Payment and Refunds. 14Important InformationUNDER 18 YEARS OF AGE: Students under 18 years of age when applying for universityhousing must have their parent or guardian agree to the Terms and Conditions of residenceduring the online application process.HOUSING OPTIONS/PREFERENCES: It is not possible to know whether the COVID-19pandemic will result in changes to operations in student housing and residential life inAcademic Year 2021-22. Consequently, we are not offering a housing guarantee. Universitydoes not promise or guarantee Student an assignment to any particular room or building inUniversity Housing or any particular room/apartment in University Apartments. Universitymay reassign or require Student to move to another room or building at University’s solediscretion, which may result in adjustments to the room rate based on the actual roomaccommodation. Student may be placed on a waiting list and assigned housing when itbecomes available.LEGALLY BINDING CONTRACT: Once a student is assigned housing thehousing application becomes a legally binding contract that is valid for the entire2021-22 academic year.CANCELLING HOUSING CONTRACT: Prior to taking residence, if your plans change andBilling and Payment. 16you are unable to live in university housing, you must return to studenthousing.ucsc.eduand cancel your application/contract.Payment Due Dates. 16- If a wait list application is cancelled prior to a space being assigned, student will not bebilled for any portion of the advance housing fee.Housing and DiningCalendar. 17Room andMeal Plan Rates. 18- If a confirmed contract/reserved housing space is cancelled, student will be billed for theadvance housing fee and additional late cancellation fees may also apply (see section VIII forcancellation fee schedule).After taking residence, requests for housing contract cancellation must be initiated throughthe housing office at your residential community. THE COLLEGES TRANSFER COMMUNITY REDWOOD GROVE THE VILLAGE UNIVERSITY TOWN CENTER CAMPER PARKThis contract is an agreement between a University ofCalifornia, Santa Cruz (UCSC) student, hereinafter called“Student,” and the Regents of the University of California,hereinafter called “University.” The following terms andconditions are effective as of the date a housing spaceis assigned in one of the following residence units underthe jurisdiction of the University of California, Santa Cruz.This legally binding contract is valid for the entire academicyear, and is non-transferable.I. EligibilityCollege Residence Halls and Transfer Community - Roomand board contract [Cowell College, Stevenson College,Crown College, Merrill College, Porter College, KresgeCollege, Oakes College, Rachel Carson College, CollegeNine, College Ten, Transfer Community]The term of this contract is for the entire 2021-22 academicyear (excluding winter break) commencing with the openingof the residence for the fall quarter, or subsequent quarter,and terminating at the end of the spring quarter. Due to thespread of the novel coronavirus, its threat to the health andsafety of our community, and the evolving nature of thisand future emergencies or health threats, the University mayamend the terms of this agreement, including the schedulebelow, without notice to reduce spread or to comply withpublic health orders and guidance. The University may,upon thirty (30) days written notice, change any of theterms of this contract.Residence Halls have common bathrooms and lounge areas,and a combination of shared and private bedrooms.College Apartments and Redwood Grove – Room contractonly [Cowell College, Stevenson College, Crown College,Merrill College, Porter College, Kresge College, OakesCollege, Rachel Carson College, College Nine, College Ten,Redwood Grove Apartments]Apartments have common living/dining rooms, kitchens,and bathrooms, and a combination of shared and privatebedrooms.The Village – Room only contractThe Village is a housing complex located in UC SantaCruz’s Lower Quarry. Each house includes nine singlebedrooms, three bathrooms, and one kitchenette.University Town Center – Room only contractThe University Town Center is a housing complex at 1101Pacific Ave in downtown Santa Cruz. This facility has twoand three-person studio apartments, each with a privatebathroom, and kitchenette.Camper Park – Room only contractThe UCSC Camper Park is located on the north side ofcampus. Students live in single-occupant recreational vehiclesand share a community building with restrooms, showers,laundry facilities, and a lounge/study room.Student must be a regularly enrolled full-time registeredundergraduate student of the University of California,Santa Cruz. Other students may be housed by exception.However, the Student shall be obligated, whether a registeredstudent or not, to pay University in accordance with thepayment provisions of this contract for any services provided.II. Term of ContractIII. Period of ResidenceA. Schedule: University will furnish Student with auniversity housing