21 of 1860(h)‘Registrar’, in relation to any Institute, means the Registrarthereof ;(i)“Senate’, in relation to any Institute, means the Senate thereof;(j)‘Society’ means any of the following societies registeredunder the Societies Registration Act, 1860, namely:(i)the Indian Institute of Technology, Bombay ;(ia) the College of Engineering and Technology, Delhi;(ib) the Indian Institute of Technology, Guwahati, Assam ;As per Institutes ofTechnology(Amendment) Act,1994(ii) the Indian Institute of Technology, (Kanpur) Society ;(iii) the Indian Institute of Technology, Madras ;(iv) the Indian Institute of Technology, Bhubaneswar ;(v) the Indian Institute of Technology, Gandhinagar;As per Institutes ofTechnology(Amendment) Act,2012(vi) the Indian Institute of Technology, Hyderabad ;(vii) the Indian Institute of Technology, Indore ;(viii) the Indian Institute of Technology, Rajasthan ;(ix) the Indian Institute of Technology, Mandi ;(x) the Indian Institute of Technology, Patna ;(xi) the Indian Institute of Technology, Punjab ;(k)‘Statutes’ and ‘Ordinances’, in relation to any Institute, meanthe Statutes and Ordinances of the Institute made under thisAct.(l)“University of Roorkee’ means the University of Roorkee As per Institutes ofTechnologyestablished under the Roorkee University Act, 1947(Amendment) Act,(m)“zone”, in relation to an Institute, means such group of States 2002and Union Territories as the Central Government may, bynotification in the Official Gazette, specify.Chapter IITHE INSTITUTESIncorporation ofInstitutes4.(1)Each of the Institutes mentioned in section 2 shall be a bodycorporate having perpetual succession and a common sealand shall, by its name, sue and be sued.(1A)The College of Engineering and Technology, Delhi, shall onsuch incorporation, be called the Indian Institute ofTechnology, Delhi.(1B) The Indian Institute of Technology, Guwahati, Assam shall, As per Institutes ofon such incorporation, be called the Indian Institute of Technology(Amendment) Act, 1994Technology, Guwahati.(1C) The University of Roorkee, Roorkee shall, on suchincorporation, be called the Institute of Technology, Roorkee.The Institutes of TechnologyActAs per Institutes ofTechnology(Amendment) Act, 20023

(1D) The Institute of Technology, Banaras Hindu University shall, As per Institutes ofon such incorporation, be called the Indian Institute of Technology(Amendment) Act, 2012Technology (Banaras Hindu University), Varanasi.(2)Effect ofIncorporation ofInstitutes5.The body corporate constituting each of the said Institutesshall consist of a Chairman, a Director and other members ofthe Board for the time being of the Institute.On and from the commencement of this Act ;(a)any reference to a society in any law (other than this Act) orin any contract or other instrument shall be deemed as areference to the corresponding Institute ;(b)all properly, movable and immovable, of or belonging to asociety shall vest in the corresponding Institute ;(c)all the rights and liabilities of a society shall be transferred to,and be the rights and liabilities of the corresponding Institute;and(d)every person employed by a society immediately before suchcommencement shall hold his office or service in thecorresponding Institute by the same tenure, at the sameremuneration and upon the same terms and conditions andwith the same rights and privileges as to pension, leave,gratuity, provident fund, and other matters as he would haveheld the same if this Act had not been passed, and shallcontinue to do so unless and until his employment isterminated or until such tenure, remuneration and terms andconditions are duly altered by the Statutes:Provided that if the alteration so made is not acceptable tosuch employee, his employment may be terminated by theInstitute in accordance with the terms of the contract with theemployee or, if no provision is made therein in this behalf, onpayment to him by the Institute of compensation equivalent tothree months’ remuneration in the case of permanentemployees and one month’s remuneration in the case ofother employees.Explanation 1 – The reference in this section to the As per Institutes ofcommencement of this Act shall be construed in relation to the Technology(Amendment) Act, 1994Indian Institute of Technology, Guwahati as the reference to thedate on which the provisions of the Institutes of Technology(Amendment) Act, 1994 come in to force.Explanation 2 – The reference in this section to the As per Institutes ofcommencement of this Act shall be construed in relation to the Technology(Amendment) Act, 