Other organisationsA. Political organisations not affiliated orassociated under a national agreement withthe Party, having their own programme,principles and policy, or distinctive andseparate propaganda, or possessing branchesin the constituencies, or engaged in thepromotion of parliamentary or localgovernment candidates, or having allegianceto any political organisation situated abroad,shall be ineligible for affiliation to the Party.B. The panel of the NEC responsible forassessing applications from socialist societiesto affiliate to the Party shall have regard toprocedural guidelines determined by the NEC,which are available from the Governance andLegal Unit.6. Affiliations FeesA. Trade Unionsi.Each affiliated trade union shall pay anaffiliation fee per member of 3.00.ii. After consultation with affiliatedorganisations, the NEC will determineaffiliation fees as and when necessary forAnnual Conference to approve.iii. Of that affiliation fee, a proportion shall beallocated to the Party’s national electionfund as provided by clause VIII.3.k of theserules.iv. Affiliation fees shall be payable on aquarterly basis on the first days of January,April, July and October each year and musthave been paid in full not later than 31December of the relevant year.B. Socialist SocietiesChapter 1Constitutional rulesEach affiliated socialist society or otherorganisation shall pay an affiliation fee permember of 1.25.iii. All affiliation fees shall be paid not laterthan 31 December of the relevant year.C. Affiliation fees and the allocation thereof maybe varied by Party conference and sub-clauses6.A.i to 6.B.iii above modified accordingly.7. Membership fees and insuranceA. Membership fees for each individual membershall be collected by, or on behalf of, theParty’s Head Office and shall be dividedbetween Head Office, the relevant regionaloffice, or Scottish/ Welsh office as the casemay be, and the relevant CLP, as laid down inthe membership rules.B. The NEC shall arrange on behalf of all CLPs aninsurance scheme to cover a by-electionpremium, public liability, and such other legalrisks as the NEC considers appropriate. Theestimated cost of such insurance for thefollowing year shall be advised to the annualsession of Party conference and each CLPshall be notified of its share of the cost whichmust be paid by 15 April of the following year;wherever possible this shall be deducted froma CLP’s share of membership subscriptionsduring the first quarter of each year.8. There shall be a Women’s representativestructure, including a national Women’sCommittee and a national Women’s Conference.Which shall operate on procedural guidelinesissued by the NEC9. There shall be a BAME Members’ representativestructure which shall operate on proceduralguidelines issued by the NEC.10. There shall be a Disabled Member’srepresentative structure which shall operate onprocedural guidelines issued by the NEC.Clause III.The Party’s financial scheme1. The Party shall maintain a financial schemeapproved by the Electoral Commission and shallconsist of a central organisation with accountingunits2. The following may, subject to the approval of theNEC, be registered as accounting units under theParty’s financial scheme:Page 2

Labour StudentsE. the Association of Labour Councillors (‘ALC’)F. the Trade Union and Labour Party LiaisonCommittee and the National and RegionalTrade Union Liaison CommitteesG. the Parliamentary Labour Party (‘PLP’)H. such other Party units as shall from time totime be agreed by the NEC to be eligible forregistration.3. All accounting units will comply with their legalobligations under PPERA 2000, including using 1January to 31 December as the financial year,maintaining adequate financial records,identifying and reporting donations and loans,producing an annual statement of accounts bythe end of the first quarter of the following yearand providing all relevant information asrequested to the Party. Failure to meet theseobligations may lead to the NEC takingdisciplinary action against individual members,the suspension of the appropriate Party unit orboth.4. The financial year for all units of the Party shallbe 1st January to 31st December.Clause IV.Aims and values1. The Labour Party is a democratic socialist Party. Itbelieves that by the strength of our commonendeavour we achieve more than we achievealone, so as to create for each of us the means torealise our true potential and for all of us acommunity in which power, wealth andopportunity are in the hands of the many not thefew; where the rights we enjoy reflect the dutieswe owe and where we live together freely, in aspirit of solidarity, tolerance and respect.2. To these ends we work for:A. A DYNAMIC ECONOMY, serving the publicinterest, in which the enterprise of the marketand the rigour of competition are joined withthe forces of partnership and co-operation toproduce the wealth the nation needs and theopportunity for all to work and prosper with athriving private sector and high-quality publicservices where those undertakings essentialto the common good are either owned by thepublic or accountable to themChapter 1Constitutional rulesB. A JUST SOCIETY, which judges its strength bythe condition of the weak as much as thestrong, provides security against fear, andjustice at work; which nurtures families,promotes equality of opportunity, anddelivers people from the tyranny of poverty,prejudice and the abuse of powerC. AN OPEN DEMOCRACY, in which governmentis held to account by the people, decisions aretaken as far as practicable by thecommunities they affect and wherefundamental human rights are guaranteedD. A HEALTHY ENVIRONMENT, which we protect,enhance and hold in trust for futuregenerations.3. Labour is committed to the defence and securityof the British people and to co-operating inEuropean institutions, the United Nations, theCommonwealth and other international bodies tosecure peace, freedom, democracy, economicsecurity