A discussion took place regarding growth and its effects onthe community.5. Consent Calendar:a. Approve and ratify the minutes of the july 26, 2021 meetingb. All other corners willbe set in accordance with the recorded subdivision plan, however, the five comers in question wouldrequire the surveyor to coordinate with adjacent private property owners to access their lots.A motion was made by Michael McKinne and seconded by john Dice to waive the requirement to setproperty corners in the five locations as requested. All members present voted in favor of the motion.b. 1925 Sheaffer Road- Proposed Residential Development (#21-05-PLDP)- Proposal to develop a 53.15-acresite consisting of two tracts located at 1925 Sheaffer Road. The site is located within the R-2 MediumDensity Residential District. 299 townhome units, 80 multifamily units, and a community building areproposed on the site. The townhouses are intended to be in a condominium form of ownership.Greg Schwartz, consultant for the applicant, returned to the Planning Commission with a revisedpreliminary plan and several modification requests. Mr. McKinne voiced concerns with modifying thestandards for stormwater management, especially as the intensity of storms increases. Mr. Baker askedfor more specifics about the street tree modification. Since there was not enough space along theroadway to plant the required street trees, the applicant wishes to plant four of them in differentlocations on the site.Ms. Heilner asked about the lack of recreation areas, especially playground equipment for children.There is a path system throughout the site and open space available for residents to use. The applicantwill consider playground equipment in the next plan submission. A discussion took place regarding theTownship's recreation space requirements and its philosophy in terms of what size of space is acceptablefor dedication to the public versus accepting the fee in-lieu to construct and improve the three municipalparks.Mr. Schwartz explained the other waiver requests. They have engaged a new lighting designer who hascreated a better lighting plan for the project, though a small modification is needed for a specific area.The curb reveal request pertains to reducing the 8" curb within the apartment parking lots to 6" for theconvenience of the residents. Additionally, the swale side slope request pertains to a small segment belowthe Ridge Road properties that should not be an issue for property maintenance and will not diminishthe capacity of the swale.The Commission discussed several concerns with Mr. Schwartz, including parking and the timing of theroundabout construction. Mr. McKinne reiterated the need for local emergency services to review andprovide feedback on the project. The applicant noted that they have consolidated the project into asingle-phase project with Landmark Homes as the builder.Mr. Oberholtzer asked Mr. Evans to provide details on municipal responsibilities when condominiumprojects fail and on the local tax implications of condominium ownership versus fee simple lotting. Inshort, local land use controls cannot prohibit condominiums and a HOA failure typically goes throughbankruptcy proceedings before future responsibilities are determined. Although real estate taxes are notlevied on common areas owned by the lot owners, that assessment is divided amongst the lots and carriedthrough to the owners that way.Mr. Brewer addressed the Commission after the presentation. He spoke about the Township's 1990s planfor open space and clustered development to balance new neighborhoods, requesting more green spacebe integrated into developments. Parking for guests may be a challenge if overflow spaces are not madeconvenient. He then asked whether the street lighting will have offsite light trespass. No, it will meetTownship standards for shielded lighting on 13'-high standards.A motion was made by Delmar Oberholtzer and seconded by Richard Gates to grant the following waiversas requested (§119-52.0(1) relating to the requirement for minimum footcandles (0.4) and maximumuniformity ratio (6:1) for streetlights; §119-53.C(2)(a) relating to the requirement for an 8" curb reveal;

Mr. Hitz commented on the application,which states that the Hughes bought the property at a valuation that assumed a home could be constructed on it. Mr.Evans provided an overview of the stormwater management planning process and the complexity of the zoningreview that arrived at the conclusion that the Zoning Ordinance prohibits construction of a dwelling on it. This dueto a prior zoning hearing decision and a change of the Zoning Ordinance in 2012.Mr. Hitz asked if the existing structures on the farm are used for agricultural purposes. Yes, they are used for growingproduce and storing equipment and supplies. Mr. Campbell then asked about access to the property. Its primary accessis via Rissermill Road, though the Hughes also own adjacent property with access via Milton Grove Road. However,that will not be available if they sell the other property.Mr. Hughes confirmed receipt of the Zoning Officer's August 9, 2021letter and is in agreement with the proposedconditions therein. Mr. Hershey asked what kind of educational programs are provided. They run youth educationcamps for young people to learn farming practices and vegetable processing.A motion was made by Gregory R. Hitz, Sr. and seconded by james E. He wishes to build a small office on the farm toconduct his trucking brokerage business in, as well as to continue the commodity storage activities taking place there.The truck brokerage primarily consists of dispatching trucks from one location to another and processing paperworkinvolved in the business operations. The dispatch office will not bring truck traffic to the site because they are haulingloads from one offsite location to another. Nearly all of those loads are agricultural products. He will be the onlyemployee on premises at first but anticipates having up to four employees in the future if the business grows. Mr.Garman submitted the following exhibits: A-1 - Proposed Building LocationA-2- Driveway Location ChangeThe property contains two wells and on-site sewage disposal. He needs to construct a bathroom inside the office, sosewage planning will be required for a non-residential structure. The existing dispatch office is located on Mr.Garman's property, from whom he is purchasing the business. Moving the office to this property will eliminate hiscommute. He made the point that the truck brokerage/dispatch is separate from the commodity storage business onthe farm, although his trucks occasionally move commodities in or out of the storage buildings.Mr. Campbell asked about the use of the three large buildings currently on site. They are all used for commoditystorage. The amount of product moved on or offsite per month varies but at an average of 16-20 trailer loads per week.Full capacity is approximately 108 loads in the two largest buildings and 30 in an old chicken house. Some productsstay in storage for longer periods than others and his business does not own any of them. Approximately 95% of what

The brokerage business consists of computers, files, and other office equipment but does notown any other large assets such as trucks.Mr. Hershey asked about storm water management for the proposed office and the small parking area. Mr. Evans notedthat the goal is to keep the earth disturbance and new impervious coverage under 5,000 sf. so the runoff can beaddressed through the small project process. That will enable management through a non-engineered approach likean underground infiltration pit.Steven Heidlauf, resident at 1651 Grandview Road, questioned the claim of no additional truck traffic resulting fromthe office building construction. Mr. Garman confirmed that the truck brokerage does not transport products into orout of the subject property. The only traffic impact would be passenger vehicles from any future employees, thoughthe elimination of his commute will help offset that. He also noted that the previous owner of the property had atrucking business on site.Thomas McKinne, resident at 2366 Grandview Road, expressed concerns with the ambiguity of what expansion meansas stated in the public notice. His greatest concern is increased truck traffic resulting from a vague approval ofexpansion. Mr. Garman stated that he has no intent to expand the storage business at this time, which is the primarydriver of traffic. Relocating the truck brokerage office to this location will not create any additional truck trips. Mr.McKinne referenced the Milton Grove landfill and how it started small but became the large facility that it is now. Healso prompted Mr. Garman to work through PennDOT for approvals. When asked, Mr. Evans explained that landdevelopment approval is not required for non-residential accessory structures smaller than 2,500 sf.After a break in the hearing, john Henry stated that there is a procedural issue with the agenda language in referenceto the specific request that is on the table. Due to the recent legislative changes with the Sunshine Law, the requestcannot be substantially changed from the floor. Mr. Garman clarified that the request is to construct an office buildingfor the truck dispatching company, not for an expansion of the commodity storage business. The request for reliefneeds to be clarified through a new application.The applicant requested a continuance to a future meeting. A motion was made by Thomas N. Campbell and secondedby Gregory R. Hitz, Sr. to continue the hearing to a future meeting.