residence during the 2021-22academic year according to the following schedule.Please note that dining service may be limited to carryout/pick-up options only.FALLSaturday, September 18, 2021: Residences open, diningservice begins with brunch(Note: Some residences may require an earlier move-in for newstudents, and dining service will be provided for boarding students.Continuing students may be required to move in on a later date. In addition to the campusdining halls and most other dining locations being closed duringthe winter break, the residential facilities at the ten colleges,Transfer Community, Redwood Grove, The Village, UniversityTown Center, and the Camper Park will close at 12 noonon Saturday, December 11, 2021 and will reopen on Sunday,January 2, 2022 at 10:00 a.m.Students who have a valid need to stay in residence during theweekend following fall finals (Dec. 11–12) may submit a latestay request. Requests will be limited to these specific datesand are subject to the review and approval of the student’scollege/residential facility.Spring Break: The period of residence between winter andspring quarters is covered by this contract. Although there is noadditional fee to remain in residence, Student may be requiredto submit a written request to remain in residence during anyportion of the break period. Please note that dining service inthe dining halls is available during this time at an additionalcost. See dining.ucsc.edu for details.B. Failure to Take Occupancy:1. Students who have not occupied their assigned spaceby 5:00 p.m. one day prior to the first day of academicinstruction or have not made arrangements withUniversity for late arrival will forfeit their reservedhousing space. See section III. A. for specific dates.2. If the Student fails to take occupancy, and does notnotify the University, in writing, prior to contract startdate, the University may continue to charge theStudent. Student shall be liable for payment of roomand board fees until a replacement Student, if any, canbe secured by the University and assigned to the samespace and/or the University has waived such liabilityin writing. University shall assess a 350.00 contractcancellation fee upon termination of contract.C. Failure to Move: Students who vacate their assignedroom later than required under the periods of residencespecified herein or as otherwise agreed between theUniversity and Student are subject to a 100.00 per dayliquidated damages charge as well as any other chargesallowed by law. Any Student discovered to be in a closedresidential facility without prior authorization shall beconsidered trespassing on University property and legalor University sanctions may be imposed.D. Temporary Disruption: The University shall havethe right, at its sole and absolute discretion, to makea temporary housing assignment for the Student ifthe University deems such an assignment necessary ordesirable. Student shall be responsible for moving or othercosts associated with the temporary reassignment.E. Disruption in Service: Disruption of service, usually,but not limited to, dining or custodial services are rarebut may occur without notice. In the event of any longterm changes in service, the University will communicatechanges in service to Student, maintain or modifyappropriate levels of service and deploy mitigationmeasures as necessary. By accepting room assignmentStudent agrees this is a binding Contract, the Studentagrees that they have been advised of said potentialdisruptions, and acknowledges that there may be changesin service resulting from such disruptions and has agreedto such. Student Housing and Dining Services reservesthe right, at its discretion, to adjust services to meet thechanging needs of business.IV. Residence and Housekeeping ProvisionsA. All Residence Units1.Construction: Construction and/or remodelingor repair of academic and residential buildingson the UC Santa Cruz campus in the vicinityof the residential facilities is scheduled duringthe contract period. Construction may resultin disturbances and disruptions, including, butnot limited to, increased noise and dust in thearea surrounding the residential facilities. Theremay also be both planned and unplanned utilityshutdowns in the residential facilities. By agreeingto these terms and conditions, Student agrees thatStudent has been advised of said construction,acknowledges that there will be disturbances anddisruptions resulting from construction, and thatsuch reasonable disturbances and disruptions arenot grounds for cancellation of this contract.Terms and Conditions 2021-223

