Not all the facts presented to the Executive Committee and Representative Council as part ofrequests to waive eligibility regulations are included in the reports of those meetings, eitherbecause of the volume of material reviewed or the confidentiality requested by schools fortheir students, parents or faculty.EXECUTIVE COMMITTEE MEETINGEast Lansing, Nov. 10, 2004Members Present:Paul Ellinger, CheboyganKeith Eldred, WilliamstonWilliam Newkirk, MeridianPete Ryan, SaginawKathy McGee, FlintStaff Members Present:Tom RashidJack Roberts (Recorder)Executive Committee Authority andResponsibility - The Executive Committeereviewed its authority under Article VII of theMHSAA Constitution and specifically itsresponsibility to consider each application forwaiver of an eligibility requirement on itsindividual merits, determining if the regulation serves the purpose for which it wasintended in each case or if the regulationworks an undue hardship on any student whois the subject of a request for waiver. (Theseunderlying criteria may not be restated forevery subject of these minutes.)The Executive Committee was remindedthat it was the responsibility of each memberschool involved to provide sufficient factualinformation about the specific request for theExecutive Committee to reach a decisionwithout further investigation. If informationis incomplete, contradictory or otherwiseunclear or has been received too late to bestudied completely, the Executive Committeemay deny the request for waiver or delayaction. Such requests may be resubmitted tothe Executive Committee with additionalinformation at a subsequent meeting orappealed to the full Representative Council.It is possible that some of the informationpresented as facts to the ExecutiveCommittee by school personnel and othersmay be inaccurate. However, to avoid constant repetition in these minutes of phrasessuch as "it was alleged" or "it was reported,"no attempt is made in the introduction of eachwaiver request to distinguish between truth,allegation, hearsay, opinion, summary or conclusion.A determination of undue hardship is amatter addressed to the discretion of theExecutive Committee within the educationalphilosophy and secondary role of voluntaryextracurricular competitive athletics in theacademic environment. The ExecutiveCommittee will avoid making exceptions thatwould create precedent that effectivelychanges a rule without RepresentativeCouncil action or local board of educationadoption, which would exceed ExecutiveCommittee authority.Students for whom waiver of a particularregulation is granted must be eligible in allrespects under all other sections and interpretations of the regulations prior to their participation.Adoption of these regulations is a choiceschools make locally when they considertheir option of MHSAA membership.Consistent with rulings of the AttorneyGeneral and Michigan Supreme Court,schools are not bound by the decisions of theExecutive Committee, but the associationmay limit participation in the post-seasontournaments it sponsors to those schoolswhich choose to apply rules and penalties aspromulgated by the MHSAA and adopted byeach member school's board of education.The MHSAA exercises no independentauthority over schools or students.Birmingham-Seaholm and BeverlyHills-Groves High Schools (Regulation 1,Section 1[F]) - The Executive Committeeapproved a cooperative program betweenthese schools of the same district in boys andgirls lacrosse. Teams resembling cooperativeDecember 2004/January 2005252

programs existed for students of these schoolsin the spring of 2003-04. Seaholm will be theprimary school. The combined enrollmentwill be 2,469. Support from the OaklandActivities Association was received.Chassell High School (Regulation I,Section 1[D]) - A request to waive the enrollment regulation was made to allow 8th-gradeboys to participate on the junior varsity basketball team. The school's February 2004Enrollment Declaration Form indicated 104students. The school's enrollment is currently98 students in grades 9-12, only 5 of whomare interested in playing JV basketball.The Executive Committee denied therequest for waiver, noting that the 99-studentlimit of the regulation had been establishedand reviewed by the Representative Counciland that it would exceed the ExecutiveCommittee's authority to ignore the limit.Grand Rapids-Forest Hills Central,Grand Rapids-Forest Hills Northern andAda-Forest Hills Eastern High Schools(Regulation I, Section 1[F]) - The ExecutiveCommittee approved a cooperative programin boys lacrosse between these three schoolsof