RULES OF PRACTICE AND PROCEDURE OF THEUNITED STATES DISTRICT COURTFOR THEDISTRICT OF ARIZONAEFFECTIVE DECEMBER 1, 2020Foreword/Explanatory NoteThese Rules of Practice and Procedure of the United States District Court for theDistrict of Arizona (Local Rules) are promulgated under the authority of Rule 83 of theFederal Rules of Civil Procedure (F.R.Civ.P.), Rule 57 of the Federal Rules of CriminalProcedure (F.R.Crim.P.), and Rule 47 of the Federal Rules of Appellate Procedure(FRAP).The Local Rules of Civil Procedure may be cited as "LRCiv".The Local Rules of Criminal Procedure may be cited as "LRCrim".The Local Rules of Bankruptcy Appeal Procedure may be cited as “LRBankr”.

SUMMARY OF 2019-2020 LOCAL RULE AMENDMENTSDISTRICT OF ARIZONALocal RuleAmendmentLRCiv 3.5LRCiv 3.6Note/Explanation Regarding AmendmentWRITS OF HABEAS CORPUS AND MOTIONS PURSUANT TO 28U.S.C. § 2255. Amended to add new subparagraph (b) to impose 200page limit on habeas corpus petitions and responses, and 100-page replies,in capital cases. The Court may grant leave to exceed page limits.Subparagraph (b) will become subparagraph (c). Technical amendmentsto address electronic filing and paper filing.REMOVAL TO FEDERAL COURT. Amended to require theremoving party to identify the following 10 separate documents in theNotice of Removal: (1) Supplemental Civil Cover Sheet; (2) most recentstate court docket; (3) operative complaint; (4) service documents; (5)answers; (6) state court orders terminating or dismissing parties; (7)notices of appearance; (8) pending motions, responses, and replies; (9)remainder of state court record; and (10) verification that complete copiesof State Court documents have been filed. Further, inserts a newsubparagraph (c) regarding timing of filing State Court record, at the timethat Notice of Removal is filed. Renumbers subparagraphs (c) and (d), assubparagraphs (d) and (e).LRCiv 79.1CUSTODY AND DISPOSITION OF NON-ELECTRONICALLYSUBMITTED EXHIBITS, ADMINISTRATIVE RECORDS, ANDSEALED DOCUMENTS. Amendments to LRCiv 79.1 as well asLRCiv 77.2 to allow the Clerk’s Office, which lacks sufficient storage, toreturn non-electronic trial exhibits as well as other exhibits submittedduring the course of a case, to the submitting counsel/party. Technicalamendments to subparagraphs (b) and (c) which will require the party totransmit non-electronic exhibits to the Court of Appeals if so directed; andpermitting the Clerk, upon 30 days’ notice, to destroy non-electronicexhibits after the expiration of time for appeal or mandate on appealissues.LRCiv 77.2ORDERS AND JUDGMENTS GRANTABLE OF COURSE BY THECLERK.
