Corporate Name and Definitions.This Charter is the municipal corporation charter of the City of Aberdeen, Harford1.County, Maryland, the corporate name of which is “City of Aberdeen.”2.The terms “City,” “Municipality,” and “Municipal Corporation” in this Chartershall be construed as synonymous.Section II. General Corporate Powers.1.The Municipal Corporation here continued under its corporate name, has all theprivileges of a body corporate, by that name to sue and be sued, to plead and be impleaded in anycourt of law or equity, to have and use a common seal and to have perpetual succession, unless theCharter and the corporate existence are legally abrogated.2.The City may acquire real, personal, or mixed property within or without thecorporate limits of the City for any public purpose by purchase, gift, bequest, devise, lease,condemnation or otherwise and may sell, lease, or otherwise dispose of any property belonging tothe City. All municipal property, funds, and franchises of every kind belonging to or in thepossession the City (by whatever prior name known) at the time this Charter becomes effectiveare vested in the City, subject to the terms and conditions thereof.3.The City may condemn property of any kind, or interest therein or franchiseconnected therewith, in a fee or as an easement within the corporate limits of the City, for anypublic purpose. Any activity, project or improvement authorized by the provisions of this Charteror any other State law applicable to the City is a public purpose. The manner of procedure in caseof any condemnation proceeding shall be that established in Title 12 of the Real Property Articleof the Annotated Code of Maryland.4.The City may acquire, obtain by lease or rent, purchase, construct, operate, andmaintain all buildings and structures it deems necessary for the operation of the City Government.It may do whatever may be necessary to protect City property and to keep all City property in goodcondition.Section III. Corporate Limits.1.The corporate boundaries shall be the courses and distances as adopted by theCouncil by Charter amendment. The corporate limits or boundaries of the City of Aberdeen, untilchanged by the Council in accordance with law, are the same as prior to the adoption of thisCharter.

1-2Municipal Charters of Marylanda.A description of the corporate boundaries of the City at all times shall be onfile with the Clerk of the Circuit Court for Harford County, the Director of the Department ofLegislative Services, and the offices of the City of Aberdeen.Section IV. The Mayor.1.The Mayor holding office at the time of adoption of this Charter shall continue tohold office for the term for which he was elected and until the succeeding Mayor takes office underthe provisions of this Charter. Commencing in 2011, elections for Mayor shall be held every four(4) years on the first Tuesday after the first Monday in November. Commencing in November2011, the term of office shall be four (4) years.2.The Mayor shall retain office until a successor is duly sworn at the first Councilmeeting following the election.3.The Mayor shall have the qualifications set forth in this section at the time ofelection or appointment to fill a vacancy in the Office of Mayor and during the entire term ofoffice. The Mayor must have been domiciled in the City for at least two (2) years immediatelypreceding election or appointment and must be a qualified voter of the City. The Mayor shall beat least twenty–five 25 years of age on the Monday following the mayoral election or appointmentto fill a vacancy in the office of Mayor. A candidate for Mayor must not also simultaneously be acandidate for City Council member. If a member of the City Council is elected or appointed Mayor,that person shall be deemed to have resigned as a member of the City Council upon assuming theoffice of Mayor.4.The Mayor shall receive an annual salary as set from time to time by ordinancepassed by the Council in the regular course of business. No change shall be made in the salary forany Mayor during the term for which elected. The ordinance making any change in the salary paidto the Mayor, either by way or [of] increase or decrease, shall be finally ordained prior to themunicipal election to elect the next succeeding Mayor and shall take effect only as to the nextsucceeding Mayor. Until changed by ordinance under the authority of this section, the annualcompensation of the Mayor shall be ten thousand dollars ( 10,000.00).5.The Mayor shall:a.Establish the emphasis, direction, and vision of the City in conjunction withb.with the Council.Plan for the future, welfare, and business interest of the City in conjunctionthe Council.c.Prepare and present the annual budget for approval by the Council, inkeeping with the emphasis, direction, and vision established with the Council.d.Assure on behalf of the Council that the ordinances of the City are faithfullyexecuted by the City Manager and that the disbursement of all moneys is in accordance with the

