SANTA BARBARA COUNTY2020 Felony Bail ScheduleThe Santa Barbara Superior Court has adopted the attached uniform countywide schedule of bail pursuant toPenal Code Section 1269b. It sets the presumptive bail amount, which is applicable to warrantless arrestees untilthe matter is reviewed by a judge.Bail For Unlisted Felony Offenses: 20,000Bail Limit for Multiple Offenses - A bail limit for a case with multiple charges will be established as follows:1. Felony only: The highest bail amount for any one felony offense, plus enhancements and priors, willapply.2. Felony with misdemeanor or infraction violations: The highest bail amount for any one felony offense,plus enhancements and priors, will apply. Misdemeanor and infraction bails will not be considered.Bail Increase or PC 1275.1 Hold Procedure The peace officer shall follow the instructions provided to SBSO Correctional Facility personnel:1) Prepare “Declaration In Support Of Motion To Increase Bail Above Schedule” or “Examination of Sourceof Bail,” setting forth the facts and circumstances in support of his/her belief that bail per schedule isinsufficient or the source of the bail needs to be examined;2) Submit the form for consideration to the on call judge by contacting the Court’s on-call answering serviceprovided in the instructions. The judge will review the request and if granted will sign the order and send itback to the requesting peace officer. The peace officer will provide the signed order to SBSO CustodyRecords to effect increase in bail. The SBSO Custody deputy will then forward a copy to the Pretrial ServicesUnit.Note: Eight hours is permitted for review by a judge after the application for bail increase is made, after whichtime the defendant is entitled to be released on posting the amount set forth in the bail schedule.REMINDER:Penal Code Section 1270.1 prohibits the release of an arrestee on bail in an amount OTHER THAN THAT SETFORTH IN THE BAIL SCHEDULE prior to a hearing in open court for:(1)(2)(3)(4)Violent felonies as described in Penal Code Section 667.5(c), but not 460(a);Serious felonies as described in Penal Code Section 1192.7(c) (including those listed in Penal CodeSection 1192.8);Violations of Penal Code Sections 136.1(c), 243(e)(1), 262, 273.5, 422 (felony), and 646.9; andViolation of Penal Code Section 273.6 if the detained person made threats to kill or harm, has engagedin violence against, or has gone to the residence or workplace of, the protected party.A list of these felonies is attached.A defendant arrested without a warrant and charged with more than one offense shall be entitled to release uponposting bail in a sum equal to the highest bail for any single offense.2

VIOLATIONS OF PROBATION1. Arrest without a warrant shall have NO BAIL if offense is for violating the terms of felony probation,mandatory supervision, post release community supervision and/or parole.2. Bail will be set at 15,000.00 if offense is for violating the terms of misdemeanor probation.3