the same district. A team resembling acooperative program existed in lacrosseamong students of these schools in the springof 2003-04. Forest Hills Central will be theprimary school. The combined enrollmentwill be 2,894. Support from the OKConference was received.Rochester Community Schools(Regulation I, Section 1[F]) - The ExecutiveCommittee approved a cooperative programfor Adams, Rochester and Stoney Creek HighSchools in boys and girls lacrosse. The primary school will be Adams. The combinedenrollment will be 4,326. The programreceived approval for up to three years, aspermitted for first-time cooperative programsunder this Section. Support from the OaklandActivities Association was received.Royal Oak-Kimball and Royal OakDondero High Schools (Regulation I,Section 1[F]) - The Executive Committeeapproved a cooperative program in boyslacrosse between these schools of the samedistrict. A team resembling a cooperative program existed for students of these schools inthe spring of 2003-04. The combined enrollment will be 2,097. Kimball will be the pri253mary school. The two schools will combineinto one school in the 2005-06 school year.Support from the Oakland ActivitiesAssociation was received.Shelby Township-Utica Eisenhower,Sterling Heights-Utica Ford II, SterlingHeights-Utica Stevenson and Utica HighSchools (Regulation I, Section 1[F]) - TheExecutive Committee approved a cooperativeprogram in boys lacrosse between theseschools of the same district. A team resembling a cooperative program existed for students of these schools in the spring of 200304. Utica Eisenhower will be the primaryschool. The combined enrollment will be8,830. The program received approval for upto three years, as permitted for first-timecooperative programs under this Section.Support from the Macomb Area Conferencewas received.Alba High School (Regulation I,Section 9) - A request to waive the transferregulation was made on behalf of an 11thgrade student who attended Alba schoolsthrough the 8th grade when he enrolled tobegin the 9th grade at Bellaire High Schoolbecause his parents planned on selling theirhome in Alba and building in Bellaire. Afterthree years, the family has not yet sold thehome in Alba and has given up on the idea ofbuilding on their property in Bellaire. Anolder sister graduated from Bellaire. Thefinancial strain of a near 40-mile commuteand the friendships maintained by the studentwere also considerations in the student'sreturn to Alba.The Executive Committee denied therequest for waiver.Ann Arbor-Pioneer High School(Regulation I, Section 9) - A request towaive the transfer regulation was made onbehalf of a 9th-grade student who enrolled atAnn Arbor-Huron High School until Sept. 14,2004, and played in three games before it wasrealized that the request to attend PioneerHigh School had been granted by the district.Pioneer High School is where most of the student's previous classmates and both older sisters have attended high school. At its meetingon Sept. 27, 2004, the Executive Committeedenied the request for waiver. Additionalinformation was submitted with a request thatthe Executive Committee reconsider its deciDecember 2004/January 2005

sion.The Executive Committee denied therequest for waiver.Battle Creek-Central High School(Regulation I, Section 9) - A request towaive the transfer regulation was made onbehalf of a 12th-grade student who was livingwith his mother and attended school inAlabama before enrolling at Battle CreekCentral on Sept. 16, 2004, residing with hisfather in the district. The parents never married. An otherwise completed EducationalTransfer Form was submitted with a birth certificate that does not identify the father.Noting that supporting documentationwas insufficient, the Executive Committeedenied the request for waiver. It was noted,however, that the student became 18 years oldon Dec. 31, 2003 and can be eligible throughthe exception for 18 year olds with a revisedand completed Educational Transfer Form.Britton-MaconHighSchool(Regulation I, Section 9[B]) - A request wasmade to waive the transfer regulation to permit eligibility at the subvarsity level only forthe remainder of the first semester on behalfof a 10th-grade student who attendedDeerfield High School for the 9th gradebefore enrolling at Britton-Macon HighSchool to begin the 2004-05 school year. Thestudent did not participate in athletics in the9th grade.The Executive Committee granted therequest for waiver at the subvarsity level onlyuntil the start of the second semester of the2004-05 school year at Britton-Macon HighSchool.Cheboygan