Charter of the City of Aberdeen1-3budget approved by the Council. The Mayor may consult with the City Manager, as needed, to theday–to–day priorities of the City. The Mayor shall be recognized as the head of the Citygovernment for all ceremonial purposes, by the courts for serving civil process, and by theGovernor for purpose of military law.e.Appoint the City Manager, and all members of commissions and boards asestablished by this Charter, subject to the approval of the Council.f.Report annually to the Council the State of the City Government and makesuch recommendations as may be proper for the public good and welfare of the City.g.Establish an Economic Development Commission, Ethics Commission, aParks and Recreation Board, Board of Appeals, Planning Commission, and such other boards andcommissions as may be appropriate, subject to the advice and approval of the Council.h.Sign all documents obligating the City to long–term debt and shall sign alldocuments and contracts for which Council approval is required or for which signature authorityhas been delegated to the Mayor.i.Have such other powers and duties as may be prescribed by this Charter ormay be required by the Council not inconsistent with this Charter. No. 17–CR–01,6–27–2017.)6.During temporary absence or illness of the Mayor and upon the Mayor’s formalrequest, a member of the Council chosen by the remainder of the Council shall perform the dutiesof the Mayor. In the event of the incapacity of the Mayor by reason of physical or mental disability,or otherwise, the Council may pass a formal resolution of temporary incapacity and direct amember of the Council chosen by the remainder of the Council to perform the duties of the Mayorfor a specific period. In the alternative, if the Council determines the incapacity of the Mayor tobe permanent, it may by formal resolution declare the office of Mayor vacant. The Circuit Courtfor Harford County shall have exclusive jurisdiction to resolve all questions of incapacity of theMayor upon the Petition of the Mayor, the Council, or any qualified voter of the City.7.Except as provided in Section IV.8 of this Charter, in case of a vacancy in the officeof Mayor, for any reason, the Council shall, by a majority vote of the entire Council, elect a personsatisfying the qualifications in § IV.3 to fill the vacancy for the remainder of the unexpired term.(Res. No. 16–CR–02, 2–7–17.)8.In the case of a vacancy arising from the failure to elect a person to serve as mayorbecause of a tie vote between two or more candidates receiving the highest number of votes forMayor at a City Election, the vacancy shall be filled as provided in this section.A.The vacancy shall be filled by a special run–off election between thecandidates who received the same number of votes at the City election. The Aberdeen Board ofElections promptly shall notify the candidates in writing of the date of the run–off election.

1-4Municipal Charters of MarylandB.The run–off election shall be conducted not more than 30 business daysafter the Aberdeen Board of Elections certifies the results of the City election in accordance withSection VII.12 of this Charter.C.A candidate may decline to participate in a run–off election by filing withthe City Clerk a written and notarized declination of participation within two business days afterthe Board notifies the candidates of the date of the special election. If a candidate’s declination ofparticipation leaves only one remaining candidate to participate in the run–off election, therun–off election shall not be held and the remaining candidate shall be deemed to be elected.D.If a run–off election results in a tie vote, another run–off election shall beconducted between the candidates receiving the same number of votes at the run–off election. Thesubsequent run–off election shall be conducted not more than 30 business days after the AberdeenBoard of Elections certifies the results of the prior run–off election in accordance with sectionVII.12 of this Charter.E.If a second run–off election results in a tie vote, the newly elected CityCouncil shall decide, by the affirmative vote of a majority of the entire Council, which of the tiedcandidates is the winner of the election. If no winner is selected by the affirmative vote of amajority of the entire Council within 30 business days after the Aberdeen Board of Electionscertifies the results of the second run–off election, the Aberdeen Board of Elections shall decidethe winner of the election by a game of chance determined and conducted by the Board in publicbetween the tied candidates. No. 16–CR–02, 2–7–17.)9.Notwithstanding any other provision of this Charter, in the event of a tie vote in anelection for the Office of Mayor, the incumbent Mayor shall remain in office until the Mayor’ssuccessor qualifies and takes office. (Res. No. 16–CR–02, 2–7–17.)Section V. The City Council.1.All legislative powers of the City shall be vested in the “Council” consisting of four(4) Council members and the Mayor. The Council members holding office at the time of theadoption of this Charter shall continue to hold office for the term for which they were elected anduntil the succeeding Council takes office under provisions of this Charter.2.a.Commencing in November 2011, elections for Council shall be held everyfour (4) years on the first Tuesday after the first Monday in November. Commencing in November2011, the term of office shall be four (4) years.3.All Council members shall serve until their successors are duly elected andqualified. Duly elected Council members shall take office on the Monday following the election.4.Each Council member shall have the qualifications set forth in this section at thetime of election or appointment to fill a vacancy in the office of Council member and during theentire term of office. Council members shall have been domiciled in the City for at least two (2)years immediately preceding their election or appointment and must be qualified voters of the City.