and environmental protection for all.4. Labour shall work in pursuit of these aims withtrade unions and co-operative societies and alsowith voluntary organisations, consumer groupsand other representative bodies.5. On the basis of these principles, Labour seeks thetrust of the people to govern.Clause V.Party programme1. At all levels the Party will ensure that members,elected representatives, affiliated organisationsand, where practicable, the wider community areable to participate in the process of policyconsideration and formulation.2. Party conference shall decide from time to timewhat specific proposals of legislative, financial oradministrative reform shall be included in theParty programme. This shall be based on therolling programme of work of the National PolicyForum. No proposal shall be included in the finalParty programme unless it has been adopted bythe Party conference by a majority of not lessthan two-thirds of the votes recorded on a cardvote.Page 3

3. When in Government the NEC, the sevenbackbench members of the ParliamentaryCommittee of the Parliamentary Labour Party(‘PLP’) plus the Chair of the PLP, the Cabinet, theLeaders of the Scottish and Welsh Labour Parties,the Chair and three vice Chairs of the NPF, twoCLP members of the NPF to be elected by CLPdelegates to the NPF, and eight Trade Unionmembers of the TULO Contact Group, shalldecide which items from the Party programmeshall be included in the manifesto which shall beissued by the NEC prior to every general election.The joint meeting shall also define the attitude ofthe Party to the principal issues raised by theelection which are not covered by the manifesto.4. When not in Government the NEC, the ShadowCabinet, the Parliamentary Committee of theParliamentary Labour Party (‘PLP’), the Leaders ofthe Scottish and Welsh Labour Parties, and theChair and three vice Chairs of the NPF and eightTrade Union members of the TULO ContactGroup shall decide which items from the Partyprogramme shall be included in the manifestothat shall be issued by the NEC prior to everygeneral election. The joint meeting shall alsodefine the attitude of the Party to the principalissues raised by the election which are notcovered by the manifesto.5. The NEC shall decide which items from theprogramme shall be included in the electionmanifesto for the European Parliament afterconsultation with the European ParliamentaryLabour Party (‘EPLP’) and with sister parties in theParty of European Socialists.Clause VI.Labour Party Conference1. The work of the Party shall be under the directionand control of Party conference, which shall itselfbe subject to the constitution and standingorders of the Party. Party conference shall meetregularly once in every year and also at suchother times as it may be convened by the NEC.2. The rules for the convening and operation ofParty conference are contained in chapter 3 ofthese rules which may be amended by decisionof the NEC, subject to ratification by Partyconference. Party conference and specialsessions of Party conference in these rules arereferred to as ‘Party conference’ and these rules(except where the context otherwise requires)shall apply thereto.Chapter 1Constitutional rulesClause VII.Party officers and statutory officers1. Party officersA. Leader and deputy leaderi.There shall be a leader and deputy leaderof the Party who shall, ex-officio, be leaderand deputy leader of the PLP.ii. The leader and deputy leader of the Partyshall be elected or re-elected from amongCommons members of the PLP inaccordance with procedural rule Chapter 4Clause II below, at a Party conferenceconvened in accordance with clause VIabove. In respect to the election of theleader and deputy leader, the standingorders of the PLP shall alwaysautomatically be brought into line withthese rules.iii. The Leader shall be the person registeredas the Party’s Leader for legal purposes.iv. The Leader shall have the right to attendany Party meeting (or to appointrepresentatives to attend on his or herbehalf) in order to promote understandingand co-operation between all sections ofthe Party.v. The Leader shall, as a member of the NEC,uphold and enforce the constitution, rulesand standing orders of the Party andensure the maintenance and developmentof an effective political Labour Party inparliament and in the country.vi. The Leader shall report to AnnualConference on the work and state of theParty and its aspirations for the countryand make regular reports to the NEC,National Policy Forum and other Partybodies between annual conferences.vii. The Leader shall in conjunction with theNEC have overall responsibility for allelections and shall appoint a CampaignCo-ordinator and a Campaign Committeeto ensure that all Labour Party electioncampaigns report to the Leader andreceive the support and assistance theyneed.viii. When the Party is in Government, theLeader shall appoint the Cabinet and allother front bench positions in theircapacity as Prime Minister. When the Partyis not in Government, MPs in the ShadowCabinet shall be appointed by the PartyLeader, as shall the Chief Whip. The PartyPage 4