E-mail: In order to communicate necessary housingbusiness, Student is expected to check theirUniversity e-mail account on a regular basis(email.ucsc.edu). Furthermore, Student is expectedto regularly update personal contact information(address and phone numbers) and emergency contactinformation.of this Contract, and/or any unlawful detainer actionin which the University is the prevailing party.5. Keys and Lockout:a.3. Furniture and Alterations:a.Furniture may not be removed from anyresidence room or common area without theprior written approval from the University inaccordance with written University policy.b. Student may not construct or install a bunk bedor loft. Only bunk beds or lofts provided by theuniversity are permitted. All bunk or lofted bedscome equipped with a safety bed rail that mustremain affixed to the bed frame at all times.University staff will not remove bed rails andStudent shall not alter or remove, or arrangefor the alteration or removal, of bed rails.Upon inspection, or at the end of residency, ifbed rail is not in properly affixed position, theStudent will be charged a re-installation fee plusany costs associated with repair or replacementof the bed rail and surrounding structure (ifdamaged), up to and including the cost of fullreplacement of the bed.c.Student shall make no alterations, improvements,or additions to the premises without prior writtenapproval of the University. This includes drillinginto walls and other structures as well as the use ofnails. This includes bed heights, which cannot bealtered without written approval of the University.Student is responsible for the cost of the removal byUniversity staff of any additions or improvementsand/or restoration of the premises to their originalcondition.4. Indemnification and Attorney’s Fees: Studentagrees to indemnify and hold the University harmlessfrom any actions, claims, losses, damages, andexpenses the University may sustain as a result ofnegligence of Student and/or Student’s guest, visitor,or invitee (See housing.ucsc.edu/insurance formore information). The Student agrees to pay allcosts, including collection costs, court costs and fees,and attorney’s fees incurred by the University in thecollection of any money due under this Contract, and/or the enforcement of any of the terms and conditionsUniversity will provide residence key(s) toeach student. Student will not duplicate anyUniversity key and will not let any Universitykey be used by anyone else. Student agreesto be responsible for key replacement costsand re-keying of the residence in accordancewith University policy in the event that anyUniversity key becomes lost, damaged or stolen.b. Students must carry keys and ensure that theirdoor is secured at all times. If a student is lockedout more than three (3) times in an academic year,there is a service fee of 15.00 upon the fourthlockout and every lockout thereafter.c.All keys to University locks are to be returnedat the end of tenancy. The Student shall pay thecost of any keys not returned, as well as the costsof any subsequent lock change(s).d. Altering, tampering, disabling, dismantling oroverriding door closing/locking mechanismsis prohibited.6. Limitation of Liability:a.If, for any reason arising out of a need tomitigate a threat to public health and safety suchas, including but not limited to, a health crisis,pandemic, infection outbreak, natural disaster,substantial power outage, the Universitycannot deliver possession of the residence tothe Student, the University shall not be liableto the Student for any loss or damage resultingfrom the University’s delay or failure to deliverpossession.b. The University shall not be held responsible orliable for the Student's accommodation if anassigned space is rendered uninhabitable due tocircumstances beyond the reasonable control ofthe University, including but not limited to poweroutages, "Acts of Nature", e.g. flood, earthquake,and unusual weather conditions, infectiousdisease.c.Neither University, nor any of its campuses ormedical centers, nor any of its employees or agentsshall be liable for any claims of loss, expense, ordamage to Student relating to the acquisition ofor exposure to any infectious disease.Terms and Conditions 2021-224

Student is required to takereasonable steps to control the growth of mold andmildew by keeping the premises dry, clean, and wellventilated, particularly when showering, bathing, orwashing/drying dishes or clothes. Student is requiredto notify the University immediately upon notice of theexistence of water leakage or overflow in or about thepremises, or the presence of mold/mildew.8. Non-Transferable Contract: This contract and theright of occupancy conferred are not transferable orassignable.9.Notice for Entry: Student’s residence may be enteredby authorized University personnel under any of thefollowing circumstances:a.In an emergency as determined by Universitywithout advance notice and whether or notStudent is present. When Student’s residence isentered, University will, within seventy-two (72)hours, inform Student of the conditions whichwarranted entry.11. Pests: Student is responsible for ensuring that allitems brought into the residences are free of pests –including clothing, bedding, suitcases, backpacks,packing materials, furniture, and other belongings.In the event Student discovers or suspects a pestproblem, Student agrees to immediately seekUniversity assistance by