High School (Regulation I,Section 9[B]) - A request was made to waivethe transfer regulation to permit eligibility atthe subvarsity level only for the remainder ofthe 2004-05 school year on behalf of a 10thgrade student who attended school inAlabama and did not participate in athleticsbefore enrolling at Cheboygan on Nov. 8,2004.The Executive Committee granted therequest for waiver at the subvarsity level onlyfor the remainder of the 2004-05 school year.Detroit-Marvin L. Winans Academy ofPerforming Arts (Regulation I, Section9[B]) - A request was made to waive thetransfer regulation to permit eligibility at theDecember 2004/January 2005subvarsity level only for the remainder of thefirst semester on behalf of two 10th-gradestudents. One student attended SouthfieldLathrup High School, the other attendedDetroit-Osborn High School, where neitherparticipated in athletics.The Executive Committee granted therequest for waiver for both students at thesubvarsity level only until the start of the second semester of the 2004-05 school year atWinans Academy of Performing Arts.Dundee High School (Regulation I,Section 9) - A request to waive the transferregulation was made on behalf of a 9th-gradestudent who resided with her mother andattended Ypsilanti-Lincoln High Schoolbefore enrolling at Dundee High School onOct. 4, 2004, to reside with her father in thedistrict. The student had participated in athletics at Lincoln. The parents never married. Anotherwise completed Educational TransferForm was submitted with a birth certificatewhich identifies the father.The Executive Committee granted therequest for waiver.Essexville-Garber High School(Regulation I, Section 9[B]) - A request wasmade to waive the transfer regulation to permit eligibility at the subvarsity level only forthe remainder of the 2004-05 school year onbehalf of a 9th-grade student who had beenattending Bay City-Central High School anddid not participate in athletics beforeenrolling at Garber on Oct. 29, 2004. Thefamily was in the process of buying a housein Bay City. The student continues to residein Essexville where public transportation toschool can be provided.The Executive Committee granted therequest for waiver at the subvarsity level onlyfor the remainder of the 2004-05 school year.Farmington Hills-Mercy High School(Regulation I, Section 9[B]) - A request wasmade to waive the transfer regulation to permit eligibility at the subvarsity level only forthe remainder of the first semester on behalfof a 9th-grade student who attended Mercyfor one day, then enrolled at NorthFarmington High School from Aug. 30 - Sept.9, 2004, before reenrolling at Mercy. The student did not participate in athletics at eitherschool.The Executive Committee granted the254

request for waiver at the subvarsity level onlyuntil the start of the second semester of the2004-05 school year at Mercy High School.Grand Rapids-Forest Hills NorthernHigh School (Regulation I, Section 9[C]) A request to waive the transfer regulation onbehalf of an 11th-grade student was tabled bythe Executive Committee on Oct. 21, 2004,pending receipt of a letter from the administration of Forest Hills Eastern High Schoolsupporting the transfer of the student, whoparticipated in a competitive cheer cooperative program between these high schools ofthe same district. The student attended ForestHills Northern as a 9th and 10th-grader andenrolled at the newly opened Forest HillsEastern to begin the 11th grade before reenrolling at Forest Hills Northern on Nov. 1,2004. A Forest Hills "In-District School-ofChoice Application" was submitted whichincluded the releasing principal's signaturefrom Forest Hills Eastern.The Executive Committee granted therequest for waiver for competitive cheer onlyfor the remainder of the 2004-05 school year.Harrison High School (Regulation I,Section 9[D]) - A request was made to waivethe transfer regulation to permit eligibility onthe 91st school day of enrollment on behalfof a 12th-grade student who enrolled atHarrison on March 15, 2004.The Executive Committee granted therequest for waiver effective with the student's91st school day of enrollment at HarrisonHigh School.Howell High School (Regulation I,Section 9[D]) - A request was made to waivethe transfer regulation to permit eligibility onthe 91st school day of enrollment on behalfof a 9th-grade student who attended RedfordDetroit Catholic Central and participated infootball before enrolling at Howell on Oct.20, 2004.Noting that the date of enrollment wasbeyond the intent of this Section as describedin Interpretation No. 