2012Indian Institute of Technology, Bhubaneswar, the Indian Instituteof Technology, Gandhinagar, the Indian Institute of Technology,Hyderabad, the Indian Institute of Technology, Indore, the IndianInstitute of Technology, Jodhpur, the Indian Institute ofTechnology, Mandi, the Indian Institute of Technology, Patna andthe Indian Institute of Technology, Ropar as the reference to thedate on which the provisions of the Institutes of Technology(Amendment) Act, 2012 come in to force.5AOn and from the commencement of the Institutes of Technology(Amendment) Act, 2002, -As per Institutes ofTechnology(Amendment) Act, 2002(a) any reference to the University of Roorkee in any law (otherthan this Act) or in any contract or other instrument shall bedeemed as a reference to the Indian Institute of Technology,Roorkee;The Institutes of TechnologyAct4

(b)all property, movable and immovable, of or belonging to the As per Institutes ofUniversity of Roorkee, shall vest in the Indian Institute of Technology(Amendment) Act, 2002Technology, Roorkee;(c)all rights and liabilities of the University of Roorkee shall betransferred to, and be the rights and liabilities of, the IndianInstitute of Technology, Roorkee;(d) every person employed by the University of Roorkeeimmediately before such commencement shall hold his officeor service in the Indian Institute of Technology, Roorkee by thesame tenure, at the same remuneration and upon the sameterms and conditions and with the same rights and privilegesas to pension, leave, gratuity, provident fund and other mattersas he would have held the same if this Act had not beenpassed, and shall continue to do so unless and until hisemployment is terminated or until such tenure, remunerationand terms and conditions are duly altered by the Statutes:Provided that if the alteration so made is not acceptable tosuch employee, his employment may be terminated by theIndian Institute of Technology, Roorkee in accordance with theterms of the contract with the employee or, if no provision ismade therein in this behalf, on payment to him by the Indianinstitute of Technology, Roorkee of compensation equivalent tothree months’ remuneration in the case of permanentemployees and one months’ remuneration in the case of otheremployees;Provided further that any reference, by whatever form ofwords, to the Vice-Chancellor and Pro-Vice-Chancellor of theUniversity of Roorkee in any law for the time being in force, orin any instrument or other document, shall be construed as areference to the Director and the Deputy Director, respectively,of the Indian Institute of Technology, Roorkee; and(e) On the commencement of the Institutes of Technology(Amendment) Act, 2002, the Vice-Chancellor of the Universityof Roorkee appointed under the provisions of the RoorkeeUniversity Act, 1947 shall be deemed to have been appointedas Director under the Act, and shall hold office for a period ofthree months or till such time the Director is appointed,whichever is earlier.Explanation – The reference in this section to the commencementof this Act shall be construed in relation to the Indian Institute ofTechnology, Roorkee as the reference to the date on which theprovisions of the Institute of Technology (Amendment) Act, 2002come into force.5B. On and from the commencement of the Institutes of Technology(Amendment) Act, 2012, -As per Institutes ofTechnology(Amendment) Act, 2012(a) any reference to the Institute of Technology, Banaras HinduUniversity in any law for the time being in force (other than thisAct) or in any contract or other instrument shall be deemed asa reference to the Indian Institute of Technology (BanarasHindu University), Varanasi;(b) all property, movable and immovable, of or belonging to theInstitute of Technology, Banaras Hindu University, shall vest inthe Indian Institute of Technology (Banaras University),Varanasi;The Institutes of TechnologyAct5