placing a work order (fixit.ucsc.edu). Student shall not attempt to treat a problemor arrange for any third-party to perform treatment.If an infestation does occur, Student must follow thetreatment protocol (including preparing the room andpersonal belongings) as instructed by the University.Failure to strictly comply with the prescribed treatmentprotocol may result in Student being liable for the costsassociated with remediation.12. Residence Assignments:a.It is not possible to know whether the COVID-19pandemic will result in changes to operations instudent housing and residential life in Academic Year2021-22. University does not promise or guaranteeStudent an assignment to any particular room orbuilding in University Housing or any particularroom/apartment in University Apartments. Universitymay reassign or require Student to move to anotherroom or building at University’s sole discretion, whichmay result in adjustments to the room rate based onthe actual room accommodation. Failure to complywith a housing assignment or reassignment is amaterial breach of this agreement and may result inStudent being denied the opportunity to participatein any future room change, and/or termination of thehousing contract.b.If a space matching the Student’s applicationpreference(s) is not available, the University may, spacepermitting, offer an alternative housing assignment.Housing offers are made via UCSC email andStudent will be required to accept the offer withintwenty-four (24) hours or the housing offer is void.Student is responsible for monitoring UCSC emailfor time-sensitive information.b. Upon twenty-four (24) hours written notice byUniversity unless consent is given by Student forearlier entrance to conduct necessary or agreedupon inspections, inventory, repairs/maintenance,alterations, or improvements, or supply servicesrequired to maintain the residence.c.All maintenance requests initiated by Studentimply consent to enter the premises to performthe requested maintenance.d. According to a pre-determined cleaning/maintenance inspection schedule presented toStudent and/or posted in common areas.e.Between quarters when, at the option of theUniversity, units may be entered with verbal and/orwritten advance notice.f.When Student has abandoned or surrenderedthe residence.g.For any other reason allowed by law.10. Personal Property: University assumes no responsibilityfor and is not liable for any loss or damage to Student’spersonal property. Student is strongly advised to obtainpersonal property/renters insurance to insure personalproperty. See housing.ucsc.edu/insurance for moreinformation.i.If the Student declines or does not respondwithin the allotted time to the first alternatehousing offer application will remain on thewaitlist.ii. If the Student declines or does not respondwithin the allotted time to any subsequentalternate housing offer, the University reservesthe right to terminate the waitlist application.Terms and Conditions 2021-225

Althoughrare, students in shared rooms may not havea roommate during a portion of the contractperiod. In such instances, new roommate(s)may be assigned at any time, with or withoutadvance notification. Student agrees not tooccupy or store personal belongings in vacantspaces and to welcome new roommate(s)/housemate(s) when assigned.d. University maintains the right to reassignStudent, with or without Student’s permission,to an on- or off-campus residential location inthe event of an actual or impending naturaldisaster, during a conduct investigation, orthe existence of another condition involvingthe health and/or safety and well-being ofStudent, which conditions would reasonablyjustify such relocation. Failure to comply witha reassignment is a material breach of thisagreement and may result in Student beingdenied the opportunity to participate in anyfuture room change, and/or termination of thehousing contract.e.Communicable Disease: If you should contracta communicable disease, you may be reassignedto quarantine or isolation housing until you areno longer contagious. Medical directives arecontingent on public health conditions at thetime of their implementation and are subjectto change. It is the student's responsibility tostay current regarding the University's policiesand requirements. See UCSC Roadmap toRecovery for updated policies, guidelines, andprotocols recovery.ucsc.edu. University makesno warranty with respect to the safety of thepremises with regard to any infectious disease.13. Severability: If any provision of this Agreement orthe application thereof shall, for any reason and toany extent, be invalid or unenforceable, the remainderof this Agreement shall be enforced to the maximumextent permitted by law.14. Student Liability: Student is individually liablefor loss or damage to the assigned residenceand its furnishings; and will be held jointly andindividually liable for damage to the entire residenceunit or apartment, not just Student’s living space, inaccordance with University policy unless