Charter of the City of Aberdeen1-55.Each Council member shall receive an annual salary, which shall be equal for allCouncil members, except the Mayor, and shall be as specified from time to time by ordinancepassed by the Council in the regular course of its business; provided, that the ordinance makingany change in the salary paid to the several Council members, either by way of increase ordecrease, shall be finally ordained prior to the municipal election for the members of the nextsucceeding Council and shall take effect only as to the members of the next succeeding Council.Until changed by ordinance, the annual compensation of each Council member, except the Mayor,shall be seven thousand five hundred dollars ( 7,500.00).6.The newly elected Council shall meet on the Monday following its election for thepurpose of organization, after which the Council shall meet regularly at such times as may beprescribed by its rules but not less frequently than once each month. Special meetings shall becalled by the City Manager, the Mayor or at least two members of the Council. Except for suchmeetings permitted to be closed under the Maryland Open Meetings Act, all meetings, regular andspecial, of the Council, shall be public meetings and open to the public at all times. No ordinance,resolution, rule or regulation shall be finally adopted except at an open meeting. The rules of theCouncil shall provide that residents of the City and other interested parties shall have a reasonableopportunity to be heard at any open public meetings with regard to any municipal question. (Res.No. 17–CR–01, 6–27–2017.)7.The Mayor shall preside at all meetings of the City Council and shall have the rightto vote on all issues.8.A majority of the members of the Council shall constitute a quorum for thetransaction of business, but no ordinance shall be approved nor any action taken upon an ordinancewithout the favorable votes of a majority of the whole number of members elected to the Council.9.The Council shall adopt rules for its order of business. It shall keep a journal ofproceedings and enter therein the “yeas” and “nays” upon a final action on any question, resolution,or ordinance. The journal shall be a public record.10.a.Except as set forth in Subparagraph b below, no ordinance shall be passedat the meeting at which it is introduced. At any regular or special meeting of the Council held notless than six (6) nor more than sixty (60) days after the meeting at which an ordinance wasintroduced, it shall be passed, or passed as amended, or rejected, or its consideration deferred. Anysuch ordinance shall become effective at the expiration of twenty (20) calendar days followingadoption.b.In the cases of emergency, the provision that an ordinance may not bepassed at the meeting in which it is introduced may be suspended by the affirmative votes of four(4) members of the Council. An emergency ordinance shall become effective on the date specifiedin the ordinance.

