment will be made to the HirePurchase or Lease Company as owner of theinsured vehicle, whose receipt of paymentshall be a discharge of any claim under thissection. If, under a Hire Purchase Agreement,you owe less than the proceeds of your claim,we will pay you the difference.In-car entertainment, communicationand navigation equipmentWe will pay an amount of no greater than 300 after the deduction of any excess thatapplies in respect of any one occurrence forloss of or damage caused to permanently fittedin-car entertainment, communication andnavigation equipment.If this equipment forms part of the originalvehicle specification and was fitted by thevehicle manufacturer or their authoriseddealer at the time the insured vehicle wasfirst registered from new, the amount of coverfor any one occurrence will be increased to amaximum of 750 after the deduction of anyexcess.Any amount payable in respect of in-carentertainment, communication andnavigation equipment will not exceedthe value of the equipment at the timeof the loss or damage after making areasonable deduction for wear and tear.New car coverIf the insured vehicle is less than one year old(calculated from the date of first registration)at the time of the incident leading to a claimunder this policy, and: suffers damage covered by the policy; and is beyond economical repairClaims Helpline: 03330 436 519

SECTION A11Section A - Loss of or Damageto the Insured Vehicle (continued)we will replace it with a new one of the samemake, model and specification.However, this new car cover only applies if: you have been the first and only registeredkeeper and owner of the insured vehicle; and a suitable replacement car is available in anycountry within the geographical limits; and anyone else who has an interest in theinsured vehicle agrees; and the insured vehicle has covered less than10,000 miles.In the event that a vehicle of the same make,model and specification is unavailable we willsettle the claim on the basis of the marketvalue of the insured vehicle immediatelybefore the loss.Once a settlement has been agreedin accordance with this new car cover,the damaged car becomes our property.If the insured vehicle is the subject of a HirePurchase or Lease Agreement we will onlyagree settlement on the basis of this new carcover if we have the agreement of the HirePurchase or Lease Company as owner of theinsured vehicle.RepairsRepairs are normally undertaken by ourapproved repairer.If you choose to use an alternative repairer: we will not guarantee the work after youhave signed a customer satisfaction noteand the insured vehicle has been returnedto you by the repairer; and The most we will pay toward the cost oflabour to repair the insured vehicle will bethe labour rate quoted by our approvedrepairer. In these circumstances we may atour option settle the claim for repairs to theinsured vehicle by making a cash paymentbased on the labour rate quoted by ourapproved repairer less the excess whichapplies to the claim.If parts required for repairing the insuredvehicle are not available in any country withinthe geographical limits our liability for thoseparts shall not exceed the manufacturers’ lastUnited Kingdom list price or if not listed theprice of those parts for the nearest comparablecar available in the United Kingdom.We will not pay the cost of importing partsthat are not available in any country withinthe geographical limits.We may at our option use parts that have notbeen supplied by the original manufacturer torepair the insured vehicle. These parts will besubject to the approved repairer’s guarantee.We will not pay the cost of any repair orreplacement which improves the insuredvehicle to a better condition than it was inbefore the loss or damage. If this does happenyou must make a contribution towards the costof repair or replacement. You may be requiredto contribute to the cost of replaced items suchas exhausts or tyres.Guidance Notes – Finance orLease agreementIf your insured vehicle is the subject of a financeor lease agreement and your vehicle is deemedto be damaged beyond economic repair due toa covered loss under the policy the market valueor written down value placed on your insuredvehicle may not be sufficient to satisfy thatagreement.This policy does not cover any amount you arecontractually obliged to pay under any leaseor finance agreement, you have entered into,over and above the cost of replacing yourvehicle.We would recommend that you discuss anyconcerns that you may have with your insuranceintermediary who may be able to supply youwith details of products available to cover anyshortfall.Claims Helpline: 03330 436 519