(c) all rights and liabilities of the Institute of Technology, Banars As per Institutes ofHindu University shall be transferred to, and be the rights and Technology(Amendment) Act, 2012liabilities of, the Indian Institute of Technology (Banaras HinduUniversity), Varanasi;(d) every person employed in the Institute of Technology, BanarasHindu University immediately before such commencementshall hold his office or service in the Indian Institute ofTechnology (Banaras Hindu University), Varanasi by the sametenure, at the same remuneration and upon the same termsand conditions and with the same rights and priviledges as topension, leave, gratuity, provident fund and as other matters ashe would have held the same if this Act had not been passedand shall continue to do so unless and until his employment isterminated or until such tenure, remuneration and terms andconditions are duly altered by the Statutes;Provided that if the alteration so made is not acceptable tosuch employee, his employment may be terminated by theIndian Institute of Technology (Banaras Hindu University),Varanasi in accordance with the terms of the contract with theemployee or, if no provision is made therein in this behalf, onpayment to him by the Indian Institute of Technology (BanarasHindu University), Varanasi of compensation equivalent tothree months’ remuneration in the case of permanentemployees and one month’s remuneration in the case of otheremployees;Provided further that any reference, by whatever form ofwords, to the Director of the Institute of Technology, BanarasHindu University in any law for the time being in force, or in anyinstrument or other document, shall be construed as areference to the Director of the Indian Institute of Technology(Banaras Hindu University), Varanasi; and(e) on the commencement of the Institutes of Technology(Amendment) Act, 2012, (i) the Vice-Chancellor of the Banaras Hindu University,appointed under the provisions of the Banaras HinduUniversity Act, 1915 shall be deemed to have beenappointed as ex officio Chairman of the Board of Governorsof the Indian Institute Technology (Banaras HinduUniversity), Varanasi under this Act, and shall hold office fora period of three years with effect from suchcommencement;(ii) the Director of the Institute of Technology, Banaras HinduUniversity, appointed under the provisions of the BanarasHindu University Act, 1915 shall be deemed to have beenappointed as Director of the Indian Institute of Technology(Banaras Hindu University), Varanasi under this Act, andshall hold his office till Director is appointed under this Act.Explanation – The reference in this section to thecommencement of this Act shall be construed in relation to theIndian Institute of Technology (Banaras Hindu University),Varanasi as the reference to the date on which the provisionsof the Institutes of Technology (Amendment) Act, 2012 comeinto force.The Institutes of TechnologyAct6

Powers ofInstitutes6. (1) Subject to the provisions of this Act, every Institute shallexercise the following powers and perform the following duties,namely :(a) to provide for instruction and research in such branches ofengineering and technology, sciences and arts, as theInstitute may think fit, and for the advancement of learningand dissemination of knowledge in such branches ;(b) to hold examinations and grant degrees diplomas and otheracademic distinctions or titles ;(c) to confer honorary degrees or other distinctions ;(d) to fix, demand and receive fees and other charges ;(e) to establish, maintain and manage halls and hostels for theresidence of students;(f)to supervise and control the residence and regulate thediscipline of students of the Institute and to makearrangements for promoting their health, general welfareand cultural and corporate life ;(g) to provide for the maintenance of units of the NationalCadet Corps for the students of the Institute;(h) to institute academic and other posts and to makeappointments thereto (except in the case of the Director);(i)to frame Statutes and Ordinances and to alter, modify orrescind the same;(j) to deal with any property belonging to or vested in theInstitute in such manner as the Institute may deem fit foradvancing the objects of the Institute;(k) to receive gifts, donations or benefactions from theGovernment and to receive bequests, donations andtransfers of moveable or immovable properties fromtestators, donors or transferors, as the case may be;(l)to co-operate with educational or other institutions in anypart of the world having objects wholly or partly similar tothose of the Institute by exchange of teachers and scholarsand generally in such manner as may be conducive to theircommon objects;(m) to institute and award fellowships, scholarships, exhibitions,prizes and medals;(n) to do all such things as may be necessary, incidental orconducive to the attainment of all or any of the objects ofthe Institute.1(A)subject to the provisions of this Act, every Institute may strive As per Institutes ofto meet the technological needs of the States and the Union Technology(Amendment) Act, 2012Territories included in its zone by(a) supporting and collaborating with technical educationinstitutions located in the zone with a view to enhance theirquality and capability;(b) Advising the State Governments and the Union territoriesincluded in its zone in the matter of technical education andany technological issue referred by them to the Institute foradvice.The Institutes of TechnologyAct7

