OverviewThis Technical Specification is a guide for vendors and law enforcement agencies who electronicallysubmit Uniform Crime Reporting data via NIBRS guidelines.Since the Department has developed their system to closely match the national program, we haveinstead focused on a document that is truly "Texas Centric". This Technical Specification is intended tobe an addendum to the FBI User Manual Technical Specifications, specifically designed for Texas dataand Texas law enforcement.For Data Quality purposes, DPS has added Texas Specific validations that supersede the NIBRSguidelines. These validations will be proceeded by T-XXX. Drug SeizuresTexas Health and Safety CodeSec. 481.185. ARREST REPORTS(a) Each law enforcement agency in this state shall file monthly with the director a report of allarrests made for drug offenses and quantities of controlled substances seized during the precedingmonth. The agency shall make the report on a form provided by the director and shall provide theinformation required by the form.(b) The director shall publish an annual summary of all drug arrests and controlled substances seizedin the state.Submission RequirementsThe national NIBRS program collects information on up to three different types of drug seized within asingle incident.Segment Level 8 must be submitted for drug seizure if it meets one of the following criteria:1. When more than three types of drugs are involved, the type of measurement for the twomost important drugs (as determined by the reporting agency based on the quantity, value,and deadliness of the drugs/narcotics) should be reported in Segment Level 3 MeasurementType 1 and Measurement Type 2; Measurement Type 3 enter X Over Three Drug Types. Upto an additional seventeen drug types can be captured in Segment Level 8.2. If three or fewer types of drugs are seized and one of the drugs is marijuana in a garden,fields, greenhouse, and/or clandestine labs or precursor chemicals were seized as part of anincident then enter the estimated quantity and type of drug measurement in Segment Level3. In addition, submit Segment Level 8 with data for Marijuana fields, garden, orgreenhouse; clandestine labs; and/or precursor chemicals.Segment Level 8 – Data Elements and Values (Drug Seizures)Suspected Drug Type – 1 character; 047: This data element is to be used to identify the types ofdrugs or narcotics seized in an incident. This field is used when the types of drugs seized exceeds three(submitted in Segment Level 3).Example: If one of the offenses in the incident was 35A Drug/Narcotic Violation, 6 Seized wasentered into Data Element 14 (Type Property Loss/Etc.), and 10 Drugs/Narcotics was entered into DataElement 15 (Property Description) and more than three drugs were involved, enter the two mostimportant (as determined by quantity, value, and deadliness of the drugs/narcotics) in Segment Level 3,and enter X More than Three Drug Types in the third occurrence in Data Element 20. Sexual AssaultTexas Government CodeSec. 411.042. BUREAU OF IDENTIFICATION AND RECORDS(h) Information collected to perform a statistical breakdown of offenses under Sections 22.011 and22.021, Penal Code, as required by Subsection (b)(2) must include information indicating the specificoffense committed and information regarding:(1) the victim;(2) the offender and the offender’s relationship to the victim;(3) any weapons used or exhibited in the commission of the offense; and(4) any injuries sustained by the victim.(i) A law enforcement agency shall report offenses under Section 22.011 or 22.021, Penal Code, tothe department in the form and manner and at regular intervals as prescribed by rules adopted by thedepartment. The report must include the information described by Subsection (h).Submission RequirementsSegment Level 9 must be submitted when the incident involves sex offenses.The types of Sexual Assault offenses to be reported are limited.