Leader shall also appoint all otherfrontbench positions outside the ShadowCabinet.ix. The Leader shall consult the DeputyLeader on a regular basis and the DeputyLeader shall provide the Leader withadvice and support in achieving the goalsof the Party and deputise as requestedB. Chair and vice-chairi.There shall be a chair and vice-chair of theParty elected by the NEC from among itsown members in accordance with theprovisions set out in procedural ruleChapter 4 II.3 below.C. General Secretaryi.There shall be a General Secretary of theParty who shall be appointed inaccordance with the provisions set out inprocedural rule Chapter 4.II.4.A below. TheGeneral Secretary shall act as secretary tothe NEC.ii. For the avoidance of doubt, wherever inthis rule book or upon instruction ordelegation by the NEC, or a committee orsub-committee thereof, the GeneralSecretary has a function to discharge, sheor he may delegate the discharge of suchfunction to such appropriate officer ordesignated representative of the Party asshe or he shall see fit. Further, the GeneralSecretary shall be deemed always to havehad the power so to delegate.D. Party Treasureri.There shall be a treasurer of the Party whoshall be elected by Party conference at itsregular annual meeting in accordance withthe provisions set out in rule Chapter 4II.5.A below.E. Auditorsi.Two conference delegates shall be electedin accordance with rule Chapter 4 II.6below to act as auditors of the Partyaccounts to be submitted to the annualsession of Party conference in the yearfollowing that in which they were elected.2. Statutory officersA. In order to comply with statutoryrequirements:i.The Party shall notify the ElectoralCommission of:Chapter 1Constitutional rulesa. a person to be registered as the Party’sleaderb. a person to be registered as the Party’snominating officerc. a person to be registered as the Party’streasurer.ii. The Party may also notify the ElectoralCommission of:a. a person or persons to be registered asthe Party’s deputy treasurer(s)b. a person to be registered as the Party’scampaigns officer.iii. Each accounting unit shall notify the Partyof the following appointments, to benotified by the Party to the ElectoralCommission:a. a person to be registered as theaccounting unit’s treasurerb. a person to be registered as theaccounting unit’s deputy treasurerB. In the case of 2.A.i.b and 2.A.i.c, and 2.Aii.aand 2.A.ii.b above, the registration of a personor persons as statutory officers shall besubject to the approval of the NEC.Clause VIII.The National Executive Committee1. The NEC shall comprise:A. 28 members elected in such proportion andunder such conditions as may be set out inrules Chapter 3.III below and Chapter 4.IIIbelow.B. the leader and deputy leader of the PartyC. the leader of the EPLPD. the treasurer of the PartyE. three frontbench Members of Parliament, atleast one of whom must be a woman,nominated by the Cabinet (or Shadow Cabinetin opposition)F. one youth member aged under 27 at the dateof their election who must be a woman atleast every other term, elected under suchconditions as may be set out in rules Chapter4.III below.G. One BAME member elected under suchconditions as may be set out in rules Chapter4.III below.Page 5

H. One Scottish Labour Party member electedaccording to rules laid down by the ScottishConference.I.JOne Welsh Labour Party member electedaccording to the rules laid down by the WelshConference.One disabled member, elected under suchconditions as may be set out in rules Chapter4.III below. This member to be elected whenconditions laid out by the NEC have been met.2. The primary purpose of the NEC shall be toprovide a strategic direction for the Party as awhole and to maintain and develop an activeParty in the country, working in partnership withthe Party’s representatives in Parliament, theEuropean Parliament, devolved administrationsand local government to secure the Party’sobjectives. The key functions of the NEC are to:A. contribute to policy developmentB. win elections and maintain the support ofvotersC. maintain a healthy Party at all levels, engagedin the community upholding the higheststandards in public lifeD. ensure a high quality of service through acontract with Party membersE. fulfil its operational and constitutionalresponsibilities as defined in this clauseF. maintain a balanced partnership between allParty stakeholdersG. ensure the Party meets its legal and financialresponsibilities in compliance with thePolitical Parties, Elections and ReferendumsAct 2000 and all other legislativerequirements.3. In furtherance of its primary purpose and keyfunctions, the duties and powers of the NEC shallinclude:A. to uphold and enforce the constitution, rulesand standing orders of the Party and to takeany action it deems necessary for suchpurpose, including:i.disaffiliation, disbanding, suspending orotherwise disciplining any affiliatedorganisation or Party unit;ii. administratively suspending or takingother administrative action againstindividual members of the Party subject tothe provisions of the disciplinary rules setout in Chapter 6 below of these rules;iii. where a determination has been made asa result of a case brought underChapter 1Constitutional rulesdisciplinary proceedings concluded at NECstage under Chapter 6 Clause I.1.B belowof these rules, to impose such disciplinarymeasures as it thinks fit including:a. formal warning;b. reprimand;c. suspensions from membership of theParty, or from holding office in theParty (including being a candidate orprospective candidate at any, or anyspecified, level) or being a delegate toany Party body, for a specified periodor until the happening a specifiedevent;d. withholding or withdrawingendorsement as a candidate orprospective candidate at any, or anyspecified, level (such disciplinary powershall be without prejudice to and shallnot in any way affect the NEC’s otherpowers to withhold endorsementunder these rules);e. expulsion from membership of theParty, in which case the NEC may directthat following expiration of a specifiedperiod of not less than two nor morethan five years, the person concernedmay seek readmission to the Party onthat basis that Chapter 6.I.2 is not toapply to that readmission; orf. any other reasonable andproportionate measure.iv. A measure imposed under sub-clause iiiabove may require, or operate byreference to, the receipt of specifiedtraining by the individual concerned. Thedecisions of the NEC or the decision of theDisputes Panel as approved by the NEC(which shall have discretion not to approvethe Disputes Panel decision) indetermining such disciplinary mattersbrought before it and imposing suchdisciplinary measures as it sees fit, shall befinal, subject to any appeal to inaccordance with the provisions an