(2) Notwithstanding anything contained in sub-section (I), anInstitute shall not dispose of in any manner any immovableproperty without the prior approval of the Visitor.Institute tobe open toall races,creeds &classes7. (1) Every Institute shall be open to persons of either sex and ofwhatever race creed, caste or class, and no test or conditionshall be imposed as to religious belief or profession inadmitting or appointing members, students, teachers orworkers or in any other connection whatsoever.(2) No bequest, donation or transfer of any property shall beaccepted by any Institute which in the opinion of the Councilinvolves conditions or obligations opposed to the spirit andobject of this section.Teaching at 8.InstituteVisitorAll teaching at each of the Institutes shall be conducted by or inthe name of the Institute in accordance with the Statutes andOrdinances made in this behalf.9. (1) The President of India shall be the Visitor of every Institute.(2) The Visitor may appoint one or more persons to review thework and progress of any Institute and to hold inquiries into theaffairs thereof and to report thereon in such manner as theVisitor may direct.(3) Upon receipt of any such report, the Visitor may take suchaction and issue such directions as he considers necessary inrespect of any of the matters dealt with in the report and theInstitute shall be bound to comply with such directions.Authorities 10. The following shall be the authorities of an Institute namely :of Institutes(a) a Board of Governors ;(b) a Senate ; and(c)Board ofGovernorsSuch other authorities as may be declared by the Statutes tobe the authorities of the Institute.11. The Board of an Institute shall consist of the following persons,namely:(a) the Chairman, to be nominated by the Visitor;(b) the Director, ex-officio;(c) one person to be nominated by the Government of each of theStates comprising the zone in which the Institute is situated,from among persons who, in the opinion of that Government,are technologists or industrialists of repute ;(d) four persons having special knowledge or practical experiencein respect of education, engineering or science, to benominated by the Council ; and(e) two professors of the Institute, to be nominated by the Senate.Provided that in the case of Indian Institute of Technology(Banaras Hindu University), Varanasi, -As per Institutes ofTechnology(Amendment) Act, 2012(a) The Board of such Institute shall consist of Vice-Chairman tobe nominated, after a period of three years from thecommencement of the Institutes of Technology (Amendment)Act, 2012, by the Executive Council referred to in clause (d) ofsection 2 of the Banaras Hindu University Act, 1915, fromamongst its members including its Vice-Chancellor;The Institutes of TechnologyAct8

(b) four persons to be nominated under clause (d), out of which As per Institutes oftwo persons to be nominated by the Executive Council referred Technology(Amendment) Act, 2012to in clause (d) of section 2 of the Banaras Hindu UniversityAct, 1915, from amongst its members including its ViceChancellor;Explanation – omittedOmitted as perInstitutes of Technology(Amendment) Act, 2012Term of12. Save as otherwise provided in this section,office of,(1) The term of office of the Chairman or any other member of thevacanciesBoard shall be three years from the date of his nomination.among, &(2) The term of office of an ex-officio member shall continue soallowanceslong as he holds the office by virtue of which he is a member.payable tomembers of(3) The term of office of a member nominated under clause (e)* ofBoardstsection 11 shall be two years from the 1 day of January of theyear in which he is nominated.(4) The term of office of a member nominated to fill a casualvacancy shall continue for the remainder of the term of themember in whose place he has been nominated.(5) Notwithstanding anything contained in this section, an outgoing member shall, unless the Council otherwise directs,continue in office until another person is nominated as amember in his place.