proof ofindividual responsibility is made.15. Student Maintenance:a.Student agrees to comply with local anduniversity requirements to maintain residenceunit in a clean, safe, sanitary conditionconsistent with Centers for Disease Controland Prevention guidelines available at: ick/disinfecting-your-home.html.b. Student accepts responsibility for promptlynotif ying University of all conditionsthat require repair. Student shall notify theUniversity of maintenance requests throughthe Housing Maintenance Service RequestSystem, fixit.ucsc.edu. University personnelwill perform all necessary repairs, painting, orother alterations to residence.c.Student agrees to bear the cost of the repair ofany damage to or restoration of the building,equipment, or furnishings resulting from neglector willful act of the Student, Student’s guest(s),or other person(s) for whom the Student isresponsible.d. Student may not perform or arrange forothers to perform any repairs to damages orany corrections of deficiencies in the premiseswhether during the Student’s tenancy or uponthe termination of tenancy. The foregoing shallnot limit the Student’s right to request that theUniversity repair damage, correct deficiencies, orotherwise service the premises during the tenancy.Notwithstanding such a request, the Student shallbe liable for any damages done to the premises ordeficiencies created by the Student, normal wearand tear excepted.16. Unauthorized Residence Assignment Changes:Student may not move to another residence/space from their assigned residence/space withoutprior written approval from the University. Anunauthorized change may result in Student beingrequired to return to the original assignment,denied the opportunity to participate in any futureTerms and Conditions 2021-226

Universit y Ma intena nce: Universit y w il lmaintain on a regular basis the following items:window coverings, carpet cleaning, painting,and upholstery cleaning. However, unusual orexcessive damage to these items (as determinedby University) will result in charges to Student.3. Charges for utilities and normal wear-and-tear areincluded in the residence rate.18. Use: Assigned space is for residential purposesonly and may not be used in any manner other thanas a personal residence. Activities of a business orcommercial nature are not permitted on Universityproperty. This includes but is not limited to listing therented premises on websites or through other media forthe purpose of providing vacation or hotel/motel-typelodging. Student shall not pursue any business in theirroom/apartment, or on the premises. Student may notinscribe or affix any sign, advertisement, or notice onany part of the inside or outside of the buildings orpremises in connection with any business or service.19. Utilities: The University agrees to provide electricity,water, and refuse disposal service. However, theUniversity shall not be liable for failure to provideany of these services when such failure is caused byconditions beyond the control of the University.a.The campus is engaged in a multi-year project toimprove utility infrastructure. Efforts to upgrade,replace, or maintain equipment may result indisturbances and disruptions, including, but notlimited to, planned and unplanned power outagesin the residential facilities. By agreeing to theseterms and conditions, Student agrees that Studenthas been advised of said utility infrastructure work,acknowledges that there will be disturbances anddisruptions during the contract period, and thatsuch reasonable disturbances and disruptionsare not grounds for cancellation of this contract.University shall provide reasonable advance noticefor any planned outages.B. All Residential Facilities1.University agrees to provide lodging, furnishings,and utilities.2. Student agrees to leave the common areas of allresidential facilities, including kitchens, eating areas,lounges and restrooms, in a clean and orderly fashionafter using said facilities. Student(s) will be heldC. Apartments: Cowell College, Stevenson College, CrownCollege, Merrill College, Porter College, Kresge College,Oakes College, Rachel Carson College, College Nine,College Ten, and Redwood Grove1.Student is responsible for the cleaning of theirindividual room and is jointly responsible forcleaning of the common areas of each residence unit.Student agrees to comply with local and universityrequirements to maintain residence unit in a clean,safe, sanitary condition consistent with Centers forDisease Control and Prevention guidelines availableat: ick/disinfecting-your-home.html2. Students may be billed for excessive utility use.3. University agrees to provide kitchen facilities.D. Residence Halls: Cowell College, Stevenson College,Crown College, Merrill College, Porter College, OakesCollege, Rachel Carson College, College Nine, CollegeTen, and Transfer Community1.University agrees to provide cleaning service for thecommon areas of each residence hall.2. Student is responsible for the cleaning of theirindividual room.
