Comparison Guide to MarylandMedical Professional Liability Insurance RatesHow to Shop for Medical Professional LiabilityInsurancesure to ask the insurer when the deductible applies. If you select ahigh deductible, you will pay more out of your own pocket for aclaim; however, your premium should be lower as a result.Do comparison shopping. Comparison shopping is the key togetting the most for your insurance dollar and this is as true withregard to medical professional liability insurance as it is with otherlines of insurance. You should contact several insuranceproducers (agents or brokers) and ask them which insurers theyrepresent and what your premium would be for insurance througheach company. You may want to ask co-workers and businesscontacts for recommendations or referrals to a licensed producer.The best time to shop for insurance is well before your currentpolicy expires, you change or begin your practice, open or relocateyour facility.Pursuant to Section 19-114 of the Insurance Article, insurers arerequired to offer deductibles in the amount of 25,000, 50,000and 100,000. Please note that these specific statutorily requireddeductible offerings may be applied only to the liability coverageprovided by the policy and not to any other obligations orcoverages, including defense costs. However, the insurer maycancel your policy for nonpayment of the deductible in the eventthe deductible is due and payable under the policy. By law, theinsurer must provide you with a 10-day notice of cancellation ifthe premium is not paid by the due date.Defense Coverage for Disciplinary Hearings. Section 19-104 ofthe Insurance Article provides that a Medical ProfessionalLiability Policy may include coverage for the defense of a healthcare provider in a disciplinary hearing arising out of the practice ofthe health care provider's profession if the cost of the includedcoverage is:Ask for price quotes. In order to make an "apples to apples" pricecomparison, you must provide the same information to eachinsurance producer.Ask for discounts. To keep rates down, ask what discounts theinsurer offers and how you can qualify for them. Some insurersmay offer discounts such as new practitioner discounts, part-timediscounts, risk management program discounts, or governmentemployee discounts.- itemized in the billing statement, invoice, or declarations pagefor the policy; and- reported to the Commissioner in a form and manner required bythe Commissioner.Ask about deductibles and the required deductible offers. Adeductible is the amount you agree to be responsible for in theevent of a claim before the insurer required to make payments onyour behalf. Deductibles may apply to liability coverage only orto other obligations or coverages, including defense costs, so beInsurers may also offer a separate stand-alone policy with thiscoverage.1

Protect yourself from insurance fraud. Once you have selectedthe insurer, contact the Maryland Insurance Administration("MIA") to verify that your producer is placing you with an insurerthat is licensed to sell medical professional liability insurance inthe state. It is illegal for unlicensed insurance producers orinsurers to sell insurance. You can get this information atwww.statebasedsystems.com.What Factors Impact Rates?Insurers determine rates based on the experience of their book ofbusiness and other factors that affect the ultimate amount of thepremium charged to you. These rates are then classified byspecialty or groups of specialties.Other factors that impact premiums paid by physicians/healthcareproviders:Surplus Lines Carriers and Risk Retention Groups. SurplusLines Carriers and Risk Retention Groups usually specialize in theunderwriting of certain specialties or physicians which licensedinsurers will not write. Surplus Lines Carriers and Risk RetentionGroups are not included in this Rate Comparison Guide, as thesetypes of insurers do not have uniform rating structures andindividual physicians are rated on an individual basis. Thus,providing premiums in a comparison guide is not feasible. Pleasenote that if you are insured by a Surplus Lines Carrier or a RiskRetention Group, you are not protected by the Property andCasualty Insurance Guaranty Corporation; nor are you eligible fora premium subsidy under Section 19-801 et seq. of the InsuranceArticle. 2Location of practiceLimits of liabilityLength of extended reporting periodClaims experience

You will need to contact the insuranceproducer to determine which classification is available for yourspecialty.You may notice that some specialties are not listed and this isbecause either the insurers do not write these specialties or theyare only written by surplus lines insurers or risk retention groups.Additionally, some specialties may not be found because they arerelatively new specialties and may be included in a more generalclass description.The premiums shown for each specialty are base premiums byterritory for policy limits of 1,000,000 per incident / 3,000,000annual aggregate based upon mature claims-made rates, with aclean claims history, in effect on October 1, 2011.Premiums shown in this guide do not account for other variables;such as any discounts for which you may qualify or anydeductibles you may choose. Also, the premiums do not take intoaccount where an insurer rates a specialty on multiple rate levelsbased on exposures. Because individual circumstances may vary,it is not possible to provide the exact amount of your premium forany one insurer. Some medical professionals may pay actualpremiums less than or greater than those provided in this guide,based on their individual circumstances. If you would like toidentify how your final premium will be determined, you shouldcontact your insurance producer.3. Compare the companies and premiums shown on the RateTable.Please note that the premiums listed in this Rate ComparisonGuide reflect a mature physician with a clean claims history andlimits of 1,000,000/ 3,000,000. However, a few insurers write certain healthcareprofessional liability policies on an occurrence basis. How to File A Complaint:Consumers may contact the Maryland Insurance Administration tofile a complaint against an insurer or insurance producer (agent orbroker). Your complaint may relate to an insurer's refusal toinsure you, a proposed cancellation or non-renewal or with regardto a claim.Complaints must be received in writing or filed on-line usingthe agency's website, www.insurance.maryland.gov. UnderConsumers, you will find a link titled, File A Complaint.This page describes the process and provides instructions for filinga complaint.Please provide as much detail as possible, including copies ofrelevant documents. A trained, professional investigator willhandle your complaint. The investigator will contact the insurer/insurance producer and try to resolve the issue.
