Asof February 2, 2021, the Board has 123,780 licensees and registrants which is a 1%gain since the first quarter of FY 2020/2021. This figure includes all licenses that havebeen issued and that are current and/or eligible to renew.LICENSE POPULATION (As of ARD STATISTICSLicensing Program Applications ReceivedOverall, licensing application received volumes decreased by 16% in the second quarterof FY 2020/2021. The Board did recognize an uncharacteristic increase in theexamination applications for LMFT (54%), LCSW (37%) and LEP (217%). Thisincrease may be attributed to the desire of applicants to pay under the old fee structure.Applications received on or after January 1, 2021 are required to pay the new increasedfees.XIV b - 1

The purpose of the OA is toidentify the important tasks performed by currently practicing LCSWs. This will aid inXIV b - 3

the development of the Board’s LCSW Law & Ethics examination. OPES will be askingLCSWs to complete a questionnaire through SurveyMonkey. The deadline forcompleting the questionnaire will be March 28, 2021.Seven examination development workshops were conducted from October 1 throughDecember 31, 2020.ENFORCEMENT PROGRAMDuring the second quarter, the Enforcement staff received 518 consumer complaintsand 335 criminal convictions. A total of 556 cases were closed and 34 cases werereferred to the Attorney General’s office for formal discipline. As of December 31, 2020,there were 123 cases pending at the Attorney General’s Office. A total of 16Accusations and 6 Statement of Issues were filed this quarter. The number of finalcitations for the second quarter was 13.There was a total of 27 Final Disciplinary Orders. The average number of days tocomplete Formal Discipline in the second quarter was 389 days. This statistic ismeasured by the average number of days to complete the Enforcement process forcases investigated and transmitted to the AG’s Office for formal discipline within thereference period. The DCA Performance Measure to complete Formal Discipline is 540days.The average number of days the case is with the Attorney General’s Office in thesecond quarter was 297. This statistic is measured from the date the Board refers thematter to the Attorney General’s to the date the case is complete. The FAQs arecategorized into the following topics: associate, exams, criminal conviction and Breezehelpful hints. home order and directed all state offices to close to the public. To comply, the Board’sfront counter was closed from December 7, 2020 until February 1, 2021. In order tolessen the risk of transmission, Board staff continue to work remotely if their duties areconducive to telecommuting. The Board has also established a rotation schedule toallow staff to pick up on drop off work. This has allowed the Board to maintainoperations with approximately 70% of staff hours performed through telecommuting.WaiversThe Board has worked on six wavier requests with the Department; four of which weredirectly requested by the Board. All four requests submitted by the Board wereapproved. Staff continues to update wavier information on the website to ensureapplicants and licensees have a clear understanding of each wavier.Law & Ethics Exam Waiver for Subsequent Registration Number (Extended)This waives the requirement that Associate Marriage and Family Therapists (AMFTs),Associate Clinical Social Workers (ASWs), and Associate Professional ClinicalCounselors (APCCs) must pass the California Law and Ethics Examination before asubsequent registration number is issued. The waiver applies to all associates who arein their last year of renewal, if that renewal expires between March 31, 2020 andFebruary 28, 2021. The California Law and Ethics Exam will still need to be passed atthe by the next renewal date.Face-to-Face Training and Supervision Requirements (Extended)This waives the component of the law that only permits AMFTs, ASWs, and APCCs toobtain their required weekly direct supervisor contact via videoconferencing if they areworking in an exempt setting. (An exempt setting is defined as a government entity, aschool, college or university, or an institution that is both nonprofit and charitable.) Italso waives BPC sections 4980.36(d)(1)(B)(ii) and (d)(1)(B)(vi)(II) for MFT trainees, and4999.33(c)(3)(K) for PCC trainees, that specifically requires provision of “face-to-face”metal health services in order to complete required practicum hours. This waiver wasextended and is now effective from the beginning of the social distancing order inMarch 2020 until February 28, 2021.Waiver Extending Eligibility Period to Retake Examinations for Marriage andFamily Therapist, Educational Psychologist, Clinical Social Worker, andProfessional Clinical Counselor Applicants (Extended)This waiver extends examination eligibility for LMFT, LEP, LCSW, and LPCC applicantsthat failed to take or retake a required examination, and whose one-year eligibility totake or re-take the examination expired between March 31, 2020 and April 2, 2021.Instead of having one year to take or retake the examination, these individuals willinstead have 20 months to take or retake the examination. For individuals who have nottaken the required exam yet, the 20-month timeframe starts on the date the applicantwas notified of initial eligibility to take the examination. For individuals who need toretake a required exam, the 20-month timeframe starts on the date the applicant mostrecently participated in the exam.XIV b - 7

Practicum Enrollment Requirement Waiver for MFT TraineesUnder current law, marriage and family therapist trainees (MFT trainees) are permittedto gain experience hours outside of practicum, but they must be enrolled in a practicumcourse to counsel clients. However, the law permits MFT trainees to counsel clientswhile not enrolled in practicum if the period of lapsed enrollment is less than 90calendar days, and if that period is immediately preceded by enrollment in a practicumcourse and immediately followed by enrollment in a practicum course or completion ofthe degree program. The Director has issued a law waiver that extends the lapsedenrollment period from 90 days to 180 days. The waiver applies to trainees whowere last enrolled in a practicum course between March 31, 2020 and December 31,2020. These trainees are permitted to counsel clients while not enrolled in practicum ifthe period of lapsed enrollment is less than 180 calendar days, and if that period isimmediately preceded by enrollment in a practicum course and immediately followed byenrollment in a practicum course or completion of the degree program.Licensing Renewal Requirements (Extended)This waiver allows that that registrants (associate marriage and family therapists,associate clinical social workers, and associate professional clinical counselors) whoseregistrations expire between March 31, 2020 and February 28, 2021 do not need toattempt the California Law and Ethics Examination in order to renew their registration. Italso allows that Board licensees who are set to renew between March 31, 2020 andFebruary 28, 2021 do not need to complete continuing education in order to renew theirlicense.Waiver of Laws Requiring Individuals Reactivating or Restoring a Retired,Inactive, or Cancelled License to Complete Continuing Education and Pay aRenewal or Delinquency Fee (Extended)This waiver permits an individual with a retired, inactive, or cancelled license whowishes to restore their license in order to help with the current State of Emergency to doso during this time without being subject to the normally required continuing educationrequirements and renewal and delinquency fees. This only applies to individuals whoselicense has been retired, inactive, or cancelled for no more than 5 years. A licensereactivated or restored pursuant to these waivers is valid until July 1, 2021, or when theState of Emergency ceases to exist, whichever is sooner.XIV b - 8
