It is alsoa great time to thank our lovedones for all the support they giveus during the year.As we finish 2010, I would liketo address some issues that havecome up recently and remindeveryone to be aware of the tacticssome people will try to employespecially when times are tough.BE AWARE!!!I have heard of brokers usingthe term Co-Exclusive Listings.After checking with DBW andreviewing the California BoatingLaw manual, I am certain that thisterm and/or practice is not legal.Don’t be coerced into thinkingit is a way to avoid the possiblepitfalls related to an Open Listing.The term itself is should be causefor concern.In a transaction recently, aseller and his broker put in acounter offer that upon the buyersigning Final Acceptance, theBuyer’s Broker would release thedeposit to the Seller and his brokerbefore either the closing hadoccurred or the Buyer cancelled.Remember, funds pertainingto proceeds and commissionscannot be dispersed until the saleis completed or upon the buyercanceling the transaction. Those of you who did notattend the Northern CaliforniaLegal Seminar really missed out onsome great information. One topicthat really should be addressed byevery Broker to all sales people isthe advertising term “Buffing”. Thistopic was discussed as it related tothe recent legal action in Floridainvolving HMY Yachts. If you arenot familiar with the term or thecase, do your homework. Usingterms like: LIKE NEW, BETTERTHAN NEW, PERFECT, shouldbe used cautiously or not at all.Remember, can you prove it ina court of law? If not, be careful.The CYBA Boat ShowSpeakers Forum for 2010 wasvery successful. We were at threeshows and the attendance andoverall response from the boatingpublic was fantastic. Editor’s NotesAs I begin this letter we are but a few days awayfrom Christmas and it’s a mild 80 degrees here inSan Diego, now I remember why I moved here, noshoveling snow or bundling up to go outside – cannot say I miss any of that. Well for me to state 2010has been a trying year probably wouldn’t even beginto describe the difficulty and hardships we haveendured – but I do however think it has provided uswith a great opportunity to take a good hard look athow and what we are doing in our businesses andmaybe try and to evaluate and see if there are notareas we could improve on or change with the servicethat we provide our clients. I truly believe those whowill not only survive but thrive in this economy arethe ones that provide the highest level of service eachand everyday to their clients. Good Customer Serviceshould be priority one with all of us – why do youthink some of the top companies are so successful?Luck, product or maybe timing – NO it is customerservice. Another eventworth mentioning was the San Diego Brokers ForumAnnual Christmas party that was held on December15th 2010 at Fiddlers Green. The party was very wellattended and as always Steve Rock the owner andhis very competent staff did a fantastic job insuringeveryone had a great time.The section “ALONG THE WATERFRONT” in thenewsletter is getting great response so rememberthis is a great way for your company to get the wordout on changes at your office whether it be newpersonnel, new product-line, or maybe a new orrelocation of your office. Captain Marc Bay (no, nota USCG Capt) is extremely proud of our 2010 team.They worked very hard preparing for the 3-day 60mile walk as well as beating the bushes for donations.Marc tells us this years’ team was totally dedicatedand that, some even contributed over 900 of theirown money to reach the required goal of 2300 each!Those of you, that didn’t contribute, please thinkabout that next year! Yes, we will be back!This years’ walk took place November 19-21,2010. Friday was a beautiful San Diego day but thegreat walking weather went away and the teamended up getting drenched Saturday and got more ofthe same Sunday morning. Law Review Northern CaliforniaNovember 2010Another fabulous turnout at our Law Reviewseminar held this past November 2010 in Alameda,California. Once again, a big hand of applausegoes out to our wonderful and informative panelof speakers that provided us with informative,interactive topics of discussion throughout the day.This highly charged seminar provided many facetsof information from a panel of top rated professionalsin our industry by offering us insight, support andchallenges that test our knowledge and skills. TheLegal Seminar provides the forum to interact amonghighly regarded professionals and peers within theindustry and offers a great way to interact and gatherfacts and information to improve our profession asbrokers and salespeople.Miranda Isley and Fahim Buksh with theDepartment of Boating and waterways were onhand providing case studies, sample complaints andissues the department faces on a daily basis. Thedepartment provides this information as a courtesyto the brokers and salespeople to enhance theirknowledge and provide them with the tools andeducation to avoid future conflicts with broker tobroker issues and DBW.Our consummate panel of attorneys EarnestPierucci, David Weil, and Cris Wenthur, was on handto offer their legal opinions and advise throughoutthe highly informative day. They provided us with factfinding challenges in our daily business dealings ofcontracts and negotiations and offering suggestionsto keep us out of arms way regarding liability issues,buying and selling in Mexico and few other tidbitsto keep us informed.R.J. Lorenzi, Westmar Insurance, gave apresentation regarding, “Are you covered”, myths andrealities of broker insurance policies, that informationwas certainly something that could have gone on fordays this was certainly an area that must be givenspecial attention to, so as a caveat to all brokers besure you CYA!William E. Krauss, with the Apex Group, theCYBA’s Legislative Advocate gave a brief report fromregarding the California state budget and its impact;he also noted that many departments within in thestate are in a holding basis until after the Novemberelection.Finally our seminar concluded with “YOU MAKETHE CALL”, Dean West, Director with the CaliforniaYacht Brokers Association and Dennis Moran,Chairman for the Ethics and Arbitration committee.Dean and Dennis provided a question and answersession that was highly interactive and based on reallife arbitration cases.