(6) The members of the Board shall be entitled to suchallowances, if any, from the Institute as may be provided for inthe Statutes but no member other than the persons referred toin clauses (b) and (e) of section 11 shall be entitled to anysalary by reason of this sub-section.Functionsof Board13. (1) Subject to the provisions of this Act, the Board of any Instituteshall be responsible for the general superintendence, directionand control of the affairs of the Institute and shall exercise allthe powers of the Institute not otherwise provided for by thisAct, the Statutes and the Ordinances, and shall have thepower to review the acts of the Senate.(2) Without prejudice to the provisions of sub-section (1), theBoard of any Institute shall –(a) take decisions on questions of policy relating to theadministration and working of the Institute ;(b) institute courses of study at the Institute;(c) make Statutes ;(d) institute and appoint persons to academic as well as otherposts in the Institute ;(e) consider and modify or cancel Ordinances ;(f)The Institutes of TechnologyActconsider and pass resolutions on the annual report, theannual accounts and the budget estimates of the Institutefor the next financial year as it thinks fit and submit them tothe Council together with a statement of its developmentsplans ;9

(g) exercise such other powers and perform such other dutiesas may be conferred or imposed upon it by this Act or theStatutes,(3) The Board shall have the power to appoint such committees asit considers necessary for the exercise of its powers and theperformance of its duties under this Act.Senate14. The Senate of each Institute shall consist of the following persons;namely :(a) the Director, ex-officio, who shall be the Chairman of theSenate;(b) the Deputy Director, ex-officio ;(c) the professors appointed or recognized as such by the Institutefor the purpose of imparting instruction in the Institute ;(d) three persons, not being employees of the Institute, to benominated by the Chairman in consultation with the Director,from among educationists of repute, one each from the fieldsof science, engineering and humanities; and(e) such other members of the staff as may be laid down in theStatutes.Provided in case of the Indian Institute of Technology (Banaras As per Institutes ofHindu University), Varanasi, three members shall be nominated Technology(Amendment) Act, 2012by the Executive Council referred to in clause (d) of the section 2of the Banaras Hindu University Act, 1915.Functionsof Senate15. Subject to the provisions of this Act, the Statutes and theOrdinances, the Senate of an Institute shall have the control andgeneral regulation, and be responsible for the maintenance, ofstandards of instruction, education and examination in the Instituteand shall exercise such other powers and perform such otherduties as may be conferred or imposed upon it by the Statutes.Chairman of 16. (1) The Chairman shall ordinarily preside at the meetings of theBoard and at the Convocations of the Institute.Board(2) It shall be the duty of the Chairman to ensure that thedecisions taken by the Board are implemented.(3) The Chairman shall exercise such other powers and performsuch other duties as may be assigned to him by this Act or theStatutes.Director17. (1) The Director of each Institute shall be appointed by the Councilwith the prior approval of the Visitor.(2) The Director shall be principal academic and executive officerof the Institute and shall be responsible for the properadministration of the Institute and for the imparting ofinstruction and maintenance of discipline therein.(3) The Director shall submit annual reports and accounts to theBoard.(4) The Director shall exercise such other powers and performsuch other duties as may be assigned to him by this Act or theStatutes or Ordinances.The Institutes of TechnologyAct10

DeputyDirectorRegistrar18. The Deputy Director of each Institute shall be appointed on suchterms and conditions as may be laid down by the Statutes andshall exercise such powers and perform such duties as may beassigned to him by this Act or the Statutes or by the Director.19. (1) The Registrar of each Institute shall be appointed on suchterms and conditions as may be laid down by the Statutes andshall be the custodian of records, the common seal, the fundsof the Institute and such other property of the Institute as theBoard shall commit to his charge.(2) The Registrar shall act as the Secretary of the Board, theSenate, and such committees as may be prescribed by theStatutes.(3) The Registrar shall be responsible to the Director for theproper discharge of his functions.(4) The Registrar shall exercise such other powers and performsuch other duties as may be assigned to him by this Act or theStatutes or by the Director.Otherauthorities& officers20.