92, as well as theabsence of compelling circumstances thatwould require a change of schools, theExecutive Committee denied the request forwaiver.Kalamazoo-Hackett Catholic CentralHigh School (Regulation I, Section 9[C]) A request was made on behalf of a 10th-grade student to waive the transfer regulationand the language of the Section which statesthat immediate eligibility may only be granted in the sports in which the student actuallypracticed or competed during the previousseason. The student had been attendingKalamazoo Central High School and wasselected for the cooperative ice hockey teambetween Hackett, Kalamazoo Central andLoy Norrix as a 9th-grader but decidedinstead to play travel hockey. Reports ofhealth concerns were provided.The Executive Committee denied therequest for waiver.North Branch High School (RegulationI, Section 9[D]) - A request was made towaive the transfer regulation to permit eligibility on the 91st school day of enrollment onbehalf of a 10th-grade student who attendedNorth Branch-Wesleyan Academy andplanned on enrolling at North Branch HighSchool on Nov. 8, 2004. The student wishesto enter a building trades program offered atNorth Branch High School where his fatheris a teacher.Noting that the date of enrollment wasbeyond the intent of this Section as describedin Interpretation No. 92, as well as theabsence of compelling circumstances thatwould require a change of schools, theExecutive Committee denied the request forwaiver.North Muskegon High School(Regulation I, Section 9[D]) - A late requestwas made to waive the transfer regulation topermit eligibility on the 91st school day ofenrollment on behalf of a 10th-grade studentwho was denied eligibility by the ExecutiveCommittee on Oct. 21, 2004. The student hadbeen attending Muskegon-Western MichiganChristian High School before enrolling atNorth Muskegon on Oct. 25, 2004. WesternMichigan Christian and North MuskegonHigh Schools are in a cooperative agreementin football in which the student participatedthis past season, concluding Oct. 22, 2004.The family had inquired about transferringduring the football season, prior to the fourthFriday after Labor Day, and requesting waiver under Section 9(C) (transferring betweencooperating schools), but it was decided thathe would finish the football season as aWestern Michigan Christian student.255December 2004/January 2005

North Muskegon requested reconsideration of the decision, submitting additionalinformation indicating that the student waschanging schools to remove himself from anenvironment of student ridicule, bullying andtaunting throughout the school day. Therequest was for eligibility on the 91st schoolday of enrollment based on other compellingcircumstances. The school's superintendentand principal met with the ExecutiveCommittee.The Executive Committee tabled thematter and directed staff to seek additionaldocumentation.Pinckney High School (Regulation I,Section 9) - A request to waive the transferregulation was made on behalf of an 11thgrade student who had been attendingYpsilanti-Willow Run High School, residingwith his father and an 8th-grade brother untilhis father rejected the student from his homein May 2004. The father was given custodyeight years ago when the mother was arrestedfor drug possession. On June 30, 2004, thestudents moved in with their grandparents inPinckney. The probation officer reported thatthe mother is currently incarcerated and thebrothers have been neglected and highlyabused by the father, who is also a substanceabuser whose home was drug infested andraided on several occasions. The 9th-gradebrother also attends Pinckney High School.The Executive Committee granted therequest for waiver.Portland High School (Regulation I,Section 9[B]) - A request was made to waivethe transfer regulation to permit eligibility atthe subvarsity level only for the remainder ofthe 2004-05 school year on behalf of a 9thgrade student who attended Portland-St.Patrick High School before enrolling atPortland on Nov. 1, 2004. An aquatic center wasopened within the school in the fall of 2003.The school is working with a communityeducation Water Safety Instructor to developsome future coaches. The school cited limited coaching resources due to the infant stagesof the program, which has recently enteredinto cooperative agreements in both boys andgirls swimming and diving.The Executive Committee reviewed thepurpose of the rule and recent discussions ofthe Representative Council regarding applications of the rule when employees of aquatics or tennis facilities also serve as schoolcoaches.