Young and InexperiencedDriver ExcessesYou will be responsible for paying the followingamounts while the insured vehicle is beingdriven by, is in the charge of or was last in thecharge of the categories of driver listed below:Age or experience of persondriving, in charge of or last incharge of the insured vehicleAmountof ExcessAged 20 years and under 300Aged 21 to 24 years inclusive 200Aged 25 years and over but: who holds a provisionaldriving licence; or who holds an internationaldriving licence; or has held a full drivinglicence to drive a privatemotor car issued either ina country contained withinthe geographical limits ora member country of theEuropean Union but for lessthan one year. the cost of re-delivery after repairs to yourhome address; and the cost of storage of the insured vehicleincurred with our written consent.SECTION A12If the insured vehicle is damaged beyondeconomical repair we will arrange for it tobe stored safely at premises of our choosing.You should remove your personal belongingsfrom the insured vehicle before it is collectedfrom you.In the event of a claim being made underthe policy we have the right to remove theinsured vehicle to an alternative repairer,place of safety or make our own arrangmentsfor re-delivery at any time in order to keepthe cost of the claim to a minimum.Guidance Notes – Flood Advice If possible move your car to a safer place outof the reach of floodwater before the floodstrikes (e.g. to higher ground). 150The Young and Inexperienced Driver Excessapplicable at the time of loss or damage isdetermined by the age or driving experienceof the person driving/in charge of the insuredvehicle at the inception date or last renewaldate of the policy whichever is the later.The amounts shown above are in addition toany other excesses shown elsewhere in thispolicy document or on your Policy Schedule orin any endorsement.Protection and RecoveryIf the insured vehicle cannot be drivenfollowing an incident leading to a valid claimunder this section, we will pay: the cost of its protection and removal tothe nearest approved repairer, competentrepairer or nearest place of safety; and Do not attempt to drive your car throughfloodwater as it is inevitable that this willdamage your engine particularly if yourcar has a diesel engine or turbo charger.The policy does not pay for electrical faultsand these are also likely to occur if you dodrive through floodwater. If your car is submerged do not try to startthe engine. If possible get your car pushedor towed out of the water and allow it to dryout. You may be lucky and the water maynot have penetrated sufficiently to ruin theengine. Repairs to the insured vehicle resultingfrom flood damage are covered if yourpolicy cover is comprehensive but claimswill be subject to the policy excesses.A comprehensive policy will also pay fortowing as well as damage to upholstery,carpets and stereo systems resulting fromflooding but only up to the limits shownwithin this document.Claims Helpline: 03330 436 519

SECTION B13Section B - Loss of or Damageto the Insured Vehicle by Fire or TheftThis section only applies if the cover shown onyour Policy Schedule is either Comprehensiveor Third Party Fire and Theft.What is coveredWe will cover you against loss of or damageto the insured vehicle (less any excess thatapplies) caused by fire (other than fire byvandalism or malicious intent), lightning,explosion, theft or attempted theft.Cover also applies under this section whilethe insured vehicle is in the custody of amember of the motor trade for servicing orrepair.Under this section we may either: pay for the damage to the insured vehicleto be repaired; or with your agreement provide a replacementcar; or pay an amount of cash equivalent to the lossor damage.The most we will pay will be either: the market value of the insured vehicleimmediately before the loss; or the market value of a replacement carif we deal with your claim under the‘New Car Cover’ sub section, or the cost of repairing the insured vehicle,whichever is the lower amount; or the written down value or market value,whichever is lower, if your insured vehicleis under a lease agreement.We are not liable for any amount you arecontractually obliged to pay under any leaseor finance agreement, you have enteredinto, over and above the cost of replacingyour vehicle.If the insured vehicle was not first registeredfrom new in any country within thegeographical limits we will not pay morethan the purchase price paid by you at thetime that you purchased the insured vehicle.If the insured vehicle: is stolen and has not been recovered atthe time of settlement; or is deemed to be beyond economical repair,as a result of loss covered under this sectionof the policythe lost or damaged vehicle becomes ourproperty once a claim is met under the policy.You must send us the vehicle registrationdocument and MOT certificate (if one isrequired by law) before we are able to meetthe claim.If the insured vehicle is the subject of a HirePurchase or Lease Agreement we will pay upto the amount defined above under ‘the mostwe will pay’. This payment will be made tothe Hire Purchase or Lease Company as owner,whose receipt shall be a discharge of any claimunder this section. If, under a Hire PurchaseAgreement, you owe less than the proceeds ofyour claim, we will pay you the difference.In-car entertainment, communicationand navigation equipmentWe will cover you for loss of or damage causedto permanently fitted in-car entertainment,communication or navigation equipmentcaused by fire (other than fire by vandalismor malicious intent), lightning, self ignition,explosion, theft or attempted theft.
