RestorativeDental Specialty Education Inc. Dr. Sabin Ewing addressed the Board concerning theConsultant’s initial recommendation to deny. Dr. Prince made a motion to deny the coursebecause it would not be taught at a school of dentistry or a school which offers a specialtyprogram in a recognized specialty branch of dentistry. Second was given by Dr. Hall.Motion carried. Motion carried.6. Multiple Courses – Kessler, Kyndall – Palmar College-Sealant Application and CoronalPolishing - Ms. Warner made a motion to approve as equivalent. Second was given byMs. Vaughn. Motion carried.CORRESPONDENCEAccreditation and Testing Agencies The Board reviewed ADEX 2015 highlights from theannual meeting; ADEX dental examination score portal; ADEX update; ADEX 2016 meeting info;ADEX report from Dr. Charles E. Holt, Jr.; CITA 2016 Annual meeting Info and a letter from SRTA– all with no action.Licensees and others The Board 1) reviewed a letter from Dr. Ben Spaulding asking the Boardto consider a new license that would allow retired dentists to work in a limited capacity. Ms.Putnam will respond advising this would require a statute change. 2) a Letter from John Saranrequesting the board consider programs that would involve patient discount savings where onlythe patient receives any benefit from the program. Ms. Putnam will respond advising that theboard took no position. and 3) a letter from Vanderbilt University Medical Center regardingprofessional development courses available, with no action.REPORTS The Board received the following reports for review: Executive Director Dea Smith gave an administrative report of the activities that havetranspired in the administrative office since the last meeting. As of December 31, 2015, thetotal number of active licenses for dentists is 3,830, hygienists 4,663 and assistants 9,412.The 2015 Continuing Education Audit Report showed 81% of the dentists were compliant,82% of the hygienists were compliant, and 59% of the dental assistants were compliant. Ms.Smith also provided the Board with handouts from the AADB Annual meeting. It was theconsensus of the Board that Dr. Prince attend the April, 2016 meeting of the AADB in theplace of Dr. Hall. The attendees will be Dr. Prince, Dr. Maroda and Ms. Puckett. Office of General Counsel Ms. Putnam presented the Board with a report from the Office ofGeneral Counsel. The Ethics and Jurisprudence Rules are still pending until an internetbased examination program can be developed. Sedation audit – The Board reviewed the January through November, 2015 results of thesedation audit. Financial Report – Ms. Vanessa Crutcher provided the board with a report showing theactual revenue and expenditures of the Board for Fiscal Year ending June 30, 2015. Theboard requested Ms. Crutcher provide an estimate on how a possible reduction in certificationfees and reinstatement fees might impact the board’s fiscal standing. SRTA update – Dr. Jubran provided the Board with an update on the Southern RegionalTesting Agency (SRTA). The Board appointed Dr. DeWald to the Education Committee. Office of Investigation Nichelle Dorroh provided the Board with a report detailing thenumber of complaints currently open in Investigations as well as a summary of currentlymonitored practitioners. Wellness Committee Dr. Wayne McElhiney provided the Board with the Quarterly Report ofActivities of the Wellness Committee for the period July 1, 2015 to September 30, 2015, andMINUTES January 14, 2016TENNESSEE BOARD OF DENTISTRY

discussed renewing the contract for another year. Dr. Meadows made a motion to renew thecontract for 2016. Second was given by Ms. Puckett. Motion carried. Dr. McElhiney alsodiscussed with the Board a newly implemented “Student Voluntary Monitoring Agreement”through the Wellness Committee in an effort to reduce the cost associated with providingsupervision and monitoring of the participant’s health. University of Tennessee Dr. Timothy Hottel, Dean, gave an update on the happenings atthe University of Tennessee School of Dentistry. The clinics in Bristol and Union City areopen and the one in Chattanooga is expected to be operational in the summer.CONSENT ORDER(S)William L. Culley Dr. Culley entered into a Consent Order wherein he stipulated