Theyhave not been evaluated by the Agencyand do not reflect the views of theAgency. MASA described the subjectnoncompliance and stated their beliefthat the noncompliance isinconsequential as it relates to motorvehicle safety.In support of its petition, MASAsubmitted the following reasoning:1. Operational Safety:a. MASA stated their belief that a TINmarking noncompliance does not createany operational safety risk for thevehicle. The tires comply withapplicable FMVSS performancerequirements and all other applicableregulations. A summary of productiontire compliance audit testing will beprovided to NHTSA separately from thisfiling.b. The incorrect TIN marking withadditional characters in the optionalcode has no bearing on tireperformance.c. The subject tires are properlymarked with all other markings requiredunder FVMSS No. 139, such asparagraph S5.5(c), maximumpermissible inflation pressure, andparagraph S5.5(d), maximum loadrating. The necessary information isavailable on the sidewall of the tire toensure proper application and usage.d. The subject tires contain the DOTsymbol on both sidewalls, thus,indicating conformance to applicableFMVSS.2. Identification and Traceability:a. All information required by 49 CFR574.5 for the TIN (plant code sizecode option code date code) ispresent on the sidewall of the tire.b. For identification and traceabilitypurposes, the key information of theplant code and manufacturing date ispresent on the tire.c. The existence of extra characters inthe optional code does not inhibit theability of a tire distributor, the tiredealer, or the consumer to register thetires.d. ln the event that dealer/ownernotifications are required, the TIN, asmolded on the subject tires, is sufficientto ensure proper communication andidentification of the tires.e. To date, there is no record of adistributor, dealer, consumer, or otherconcerned party raising a question abouttires with the extraneous characters7. Summary: Based on theinformation presented, the tires moldedwith extraneous TIN optional codecharacters do not present a risk formotor vehicle safety. Additionally,identification and traceability of thesubject tires could be accomplished inthe event of a need to conduct a dealer/owner notification. Production recordslink plant code, size code, and optionalcode with the manufacturing dates forall concerned brands and tire sizes.MASA concluded by expressing thebelief that the subject noncompliance isinconsequential as it relates to motorvehicle safety, and that its petition to beexempted from providing notification ofthe noncompliance, as required by 49U.S.C. 30118, and a remedy for thenoncompliance, as required by 49U.S.C. 30120, should be granted.NHTSA notes that the statutoryprovisions (49 U.S.C. 30118(d) and30120(h)) that permit manufacturers tofile petitions for a determination ofinconsequentiality allow NHTSA toexempt manufacturers only from theduties found in sections 30118 and30120, respectively, to notify owners,purchasers, and dealers of a defect ornoncompliance and to remedy thedefect or noncompliance. Therefore, anydecision on this petition only applies tothe subject tires that MASA no longercontrolled at the time it determined thatthe noncompliance existed. Payment for aconsultant’s services may not exceed the current maximum of thedaily equivalent rate paid to an Executive Schedule Level IV Federal employee. The Applicant must comply, as applicable, with section 2 CFR 200.216 of the Uniform Requirements, with respect topayment of Professional Service Costs.Grant funds used to pay costs of transportation, lodging, subsistence,and related items incurred by the Applicant’s personnel who are ontravel status on business related to the CDFI Rapid Response Program grant, in accordance with section 200.475 of the Uniform Requirements. Travel Costs do not include costs incurred by the Applicant’s consultants who are on travel status. Any payments fortravel expenses incurred by the Applicant’s personnel but unrelatedto carrying out the purpose of the CDFI Rapid Response Programgrant would be deemed unallowable. As such, documentation mustbe maintained that justifies the travel as necessary to the CDFIRapid Response Program grant.Grant funds used to pay the cost of training and education providedby the Applicant for employees’ development in accordance withsection 200.473 of the Uniform Requirements. Grant funds canonly be used to pay for training costs incurred by the Applicant’semployees. Training and Education Costs may not be incurred bythe Applicant’s consultants.Grant funds used to pay for tangible personal property, having a useful life of more than one year and a per-unit acquisition cost of atleast 5,000, in accordance with section 200.1 of the Uniform Requirements.