1-6Municipal Charters of Marylandc.Each ordinance passed by the Council or a fair summary shall be publishedat least once on the City’s internet website and in a newspaper having primary circulation inHarford County, if one exists, within two (2) weeks of its passage.11.Referendum:a.Any ordinance may be brought to referendum within thirty (30) days of itspassage by petition filed with the City Clerk containing the signatures of not less than twentypercent (20%) of the qualified voters of the City requesting that the ordinance or any part thereofbe submitted to a vote of the qualified voters of the City for their approval or disapproval.b.Following acceptance of the petition and verification of the signatures, theCouncil shall have the ordinance or the part thereof requested for referendum submitted to a voteof the qualified voters of the City at the next regular City election or in the Council’s discretion,at a special election occurring before the next regular election.c.No ordinance or the part thereof requested for referendum shall become orcontinue to be effective following the receipt of such petition until and unless approved at theelection by a majority of the qualified voters on the question, excepting however that an emergencyordinance or the part thereof requested for referendum shall continue in effect for sixty (60) daysfollowing receipt of such petition. If however the question of approval or disapproval of anyemergency ordinance or any part thereof has not been submitted to the qualified voters within sixty(60) days following receipt of the petition, the operation of the ordinance or the part thereofrequested for referendum shall be suspended until approved by a majority of the qualified voterson the question at any election.repealed.d.Any ordinance or part thereof disapproved by the voters shall stande.The provisions of this section shall not apply to any ordinance or partthereof passed under authority of this Charter levying property taxes for the payment ofindebtedness, but the provisions of this section shall apply to any ordinance or any part thereoflevying special assessment charges.f.The provisions of this section shall be self–executing but the Council mayadopt ordinances in furtherance of these provisions and not in conflict with them.g.Any Council member is subject to recall from office for cause and by areferendum of the qualified voters of the City. A request for recall of a member of the Councilshall be initiated on the receipt of a petition signed by not less than twenty percent (20%) of thequalified voters of the City. Upon receipt by the City Clerk of a petition for recall of a member ofCouncil, the City Clerk shall forward the petition to the Aberdeen Board of Elections for thepurpose of confirming that a minimum of twenty percent (20%) of the qualified voters has signedthe petition, that the names and addresses of the qualified voters are clearly legible and that thecause for recall is clearly presented on the petition. All pages of the petition shall be presented tothe City Clerk at one time and may not be amended or supplemented after submittal. If the petition

Charter of the City of Aberdeen1-7for recall conforms to the requirements of this paragraph, an election on the recall shall bescheduled by the Aberdeen Board of Elections no later than sixty (60) days after receipt of thepetition by the Aberdeen Board of Elections. The recall election shall be conducted in generallysimilar manner as other City elections. The petition for recall shall clearly state one or more causesfor recall which shall be one or more of the following: (1) failure to uphold the oath of office; (2)malfeasance, examples of which are placed upon the petition; (3) misfeasance, examples of whichare placed upon the petition; (4) engaging in illegal conduct for which the Council member hasbeen charged and convicted; (5) gross abuse of public authority examples of which are placedupon the petition; (6) the coercion of any City employee into taking illegal or improper action ortaking retaliatory action against any City employee as a result of that employee’s disclosure ofinformation relating to the illegal and improper action in City Government; (7) gross negligenceor incompetence in the performance of public duties, examples of which are placed upon thepetition. Votes cast in the election are for the removal of the member of the Council. That membershall be deemed removed from office immediately upon certification of the results of the electionby the Aberdeen Board of Elections. The vacancy shall be filled as provided in this Charter.12.inspection.Ordinances shall be permanently filed with the City and available for public13.The Council shall have the power to pass all such ordinances not contrary to theConstitution and laws of the State of Maryland or this Charter as it may deem necessary for thegood government of the City, for the protection and preservation of the City’s property, rights andprivileges; for the preservation of peace and good order; for securing persons and property fromviolence, danger, or destruction; and for the protection and promotion of the health, safety, andwelfare of the residents and visitors of the City.14.In addition to the general powers set forth hereinabove, the Council shall have thefollowing specific ordinance–making powers:a.To levy, assess and collect ad valorem taxes.b.To appropriate and expend municipal funds for any public purpose.c.To provide any valid charges, taxes, or assessments made against any realor personal property shall be liens upon the property to be collected as municipal taxes.d.To create, change and abolish offices and departments, commissions andagencies not inconsistent with this Charter and to assign additional functions or duties to offices,departments, commissions, or agencies, established by this Charter so long as the Council does notdiscontinue or assign to any other office, department, commission, or agency, any function or dutyassigned by this Charter to any other office, department, commission, or agency.e.To provide, maintain, support or operate community and social services forthe preservation and promotion of the health, recreation, welfare, and enlightenment of theinhabitants of the City and to improve their environment.