to failing to bein compliance with the 2015 sedation audit. Dr. Culley agreed to a reprimand of his dentallicense and the payment of a 100.00 civil penalty. Motion was made by Dr. DeWald to approve.Second was given by Ms. Puckett. Motion carried with Dr. Prince recusing.Mark S. Dill Dr. Dill entered into a Consent Order wherein he stipulated to failing to properlyplace implants resulting in a malpractice settlement in the amount of 40,000.00. Dr. Dill agreedto a reprimand of his dental license and complete at least fourteen (14) hours of continuingeducation hours in the area of implant prosthesis in addition to the regular continuing educationrequirement. Motion was made by Dr. Hall to approve. Second was given by Dr. DeWald.Motion carried.Laura B. Dove Dr. Dove entered into a Consent Order wherein she stipulated to failing tocomply with a 2012 Consent Order requiring her to reimburse several patients listed in theStipulations of Fact Section of that Consent Order. Dr. Dove agreed to her dental license beingplaced on probation for a minimum of two (2) years and pay a civil penalty in the amount of 500.00 and provide proof that all patient reimbursements have been made pursuant to the 2012Consent Order. Motion was made by DeWald to approve. Second was given by Dr. Meadows.Motion carried.James W. Gamble Dr. Gamble entered into a Consent Order wherein he stipulated to failing toproperly document files and properly secure prescription pads. Dr. Gamble agreed to having hisdental license placed on probation for five (5) years, complete a two day medical course entitled“Intensive Course in Medical Documentation: Clinical, Legal and Economic Implications forHealthcare Providers”, or an equivalent course pre-approved by the Board’s Consultant, and pay 5,300.00 in civil penalties. Upon completion of the course and payment of the civil penalties, hemay petition the Board for an Order of Compliance to have the probation lifted at the discretion ofthe Board. Motion was made by Ms. Puckett to approve. Second was given by Ms. Warner.Motion carried.Travonya L. Gilbert Ms. Gilbert entered into a Consent Order wherein she stipulated to failing tocomply with a conditional licensure letter dated July 7, 2014. She is in arrears 350.00 of anassessed 1,000.00 civil penalty. Ms. Gilbert agreed to a reprimand of her dental registration andpayment of the remainder of the civil penalty assessed against her. Dr. Prince made a motion toapprove. Second was given by Dr. DeWald. Motion carried.Ronald P. Lubovich Dr. Lubovich entered into a Consent Order where he stipulated to failing tobe in compliance with the 2015 sedation audit. Dr. Lubovich agreed to a reprimand of his dentallicense and the payment of a 200.00 civil penalty. Motion was made by Dr. Prince to approve.Second was given by Dr. DeWald. Motion carried.Daniel S. Read Dr. Read entered into a Consent Order wherein he stipulated to failing to be incompliance with the 2015 sedation audit. David P. Smith Dr. Smith entered into a Consent Order wherein he stipulated to failing to be incompliance with the 2015 sedation audit. Dr. Smith agreed to a reprimand of his dental licenseand the payment of a 200.00 civil penalty. Motion was made by Ms. Warner to approve.Second was given by Dr. Prince. Motion carried with Dr. Meadows recusing.Gary D. Stump Dr. Stump entered into a Consent Order wherein he stipulated to failing tocomply with terms of a guilty plea with the U.S. District Court in that he was not allowed to lawfullypossess firearms or ammunition. On June 2, 2015, he pled guilty to one Count of Felony inPossession of a Firearm and was sentenced to eighteen (18) months with the United StatesBureau of Prisons and assessed a 5,000 fine. Dr. Stump agreed to the suspension of his dentallicense for eighteen (18) months. Motion was made by Dr. DeWald to approve. Second wasgiven by Ms. Warner. Motion carried.Christel M. WestmorlandDr. Westmorland entered into a Consent Order wherein shestipulated to failing to be in compliance with the 2015 sedation audit. Motion carried. 3) Theboard members reviewed and signed the Conflict of Interest form.Election of Officers: Dr. Jubran was nominated as Chair, Ms. Warner as Vice-Chair and Dr.Hall as Secretary/Consultant.