1-8Municipal Charters of Marylandf.To provide for advertising for the purposes of the City, for printing andpublishing statements regarding the business of the City.g.To provide in the interest of the public welfare for licensing, regulating, orrestraining theatrical or other public amusements.h.To license, tax, or regulate all permanent or transient businesses,occupations, trades or places of amusement, or to prohibit same; to establish and collect fees andcharges for licenses and permits issued under the authority of this Charter or ordinance enactedpursuant to this Charter.i.To establish a municipal band, symphony orchestra or other musicalorganization, and to regulate by resolution the conduct and policies of such band, orchestra ormusical organization.j.To license, tax and regulate, restrain or prohibit the erection or maintenanceof billboards within the City, the placing of signs, bills and posters of every kind and descriptionon any building, fence, post, billboard, pole, or other place within the City.k.To exercise municipal borrowing powers.l.To make reasonable regulations regarding buildings and signs to be erected,constructed, or reconstructed in the City, and to issue building permits; to formulate a buildingcode, a plumbing code, and other code related to construction of buildings and other structures andto appoint a building inspector and a plumbing inspector, and to require reasonable charges forpermits and inspections; to authorize and require the inspection of all buildings and structures; toauthorize the condemnation thereof in whole or in part when dangerous or insecure, and to requirethat such buildings and structures be made safe or be razed.m.regulate cemeteries.To regulate or prohibit the interment of bodies within the City and ton.To prohibit youth from being in the streets, lanes, alleys, or public places atunreasonable hours of the night.o.To compel persons about to undertake dangerous improvements to executebonds with sufficient sureties conditioned that the owner or contractor will pay all damagesresulting from such work which may be sustained by any persons or property.p.To provide for licensing and regulation for the keeping and disposition ofanimals and to provide authority for the impounding, retention, sale and redemption of suchanimals when found in violation of any such ordinance.q.To regulate or prevent the storage of gunpowder, oil, or any other explosiveor combustible material and to regulate or prevent the use of firearms, fireworks, bonfires,explosives, or any other similar things which may endanger persons or property.

Charter of the City of Aberdeen1-9r.To compel the occupant of any premises, building, or outhouse situated inthe City, if it has become filthy or unwholesome, to abate or cleanse the condition; and afterreasonable notice to the owners or occupants, to authorize such work to be done by the properofficers and to assess the expense thereof against the property, making it collectible as taxes oragainst the occupant or occupants.s.To suppress fires and prevent the dangers thereof and to establish andmaintain fire departments and emergency medical and rescue services; to contribute funds tovolunteer fire companies serving the City; to inspect buildings for the purpose of reducing firehazards, to issue regulations concerning fire hazards, and to prohibit the use of fire–hazardousbuildings and structures permanently or until the conditions of City fire–hazard regulations aremet; to install and maintain fireplugs where and as necessary, and to regulate their use; and to takeall other measures necessary to control and prevent fires in the City.t.To inspect and to regulate the sale of any food products and to requirecondemnation of unwholesome food.u.To grant and regulate franchises to water, electric light, cable television,telegraph and telephone, transit and taxicab companies, and to such other businesses which maybe deemed advantageous and beneficial to the City, subject to appropriate license fees, charges, ortaxes. No franchise shall be granted for a longer period than fifteen (15) years; in the alternative,to create appropriate instrumentalities to render such utility service.v.To provide waste collection and disposal service; to prevent the deposit ofany unwholesome substance either on private or public property and to compel its removal todesignated points; to require garbage, ashes, and other waste or other unwholesome materials tobe removed to designated points, or to require the occupants of the premises to place them forconvenient removal.w.To accept gifts and grants of Federal or of State funds from the Federal orState governments or any agency thereof, and to expend the funds for any lawful purpose,consistent with the conditions under which the gifts or grants were made.x.To establish such offices and agencies to protect and preserve the health ofthe City and its inhabitants and to regulate persons, buildings and persons [buildings], businesses,and properties to promote and provide for the health and safety of the City and its inhabitants.y.To regulate the numbering of houses and lots and to compel owners torenumber them, or in default thereof, to authorize and require the work to be done by the City atthe owner’s expense, such expense to constitute a lien upon the property collectible as a tax.z.To provide for the lighting of the City.aa.To obtain by lease or rent, own, construct, purchase, operate, and maintainpublic markets within the City.

Conveyances of real propertyshall be subject to any limitations and provisions specified in State law.kk.To regulate the use of sidewalks and all structures in, under, or above them;
